Mahinda.info releases the original police report showing no time for torture

Mahinda Rajapaksa Information Center, Mahinda.info yesterday published a scanned copy of the original report filed by Inspector Damian Perera, OIC, Police Station Narahenpita on 2012 May 21, four days after the incidence which produced the body identified as Wasim Thajudeen’s in the burnt car registered in his name.

This report lists the initial evidence of the friends who last saw Thajudeen alive as well the first spectators at the site of the crash. The last person who saw Wasim Thajudeen alive, was Mohamed Sakeer Badurdeen (The name is written in Sinhala and is given in English as it sounds). Thajudeen dropped Badurdeen off at the residence of the latter at No. 15, Nihal Silva Mawatha, Kirulapone at 11. 50 or 11. 51 pm on 16 May 2012. One of the first spectators at the crash site Balendran Premananda of No. 74, School Lane, Wellawatte passed Shalika Grounds around 12 midnight on 16 May 2012 on his way to the Airport, Katunayaka and saw Wasim’s car on fire. He also reports seeing one person already near the car. According to the times on this report there was only about 10 minutes for the alleged abduction and torture of the victim to take place. The CID intimated to the Court on 27 July 2015 that they suspect murder followed by torture.

Wasim_Thajudeen_JThis initial Police report gives the evidence of the three friends who were the last people to see Thajudeen alive. They were Junadeen Mariana Rashmi de Silva, Chaminda Jeya Prakaash and Mohamed Sakeer Badurdeen. All three state that the three men Chaminda, Mohamed and Wasim drank two bottles of Old Arrack at the residence of Mariana Rashmi, the girlfriend of Chaminda Jeya Prakaash. According to Mariana Rashmi and Chaminda Jeyaprakaash, Wasim Thajudeen and Mohamed Sakeer came to Rashmi’s residence at 7.30 pm on 16 May when Chaminda Jeya Prakaash was already there. According to Mariana Rashmi and Mohamed Sakeer the company of the three male friends left the girl Rashmi’s place at 11. 30 pm on 16 May. However according to the statement of Chaminda Jeyaprakaash, Rashmi’s boyfriend, they left at 11 pm. From Rashmi’s rented place at Anderson Flats, Colombo 5, the three men got into Waseem’s car and drove to No. 36, Galhena Road, Gangodawilla, Nugegoda, which was the residence of Chaminda Jeya Prakaash. According to Chaminda Jeya Prakaash, he left Wasim Thajudeen’s car at around 11. 45 pm while Thajudeen drove off having expressed the intention of dropping off Mohamed Sakeer.

This Police report lists the testimonies of three spectators at the crash site. According to all three they were not the first to reach the site. There already were other people there when each of them reached the site. All three claim to have called 119. The notification from 119 reached the Narahenpita Police at 12. 55 am, nearly an hour after the spectators testify to have seen the crash and the fire.

Whichever the investigations on the exhumed body of Waseem Thajudeen goes, the issue of timing will prove crucial. Did Thajudeen’s friends, the last to see him alive give false times or did Inspector Damien Perera (still a serving officer in the Police force) falsify the times in the report?

Could the injuries detected on Thajudeen’s body be the result of a car crashing into the Shalika Wall with enough force to break it down especially if (as Mahinda. info reports) Thajudeen was not wearing a seat belt and the airbags of the car had failed to work? Could the forensic pathologists distinguish between injuries caused by a car crash and those caused by torture? Do the breaking of teeth, bone fractures, trauma from a blunt instruments and etc on Thajudeen’s body carry the unique and unmistakable imprint of torture to the exclusion of trauma associated with a car crash? The Government ministers issuing statements, Sujeewa Senesinghe for one seems not to be aware that there was an actual car crash.

This is evident from Senesinghe’s statement reported at Sirasa which contains the deputy minister’s puzzlement as to why Thajudeen did not get out of the car and walk away before it was devoured in the fire. This could be the result of not having seen photos of the crash site with the broken down Shalika wall. It could also be Senesinghe’s unfamiliarity with car crashes. The vast majority of cars that crash into walls with fatal consequences do not catch fire. Yet the occupants of these cars never get out or walk away due to the simple reason of being dead or unconscious or too severely damaged in their soft tissues.

