Update: Parliament Passes 19th Amendment – 212 Votes In Favour

Parliament today adopted the 19th Amendment to the constitution.

MaitreIn the third reading of the 19th Amendment, two hundred and fifteen (212) Members of Parliament (MPs) voted for the amendment while only one, MP Sarath Weerasekara voted against it. MP Ajith Kumara abstained the voting while ten Members of Parliament were absent. Three MP’s who voted for the second reading of the amendment, including DM Jayaratne were absent.

Parliament today passed the second reading of the 19th Amendment.

Two hundred and fifteen (215) Members of Parliament (MPs) voted for the amendment while only one, MP Sarath Weerasekara voted against it. MP Ajith Kumara abstained the voting while seven Members of Parliament, Basil Rajapaksa, Premalal Jayasekera, Janaka Priyantha Bandara, Dr. Jagath Balasuriya, Keheliya Rambukwella, Ven. Ellawela Medhananda and Susantha Punchinilame were absent.

MP Sarath Weerasekara voted against the amendment while MP Ajith Kumara abstained from voting. The government agreed to the SLFP move to dilute the composition of the Constitutional Council. The SLFP proposed to include 7MPs to the constitutional council with 3 non MPs. The Constitutional Council as proposed by the 19th Amendment would be a representative body reflecting the views of diverse groups in Parliament and would be apolitical in so far as the seven non ex-officio persons who are not politicians and are distinguished in public or professional life.

    With the aparthied inspired “consitutional council” concept pretty much destroyed, the 19A really is nothing. The “consitutional council” was designed to turn Sinhalese into 3rd class citizens in their own and only country and empower the alien Christians in Colombo and foreign imported Tamils as supreme rulers, turning the clock back to the British style of barbaric rule of butchery over Sri Lanka and the Sinhalese. When the General Election is held (that is if Ranil wants to face an election or continue his illegal anti-democratic dictorial and highly corrupt national wealth robbing rule) MR will sweep the polls and came back to lead SL as the executive PM.

    This is a victory for MR’s return, LOL. These “good governance” dictatorship preachers don’t realise how they’ve shot themselves in the foot. They maybe celebrating now, but it will be short lived. In the long term they are done for. The powerful and clever master stroke by the MR faction will see MR return with full powers and ensure these white worshippers who couldn’t care less if Sri Lanka disintegrated tomorrow (as evident with how they openly supported the LTTE, wanted our own Army defeat during the war, celebrated LTTE victorys and casualities amongst our soldiers and went around the world demanding economic sanctions to make the people suffer) will not just be thrown in jail but put out of existence. Just watch the fate to befall these “good goverance” criminals who came to power on lies (like good Lasantha style Christians) and are robbing Sri Lanka of her wealth to fill their bank accounts and enjoying foreign trips on first class air travel to luxury hotels while selling our country out and crushing the basic rights of Sinhalese to empower the blood demanding Tamil racist imports, the Church and of course to please their benefactors in the West.

    Wonderful news ! A tremendous step forward. But I regret that the government conceded to the SLFP demand to dilute the composition of the Constitutional Council thereby reducing the weightage of civil society in the Council. The governnment should have stuck to its guns and said “no deal”. No more dilution. Given the tremendous build up of public opinion in favour of the 19th Ammendment the SLFP now in disgrace disoriented and still licking its wounds after January though all the while fussing and blocking – would in the end not have dared to vote against the 19th Ammendment. The government should have called their bluff.

    Yes it is a very good thing that 19A has secured a 2/3 majority. But do not wish away its now 3 (previously 2) massive defects. (i) by establishing dual-centres of power – elected president and parliamentary power it has sown the seeds of future instability; (ii) the Council of State (pseudo second chamber) is an empty and vacuous body appointed 80% by PM and Leader of Opposition.

    And now we have a third contemptible capitulation. The Constitutional Council (CC) which will vet high level appointments (Judges, IGP, AG, Bribery C and many key posts) was to include 7 persons of high repute appointed by the President on the recommendation of PM, Leader of Opp, political leaders etc. Now Sirisena-Ranil have capitulated shamelessly and agreed to have 7 MPs instead. This incestuous relationship between CC and Parliament destroys the principle of division of power between Legislature, Executive and Judiciary. (Dot confuse this with the US Senate’s vetting system for high appointments which is quite different in powers and tradition – actually we have no traditions in this respect).

