President Gotabaya Rajapaksa Must Demonstrate Respect For Human Rights & Address Impunity: ICJ

Sri Lanka’s newly elected president, Gotabaya Rajapaksa and his government must demonstrate that they will uphold human rights and rule of law, and ensure that Sri Lanka sustains its international obligations and commitments to justice and accountability, said the International Commission of Jurists (ICJ) today.

Gotabaya Rajapaksa faces credible allegations of involvement in war crimes and crimes against humanity that took place during the country’s armed conflict.

“The election of Gotabaya Rajapaksa, after a highly polarizing campaign, has alarmed human rights defenders in Sri Lanka and abroad, who have little reason to believe that someone facing such serious allegations of perpetrating human rights violations can be relied upon to meet the country’s obligations under international law,” said Frederick Rawski, ICJ Asia Pacific Director.

Gotabaya Rajapaksa, who won the presidency with 52.25% of votes, served as Sri Lanka’s Secretary of the Ministry of Defence from 2005 to 2015 during the tenure of his brother Mahinda Rajapaksa, at the height of the armed conflict against the Liberation Tigers of Tamil Eelam (LTTE).

Both the military and LTTE perpetrated war crimes and gross human rights violations during the conflict, and particularly during its bloody final stages. As Defence Secretary, Gotabaya was accused of ordering the killing of surrendering LTTE fighters, ordering strikes on civilians and hospitals, and authorizing attacks on human rights defenders.

International condemnation of atrocities committed during the conflict led to the UN Human Rights Council demanding that the Sri Lankan government commit to a process of transitional justice, in view of the systematic failures of accountability mechanisms in Sri Lanka in the past, as documented by the ICJ in its submission to the Human Rights Council, and others. Despite commitments from the Sri Lankan government, the transitional justice process has effectively stalled and impunity has prevailed.

“The ICJ is deeply concerned that even the limited strides made over the past five years in Sri Lanka on transitional justice, positive constitutional amendments and institutional reform will be reversed,” said Rawski.

The ICJ urged the Government to deliver on its commitment to the transitional justice process, including by holding those responsible for human rights violations and abuses accountable, and complying with the obligations set out in United Nations Human Rights Council Resolutions 30/1, 34/1 and 40/1.         I have now become somewhat cynical. I hate HUMAN BEINGs to some extent since I cant make my mind up to see that LOOTERs and MURDERers are back to power by an election.
        I think even if our high literacy rates, people are no different to that low-literacy countries such Pakistan.
        In Pakistan, there had been leaders who looted the state several times consecutive manner, but got elected by the people every other 5 years or so: But this went on until Mr Imran Khan came into power. It took him that long in that fight, but once he is in place today, things seem to be transparent and less corrupt. He has set his own examples not being corrupted.
        The very same, should be the case with lankens dominated by uneducated masses in this country.
        The manner, Mahinda Rajapakshe got back to power is beyond my bearing. Not just looting, but hoodwinking or various nature is seen yet in his person. He does not care about the destitute who earns not even 2 dollars a day but his big tamashas and abusive nature of wastages ranging to all ends and edges.

        Babalathappu, first list what are the rights that Tamils or Muslims do not have but the Sinhalese do. That is impossible isn’t it? Is it a human right violation to have a separate personal law for the Muslims allowing them to marry children, keep four wives and take away even a basic right as initiating a divorce or signing a marriage certificate from women? Of course they are violations of the rights of Muslim children and women? Is it a human right violation for only Vellalas to own land in the Jaffna peninsula and keep the low cast Tamils landless subsistence farmers, yes of course it is a human right violation against the Tamil so called lower cast people. So yes let us remove all those rights violation in a new constitution, and if you can come p with single right that the minorities lack but majority have let me know.

          These are just few statements, but you and I know it very well that they dont marry 5 times. After leaving home country for Europe only I got to know all these.
          Today even our sinhalaya get married 5 or more calling that they dont even need to marry but could have lot s spare wheels.

If I am very honest, i would kill that Madhumadawa or Gonathadipila to haveworked on those riots by which another few hundreds of innocient srilankans (though muslims, tamils or others by their origin) got hurt. We are all made out of bones and flesh so as the westerners that let enjoy all as equal. I know there are miniorities living in Germany, France, Uk, Switzerland or any other countries, but they dont get treated the way our minorities do yet today. We should all be ashamed, even after 30 long year war, which brought us that backward, our people are still as that racial and extremists.
          They are all suffering from delusion of grandeur for some reasons. I really dont know why we the sinhalaya should always be kept above while other minorities let not chance to enjoy equal rights as srilankens.
          I have no doubt, if people were intelligent, Gota or the like men would have become the leaders to represent us.
          The election held few days ago was and selection between two groups. That are.. civlized dignified people and uncivilized racial extremists idiots.

      Ruwanveli Seya is a great symbol of victory built in the 2nd century BC. President-elect Gotabaya Rajapaksa chose this venue to tell the world in no uncertain terms that, though Sri Lanka is a small nation, it doesn’t tolerate foreign invasions that may come in the form of interventions or/and interference.
      King Dutugamunu defeated the invader king Elara from South India and built this religious symbol to serve two purposes.
      First is to venerate the Buddha and place his relics in the Stupa.
      Second is to tell invaders and coup planners that, no matter what and how long it takes, such invasions and coups will be defeated.
      There is a new political culture emerging in South Asia. Let’s be part of it by working for it.

          We need both because both practicing and venerating of symbols act reciprocally for Buddhists to achieve the ultimate target.
          It is like the national flag; the flag depicts a symbol (or a set of symbols) but what is indicated by those symbols is interpreted somewhere else like in the constitution, traditions, beliefs, etc.

