President Sirisena Justifies Pardoning His Distant Relative From Death Row

MP Athuraliye Rathana was at the forefront of the efforts to obtain a presidential pardon for Jude Shramantha Anthony Jayamaha who murdered the sister of his girlfriend Yvonne Johnson at the Royal Park Apartments in Rajagiriya in 2005, a statement from the President’s Office said yesterday.

Athuraliye Rathana has pledged support to SLPP candidate Gotabaya Rajapaksa for the presidential election.

The controversial monk has recently been at the centre of several major controversies, including the false conspiracy to frame Dr Shafi in Kurunegala and the fast unto death to force the Government to sack Muslim MPs after the Easter Sunday attacks.

In an astounding act of callous abuse of his office, President Maithripala Sirisena granted a Presidential pardon to Jude Shramantha Anthony Jayamaha breaching all procedures stipulated in the Constitution.

In his media statement President Sirisena claimed that Rathana had intervened in the matter and arranged a meeting between the President and the convict’s family. The statement said that several requests had also been made by a Catholic bishop, lawyers and retired Supreme Court judge Rohini Marasinghe. The pardon had also been granted on the basis that Jayamaha had been rehabilitated in prison, his young age when he committed the crime and the fact that he had pursued a higher education while being incarcerated, the statement said.

However, Colombo Telegraph learns that Jayamaha – now 32 years old – has also been charged with having a cellphone in his possession while being on death row. President Sirisena has pardoned him for that offence too.

When he was 19, Jayamaha infamously murdered the sister of his girlfriend Yvonne Johnson at the Royal Park luxury apartment complex in 2005, chasing her and physically brutalizing her to death whilst banging her head causing it to fracture in to 64 pieces. Jude Shramantha Anthony Jayamaha is the son of reputed businessman Preethi Jayamaha, the owner of Coronation Bar & Restaurant in Negombo, also owning several highly sought after high end catering services in Colombo.

Kanthi Jayamaha who is the second wife of Preethi Jayamaha is the step mother of Jude Shramantha Anthony Jayamaha. Kanthi Jayamaha is related to Dudley Sirisena, the brother of President Sirisena through her niece.

In an emotional open letter written to the President, Caroline Johnson, the sister of the victim wrote: “I cannot begin to understand how a father of two daughters reached the decision to release this monster?” “She fought for her life, even running from her attacker with broken ankles. I know you didn’t follow due process for this murderer’s release, but did you even take the time to look into this case at all?” “Your silence on the matter since your speech makes me fear we may never know the truth behind your decision, but you will now be attached to this case forever and for all of the wrong reasons”.

The Presidential Media Unit today released an explanatory media release defending the president’s decision. The proviso to Article 34 of the Constitution stipulates that “Provided that where any offender shall have been condemned to suffer death by the sentence of any court, the President shall cause a report to be made to him by the Judge who tried the case and shall forward such report to the Attorney-General with instructions that after the Attorney-General has advised thereon, the report shall be sent together with the Attorney-General’s advice to the Minister in charge of the subject of Justice, who shall forward the report with his recommendation to the President.”

Several constitutional experts opined that President Sirisena had not followed the procedure when granting presidential pardon to Jayamaha.

Posting on Facebook, Saliya Peiris PC said that the release from the President’s Office made it clear that there had been no consultation with the family of the victim at all who too was a young girl when she was murdered. He added that the manner of the killing had not been taken into account when the pardon was granted.

“The Court of Appeal rejected the contention of a sudden provocation. That defence was not taken up in court. Also the court held the killing was done in a cruel and unusual manner. The Accused went through the entire trial and did not seek to enter a plea,” the post on Peiris PC’s Facebook said.

He added that this was not a case taken up along with the cases of all other prisoners young and old serving life sentences. There are other accused too of a young age on death row and serving life sentences. “Some of the elderly prisoners are gravely ill or disabled and yet have to serve their sentences. Other convicts were not given opportunities for their families to meet the powers that be and seek pardons for their families. If they did they too would have been able to present their stories. They too may be able to get recommendations from the prelates in their temples, churches, mosques and kovil,” he explained.

Peiris said that it did not seem that that the recommendations of the Attorney General or the Minister of Justice was obtained.

Furthermore the senior lawyer noted that it appeared that Jayamaha had been given a “free pardon” rather than a “remission”

“If so that means that the conviction has now no consequences at all,” the post added.

Ironically, Jayamaha was prosecuted for the murder of Yvonne Johnson by then Deputy Solicitor General Jayantha Jayasuriya, who currently serves as the Chief Justice of Sri Lanka. The case was landmark in that when it came up for appeal, the convict was sentenced to a graver punishment – that of death – due to the violent nature of the crime.

Women’s groups have expressed outrage about the pardon for Jayamaha.

NPP Presidential Candidate Anura Kumara Dissanayake issued a statement condemning the pardon yesterday.

