Mahinda Rajapaksa (responding to questions about the sil-redi verdict)[i]

I ordered, he says, as if those two words would suffice. Perhaps they do, in his eyes. ‘I’m the state,’ Louis XIV declared, according to Carlyle. Mahinda Rajapaksa sees himself as the nation, which also encompasses the state. So how can he misuse state-funds?

Rajapaksa’s anger at the sil-redi verdict is not contrived. He doesn’t understand the fuss; he certainly doesn’t understand the verdict. His bemusement reeks of authenticity, and of Trumpian-level ignorance. “If this is an election-case, they should have gone to the Elections Commissioner for punishment,” he says. “If this is an election case, they can’t punish here,”[ii]he adds, here meaning the courts. (The former president, who is also a lawyer, thinks that violation of election laws must be punished by the Elections Commissioner and not the courts!).

The former president’s response to the verdict demonstrates that defeat has taught him nothing; he is as wedded to impunity now as he ever was.  Laws are a bagatelle is the subtext of what he says, especially election laws. In his unrepentant eyes, the law is there to punish the poor, the powerless and political enemies. He, his kith, kin and acolytes are above the law. Lalith Weeratunga and Anusha Palpita did what he told them to do. Ergo, they cannot be wrong.

Unlike the former president, Mr. Weeratunga and Mr. Palpita would have known that using state funds to distribute sil-redi four days before a presidential election amounted to a clear and colossal violation of election laws. They didn’t care, because they never thought they’d lose. In any case, their years at Mr. Rajapaksa’s side would have accustomed them to regard the law as something infinitely tensile. Mr. Weeratunga’s name, for instance, featured prominently in the Helping Hambantota case. (The police investigation into that case was stopped by the then Chief Justice Sarath N Silva. Mr. Silva lashed at the police for their presumption and berated the CID for questioning ‘a senior civil servant like PM’s Secretary Lalith Weeratunga,’ for more than five hours[iii] – a stance which amounted to liberating power-wielders from the confines of the law.)

The timing was everything. If the distribution of sil-redi was the result of an old plan, why do it on the Duruthu poya day, just four days before a crucial presidential election? Why not wait another month? According to media reports, the presiding judge had wanted to know whether all those who observed sil were subject to some natural calamity which destroyed their sil-redi. Such a disaster might have gone some way in explaining the decision to distribute sil-redi in January, in the midst of a presidential election campaign. Of course there was no such mitigating disaster. The emergency was not natural; it was politico-electoral, the urgent need to offer one more bribe to Sinhala-Buddhist voters on behalf of Candidate Rajapaksa.

The sil-redi case is a classic example of how politicians use religion in the furtherance of their own ambitions. The distribution of sil-redi couldn’t be postponed until the Nawam poya day not because such a postponement would have harmed Buddhism, but because by Nawam poya the presidential election would be over. So the money was obtained in a hurry, without due approval from the TRC director board. A piece of paper, which reminded the recipients that the gift was made by President Rajapaksa, was inserted into every packet of white cloth. Mr. Weeratunga and Mr. Palpita facilitated that bribe, knowing it was a bribe. There’s no way they could be innocent of misappropriating state funds and of breaking election laws.

‘They have learnt nothing and forgotten nothing,’ Talleyrand is supposed to have said about the Bourbons. It is certainly true of Mr. Rajapaksa (and his family). If the Rajapaksas return to power, they will enthrone abuse and impunity, again. The law will become nothing other than the servant of an all powerful ruler and his immediate family.

Sil-redi and CB-bonds

Corruption is a multi-partisan thing, as the irregularities around the Central Bank bond issue proves. That scam, like the sil-redi distribution, was grounded in a belief of impunity. The bond-scam’s authors and their underlings would have thought they’d be safe from discovery, let alone from eventual prosecution, given their exalted positions and powerful connections. The work of the Presidential Commission, Attorney General Department and various investigative organisations indicate that the era of impunity is over. Corruption has not been eradicated, but the corrupt can no longer be certain they’d get away with their crimes. That sends a powerful message to politicians, officials and business magnates – they cannot count on impunity all the time, as they once did.