      I have serious concerns too about how the Contitutional Council will now be constituted . The SLFP has succeeded in sabotaging a key innovation in the 19th amendment to ensure the independence of key instructions through a body of educated and experienced persons from the civic society ,combined with the PM, opposition leader and the Speaker.
      The lean, mean and hungry-looking Casca has successfully stabed Caessar in the back!

      The President will have to now play an active role to ensure that the persons nominated to the independent commissions are indeed independent, of high calibre and beyond political interference.

      A new constitution has to be definitely formulated once a new parliament is elected. This would also hinge on the quality of persons we elect to the new parliament and the fate of the 20th amendment.

      These well-known thieves held us to ransom once again. At the last moment of a historic process. Indeed they have stabbed us in the back. They will never be forgiven. Ever.

      Yet, we have come so far. We can finish the job. Fix it I hope after the General Election.

      Number One priority now is to flush those corrupt monkeys out of Parliament. Preferably down the toilet of history..

      Navin – Do not underestimate MaRa’s capabilities. He will plant some of his supporters to contest under SLFP ticket and cross over once ministry ships are not offered to some of them as govt. cannot offer every winner a ministerial position and there is a possibility that only SLFP ministers, UNP’ers and minority parties sitting on govt. benches and the rest sitting on the opposition benches, whose no. may even be higher. The Govt. had created a precedence by accepting lower rung parliamentarians in the current govt.as ministers and how will they accommodate the seniors in the party ,after the election,so Navin, Ar’nt we not back to square one.?

    Now that 19th amendment is passed with amendments. This was not the 19th amendment that what was given publicity at the beginning of the new govt. CT had a draft which was very useful. On the basis of SC ruling certain sections were deleted and then the SLFP wanted certain amendments.What is left of the original amendment.
    We have not got the copy of the 19the amendment that was just passed. Is it possible for CT to give us gist of the amendments that was just passed or should we wait for the 3rd reading. This would help the CT readers

    Congratulation My3, Ranil, Ven. Sobitha Thero and the untiring efforts of everyone else in the team. The Ideal amendment was watered down because of the need to accommodate he elite group of parliamentarians who wants control over the Srilankan destiny against the will of the people. We should strive to get the agenda forward to include the original version when the elections are over to make sure the constitutional council is filled with descent, professional and insightful patriots who will do the right thing versus a bunch of thieves who think that Srilanka should move in the direction they want. Lets mobilize today and work until we achieve the ideal outcome.

    Basically the Rajapaksa’s have lost the match at this point. Now the Bribery Committee can really start doing their job and not just arrest Basil for a couple of days upgrading him quickly into hospitalization. Now some serious cleaning can start take place.     This is victory for the West. Ranil too can celebrate. Tamils do not have anything. Still they will have a say in president election process. Other than that Tamil did not have a voice in Westminster style parliament. This is done. But if they want to help Tamils to come out of oppression, West need to have this Parliament scrapped. This is what damaged the Tamils liveness in the Island. This only for the majority community. Anything overly good for the majority community is, logically, oppressing the minority community.

    Thank you Mr. President, thank you Ranil, thank you to UNP and all the rest who collectively supported and put in whatever small effort to get these Constitutional Amendments passed with such overwhelming majority. This victory for the masses is only half the battle that was won. Still waiting for the naming and shaming of those who robbed the country of its resources and flourished on the drug trade. They even made ordinary citizens pay for their luxurious and high flying lifestyles. As minorities, we (Muslims and Christians) were subjected to attacks and hate speech by bigots and goons like BBS and RB, whilst the Police and soldiers were made impotent and ineffective and looked the other side when homes were being looted and everything was going up in flames. Hopefully we could expect some justice tp be served now that the judiciary has been made independent, and all the country’s citizens will be treated equal before the law.

    Amid all the euphoria it is worth remembering that Sri Lanka had a similar parliamentary system before 1977. It did not prevent nepotism, bribery and corruption from occurring. Good governance depends as much on there being upright and sincere politicians as on there being checks and balances. How many upright and sincere politicians do we have? I cannot think of any.
