Need To Address Root Causes To Get Out Of Geneva Spotlight

Sri Lanka faced its worst ever defeat at the UN Human Rights Council last week when it voted on Resolution No 51/1 titled “Promoting reconciliation, accountability and human rights in Sri Lanka,” against the wishes of the government. Sri Lanka was able to only obtain the support of seven of the 47 countries that had been elected to represent the international consensus on human rights by the UN General Assembly. This was the 9th UNHRC resolution on Sri Lanka that different governments, including the present one, have refused to accept. However, in Sri Lanka itself, expectations regarding the UN’s ability to implement its resolutions appear to be low. The government has continued to arrest those who have been part of the protest movement despite condemnation by international and national human rights organisations.

The list of demands placed on the government by the UNHRC are greater than ever before. They include all the unmet demands of previous resolutions plus some more. The most significant of these is the addition of economic corruption to the watchlist of crimes that are taking place in the country. There is concern regarding what this might mean as it is a new area of focus for the UNHRC. There is also the latent threat at the strengthening of the evidence gathering mechanism based in Geneva which is monitoring what is going on in Sri Lanka in terms of human rights violations both past and present. But so far except for travel bans placed on a handful of military officers, there has been no accompanying punitive action. There appears to be a complacent belief in the government that nothing will change.

The government was particularly strong in rejecting the evidence gathering mechanism created by the Office of the High Commissioner for Human Rights. It argued that no sovereign state can accept the superimposition of an external mechanism that runs contrary to its constitution. It recommitted itself to replacing the Prevention of Terrorism Act with a comprehensive national security legislation. This was promised on the last occasion as well along with a pledge not to use the PTA, which was not honoured when university student leaders of the protest movement were incarcerated without charge under it. The manner in which the government is now trying to pass a new law to send extremists, drug addicts and others it chooses to Soviet-style rehabilitation centres suggests that the government’s policy makers have no sense about international human rights standards. Likewise, the Prevention of Terrorism Act was enacted in 1979 as a temporary provision for six months but has yet to shed it even after four decades.

India’s Support 

The government is also planning a longer term response to the UNHRC through a Truth and Reconciliation Commission. Minister of Foreign Affairs Ali Sabry stated that the government is awaiting the final report of the Presidential Commission headed by Justice Nawaz. He indicated that the establishment of a domestic truth-seeking mechanism that would deal with issues of the war and the large scale violations of human rights that took place on all sides is close at hand. Finding the truth of what happened in the past and acknowledging it necessary to move on from the past to the present and to design a new future together. However, such a mechanism cannot be a stand-alone institution. It needs to be part of a larger system of change if it is to a success as was the South African Truth and Reconciliation Commission.

Unfortunately, at the present time there are no signs at all that a supportive environment for a successful truth and reconciliation mechanism is being created. If it is to accord with international standards that would satisfy the UNHRC the framework of national reconciliation needs to include provision for constitutional reforms that address the causes that led to war in the first place. There are no signs of this at the present time. India’s representative at the UNHRC, Ambassador Indra Mani Pandey said that while India has taken note of the commitments by the government of Sri Lanka on issues of implementation of the commitments in the spirit of the 13th Constitutional Amendment, meaningful devolution and the early conduct of provincial elections, “we believe that the progress towards the same remains inadequate.” India urged Sri Lanka to work meaningfully towards early implementation of these commitments because “Achieving prosperity for all Sri Lankans and realising the legitimate aspirations of Tamils of Sri Lanka for prosperity, dignity and peace are two sides of the same coin.”

The failure to obtain India’s support on this occasion can be taken as a major foreign policy setback. As the largest democracy in the world India’s position on any international issue is of global proportions. During the past year the economic assistance that India gave Sri Lanka, and continues to give, was the largest of any single country and dwarfing the contribution of all the countries that voted against Sri Lanka. The political concerns that India has with regard to the problems of the Tamil people in Sri Lanka needs to be seen in the context of India’s own Tamil population, and of India’s larger support to the Sri Lankan economy, and not simply as bias towards the Sri Lankan Tamil people. The shiploads of petrol and diesel that India sent at the height of the dollar shortage when the lines in front of the petrol and diesel stations stretched for kilometers and for days, and when people died in those lines, must not be forgotten.

Root Causes 

The series of UNHRC resolutions on Sri Lanka are a direct outcome of this country’s inability to resolve the ethnic conflict in a peaceful and just manner that meets the needs of all its citizens. The origin of Sri Lanka’s three-decade long war lay and continues to lie in the political problem of how best to govern a multi ethnic and multi religious country. The solution from the time of SWRD Bandaranaike in the 1950s to Ranil Wickremesinghe today has been in in the provision of a measure of self-government (provincial government) to those parts of the country in which the ethnic and religious minorities are a regional majority. This is the practice in other multi ethnic and multi religious countries, both large (India and Nigeria) or small (Malaysia and Switzerland).

