President Appoints “Bunch Of Men” As President’s Counsels

President Maithripala Sirisena has appointed a bunch of all male legal professionals as President’s Counsels.

Out of the twenty-five male legal professionals elevated to President’s Counsel, two of them, TNA spokesperson M.A. Sumanthiran MP and Upul Jayasuriya, the chairman of the Board of Investments (BOI), had not applied through the formal channels. However, a number of senior female legal professionals – some of them with over thirty years of consecutive service in the bar – had also applied as per existing rules. It appears that they were not given due consideration.

When asked on the exclusion of eminent women who had applied, gender justice activist Dr. Chamindra Weerawardhana said “In a government that presents itself as an advocate of yahapalanaya (good governance), and as promoting gender equality and women’s representation in the professions (including electoral politics), it is a cause for grave concern that such equality measures do not seem to apply to the senior-most women in the legal profession. As it is usually done in countering critiques of this government, one can argue that similar all-male appointments were made under the Rajapaksa administration. However, in voting for good governance, many Sri Lankans expected a change, this certainly is not the ‘change’ voters expected. This is a telling example of continuing business as usual in an extremely patriarchal power structure”.

The President’s official website said: “the President appointed these Senior Lawyers, who have reached eminence in the profession and have maintained high standards of conduct and professional rectitude, according to the power vested in him under the clause 33(2)(e) of the Constitution as President’s Counsels.

        When such a large number were appointed, it reminded me of the appointment of J.PP.( All island)
        When Dudley was offered a Knighthood he turned it down.
        When told only Winston Churchill and Mahatma GHANDHI had refused. He said he woul prefer to be
        grouped with them.
        Surely an exPresident and ” Senior Lawyer’ at that Mahinda Rajapakse should have been appointed.

          Since the president selected and elected only males, who happen to have balls, just like what the Ulama wants to do with Qazi Judges, by analogy made the connection with ACJU.

      What can you expect from an uneducated president who employed stooges to pressure the then (current) CJ to resign and when that failed he promptly removed him with a mare chit and let the ex-CJ whom he himself had voted to remove at an impeachment as the Chief Justice.

    In those days Kings Counsel (KC)and Queens Counsel(QC) were a rare breed highly looked up to..It was extremely difficult to become one.They lived and worked in keeping with the high title.Dr Colvin R de Silva richly deservedit but never bothered to take Silk.Now we have Presidents Counsel (PCs) who are there cheaper by the dozen! Yes they are there in great numbers like the common PC (Police Constable) Even the hilarious Ali Sabry is one!So is Kusumsiri Balspatabendi.Is Mervyn Silva a PC too ?

      Ali Sabri is a big mottaya, he knows only to lie in court. Because he did Gota’s dirty linen, with so many unethical tricks, he was given made a PC, bringing down the reputation of the entire legal profession in Sri Lanka

      Old Legal Eagle, you are spot on. Just listen to Ali Sabri speaking in the court room, a 5th standard student can do a better job. He rings Judges and try to win cases. Big headed Ali Sabri should go; he is not worth to be a lawyer, he is good to be a donkey

    Author should reveal who the women who applied were so that we can decide if they were worthy of appointment. After all yahapalanaya cannot surely mean appointing women just cos they apply?

    Appointing President’s Counsel (PC) is always the case of “our crowd”. No yard-stick was ever used to grade people even in the yester-year but the intuition was never challenged as not good. The complaint now appears to be on gender based. Though MY3 is subject to many a criticism now we have to be fair by him. Are we trying to tell the world that the fair sex was ignored just because the number of them in proportion to the total is much less? Worst is are we trying to imply that Jarapassa times were better in that respect though it is stated that even in Jarapassa times male domination persisted.

    I cannot read the mind of Prez MY3. But it is desirable that principles of meritocracy applies in this respect and criteria be pre-published. If there is going to be a gender bias in favour of women as affirmative action then let the criteria for the bias too be pre-published so that everything is transparent.

    May be president Sirisena thinks, like his wife, all women begin their life collecting the remnants from the village saw mill to be used in their kitchens and as such, women’s duty is to look after the children and the kitchen.

      I guess, kids and housework are the women’s primary domain and the priority where a mother can’t be replaced. Working / career women shoulder additional responsibility of the work place where they get replaced often.