“We strongly condemn President Maithripala Sirisena for granting a pardon to #RoyalPark murderer arbitrarily. It is a blow to the independence of the Judiciary of #SriLanka and a humiliation to the entire country. This bad precedent should never have happened. The JVP has urged the legal fraternity and the Attorney General to step in to rollback the arbitrary presidential decision to pardon Jayamaha.

Social media users were outraged by the pardon for Jayamaha.

“Her name was Yvonne Jonsson, @MaithripalaS. She was half Sri Lankan. My name is Natsumi Suzuki. I am half Sri Lankan. I could’ve been Yvonne. I condemn you. I condemn your presidency – I will never pardon YOU for this absolutely heartless decision.”

    why are they having this clause in the constitution that the president can pardon criminals.Was he elected by the people for the people for that purpose.This clause should be removed forthwith as it has ben misused by JRJ and now sirisena.We did not elect presidents to be gods,only to run the country.Even that they don’t seem to be able to do properly,so why these other powers too.

    Part I. of the comment. Don’t forget that President DB Wijetunge granted a pardon to a guy long before even a trial took place. How many convicts of this kind have been pardoned before? When President JRJ, particularly at the behest of RW the current PM, pardoned Gonawala Sunil, a brutal rapist, made him a Justice of the Peace and then became a collector of cash for sons of fellows to be admitted top schools where was the noise of the so called respected? Where was the noise of the so called women’s groups. NONE. NONE. NONE. The permanent secretary of the ministry of justice at that time was simply done away with for “not recommending” the pardon. Don’t forget that the only respected head of state we had was Late Mr. William Gopallawa. The politicization of the Presidency is the root cause for all these illnesses and for the not so deserving to adorn that high office. I get the impression that had this pardon been granted by President JRJ all the wagging tongues now would be paralyzed and even welcome the convict to wining and dining parties. In fairness to MY3 it must be said that he intimated to the media days before he actually pardoned of his intention to do so. At that time not a murmur. Why after the event? My information is that the relatives of the convict have been throwing money by the millions to all sorts of fellows to get relief for this guy. I am informed that this noise is a part of the cry “hey! You did not give my million for me to be silent”. If so it is a SHAME.

    Part 2 of the comment. I would like to comment on a parallel case where a politician’s wife was convicted for the murder of his paramour. The death sentence was commuted t life imprisonment in no time. After two years in prison the convict was released on an amnesty citing the women’s day along with some others. The President who did this was Percy Mahendra Rajapakse. NOT A MURMUR. Even the Indatissa’s were mum silent at that time. It is JRJ who introduced the special requirement in the constitution for the pardoning of murder convicts and it is HE who asserted that it is not applicable in commuting the death sentence to life if it is in the form of an amnesty. The politicians wife and as well as the Royal Park murder convict was pardoned in two stages. In the first stage the death sentence was commuted to life imprisonment What legal tools that MR did to effect the first stage is not known. If it is a simple pardon it requires a report of the trial judge submitted through the Attorney General and administratively through the minister. In case of the Royal Park murder convict a committee appointed to look into recommended the commuting the death sentence to life imprisonment with many others. BOTH THE CONVICTS PASSED THE FIRST STAGE WITHOUT A MURMUR. No Indatissa’s legal jargon at that time. Second stage of releasing from the prison in the case of the politicians wife took within two years after the first stage whereas in the Royal Park case it took more time than that. It is for the release of the second stage, particularly in the Royal Park case that lawyers now mix up things with the requirements of the first stage.

    Part 3 of the comment. The purpose of my previous parts was to highlight the selective treatment meted out on the Royal Park murder convict presumably for a corrupt purpose. At no stage do I condone the brutal act of the convict. His parents too must take the fair share of the blame for bringing up the children in a wayward manner. The pain of the loss a young girl is only known to the near and dear. No amount of punishments meted out on a convict of murder will bring back the life of the victim. The processes in the country must be straightforward and honest. It is interesting to note that in Singapore from its date of independence in 1965 there were only a single digit number of pardons granted for murder convicts, all others were hung by the neck until they were dead. That is a society with the least amount of detected corruption. HERE! If the death sentence were to be implemented fellows would be minting money. You get hanged because you could no longer pay the gratifications demanded from time to time. The bribery sleuths will have to man a permanent watch on famous rendezvous such as hotel car parks. All these incidents, inconsistencies only reveal the poor state of governance in the system.

