Pillay Calls For An International Inquiry; 74 Point Report

A damning 20-page report from United Nations Human Rights High Commissioner Navi Pillay became the subject of close scrutiny by the UPFA Government this week, the Sunday Times repots. According to the newspaper, Pillay’s office urged the Government, as is the practice, to respond to the contents of this 74-point report — the precursor to the United States backed latest resolution on Sri Lanka next month — within a week. The External Affairs Ministry (EAM), which co-ordinated the point by point answers converting it to a formal document kept to the deadline which was last Wednesday (February 12).

Navi PillayThe Sunday Time said; this report, a copy of which was seen by the Sunday Times, has made recommendations both to the 25th sessions of the UN Human Rights Council as well as the Government of Sri Lanka. To the UNHRC, it recommends, that it should “establish an international inquiry mechanism to further investigate the alleged violations of international human rights and humanitarian law and monitor any domestic accountability process. OHCHR (Office of the High Commissioner for Human Rights) stands ready to assist such a process.”

Here is what the Pillay report calls upon the Government of Sri Lanka to carry out:

(a) Finalise laws dealing with incitement to hatred, witness and victim protection, the right to information, the criminalization of enforced disappearances, in line with international standards, and revise existing laws to bring them into line with International Human Rights Law;
(b) Repeal of the Prevention of Terrorism Act and lift the regulations promulgated under it which allows for arbitrary detention;
(c) Arrest, prosecute and punish alleged perpetrators of attacks on minority communities, media and human rights defenders, and ensure protection of victims;
(d) Undertake independent and credible criminal and forensic investigations with international assistance into all alleged violations of human rights and humanitarian law, including recently discovered mass graves;
(e) Establish a truth seeking mechanism and national reparations policy in line with international standards as an integral part of a more comprehensive and inclusive approach to transitional justice;
(f) Broaden the scope and tenure of the Commission on Disappearances to encompass cases from all parts of the island and all periods of the history of disappearances. Ensure an effective public information campaign and provide sufficient time to hear and record all petitioners who wish to submit complaints;
(g) Publish the final report of the military courts of inquiry, presidential commission of inquiry 2006 and more recent commissions of inquiry to allow the evidence gathered to be evaluated;
(h) Take further steps in demilitarization, and initiate a meaningful and transparent reduction of the military presence to peacetime levels, which would require a clear timeline for demobilisation, disarmament and disengagement from activities that are meant to be civilian;
(i) Engage civil society and minority community representatives more fully in an inclusive and consultative process to support implementation of the LLRC recommendations;
(j) Implement the LLRC recommendation for a national day of commemoration, allow all citizens their right to hold individual or group commemorations, and hold national consultations on the design of appropriate memorialisation for the victims of the war;
(k) Give positive consideration to the offers of technical assistance made by the High Commissioner for Human Rights;
(l) Invite special procedure mandate holders with outstanding requests to visit the country in 2014, particularly the Working group on Enforced and Involuntary Disappearances and the Independent Expert on Minority Issues.

Among other matters, Pillay says that “new evidence — including witness testimony, video and photographic material — continues to emerge on what took place in the final stages of the armed conflict. Human remains also continue to be discovered, for instance in Matale in November 2012 and Mannar in December 2013.” She adds: “As the emblematic cases highlighted above show, national mechanisms have consistently failed to establish the truth and achieve justice. The High Commissioner believes this can no longer be explained as a function of time or technical capacity, but that it is fundamentally a question of political will.

The Secretary-General’s PoE (Panel of Experts) and initiatives by international non-governmental organisations have shown that witnesses are willing to come forward to testify to international inquiry mechanisms which they trust and which can guarantee their protection. For this reason, the High Commissioner remains convinced that an independent, international inquiry would play a positive role in eliciting new information and establishing the truth where domestic inquiry mechanisms have failed. In the absence of a credible national process, she believes the international community has a duty to take further steps which will advance the right to truth for all in Sri Lanka and create further opportunities for justice, accountability and redress.

“The High Commissioner reiterates concern about the continuing trend of attacks on freedom of expression, peaceful assembly and association, particularly against human rights defenders, journalists and families of victims; the rising levels of religious intolerances; and continued militarisation which continues to undermine the environment where accountability and reconciliation can be achieved. She therefore reiterates and updates the recommendations made in her previous report to the Human Rights Council, most of which remain unimplemented.”

        IN response to Madam Pillay’s report I just read that: “The government of Sri Lanka will introduce a new scheme to assist Sri Lankans residing overseas to reclaim their lands that are occupied by squatters.”

        In that case, my understanding is that the Sri Lanka army, air force and Navy along with the Rajapaksa brothers and sons who have acquired acres of valuable coastal property are the biggest SQUATTERS in Sri Lanka!

        A sad day for any hopes for a just new world order.

        The whole report is unmitigated hypocrisy and unrelenting negativity.

