Presidential Amnesty Rules The Day

We are now at the peak of the Sinhala-Buddhist mood in politics and society.

President Maithripala Sirisena has proven he could rise to the altitude of greatness in this sweeping search for ethno-religious dominance.

He gained blessings from the Hindu deity at Thirupathi leading to a post-Sinhala New Year holiday in Singapore, when the blasts by Islamic terrorists brought the carnage of Easter Sunday.

He was doing important negotiations in China, including proposals for Chinese forces to guard the Colombo Port City, Hambantota Port and the Shangri-la Hotel in Colombo, when the religio-ethnic violence broke out in many districts.

The greatness in abiding by the Sinhala-Buddhist culture was seen in his pardoning of the leader of the Bodu Bala SenaGalagoda Atte Gnanasara Thera, who was sentenced by the Court of Appeal, and confirmed by the Supreme Court for Contempt of Court, to 19 years in prison, to be served in six years.

President Sirisena is in great presidential heights in this performance of generosity. He has followed the record of President JR Jayewardene and President Mahinda Rajapaksa in this groovy pardon performance.

Some pardoning recollections are helpful. This brings us to Gonawela Sunil who was Kelaniya-based and was about the most powerful thug of his time and enjoyed UNP patronage at the highest level. He was sentenced to 10 years imprisonment for rape. He was then in Ranil Wickremesinghe’s political arena, was also known for involvement in prison killings, and many other situations of violence.

He was serving prison sentence when Sri Lanka celebrated the Golden Jubilee of Universal Franchise – on 7th July 1981. This great event brought his pardon and release from prison by President Jayewardene. There was one little legal escape for President JRJ. The conditions for amnesty was for persons convicted for the first time, with less than 10 more years to serve, and for offences NOT including murder, treason, unlawful assembly, bank robbery, highway robbery, default of income tax payment, bribery etc., with the singular exception of RAPE. It seemed a law perfectly planned to serve Gonawala Sunil.

The amnesty exercise was quickly named ’Sunil Samava’ or Sunil Amnesty. It did not take long for this master of criminal performance in various fields, including political and prison violence, to be made an All-Island Justice of Peace!

If President Sirisena is glad to have followed this amnesty tradition of JRJ, no doubt on the special request of Ranil W of Kelaniya and UNP politics of that day, he has another example of amnesty too. That is the Mahinda Rajapaksa performance.

The wife of then Minister Milroy Fernando, Mary Juliet Monica Fernando, was convicted for a double murder. President Rajapaksa initiatives saw her life sentence commuted, and the next year she was freed on a Presidential Pardon to mark International Women’s Day. This prisoner escaped the lengthy legal process involved in obtaining the recommendation for a presidential pardon, by her sentence being commuted on the earlier presidential decision. It was a DOUBLE MURDER amnesty. What a wonderful record to follow!

Aren’t we a truly great society, and how great President Sirisena must feel in having two such amnesty precedents before him!

The latest amnesty to Galagoda Aththe Gnanasara Thera is for the offence of Contempt of Court. What the rising politics of the Sinhala Buddhist phase in our modern society should consider is changing the laws of this land, to prevent the very concept of Contempt of Court. Why can’t the courts be disturbed, judges insulted, witnesses threatened in the Court premises. This is surely not in keeping with our traditions of Sinhala Buddhist culture, as we know it today.

It is this non-Sinhala Buddhist culture that led the Court of Appeal to pass any such sentence on this yellow robed member of the Buddha Saasana.

Amidst the continuing social crumbling in the post-Easter Carnage, it is necessary to look at how we can evade the whole process of Contempt of Court, and even worse, how a fiercely active member of the Yellow Robed body of Buddhist teachers could ever be accused of such an offence.

One way is to do away with the entire Court System. Let’s not forget that it all came from colonial power and imperialism. Why do we need to know or follow Roman Dutch Law – with its western and later Christian roots? Why do we need a democratic process – when we could do very well with our own monarchic rule and feudal traditions? If we don’t need Sharia Law, why do we need Roman-Dutch Law? We may have to think of ways to find our next king, but could it be any worse than finding our next President? Who will replace Sirisena?

With the Sirisena Amnesty granted to Galagoda Atte Gnanasara Thera, it is necessary to forget the Dharga Town and Aluthgama tragedies of 2014, for which no organizers were charged, and innocence prevailed. Let’s wipe out such events from our history. Let us live in a new Age of Amnesty, where Contempt of Court is ridiculed and made a travesty of imported, colonial and non-Sinhala Buddhist Law.

