Lawyers for Gotabaya Rajapaksa are desperately scrambling to put doubts about his US citizenship to rest and making things exceedingly worse for the SLPP candidate who thought this chapter of his presidential bid was far behind him by early October.
At a press conference on Sunday Ali Sabry PC who is the head of Rajapaksa’s legal team said that the SLPP candidate did not need to show his documentation to the public, but that his renunciation documentation had been handed over to the Elections Commission.
However on Monday, Elections Commission Chairman Mahinda Deshapriya said the Commission was never provided copies with Rajapaksa’s nomination papers.
In his rush to counter a statement by Deshapriya, Ali Sabry posted an affidavit purportedly provided by Gotabaya Rajapaksa to the Elections Commission on his official Facebook page setting out his citizenship status.
The image Sabry posted featured only the signature of the Justice of the Peace who had signed the affidavit – a G.K.A.P.K Kularatne from Maharagama. In the first document filed by Ali Sabry PC, the cage for the signature of the person declaring the affidavit was empty.
Realising his error few minutes later, Gotabaya’s lawyer deleted the first image and uploaded a second.
The second contained the exact same signature of Attorney Kularatne, with the signature crossing his seal in the same precise way, except the second image included Rajapaksa’s signature and a Rs 50 stamp. 
The President’s Counsel who has lately performed the role of attack dog for the SLPP candidate and his main canvasser of Muslim votes, has created more documentation problems for his boss, with social media already explosively discussing Rajapaksa’s citizenship status and allegedly fraudulent documentation being released by Sabry and other lawyers trying to defend the position.
Sabry’s first image makes it clear that the JP had signed the affidavit before the affirmant. An affidavit is not valid unless the affirmant has signed the affidavit in the presence of the JP. In this case, as with all documentation matters pertaining to the former Defence Secretary, the signature of the JP has been placed on the affidavit prior to Rajapaksa having signed the declaration.
This would make the affidavit null and void, lawyers explained. Furthermore, Sabry’s revelations with the two documents posted online could amount to a serious breach of the law by the unwitting attorney who placed his signature on the document before Rajapaksa signed it. Legal experts said that certifying an affidavit before an affirmant has signed it is not only bad in law, but also ex facie fraudulent.
The latest gaffe comes amid a furore over Rajapaksa’s allegedly cancelled US passport, which is being widely questioned for authenticity online.(By TB Bambaradeniya )

1. The dates on the certificate and approval merely two weeks apart. I believe it takes a lot longer for the approval.
2. When a passport is cancelled, the cancellation stamp is normally on the biodata page and should say CANCELLED with a signature and stamp.

Well observed Valentine. The reason that the biodata page has not been “tampered” with is because he would have to use the passport soon after the elections to get back to US. The “Cancel” (instead of the usual “Cancelled”) stamp on the inside pages could have been expertly inserted (to be removed later) or the stamp itself may have been with an ink that could be easily removed without causing any damage to the passport. Besides, there are so many expert “passport manufacturers” in Sri Lanka, the passport Gota has been waving to the media could have itself been a masterpiece of these fraudsters.

It has been repeatedly said here that a US citizen will have to take oath to serve in military to be naturalized. It is said a US citizen may not repudiate that duty any time, even after quitting the US.
Ali Sabry was asked if Old Brother Prince is still a US citizen. He denied. Then reporters asked “But his wife and children are”. He said that is irrelevant.
In court, until the accused is proven guilty, he is innocent. If he could not be proved guilty, he is innocent beyond doubt. Is that applied to an election candidate too? This is not an issue that will simply go away by explanations and clarifications at ‘press briefings’ It can only be put to bed by the Court system in Sr Lanka. Perhaps, it will be a punishable offense, if it can be proved, NGR knowingly violated the Constitution of Sri Lanka?

At the presser (set up only for hiru and derana while all other chairs were taken by GR henchmen to deter other reporters from coming in) he said the docs were shown only to the person that it should be shown to: the EC. But what about the millions who must see them before they cast their vote? The millions who are being wooed to to vote for his “boss”. Don’t they also matter?
The affidavit with and without the stamp is a total give-away and must be exposed. I wonder what sabry’s explanation will be?

Hythe Election Commissioner should have looked into this matter as per the constitution a duel citizen is not eligible to run for this and furthermore they must have a very clear vision of the candidate’s past records. The whole world knows how he acted while in office as Defence secretary. The Election Commissioner acts broadly. This is evident by the way he acted when the Colombo GA Kannangara entered Rupavahini premises.
There is no clear and firm legal system in Sri Lanka to trace and trap political culprits.

If all the candidates were asked to submit an affidavit and this one did not then on what basis did the NEC accept his nomination. More evidence of unfair bias and preferential/illegal treatment. But this is not the main problem. He has committed a criminal offence under US law by faking a cancel stamp on his US passport. The wording gives the game away. I know this because I have seen the genuine stamp in my own passport put there by the US Consulate. Also the date format is wrong. It is an offence to tamper with a passport.

Ali Sabri thinks that the public sphere is just like a court where judges consider facts and lie separate and come with their own judgment and not counter the counsel asking why you the counsel keep lying to the court in the name of appearing for the client while the audience is kept muted.

In a banana republic like Sri lanka it matters not whether Gota is eligible to run for presidency or not. Even if it was proven he cant, he will still have millions of supporters who want him to run illegally. They are like the hardcore trump supporters in america, who dont care what is exposed on trump, they will blindly support him to the end. 95% of the lankan population are criminal minded in nature. They will complain all day about corrupt politicians. But will do the exact same things if they got into political positions themselves. Even in their day to day behaviour most sri lankans dont follow the rules, laws, common courtesy and will happily steal and committ fraud when they can. The country and its people are rotten from the bottom all the way to the top.