The political solution needs to recognize that inasmuch as there is a national majority (Sinhala) which wishes to be in charge of their collective lives, so are there regional majorities (Tamil and Muslim) who likewise wish to be in charge of their collective lives. The unfortunate reality in Sri Lanka at the present time is the paucity of national political leaders who both understand this and are prepared to explain it to the people who look to them for leadership and guidance. Such leaders have been few and far between and their voice is not loud any more. In the past there was SWRD Bandaranaike, JR Jayewardene, Chandrika Bandaranaike Kumaratunga and Ranil Wickremesinghe. At the next level there were leaders such as Prof Tissa Vitarana, DEW Gunasekera, Vasudeva Nanayakkara and Prof GL Peiris. Those of them in active politics today need to make their voices heard.

During the halcyon days of the protest movement the young leaders of the Aragalaya spoke boldly against racism and racist politics practiced by those in government in which those of other communities were portrayed to be threats to national security and potential enemies of the state. Tragically, the idealism of the Aragalaya that sought a system change has been crushed and suppressed by those who fight a rearguard action to preserve their feudal entitlements and access to corruptly obtained wealth. Those who struggled for a systems change are now being incarcerated as extremists. Even as the shades of twilight fall on the prospects of Sri Lanka becoming an internationally respected middle income country in the foreseeable future, the hope that idealism will prevail over cynicism must remain the leitmotif of those who work for system change.

      No Sinhala government will ever address the root causes. Only international intervention will bring justice to Tamils and punish perpetrators of atrocities.
      1. Sharing of power and territory with Tamils in a fair and effective manner acceptable to majority of the Tamils where there will be no interference from the Sinhalese. Invitation of Solheim is a bogus move to tell the world that they are ready to settle the problem.
      2. Punishing of war criminals – When there is outright denial from almost all quarters, how can one expect a fair trial, especially when Srilanka judicial system is institutionally racist.
      3. Returning of lands appropriated from Tamils – not only this will happen but more lands will be appropriated on various pretext to settle Sinhalese to alter demographic pattern.
      4. Reparation to victims – government never compensated Tamil victims in the past and to expect them to do so now when there is economic disaster is far fetched.
      Nothing tangible will happen but hoodwinking exercise to drag on he issue will take place.

    Jehan, how is it possible ??? 1) Ranil as PM under MS drafted his own resolution which was supported by all 2) Gotha soon after as President rejected any resolution passed by Geneva including the previous one agreed by Lanka/ Ranil 3) Now FM Ali Sabry under Ranil “categorically rejects , calling it interference in our sham sovereignty”. 4) Since the end of war, Rajapaksas went through the motion for almost a decade, with their deception, BS, and other skills 5) But the very first resolution was passed in favor of Sham Lanka congratulating DJ’s , for his made up “zero casualty” (soon after Geneva realized they have been taken for a ride).

      Two Australians are arrested by Federal police for arranging bribes over $ 200, 000. to government officials in Lanka between 2009 and 2016 in the pursuit of getting approval for two projects worth over A $ 14 million. The involved Australian company is SMEC. In 2017 WB temporarily barred engineering Corp and it’s subsidiaries (in Lanka, Bangladesh, India) for inappropriate payments (kick backs) in Lanka and Bangladesh. State Finance Minister Ranjith Siya says “URGENT measures taken to give people the value of illegally imported vehicles”(including two HUMMERS found in a container). Previously seized Hummer was auctioned to the same person who illegally imported for much lesser price. Four containers labeled as scrap paper for export,were loaded with brass, copper, and galvanized pipes. Tip of an iceberg in Sham Lanka.

      Actually it wasn’t supported by MS and his gang. MS, a Sinhala Buddhist nationalist was at best lukewarm in prosecuting war criminals. He connived in getting Karannagoda and his predecessor off the hook, openly saying that “war heroes” shouldn’t be disgraced, and sabotaged anti-corruption investigations. In the Avant-garde case, it was the odious Wijedasa Rajapakshe who saved the Rajapaksas.

        OC, what I meant was accepted by all Geneva members with added changes, mainly collecting and preserving witnesses which Lanka was not happy with. MS did a somersault saying he was not informed about the draft and soon after ordered AG to close cases , promoting ranks and pardon those who are guilty. As usual SLPP and Theros accused Ranil of betraying.