If the bond-scam proves that power corrupts, its aftermath demonstrates that in a democracy, impunity is not destiny. Where dissent is possible, the people have the capacity to demand and obtain a modicum of accountability if not justice. The bond-scam investigation and the sil-redi verdict, in conjunction, constitute a beacon of hope in a dark time. They provide a kind of roadmap for a future which is better than the past or the present. They also demonstrate that Sri Lanka can be saved from utter ruin – not by ‘I’m the Saviour’ politicians, but by good laws and strong institutions capable of withstanding partisan pressure, a vibrant media and an engaged public. This positive potential would be completely destroyed if the Rajapaksas manage to return to power again. Sri Lanka would retrogress to a time when the president, his family and his underlings were above the law. Sri Lanka would also retrogress to a time when the BBS types could attack ethnic and religious minorities with complete impunity.

If there is one man more responsible than any other for the horror that is unfolding in Myanmar, that man is Ashin Wirathu, the ‘Burmese Bin Laden’. Three years ago, in September 2014, Wirathu arrived in Sri Lanka to attend the BBS-organised Sangha Convention (held at the Sugathadasa Stadium). By that time Wirathu’s 969 Movement had been effectively banned by Myanmar’s Sangha Council, “the government-appointed body of monks that oversees and regulates the Buddhist clergy.”[iv] The Rajapaksa administration could have refused him a visa, without discomposing the Myanmar government. But the regime not only gave him a visa; he entered Sri Lanka “via the VIP lounge and was whisked to a safe place,” as the BBS boasted on its Facebook page. Such happenings were possible because the BBS was enjoying the patronage of the government in general and Gotabaya Rajapaksa in particular.

Wirathu, who has mastered the art of spewing incendiary words while maintaining a facade of serenity, (unlike most of his Lankan counterparts) promised that his 969 movement will work with the BBS to protect Buddhism in Asia from the ‘Jihadist threat’. The CEO of the BBS declared that the name of Sri Lanka should be changed to Sinhale, that Lankan-Tamils must be renamed Sinhala-Tamils and Lankan Muslims Sinhala-Muslims. Only Sinhala-Buddhist culture should be allowed. The BBS would soon present a new constitutional-blueprint which would include these and other changes. Galagoda-Atte Gnanasara attacked Rev. Sobhita Thero for promoting the idea of a common candidate and spoke in defence of the presidential system.

The BBS Convention was an attempt to incite Sinhala-Buddhist fears and harness them to the Rajapaksa chariot, in time for an early presidential election. Mahinda Rajapaksa needed every single Sinhala-Buddhist vote possible and one of the tasks of the BBS was to deliver these votes by addling Sinhala-Buddhist minds with fear about a Muslim/Jihadist threat.

Had Mahinda Rajapaksa won in January 2015, he would not have implemented any of the more insane ideas advocated by the BBS. But during a Rajapaksa third-term the BBS would have continued to ride roughshod over minorities, thereby rendering other Aluthgamas not only possible, but also inevitable. A Rajapaksa victory would have hurtled Sri Lanka along the Burmese path, towards a religious civil-war.

The Way of Myanmar

Like for Mahinda Rajapaksa – or Donald Trump or innumerable other political leaders – for the Burmese generals too minority-phobia was, first and foremost, a political weapon. Divide and rule did not end with colonialism. The generals who controlled Myanmar during much of its post-independent history fanned the flames of religio-racial hatred against the Rohingya minority as a way of gaining Buddhist-Burman support. The Rohingyas served as ideal scapegoats – Muslims in a land of Buddhists, different and alien in many ways, from cultural practices to skin colour.

But the generals alone couldn’t have transformed quotidian suspicion and dislike on the part of ordinary Burmese into an all consuming phobia and hatred of Rohingya Muslims. That radical change was made possible by a segment of Burmese Buddhist monks, especially those associated with Wirathu’s 969 Movement and its successor, MaBaTha. These extremist-monks rendered religio-racial hatred respectable and popular; they made it seem compatible with democracy, and depicted it as necessary to the protection of Burmese Buddhism.

“All fear punishment, all fear death, comparing oneself with others, one should neither kill nor cause to kill.” That was Siddhartha Gautama, the Buddha.[v] That injunction against causing hurt, harm or death covers not just all humans but all living beings. That one stanza would have sufficed to prevent the unfolding tragedy of the Rohingya people, had Buddhists of Myanmar paid even an iota of attention to what Buddha taught. But in Myanmar, as in Sri Lanka, the Buddha’s teachings, especially his unequivocal and total rejection of violence, are being observed only in the breach. According to UN statistics almost 400,000 Rohingya men, women and children, had fled their homes to Bangladesh, triggering a massive humanitarian crisis. The fact that this ethnic-cleansing is being committed in the name of Buddha and Buddhism demonstrates that the contagion of violent-intolerance is not the legacy of any one religion.