      Ruggerite Wasim Thajudeen’s body was exhumed a short while ago at Jummah Mosque Cemetery, Dehiwala as per the order of Colombo Additional Magistrate Nishantha Peiris.

      The Magistrate on Thursday ordered a panel of judicial medical officers to exhume the body of former Havelock’s Rugby captain, Thajudeen, today.

      The Criminal Investigation Department (CID) earlier informed the Magistrate that Thajudeen’s death was not accidental but a murder.

      The exhumed body was sent to the inspection of Colombo Chief Judicial Medical Officer.

    There are CCTV camera everywhere in shops and residences. The time can be easily corroborated with video footage.

    Thank you for the logical analysis which sheds light from a credible source of a police report. Your questions beg a logical answer. Hope the UNP who’s desperately trying to sell a dead body now to win, can speak with facts rather than innuendo. So far no real credible sources have been brought forward for the alleged new evidence except stories. It’s disgusting to see how low people can go to win at any cost. However the sad thing is, it’s only making sensible people want to puke !! With Credibility in shreds after not finding the horas, the new twist of “murderer” will not stick !     In all fairness to this writer, in one sentence she questions ‘Did Thajudeen’s friends, the last to see him alive give false times or did Inspector Damien Perera (still a serving officer in the Police force) falsify the times in the report? The rest of it is essentially part of the police report released by Mahinda.info in defense of the torture theory. This writer also mentions The CID intimated to the Court on 27 July 2015 that they suspect murder followed by torture’, Murder followed by Torture?

    But whatever it is, just the mention of the word Mahinda is enough to cast doubt on their theories, however sincere and genuine they may be, as they are past masters of this game, and will undoubtedly stoop to any level to cover their tracks. Power of money and wealth is their weapon of choice, and if that fails, silencing them for good. Gota served as the Defence man which was the worst period for the country and its people.

    Sorry mistake. “Murder following torture’ it should be. Also this Police Report is genuine. It’s certified by the seal of the Magistrate Court dated 5th August 2015. Significantly after this article the site mahinda.info has been blocked in some way. The site carries the notification that it has been subjected to severe interference and that until it’s resolved all new articles will be published elsewhere. Luckily CT has pdfed the report. Ironic considering CT was blocked during the MR regime.

        United National Front for Good Governance (UNFGG) General Secretary and Minister Patali Champika Ranawaka said today that former president Mahinda Rajapaksa would be stripped of his civic rights if he was found guilty of misappropriating Tsunami funds.

        “Mahinda Rajapaksa will have to face the charges levelled against him with regard to the misappropriating of Tsunami funds and assisting a terrorist organisation. He had presented a Cabinet note instead of a proper Cabinet paper to release funds for the LTTE. Since he had taken measures in his capacity as the then finance minister when asking the Treasury to release the funds to the LTTE, the legal immunity of a president will not be able to protect him,” the minister told a news conference.

        He said according to Clause No: 157 of the Constitution, aiding and abetting a terrorist organisation could result in a person losing his or her civil rights for seven years. It also includes the from employment in state institutions if they are state employees.

        The minister said Mr. Rajapaksa had provided Rs.800 million to the LTTE, through the Reconstruction and Development Agency (RADA) headed by former parliamentarian Tiran Alles and said the police had found records of a part of it being a cash transaction of some Rs.169 million.

        He said the funding of the LTTE by Mr. Rajapaksa through bogus companies had continued until the LTTE attacked former Defence Secretary Gotabaya Rajapaksa in 2006.

        “Neither Mahinda Rajapaksa nor his brother Basil, who had secret meetings with LTTE front-liner Emil Kanthan, had denied the charges against them of having funded the LTTE,” the minister said.

        He challenged the former president for an open debate on charges against him and said he was equipped with evidence to prove the charges.

        Meanwhile, commenting on the Supreme Court delaying the arrest of former MP Tiran Alles, the minister said the case was blow to the reputation of the Supreme Court.

        “The case should not be heard in the Supreme Court. I may be charged of contempt of court for making these remarks but I’m not afraid to tell the truth,” he said adding that they would make sure the judges are impartial in future and would probe all cases of corruption and disappearance.     MR himself said he will investigate the “MURDER” which means he himself admits it is MURDER. In your own timeline there are discrepancies. You claim that everyone called 119 at 12.00 but the actual notification came at 12.59. One friend claims they left at 11.00 while the others state 11.30 so even the time line prepared by the police casts enough doubt and demands further investigation.