        Corruption is not easily tolerated in Singapore or similar countries. Some level of corruption may exist in the developed world. What matters is the level of corruption. There is a lot of corruption where homo sapiens gather. That’s why I started to respect animals more. In fact I have been offering free food to stray dogs since 2016. Their tail wagging gesture gives me more.

        In a country without law, whatever is said is meaningless. It benefits the Rajapaksa dogs.
        And the so-called “pure politicians” aka “JVPRS”: Not a single JVP politician could come up with any plausible argument to prove that the central bank bond was introduced by the MS-RW government. Any rival politician can be accused, mitigating actual criminal charges against Rajapakshe criminals. It is called “Planting News” in modern times.

    Jehan, It has taken you (or, more aptly, you have waited for) 9 resolutions to declare that Sri Lanka HAS TO RESOLVE the ethnic conflict to keep UNHRC away!
    Nothing will move Sri Lanka. That is UNTIL India moves!

    JP, The whole world knows what you finally said that aragalaya is suppressed by those who want to preserve their access to corruptly obtained wealth. Only seven out of forty seven countries tried to help Sri Lanka at the Geneva UN session. Only legal judgements with imprisonment of the robbers of national wealth alone can reverse this trend. Until then, these greedy robbers will paralyse nation with downhill poverty till they die.

      Look at the voting pattern
      It is in essence US & partners v. Third World on every issue.
      UNHCR resolutions are much less about human rights violations than about global politics.
      The most blatant violator, Israel, gets away with mass murder time and again.
      But even those screaming out for justice here turn a blind eye to it— merely to please the big bullies.

          Israel carries on regardless with the fullest backing of the US.

Permanent Representative of China to the UN Office at Geneva Ambassador Chen Xu on September 12 openly spoke for Sri Lanka and opposed external interference during the Interactive Dialogue on the island nation at the 51st Session of the UN Human Rights Council (UNHRC).
Ambassador Chen stressed that China appreciates Sri Lanka’s continued efforts in enhancing and protecting its human rights, especially in reconciliation, reconstruction and counter-terrorism. As a traditional friendly neighbour of Sri Lanka, China firmly supports Sri Lanka in safeguarding national sovereignty and independence, maintaining social stability and realizing economic recovery. We believe that the Sri Lankan government is able to lead the people to overcome temporary difficulties.
The Chinese envoy emphasized that the UNHRC’s resolution on Sri Lanka is a product of politicization. It does not abide by the principles of impartiality, objectivity and non-selectivity. It has not been recognized by Sri Lanka, the country concerned, and has not played a constructive role in promoting and protecting human rights in Sri Lanka.

        I wonder if you’d be interested to know that a Palestinian resturant has recently opened in Colombo. “Dolce Falestine” at 210/B Havelock Rd, nr the turn to Dickmans Rd.

        Some friends who went there found it closed as there was a power cut which unfortunately the young chef hadnt anticipated.  Hopefully he has managed to get a generator by now. 

        Dining out is pretty much a luxury these days but I would like to patronize this place and spread the word about it. 

        For me the plight of the Palestinian people is one of the great crimes of 20th c.  I cant even bear to know of the latest horror being inflicted upon them. 

        You are right to remind us what Israel continues to get away with…the last (?) colonial settler state.

    Yes please consult, Sarath Weerasekera, Sarath Fonseka, the Mahanayakes/Buddhist clergy, Ravi Perera, Toni/Tonino/Anthony or Antonio, Shenali Vadukan, Komalika and the rest of the ilk regarding just Thamizh rights and they will say what Thamizh rights, they already have the rights that they deserve.         Manel . F / Hancho and others, I condemn Israel and U.S (especially WMD saga in Iraq) as much China, Russia and Sham Lanka. Lets not deny one for another. The difference being 1) in the U.S right minded people / law makers have criticized, condemned, protested, voted against war in Congress, whereas none of this is ever heard or even expected from the rest. 2) politicians have won and lost elections because of their stand against war 3) some of the war crimes , atrocities were exposed, investigated, and perpetrators punished. 4) There are few isolated incidents, if not for their own admission ,would not have come to light. 5) Yes, US is as guilty as others and fair amount of their own people / politicians will readily admit to it. I consider blame game and finger pointing as enabling. Given our sordid history, we Lankans should be the last to criticize any.

          Fortunately members don’t see the way few Lankans do. It’s almost a decade , members changing time to time, steadily dwindling numbers in favor of SHAM Lanka, what may be the clear stand??? Recently India, China and Sham Lanka abstained from voting against Russian escalation in Ukraine. Is that Western/ Eastern , anti/ pro , US / Russian , clear stand / missing root cause, none/ all of the above ??? (Funny indeed).