The Rohingya people suffered violence and discrimination for decades without resorting to counter-violence. When peaceful and democratic resistance fail, those who advocate counter-violence as the only possible-solution gain upper-hand. Arakan Rohingya Salvation Army (ARSA) was formed by Rohingya exiles living in Saudi Arabia, according to a report by the International Crisis Group. ARSA, which is reportedly being funded by wealthy Saudis and Pakistanis, had mounted several attacks on Burmese security forces. The latest such attack served as the excuse for the current round of anti-Rohingya bloodletting.

What is happening in Myanmar today is not dissimilar to what happened in Sri Lanka, post-Black July. Extremists on either side are serving each other’s interests. The mass-killings and expulsion of Rohingyas would provide more fodder to the ARSA, both in terms of money and recruits. There is a real danger of unemployed IS fighters on the lookout for a new cause and a new battlefront making their way to Myanmar. This in turn will strengthen Buddhist extremists and their project of ethnic-cleansing. As the cycle of violence spins ever faster, the military will use it to regain what power they lost due to democracy’s advent. Aung San Suu Kyi failed to do the right thing because she wanted to hang on to power. But by failing to do the right thing, she had paved the way to her eventual ejection from power.

For all its faults – and the faults are many – the Sirisena-Wickremesinghe government does not support blood-and-faith nationalism, yet. But it remains vulnerable to extremis-winds, especially if the economic conditions of ordinary people fail to improve fast. Opposition to a new constitution and anti-federalism seem to be the keystones of the Gotabhaya-led movement to restore Rajapaksa-power, for now. But come election time, the Rajapaksas are likely to bring out other slogans and other bogies, especially rehashed narratives about renewed Tiger threats and new Jihadist threats. If the Sirisena-Wickremesinghe administration fails to improve its performance in the coming months, the incendiary rhetoric of blood-and-faith nationalism might find too many receptive ears in Sri Lanka, as it did in Myanmar.

      Master piece as usual.

      The bottom line is MARA henchmen never expected to lose the election. Also made to understand that the amount spent in Sil clothes is much less than Rs 600 m and yet to find out what hapenned to the balance.

      The four decision makers during MARA that is Gota, PBJ, Lalith and Nivard and they ran the government with the cabinet being a mere stamping authority only.

      The whole issue is most Buddhist priests have embraced politics supporting all parties and their existence is dependent on their candidates doing well so that they would benefit later on.

      The other issue is that the Mahanayakes have no say over the activities of the 30,000 priests and the 10,000 temples in existence. You need two simple rules, that is all bhikkus are answerable to Mahanayakes through a hierarchical governance system and all of them are transferable to another temple after 3-5 years.

      Unfortunately any religious leader can be bought over either via expensive cars or money or by other means by any govt and this has been proven over and over.

      I think Rajaakshe Regime betrayed innocient lanken buddhism by having invited this Wirathu lanka, not thinking twice. I read this as ” buddhist terror” on the time magazine.
      Many known to me kept question if that is that worse in the country today, breaking their thoughts held about the island nation.
      I believe many activities that Rajaakshe just let it go damaged entire nation on international podium. He never thought, that the nation woudl face consequeses if the bugger mentalities allowed to do any kind of thoughts that many of th enation would not bear.
      For example, we now know, that many among the buddhists, born buddhist would not respect the manner lanken buddhist monks have been.

    Tisaranee, you have done a timely vital job in writing this article to tell those who are open to persuasion that JO and other associates of MR King are trying to bring back the most dangerous autocrat to power for their selfish purpose and to bring back corruption, impunity of murderers and abductees and inciters of hatred.
    The evil leaders use hatred of minorities to inject fear of the oppressed for political ends. MR King and his family knew the mastery of breeding hatred in order to destroy the minorities while many the latter were made to feel they were their friends.
    The karma is so strong that MR King himself did everything to bring his corruptive regime to an end. If he did win the election not only his rival common candidate but many other dissidents, journalists, businessmen of minorities would have met the same fate of the rugger rite without any trace.

    Just read that the Maharagama Cancer Hospital has no PET Scanner. 14 months ago the father of a cancer patient collected Rs.200 million and handed it over to the Govt to buy this PET Scanner. The LC has yet to be opened! He is devastated. 600M can buy 3 PET Scanners for those poor cancer patients. Nobody will question if the TRC made this their CSR project instead of some silly redi.