        Just look at the very first recommendation: “(a) Finalise laws dealing with incitement to hatred …” If this is not incitement, what is incitement? A country desperately trying to put its past behind and move forward by taking constructive steps towards reconciliation and unity based on pluralism is being constantly bombarded with narrow and divisive ethno-nationalist messages. The whole exercise is to keep reminding the people of their past failures in nation building and to rekindle the hatred and mistrust that beset the country for so long. People are being encouraged to seek revenge rather than reconciliation.

        Navi Pillay talks about right to information. But whose right? Will she also respect the right to information of the Sri Lankan people and take steps to make available the following information to us:

        1) India’s role, in contravention of international law, in financing, training and equipping the LTTE and other Tamil militant groups to launch terrorist attacks in Sri Lanka.

        2) How Norway, in contravention of international law, conspired with the LTTE to undermine the constitution and sovereignty of the people, and divide the country under the pretext of “peace negotiations.”

        3) How the US, EU and Norway, in contravention of international law, tried to impose a ceasefire with the connivance of the UN to rescue Prabakaran and other top LTTE leaders in order to give oxygen to LTTE and keep the country embroiled in conflict and thus prolong human right violations.

        4) How the western countries with Tamil Diasporas violated international law in overlooking or even allowing the LTTE to use their soil and resources to raise funds (through voluntary contributions, extortion, and through various criminal activities), undergo training, and procure weapons in order to launch terrorist attacks in Sri Lanka.

        5) Finally will Navi Pillay stop violating the rights of Sri Lankan people by withholding information about current efforts of the US and its allies to bring about a regime change in Sri Lanka with the connivance of the UN, human rights organizations, NGOs and their local civil society agents under the pretext of redressing human right violations and war crimes.

        What Navi Pillay is presently revealing is only partial information sanctioned by her US masters meant for public consumption. Navi Pillay, we Sri Lankans demand you to provide us access to full information pertaining to measures that are underway to deprive our freedom as a people and undermine the future of our country – instead of the cynical public relations prattle that you have come up with. It is our right to information that you are violating.

    Q to Pillai: But nothing is mentioned regarding minorities recruiting child soldiers, engaging in terrorist acts of bombings, killings etc and is Pillai demanding Sri Lanka legitimise terrorism?

    Does c) and b) apply only to Sri Lanka? Steps being taken by US, UK as regards prevention of terrorism are far more draconian. Can you (Pillai) visit people in detention and being interrogated by CIA and check if they are in good health? No perks there for you?

      Those who attacked sections of the majority community and Buddhist shrines were a group of terrorists and they have been banned as such by the International community. Action has been taken against them by the Government and no one is condemning that. Now these terrorists have been decimated. So why keep referring to this time and again. The same applies to recruitment of child soldiers, terrorist bombings etc.

      The issue that the UNHCR is concerned about is the purported blatant neglect of its call for an acceptable enquiry into atrocities and human rights violations committed and being committed by the various Government forces against which no action has been taken, despite promises to the International community by non other than the President of the country. If such an enquiry reveals that nothing untoward has happened, then what is there to be concerned about. The Prevention of Terrorism Act, which has outlived its purpose, is now being used to suppress freedom and violate human rights.

      If there have been similar violations of human rights by other groups and countries of the International community, where action has not been taken, then why not bring it up instead of cooking up weak criticisms and trying to sweep these issues concerning Sri Lanka under the carpet.

They will continue to remain unimplemented if there is no international intervention and pressure. Now “We” are considering the casual recommendation made by the discredited Zuma, the South African President to hold a Truth and Reconciliation Commission as if we are hearing it for the first time. Zuma who made political capital of Mandela’s serious illness during Mandela’s last days is now campaigning for his re-election, under a cloud. The South African peoples including the Zulus will bring him down spelling the unprecedented downfall of the ANC. The proposed commission, one of the numerous others with no result , now being showcased by Rajapaksa is the latest ruse to bide for time to put the international community off their trail.     The only surprising thing here is the explicit rejection of amnesty for those who are guilty of war crimes. You would think that the prospect of amnesty will be used as a carrot in negotiations with the GOSL.
     
    The other issue is the timeline: Ms.Pillays report does not alleviate the concern that this will be a long drawn out battle at the UN that could take years to unfold. However, we need to reserve judgment until we see the text of the US sponsored resolution. To me, inclusion of the words “United Nations Security Council” is a must if the process is to have a swift, decisive conclusion.

          if i’m not mistaken , Mr Milosevic had been extradited to Hague and convicted for his crimes , but before the conviction he was found dead in his cell in 2006.

    Ms NP is trying to do some valuable things for the people and justice of this country. However, she has only touched on the symptoms and not highlighted the core of the issue which is the despotic Rajapaksha Regime. The despotism has been concealed by a façade and label of democracy but in actuality there is complete absence of democracy, law and order etc. and anarchy is the status quo. So long as the Rejapaksha regime is in power and hold fake elections and international community and able players do not recognize this fact and accordingly take measures to oust the despot and establish a democratic government all these resolutions passed one after the other will be in vein and a waste of time. If you want to really address these issues you must deal directly with the Rajapakshas and get rid of this first and then have whatever things done.