    Dr. JP: At the Human Rights Hypocrisy show in Geneva 27 countries either supported Sri Lanka or abstained. The Western puppet masters who are the biggest HR violators, war mongers and arms producers in the world sponsored the Resolution!
    It is now clear that the Norde Stream pipeline environmental terrorism attacks were done by US marines based in Gdansk Poland, and the US is the biggest Hybrid Economic and energy War sponsor of terrorism in the world. Also SOF and CIA are attacking transport infrastructure and energy infrastructure in their Energy War all over the world. Germany’s and Sri Lanka’s trains, Bridges in Russia and Gas pipleines in the North Sea. This is why US has 750military bases all over the world!
    Finally, US debt is 31 trillion and the EU is close behind but no one is talking about their debt! US and EU are using Dollar Debt Colonialism to stop Sri Lanka de-dollarizing and buying oil and gas from Russia.!

      Majority of counties in UNHRC supported Sri Lanka by abstaining from the US-EU-project including India.
      Again the narrative misrepresents the facts. India voted against the motion on China too!
      Also, Human RIghts are indivisible and we need to talk of Economic Rights, Debt Cancellation for Debt Justice and US Dollar Weaponization and Colonialism.
      In a nutshell, the Geneva Human Rights show was to force Sri Lanka to accept Washington’s hegemony and IMF’s Dollar Debt Colonialism.

      The solution to Sri Lanka’s dollar debt trap is simple, NOT rocket science: There should be a ban on borrowing from private capital markets and Bond Traders like BlackRock Vulture fund, and the Odious ISB debt has to be cancelled. Strategic Sri Lanka can on a monthly basis cover its import bill with its exports and is otherwise solvent if it can re-structure the bi-lateral and multilateral debt, and de-dollarize and buy oil from Russia in rubles!
      This is not Rocket Science but the IMF and Paris Club make it so in order to delude, distract and Colonize Lanka!

        Dinuk is at it again. China finances white elephant projects such as Rajapakse International Airport , stadium, conference centres, Lotus Tower and the port. Perhaps a quarter of the loan was swindled by Rajapakse clan and their hangers on. When there is no return, Sri Lanka cannot pay the debt and China takes over Hambantota Port.
        Corrupt and authoritarian governments borrow money from authoritarian regimes and there is no transparency – the ruling class swindles the money.
        The western institutions or governments would not have given loans for any of these sham projects because they see no return and the loans cannot be repaid.
        Neither China nor Russia lifted a finger when the country could not get fuel or food – India gave the money and so did Australia and the US.
        Most of the fuel was diverted to the bloated defence sector and for the MPs and their hangers on.
        Until Sri Lanka reduces its defence spending and police spending by at least half, the country cannot start to come out of the abyss.

          How did you forget the Hambantota Harbour white elephant? Because it has ceased to be?
          The Port City and even before it Lotus Tower will be money spinners. These are not like Jack’s bean seeds to grow tens of feet tall overnight.
          The other projects rely heavily on the interest the state takes in them. One government stored paddy in the aircraft hangers. That was to spite another government.
          If China or Russia gave freebies, I am sure that you will have other explanations.
          Do you know that China offered diesel from its storage facilities in Singapore and the government at the time ignored the offer?
          Have you checked on what India has gathered in return for its kindness?
          China has given humanitarian assistance all along, if you read the news. But baling a country out of its own folly is not something that it does usually.

    One of the most important and urgent needs for Sri Lanka is not mentioned by this writer. That is the issue of rampant corruption and undemocratic rule by a neo fascist dictatorship. The people must unite as one to dismantle this parasitic curse and allow the educated intelligent and committed youth to take over the administration and bring the country back to that resplendent isle known around the world for its warm hospitality. No new elections can bring a systemic change as nomination is always given to utterly corrupt rascals who lack any scruples but have money to throw around for campaigning. The time to act is now. Everybody must cooperate with the peaceful revolution..!

    The people of Sri Lanka needs to understand the fact that the economic crisis or economic bankgruptcy is the result of racism and fundamentalism that was practised by our political leadship from DS Senanayaka to Ranil Wickremasingha. Even after the country gone into bangruptcy our political leadership are not prepared to give up political thuggerism, racism and fundamentalism because the bankgrptcy does not affect the political leadership like the ordinary people queing for a piece of bread or a cup of plain tea. The people problem is what to do for next meal but the problem of
    the politicians is how to cheat you. Ask a question yourself whose land is this? Is it yours? or Is it Rajapaksas or Ranils? How come they have a luxuary life and why you have to suffer for next meal? You don’t need any more evidence to proof that they robbed your life, your wealth and your future? Think Do we need them any more?