      A wife, being a housewife is a luxury today with the high cost of living. Unfortunately less respected as many think they don’t contribute to pay the bills despite them working harder and more, carrying more responsibilities than an average working-woman

    The last time Silk was conferred was during 1965-1970 period.They were Queens Counsel[QC.]AND JUST A HANDFUL WHO WERE ABLE ADVOCATES.After 1972,when we no longer had the Queen of the UNITED kINGDOM as nominal Head of state Silk was not in vogue.Came JR and his Executive Presidency there was no hard and fast rules to confer silk as Presidents Counsel.One such example was Gamini Dissanayake!
    Came 1994 and with it CBK as Executive President. M.H.M.Ashraff who had only a Magisterial court practice at Kalmunai and Akkaraipattu before he became a Minister was made PC by CBK!
    Thus the stringent requirements to take Silk for QCC no longer applied to take silk as PC. Any mothers son who is an Attorney=At-Law with political clout of-course can become a PC.
    There are so many of them around,if a stone is thrown at random the chances that it will hit a PC is 100%
    Apparently,M.A.Sumanthiran as per this write-up had not applied,but conferred SILK;wILL HE THEREFORE REJECT IT? I doubt it;Make hay while the sun shines!

    So what is the big difference from the previous appointments made by the previous regimes and juntas from 1948. All are same, All political leaders know “Power without judiciary is empty”. No wonder why some countries demands foriegn judges to hear various abuses in Sri Lanka. Corrupt and illiterate politicians enables laws, rules and regulations and they appoint their own judges and promote the lawyers. It is a pathetic system.

    President Sirisena is a village fold ignorant of what he does on instructions
    from his henchmen.

    Without an aorta of idea about legal traditions he appointed a person as a High Court Judge and this person is sitting as a judge violating the constitution.

    Why did he go to Russia to sign a gazatte notification on Wilpattue.

    he sacked an honest DG in the bribery commission and by malking idiotic public statement he unconsciously influenced the court system inquiring into serious crimes committed by the powerful royal family and the politicians in the former govt.

    Learned people with integrity, eminence and righteousness never ask anything on their favor, unless offered a place by an appointing authority itself, that shall decide after examine the character, integrity, credibility and loyalty of the persons concerned that the authority may consider fit to appoint to such high offices.

    But in Sri Lanka the President Counsels are appointed further to a request made in that regard. This is absolutely unacceptable.

    Seeking favors or canvassing for such appointments itself shall be good enough for disqualification.

      We all have been in barking at the wrong tree. You have to understand that “corruption breeds corruption”. Corrupt and illiterate politicians have taken over the affairs of our nation since the demise of D.S.Senanayake. Your campaign will never succeed as you have been going to the corrupt agencies and tainted court system to remedy the injustices done to the citizens of Sri Lanka. The people have become numbed to the systematic pain inflicted on them by odious politicians since 1948. MY3 is not an exception. Corrupt and vile politicians who took over the power to govern the nation have been ransacking and robbing the nation, systematically desensitising our children for nearly 65 years through malnutrition, substandard education, immoral acts (including ethnic violence/class struggles) and Alcohol/drugs.

      These vile political leaders have told our children CORRUPTION is GREAT as long as it feeds them. So my dear friend, time has come to understand the real problem and think about real democratic solutions. Barking at the wrong trees will not get us anywhere. Moreover, seeking justice from a system that is filled with LEGAL ABUSERS (Products of Corruption) is a futile exercise.

    When lawyers are made PCs, their fees go up.
    Nothing else happens.
    They are the only breed who are ‘anointed’ with artificial increase of ‘brains’.
    In most other disciplines, extra qualifications, & publication of original contributions to the sum total of human knowledge is necessary to ascend to the next level of expertise.

    I have read of two famous lawyers who were invited by the full bench of the Supreme Court to take Silk and sit in the inner Bar.
    1]Herbert Victor Perera[THE legendary HV.Perera!]
    2]G.G.Ponnambalam.
    This was prior to independence.
    Both have appeared in cases challenging the Govt: of the day.This did not stand in their way of taking Silk.
    We have now degenerated into a servile form of Governance.If one does not play ball no silk!And that too you have to be a Good chap according to a one time GSN!
    You are better off by not being a PC!

    Absolute disgrace. The country with the first elected Head of State in the 60’s has NOT A SINGLE lawyer thought worthy of this appointment.

    Sirisena’s lack of intellectual curiosity is becoming apparent, and increasingly disappointing. Constrast this phenomenon with the increasingly arrogant PM, who thinks everyone in Sri Lanka as still running around in Amudey’s EXCEPT for his coterie of ROYALISTS.

    When will Mother Lanka be rescued?