        As for masochism only DR can answer that definitively unless you are having some insider information.

        I assumed that because I could not think of any other reason. DR should have rather stick to Nagas and Yakkas. Perhaps she should add some sexy pics on her blog page (have not visited that page since I last did during the era of Nagas and Yakas) that should really encourage the patrons to be creative and write comments bypassing the CT editor boss yet giving the sexual pleasure she desires.

    Darshanie Ratnawalli ,the writer of this article has clearly missed the point of the latest investigation. The case was reopened because the report filed by Inspector Damian Perera of the Narahenpita police was false. It contained so many inaccuracies. These were proved by CCTV footage police gathered. But this CCTV footage was never included in the initial “B” report submitted to the magistrate. The then Colombo DIG Anura Senanayake ordered that the case be closed as an “accused unknown fatal road accident.” Senanayake forgot that by mentioning that “accused” were “unknown” he was also leaving the door open for suspicion that someone else was responsible for this fatal accident.

    I am surprised that the CT writes an extensive report on such a sensitive matter without any reference to why a new investigation was necessary and the extent of the cover up. I hope it must be the inexperience of the writer. Hope it is shoddy journalism and not a conspiracy.

      This ROHAN pERERA is so false. In this report page number 268, paragraph number P. C. I. B 231 fakeness or genuineness of content does not depend on CCTV FOOTAGE. It can only be fake if the individuals giving statements were fake/non existent characters, if the statements recorded from even actually existing individuals were falsified and not what they actually said. If the people appearing in this report had made representations that their statements were falsified. If certain witnesses had found their statements omitted. This report does not require CCTV footage at all. It’s a preliminary report featuring eye witness reports, accounts from the last people who saw Thajudeen alive, relations who had to identify him. It records that the body had been given to the JMO and the wrecked vehicle had been given to the Government Analyst. It requests the Magistrate to order the director of Nawaloka to release the bedhead ticket from Thajudeen’s stay in Nawaloka. It does not request the Magistrate to issue an order that will enable Police to access CCTV footage of residential or business establishments in surrounding locations. That if it came at all would have come later in the investigation.

    Is it intended to whitewash MR family. MR is no more in power and investigations are being carried out by CID and how MR releases police documents now. Was he hand carrying these documents when they left the Temple Trees on 9th January?
    More suspicions are being created with these releases.

    Yes timing of Thajudeen’s movements before the incident is very vital and the statements made by these witnesses.

    How long will it take to torture?
    Where did it take place?
    How long would it have taken to transport the tortured body or corpse to the accident site in the same car?
    Are there any witnesses to this?
    Was this murder before torture, murder after torture or accident due to driving under influence of liquor?
    When were these statements recorded from these witnesses?
    Was it immediately or a few days later?
    Were there any alterations in between this recording and the day it was produced to the Magistrate for certification?
    Can these witnesses certify that this is what they really told the police while making these statements given to and certified by the Magistrate and has been recorded correctly?

    What naivete displayed by this writer of common sense?

    If the body was charred it could not have happened in a flash but would have burned for a while. Then again the heat must have been so intense that the branches above and the flowers would have wilted. There is no such sign. On the contrary the leaves and the flowers are just fine and intact.
    If the car impacted on the wall for the engine to be thrown out it certainly would not have only damaged the plaster of the wall alone but would have toppled the wall. No such sign either and the plaster peal looks old and certainly not due to this impact. Besides one can observe the wall is not a reinforced wall to resist such impact, where part of the wall has come down and the gap has been covered by some zinc sheets.

    The obvious is this vehicle did not meet with an accident at this point, hitting against the wall. If it did, it would have certainly toppled the wall. Further it did not burn there as the branches above look fresh and was burnt elsewhere with the body inside. Thereafter the vehicle with the charred body has been dumped there in a hurry and in the process the engine had come of the vehicle due to ruff and hurried handling. Obviously this could not have been done by a couple of hands, but a team of people.

    My advise to this novice of a Forensic, is to stick to her area without dabbling in things she has no knowledge about displaying her ignorance and trying to misdirect others.