    Lack of JUDICIARY INDEPENDENCE is the main root cause of all the ills.

    Ideally when Ceylon got independence in 1948 February those who had been living and working in the country should have EQUAL rights to be a Ceylonese citizen. Attempts to make up country Tamils stateless ; Sinhala as sole official language; colonisation in N&E of Ceylon of Singhalese by the state; state sponsored Terrorism against Tamil speaking Ceylonese; 1972 constitution ;Unchecked Corruption
    ARE the main ROOT causes for the current pathetic state of SL

    Citizens in the north and east of SL wants to see a 13A+++ constitutional amendment carried out with International supervision. Chief Executive should have land and police powers and should NOT have a Governor above him/ her.
    The northern and eastern CE should have the authority to get foreign investments to their provinces.

    Can we get a solutions to all those ROOT CAUSES that had SL to be in the current state by bringing in a New Constitution[NC] that will be put to REFERENDUM and NOT to the current parliament?

    It is a mental negative to consider that the 20 who abstained at the UNHR vote voted for SL specifically considering and knowing that their abstaining will result in the vote against SL suceeding and the netaive resolution against SL being passed.

    The only logical explanation in the above scenario is that 40 voted against SL and 7 low level bankrupt beggar nations akin to SL (birds of a feather) voted in favour of SL. (excluding china the biggest international HR Violator which imprisons muslim men and then legally mandates that han chinese sleep in their wifes beds and mandatorily enjoy the muslim women – SOMETHING that Sinhala women may experience in the future) considering that the current govt in SL has confirmed that SL has denerated to a POOR country

    Why is the “Travel Ban” only on Military Personnel? If UNHRC is particularly and seriously concerned and interested in bringing those “Accountable” and “Responsible” for “Economic Crimes”, it can initiate immediate action to strike a “Travel Ban” on all those “Respondents” named in a recently filed court case in SC. Those named “Respondents” are: (1) Gotabaya Rajapakse (2) Mahinda Rajapakse (3) Basil Rajapakse (4) Ali Sabry (5) P.B.Jayasundara (6) Nivad Cabrall (7) S.R. Attygalle. This case is supported by the BASL (Bar Association of Sri Lanka)

    Recently (10-10-2022) Ali Sabry -the present Minister of Foreign Affairs, participating in a TV discussion (Hiru TV) said, when he was the Minister of Finance, he was advised by “Professionals” such as Indrajith Coomaraswamy, Nandalal Weerasinghe, Shantha Devarajan, Shamini Cooray. In addition, “Politicians”, “Trade Unionists” and some “Social Activists” got involved. All of them could also be considered “Economic Assassins”.

    There you are “UNHRC”, you have a very “Crdibale” witness. Secure all the relevant information and bring all those revealed to book and as an initial step, impose a “Travel Ban”. Please note some of the above-named by Ali Sabry are “Foreign Nationals”. Over to UNHRC. Appreciate prompt action.

          My take on Solheim’s visir and appointment are 1) nothing to do with climate change 2) His purpose is more to pacify and blunt Geneva thorns 3) Ranil promised fixing economy which is alone is impossible and race issues better end of his Presidential term. Both are not only chronic and lasted since independence but Ranil tried before and didn’t succeed. 4) Ranil as a leader is also a culprit in contributjng creating the issues 5) Mahinda in a flash congratulated Solheim on his appointment.

            6) That to me is give away Solheim has more to do with some thing other than climate change 7) Benefit for MR family is taking some Geneva heat off which overall helps with their come back plan. 8 ) Solheim will do what he is good at” international political spin” 9 ) Tamils may have genuine concerns that “its not yet another Sham” 10) Solheim may give some credibility in international political negotiations that was long lost.

              If my thoughts are close to reality , Solheim will be another Rajiv in that he too wil be a victim of mega Lankan spin / reverse swing. ( trouble shooter with the intention of helping one ending up working for the other).

        NV: I know this Erik Solheim is an “Expert” in handling many types of “Climate” situations and their changes.

        Do I have to remind you of his “Contribution” to S/L during the tense “Climate” we experienced prior to “May 9th, 2009”? I think, Erik Solheim “Failed” in his attempts to “Defuse” and “Soften” that “Climate” of a different type. In those days, he was with all these leaders who have now once again brought him to “Advise” on a “Different” type of “Climate”.

        Wait and see how he would handle this “Climate” of the “Types” – an “Environmental” or “Political” and “Both”.