        The arrest and punishment of the two high ranking officials for violating elections law is justice. Mahinda himself accepted that he ordered the distribution of Sil-ready four days before the election. Even a five year old can understand this. If he doesn’t know the basics of election law how can you expect him to run the government by respecting the law of the nation. Is he superior to the law? Why did he call for an election instead of extending his power for another decade or another century without an election? Weerawanse and Vithange can utter anything because they thing people are fools but we people should understand how these group play with the law and how they try to cheat us.

    I wish I could share the writer’s optimism. However, when one views the connections between senior members of the current coalition, particularly the UNP part of it, and some of the most reprehensible of the Rajapaksa regime, one cannot but be a tad pessimistic.
    Just one of the issues I have raised is that of the total inaction on Mangala Samaraweera’s complaint to the CID about the attempt at a coup on the night of that famous election. The list of infamy of which that is but one instance continues to grow, the list of connections between senior UNPers and members of the most fascistic of regimes continues to GROW at a similar pace.
    there is NO CHOICE other than the emergence of a third force that doesn’t share in the corrupt practices of our current “political leadership.”

      This might qualify you for a PhD in gobbledegook but it is TOTALLY incomprehensible to anyone who understands English!

    Everybody knows the foundation Don Stephen started to put in 1948 is the one delivered the JVP child. Apparently there was no violence by those governments to Sinhalese, though Tamils minority suffered a lot. But once violence erupted from JVP, the previous governments were blamed for that reason and Standardization like programs were introduced to eliminate the future violence. Sincere or fraudulent, every measures those governments took allowed the violence to flow up to Aluthgama. Now Ranil has openly said the kidnapping and white van abductions were done by LTTE. He had advised Lalith and Anusha to appeal and get out. It is said New King is waiting for the application from convicts for the Presidential Pardon. So far no Yahapalanaya politicians have said the court is correct in convicting and the convicted are real criminals. It is on those circumstances that Tissaranee is hiding the news in Colombo media and betting on Yahapalanaya. Many others too betting on Yahapalanaya for one main reason that is, Yahapalanaya can gain confidence from IC better than Chitanta government and save Old Royals from UNHRC Electric Recliner.

    Ranil remain accused having his hand in Batalanda. Ranil blocked with his full power to keep out Rome Statute signed. By imposing impunity the history never seen, Yahapalanaya is putting foundation in much wider way than DS did in 1948, for a wider conflicts. Tissaranee may like to substantiate UNP. But historically, UNP is the one produced most violent governments from the time of freedom. One time, even Old King wanted to go against UNP seeking relief from UNHRC. But Chitanta has not committed that much serious crime on the eyes of UNP to go to UNHRC. In fact, UNP not seeing them as violence so is trying to save the Old Royals. Then what is Tissaranee Predicting?

      Malla, TG is praying not predicting that Yahapalanaya will survive, TG knows very well that what is happening in Myanmar has more to do with Sino-Myanmar pipeline than any cast or creed..the pipeline goes right trough Rakhine and the west is trying to prevent that.

    Thanks to the author of this Article for a well articulated, well rounded, well thought of piece of writing. Cannot fault with anything that has been written.
    It is true that the ‘Rajapaksas’ who think they own this Nation and therefore they are ‘above the law’, pander to the emotions of certain sectors of the Sri Lankan Society. One such sector is the ‘rural village folk’ who are not well informed and lack access to Social Media etc to realize / comprehend / understand the ‘true colours’ of the this Beast. But what I can’t understand is why certain well informed folk from the Cities, still wish to see that regime back in power. The only answer I can think of is that in some way or another they personally benefit from such a change and/or are racist/criminal/xenophobic/intolerant/corrupt in their nature/views/practices. In my opinion, such a change certainly would not benefit the Nation as whole.
    It is true this Government has failed in several areas, considering the eager expectations of the 6.2. million voters, who in their wisdom, voted for a change on 8 Jan, 2015 inspite of many a hurdles / bribes and electoral mis-deeds/crimes. But what must be remembered is that the voters did not give any one party an absolute majority in Parliament in August 2015 resulting in the current co-habitation arrangement. Working in harmony in such a scenario cannot be easy, especially with the kind/quality of Politicians who are in Parliament now. They still have almost half of the period remaining. If tangible progress is not made at the end of that period, Voters will be given the opportunity to decide what they do next. In my opinion, bringing back any of the ‘Rajapaksas’ will not be the answer. If that happens, it will be a disaster/tragedy for our Nation in ALL respects.
    I am still grateful to the majority of voting Public who had the foresight/wisdom to send MR and his regime packing, when given the opportunity to do so. It is also comforting that we have a Constitution that debars MR from contesting for the Presidency again. In my mind, he is a lunatic (confirmed from his latest utterances) who is also a thug and a criminal, whose rightful place should be behind bars. Will we see that happen on our lifetime?