Amnesty is the power of the President. Let us all say, Hail, Amnesty, and Contempt to Contempt of Court!

    Pardoning of gnanasara who was jailed for ‘contempt of court’ is itself a contempt of court made worse by the pardoner having audience with the pardoned. The (sometimes annoying) tv series ‘Sidhu’ brought out clearly the detachment there should be between a mother and bikkhu son. Apparently gnanasara has not done away with the cling on his mother’s saree.

    Sirisena has forgotten the other Buddhist monks in jail. They too should be released to repeat what they did to be in jail. Go from village to village and spread crime.

      Sirisena knows that he will never come into power, His aim is to put the country into a mess
      for his successor and to get credit in the future. By releasing these extremist monks they will only create more Zaharans. These bloody politicians have no patriotism to their country, they are concerned only in filling their pockets.

    One thing everyone can be sure of with regard to the Easter bombing .

    If suddenly a terororist attack , racial riot , uprisings and union strike continue and especially a teroror attack in a country that has won a terrorist war and enjoyed peace for 10 years .
    The only reason was some group with outside help want a Regime change badly and desperately and has nothing do with being concerned about the citizens welfare.
    Next year if the Present regime is changed people will know the reasons behind blocking intelligence and making way for the attack .
    100% sure the goats of this government is still.clueless who was behind it and is still.behind it.
    They will.wakeup when they destroy their foundation they are standing on by betraying eachother including some of their ex political marriage partners of UPFA.

    Change of government will make way for a complete iron fist autocracy governance with a constitutional amendment that will allow the new government and its leader to be in power forever and this also may ultimately oneday lead to a Military takeover once the people become desperate and external agitation is discretely fed in .

    Truthfully, I have difficulty in comprehending what Eagle Eye is trying to say with all this about ‘Asath Salley said….and Gnanasara told…..and so on. What worries me is, now that the President in his ‘wisdom’ has seen fit to give him a pardon – and that let us note was preceded by a visit to him in Welikade and an invitation to the Presidential residence after the pardon – it may not be long before we see what many have said of Gnanasara may also come true! I fail to understand Eagle Eye’s contention that the reverend gentleman only attacked the ‘Wahabi extremists’ and “did not say anything against peace loving Muslims”. I cannot remember he was ever that selective with what he had to say..

    Fred, this information is not verified, Looks like “Ape Man” did not loose any time. He is back in business. Had press meat and declared “Muslim dress code and Madrasa to be banned, and requested politicians to step aside and leave the matter to him and other Buddhist monks”.

    This act by Sirisena was an excellent response to an ‘over the top’ punishment for alleged contempt of court that illegitimate son of a P magistrate gave this national hero.

    Six years RI for cofc is unheard of in any western country. This MF, clearly a yahapalana stooge took the lw in to his dirty hands in giving such a long sentence for such a trivial alleged offence.

    The result was a loss of life of 350 children, women and men who went to pray.

    Never mind what a few may say ,
    My personal belief is no matter what short comings Sri Lanka Muslims may have , every community have their black sheep , but my strongest faith in the community is that 99.
    9% will not whitewash any real terororist especially members of the KIL nor will ever let it grow ,God willing I believe KIL ( “ISIL”) will fail.miserably in.Sri Lanka, Muslims of this Country will destroy them.

    Please encourage and support the community , I plead not to create an hostile environment towards the community which is what the Terrorist want desperately.

    Please dont let a small group spread false rumours and demonize the community.

    If Muslim restaurants are adding poison substance you can.always get it tested by the health ministry .

    Sri Lankans are an educated people , believing in such myth and sharing it on SOCIAL Media will only humiliate the entire nation .

    I plead to the Ministry of Heath to investigate and clear the suspicion asap before it takes a dangerous turn

    The photograph says it all. MS & Mrs MS chatting with Gnanasara Thero WITH Buddha watching, MS thinks, benevolently. But we have here is a Counter-sermon!
    Gnanasara and the Lankan Uniformed Services will make sure that there is no protests.
    PS: MS has let the cat out though. MS children and grand-children are not around!

    Let Ven. Thero take the leadership of regaining the glory of Sinhala nation. Ven. Thero was placed in prison to satisfy the whim and fancy of their western masters by UNP. Sametime, Eknaligoda lady is working as per NOG money. She is ruining the future of her sons. Let all get elected Mr. Gotabhaya in next presidential election to reverse these adversaries.

    16 years in jail for contempt of court ? Too harsh and doesn’t make sense to me. A fine would be enough. Also you forgot to mention how president pardoned a terrorist who had been sentenced for life for attempting to murder him. Isn’t it a problem to you ?