    I believe that the accusations of HR violation against GoRa, if no made with care, can work for his advantage now on. That is b’cos a vast majority of voters S/B voters has rejected the charges outright. Therefore, the inevitable renewed pressure coming most likely from Tamil diaspora & a minority of liberals at home can easily be explained as a product of Tamil divisionism and unpatriotic NGO s. This will be a political bonanza for GoRa supporters (media) exploit the race card in order to keep the political base of SLPP on toes – a tactic Trum is using to keep his republican base attached to him despite his unethical behaviors.

    From now on, GoRa’s HR record has to be watched not mainly on his past record, but on how he would let justice system proceed on charges currently in court and under investigation. It is very likely that He will try to stay away from White Van Culture as much as possible. The period of rehabilitation effort will last one full year to 18 months but once the financial reality sets in barring his election promises, the unhappy voters will put his patience to serious tests. Only then will the voters can be convinced of the true colors of “bipolar Syndrome”.

    Can the American government, for a start, please release to the people of Sri Lanka a document showing that Gota had ceased to be an American Citizen at the time nominations were accepted – 7th October, 2019, wasn’t it?

    The International Observers are leaving tomorrow, aren’t they? You will be right to report a peaceful poll (although there are reports of Sinhala-Muslim violence in Hambantota, with one Sinhalese man killed – if so, the backlash will claim at least ten Muslim lives).

    What the Foreign Election Monitors must do is not report on how quiet everything was, but they must meet all Three Elections Commissioners (Deshapriya, Abeysekera, Hoole) and see whether all three were happy with the Gota citizenship thing.

            I try my best to let that go through my head, but I still feel that Gota and MR will face it sooner than later. With all various allegations on various high crimes them to allow lead this nation is no means acceptable to me. Whoever whatever being said and done, i do belive their crimes for which allegations are levelled at them, are not untruths. Now people tend to believe otherway around going by the mandate gotten by gotler. But it was the media mafia brought them back as leaders. In coming days, the abusive family rule will ruin us. I am ashemed to call me SRILANKEN today. Good that i dont live in that shit hole.

          If everything is now going to be by so-called ‘mandates” then what’s the use of law & constitutions?

    GR has stated not to question the past & told the international community in no uncertain terms that SL’s independence & sovereignty is to be respected. Maybe the CIA can blackmail GR to be its puppet (after all he has pledged allegiance to US when he became a citizen of that country) but as long as we have the Chinese loan shark as our friend, we can show 2 fingers to the rest of the world, including the ICJ (one can ask the question, ‘who is ICJ?’)

    If we are up to our nose in Chinese debt, we can be a Chinese colony like Hong Kong & Tibet with a Beijing elected President for life.

Now the time has passed and let’s respect the decision made by democratic Sri Lanka to go forward. Those learned jurists, instead of making statements here and there, can come to SL and discuss the allegations and related matters with President Gotabaya Rajapaksa.
    Just because Sri Lanka is a small country please don’t try to play games. That could back-fire and the shots can be devastating!

    Mr Frederick seems to have panicked to issue this Yellow Card even before the Game has started..

    I don’t think Mr Fredericks and his ICJ Team have to sweat over wondering whether the new Prez in Lankawe will interfere with their Good Work..

    Even the UNP Senior and Dr Ranil’s Best Minister Dr Rajitha and ex Governor of the East Hesbolla also were seen rushing to meet and greet Nandsena yesterday,,

    I am sure one of them will remind this new ultimatum from the ICJ too, at some stage to include in Nandesna;s Priority List..
    Because they were closely involved in the previous Administration which never got any warnings let alone Yellow Cards from those International Bodies….

    Before all what ICJ should know is whether LTTE was a terrorist organization or not.

    They should know the amount of life & property destroyed by those terrorists.

    They should know the number of suicide attacks carried out by those terrorists to kill & maim innocent civilians.

    Unless they know those things it’s inevitable that ICJ will be named/labelled as a terrorist organization like LTTE, ISIS, Taliban etc. etc. in the near future.

    ICJ, keep your mouth shut, Sri Lankans aren’t afraid of you; let Sri Lankans solve their own problems.

    One of our problems must surely be that we expect that “somehow everything will come right”.
    .
    Another way of putting it: “there is fate, and the evil guys will someday be punished, and we good fellows will be rewarded”. Others look to “Eternal Life in Heaven”. Yet others point out to us that so many things are bad in other places on this globe. You tell them that life on this planet will soon end because of human activity, and they say that what we do as individuals is of little consequence.

    None of that is rational.
    .
    In the midst of all this, we don’t do what we have to do at the most opportune time. We’ve had elections, and to me, it seems that we have elected an American Citizen as President. Nobody is really, really, bothered.

    There is so little objective newspaper reporting that we don’t know whom to believe. Newspapers depend on advertisements, have political masters. The British newspaper, The Guardian, claims to be different. Advertisers cannot dictate to them, because they don’t carry advertisements – but they ask for donations. All that is ya da da, and it doesn’t really matter. However, it may be that it does matter that our people voted despite all the warnings.

    The consensus is that Gota never succeeded in renouncing his American citizenship. And yet we freely elected him. It was the elections Commission’s business to check on all this. Mahinda Deshapriya did all the talking, and he finally said that they didn’t check on Gota’s citizenship status. Well, did we listen to either Nalin Abyesekera or Jeevan Hoole? To listen, they must talk. True, Abeysekera said almost nothing. But Hoole talked plenty. Did we listen?

    I hope the new President will put a stop to the menace of ragging in universities and protest marches which take place every other week. No one else seems to have had the guts to address this disgraceful problem all these years.