    To “WHOM” and for “WHAT” purpose , this present “President’s attention is drawn to “Section 34 of the Constitution”? For once in the entire history of the “Office” of this Presidency, the Supreme Court of Sri Lanka, “UNANIMOUSLY” declared , that the present incumbent, Maithipala Sirisena VIOLATED the Constitution. What more we can expect from such a person. This is more than enough of any other reason to “ABOLISH” this “Office” from our Constitution and RESTRUCTURE the ” Hierarchical Power” structure of Governance , with requisite “Check and Balance” systems. No doubt, this present incumbent has brought the whole of this “Office” to a “MOCKERY”; but the only consolation is his days are “Numbered”. Yet, it is imperative that this “Mockery” shouldn’t be allowed to continue; because there are “Amber Lights” flickering indicative of the emergence of “RED LIGHTS”- (in colloquial terms “Coming colors are not good”.) Both the highly “PROPPED UP” candidates of SLPP and DNF are “SILENT” on the future of this “Hierarchical” position; because both of them have their own “Personal Agenda”. Even one of them has already declared how he is going to “RELEASE” the “Accused” and set FREE them of all such charges. Now his “COHORTS” are making statements in a mode of “Damage Control”. This and “THEY” must be STOPPED.

    I honestly believe everyone should have a 2nd chance in life and what barbaric act this boy did under the influence or alcohol or drugs or both is gruesome.

    Also do not forget that it was a complicated relationship this guy had with 2 sisters as it was the deceased he was dating before and once she left SL to higher studies, he settled with her younger sister who was 17 yrs that time.

    It came to light that he was leaving the house of the sisters when he met the deceased on the lobby and they had a heater argument etc…

    The problem here is why the President Sira did handpicked a single person to this pardon? there will be hundreds of fellow inmates in with similar of more relevant reasons for a pardon and this is only rich and influential is getting over the rule of law?

    Where is the so called BASL and its pohottu president Kainga Indatissa who did employ the fake lawyer with bogus qualifications as a junior in his law firm? These guys do shout for things like free ambulances of MCC pact and then completely mum on things that related to the rule of law.

    Then again what is this Athana Methana Rathana a so called Buddha Puthra had to do in here? is he the middleman and the pimp?

    When last years MaRa’s consitutional coup it was the Malcom Ranjith who was with Sirisena and gave his blessings for the unconstitutional coup & now its Rathana the shameful political animal who jumps one party to other and spread communal hate among masses.

    This country do not have a future with Malcom Ranjiths or Athana Methana Rathanas as religious leaders.

    This is not the first time Sirisena has violated the constitution. Civil society organizations should take him to courts after the elections. Intentionally violating the constitution, not once but many times deserves the death penalty.

    A very large “GIFT” before the end of his presidency must have fallen on his lap as well those who favored it. The president is not above the law and the investigating arm must take action on his gains and for abuses of power while in office.

    President or Prime Minister is not the owners of Sri Lanka and is not above the law but political corruption combined with racism has made them an exclusive class beyond the reach of the common law.

      There are hundreds of thousands of poor people/criminals/convicts languishing in prisons throughout the island. Why has he not use his constitutional right to look into each cases? Why it didn’t occur to saffron clad members of Sinhala/Buddhist anti people activists namely MP Athuraliye Rathana and Dr Keradewala Punnarathana Nayake to campaign for the release of poor kids from prisons?

      Its been proven time and again compassion has different meaning and value among the saffron clad thugs, racists, their followers, …. in Sinhala/Buddhist fascism.

        I doubt with the present prejudice and completely indoctrinated with nothing but hate and suspicion, No matter who rules things will never be the same.
        Sri lankans have lost the natural humour in them , they do no longer know how to laugh at little things .
        You say words of appreciation and if you are a Muslim they are suspicious , you want to sincerely help and if you are a Muslim then the devil is at work and if you say something innocently humour you are insulting. So Head or tales Muslim lose , that is reality .
        If the people are not willing to be able to think with logic and instead hold onto myths, lies and superstition. We will not get anywhere with any leader.

        Just read the hate comments of Sri lankans living in the west ,not in West. Even if such men are placed among angels in heaven they will sure pollute those holy ones too.

    This president is always unpredictable, notorious for doing the wrong thing when you don’t expect it. You can’t expect anything better from an unconscionable person like him. You feel outraged and sad, but dismayed that you can’t do anything about it. The entire SriLankan community must hang their head in shame.
    My heart goes out to the grieving family of Yvonne. I am profoundly saddened. I do not know what to say to console them.

    Which Presidential candidate is going to come out and say he will right this terrible wrong if elected? Nobody.

      AKD has condemned it. Whether he will reverse it is difficult to tell.

      To find out the answer to that, why not we all give him First Preference?

      But please don’t spoil your vote doing it. Remember, no “kathires” if you insert One, 2, and 3.

      Yes, don’t vote only for him, since his chances of coming even second are slim. But don’t be too sure even about even some of the other candidates – e.g. Dr Ajantha Perera, Mahesh Senanayake, and even Sirisena’s own nephew, Rohan Pallewatte.

      We have yet to hear from them.

      Incidentally, most of us who are shocked at this pardon, probably don’t approve of the Death Penalty. Complex issues.