      I may be wrong but reading your past comments makes me believe that you have connections to the UNP hierarchy especially Ranil.

      Forget the Rajapakses …….. people did their duty and sent them home and handed the country over to Ranil …… what did he do? He has been nothing but a total disappointment. A bumbling, bungling, incompetent, incoherent moron parading as a modern economist/technocrat. ………. The first thing the gutless idiot does after 20 years in the political wilderness is get Mahendran down from Singapore and shoot himself in the leg and come up with the most ham-fisted cover-up the country has ever seen.

      The greatest misfortune of the country today, more than even the Rajapakses, is that the UNP lacks a leader that can win elections and govern the country on his own-right. With any other leader, Rajapakses wouldn’t have got away with such crap. A JR or a Premadasa – they weren’t perfect – would have fought the Rajapakse corruption and misgovernance all the way, and once in power put the crooks – at least of the other side – behind bars where they belong.

      When people has given Ranil the opportunity to do the needful and he is just sitting on his hands It’s a bit rich for you not to blame Ranil and expect the people to save themselves and the country from the Rajapakses!

      Is one single act of courage from Ranil in his entire sorry cowardly wishy-washy life too much to ask?

    Very good analysis. One thing missed out is “MR com back process ” is being backed by high places like Asgiriya within the country. Regional and International powers too may bring back a regime that serves their interests
    I have a feeling that even the super powers East or West do not want the Rajapaksa clan to retire from SL politics .in SL Religion and Race will continue to play a major role in voters preference endorsed by Maha Sangha.

Their stupidity is at peak. Isn’t Tisaranee Gunasekara’s prediction sounds better than those guys dreams?

    When we fought to change the Government in January 2015, our critical concern was to somehow stop Rajapakse getting back to power. While the ineptitude demonstrated by Sirisena and Ranil in the last two years is downright disheartening, none of us held our breath for these two to fulfil all their promises made with well acted sincerity.
    However we cannot leave the country to slide back in to the hands of Alibaba and forty thieves aided by disingenuine academics like Dayan J Silva and GLP and the self serving leaders of the Sangha!
    TG please keep writing as before in a regular column to awaken those in a slumber!

    Understand your thrill in bashing Rajapaksa. That is the only thing your lot and yahapalana cabal is competent of doing during the whole of past two and a half years.

    However why do you seem to willfully ignore, that half of present mob including your beloved head of state were powerful members of the previous dispensation? As per available reports they themselves inserted THEIR own personal propaganda material when sil redi were distributed in their electorates. Do you think they are born again? Or their sins are forgiven for taking down YOUR enemy number one?

    TG citing the PCoI tries in vain to make us believe that the era of impunity is over!! What a joke! TG wants us to forget, that PCoI itself is a diversion. If the era of impunity is over president wouldn’t have dissolved the parliament, but allow the COPE proceeding to complete. If the era of impunity is over, then there would have been a criminal case against bond scam already in front of the courts. Bond scam issue has been kept alive only through agitation by the unofficial opposition, JO and other like minded pressure groups. No yahapalanistas. What I can say is that in fact the era of BS by yahapalanistas like TG are over. People won’t be fooled any more. TG can gauge it by pushing her masters to conduct PS and PC elections. TG in her high horse preaches us about vibrancy of democracy and strength of the institutions………. Yet she is happy democracy is trampled by the current junta to prevent here enemy number one returning. What logic is that?!

    It seems Arjun Mahendran cannot be compelled to give evidence at PCoI (which TG so highly touts) because he is a Singaporean………But Prime Minister can appoint him to head Sri Lanka’s Central Bank (the apex body governing the monetary policy) and he can sign Sri Lanka’s currency notes, the primary official exchange of value in Sri Lanka!!

    Is this how TG and other yahapalanistas intend to strengthen the institutional frame work of governance in Sri Lanka? Do you see it as funny or a joke? I don’t….general public doesn’t……..

    Thank goodness Mahinda Rajapaksha was not born in Myanmar or seemingly has no relatives in Myanmar either. Myanmar would have been his fault if not.

    Rajapakshas have served Sri Lanka for over a century and will for another century. Get used to the idea. Its easy for those who are not driven by ulterior motives and hatred
