PSC Rejects The Request Of The SC, Vote Was Taken, Chief Justice Refused To Go Without Lawyers

Yesterdays Court decision of the Supreme Court was considered today and the discussion was on whether they should wait pending the Supreme Court ruling. A lawyer who is closely following the proceedings told Colombo Telegraph “it appears that the 4 Opposition Members have done great work to hold the proceedings but failed due to the majority. Vote was taken and divided on party lines 7-4.”

 

CJ arrives in parliament

Chief Justice was asked to come to the Committee Room, where the proceedings are held, without the lawyers but she has refused to go in without her lawyers. Then the lawyers were permitted. Her lawyer President’s Counsel Romesh de Silva  recorded that CJ participates at PSC  reserving the right to challenge the jurisdiction of the PSC. After nearly three hours of closed-door talks, the PSC scheduled the next hearing for December 4. Six weeks time was sought to reply but time was granted only till 30th , only one week.

According to a informed source CJ was asked to take an oath but she has only taken a limited oath that if she gives evidence it will be true. Committee tries to get the Lawyers to give an undertaking that proceedings will not be discussed elsewhere but Romesh de Silva has only given an undertaking to abide by the Standing Orders.
Meanwhile issuing a press statement Asian Human Rights Commission says;  PSC should again reconsider the issue and after sober reflection on the most courteous request made by the Supreme Court should respond to the request with equal courtesy and respect. In doing so they will not to create an impression of impropriety and ugliness which will have a disturbing affect of the minds of the people.

SRI LANKA: PSC rejects the request of the Supreme Court and continues with the impeach proceedings

Yesterday the Supreme Court in a carefully worded order made a request of the Parliamentary Select Committee (PSC) inquiring into the impeachment not to proceed with their inquiry until the Supreme Court made a determination on the reference made to it by the Court of Appeal. The Supreme Court referred to the good relations that should exist between the two branches of the government and stated:

…..this Court whilst reiterating that there has to be mutual respect and understanding founded upon the rule of law between Parliament and the Judiciary for the smooth functioning of both the institutions, wishes to recommend to the members of the Select Committee of Parliament that it is prudent to defer the inquiry to be held against the Hon. the Chief Justice until this Court makes its determination on the question of law referred to by the Court of Appeal. The desirability and paramount importance of acceding to the suggestions made by this Court would be based on mutual respect and trust and as something essential for the safe guarding of the rule of law and the interest of all persons concerned and ensuring that justice is not only done but is manifestly and undoubtedly seen to be done.

The Constitution has entrusted the Supreme Court with the power to inquire into the constitutionality of laws and all actions of the government. That power of the Supreme Court is based on the paramount principle of the need to inquire into the legality of government actions. It is the duty of a government to act within the framework of law. It is the duty of the Supreme Court to inquire into and determine the legality of matters that are brought before it. The foundation of legitimate governance is the respect of each branch of the government to respect the functions of the other branches of the government. Where this mutual understanding and respect is lost what results is a state of chaos.

The law is the foundation of the state. Where the law is not respected by any branch of the government the resulting situation can be extremely disastrous to the whole of society and the very structure of the government could be shaken and shattered when that happens.

The issue is a very simple one of merely a few weeks delay until the Supreme Court has adequate time to make a determination on a matter of paramount importance to the nation. The PSC, if it wishes to expedite things could do so by cooperating with the Supreme Court expeditiously by filing its written submissions in reply to the papers filed by the applicants who resorted to the Court of Appeal for resolution of the dispute. There is nothing that the PSC could legitimately gain by proceeding while the Supreme Court is inquiring into the very legality of the Standing Orders under which the PSC is expected to function.

It is also an affront to law for the Chief Justice of the country to be not provided with adequate time for filing of the answers to the charges that have been made against her. Even a criminal that goes before court for a trial is entitled to adequate time for preparation of the defence. The Article 14 of the International Covenant on Civil and Political Rights provides this right for adequate time for preparation of a defence.

What is taking place before the PSC is a constitutional function of the highest importance. In all countries which are founded on the rule of law the impeachment of a judge is made under stringent conditions and this is a safeguard for the independence of the judiciary. When an inquiry of that nature takes place there is a legitimate expectation not only by the affected person but by the entire nation that the affair is conducted with appropriate dignity, decorum and seriousness. The impression of indecent hurry will create doubt on the very process.

Therefore the PSC should again reconsider the issue and after sober reflection on the most courteous request made by the Supreme Court should respond to the request with equal courtesy and respect. In doing so they will not to create an impression of impropriety and ugliness which will have a disturbing affect of the minds of the people.

      Witnessing the reaction of the lawyers today, it dawned on me that a very potent political enemy is being created here. If the CJ is impeached, she would have little choice but to get into politics. If she gets the support of SF (why not), the combined support base behind these two are truly a force to be reckoned with. Add to that the backers of Bandaranayake family and you wonder if the UNP and the JVP are even needed. People are looking for a savior and it looks like SF is not it. May be people just got one in this CJ.

      Hey, if the Constitution has to be rewritten, who better to oversee that than this well educated, good mannered, respectable lady, who actually has a clue as to what it is all about.

      Let’s see if the political pandits will still call MR a shrewd politician after this one. Talk about shooting your foot; this is more like suicide to me.

      The 4 opposition members should resign from the PSC which is clearly a Kangaroo Court that denies due process in letter and spirit to the victim / accused, the Chief Justice who is a woman.
      UNP, DNA and TNA should join with the Trade Unions and women’s organization go on the streets and organize the people to protest the Rajapakse dictatorship, also up the ante in the international campaign against the war criminals who are turning Lanka into their fiefdom and dictatorship!

    I really feel for people in Sri Lanka! Unfortunately all our functions within public sector (larges employer in the country) is attached to governing political party or keep changing the management according yo which party they support. There is no proper protection through basic employment laws or courts unless there is a political pressure! When you run institutions in this manner then employers want to protect their jobs at any cost and that is the result of why a lot of people are not coming forward or speaking out against the current regime. This is the same situation in vilages, where people get some benefit through samurdhi benefit. People spent more money for their food and cost of living that they get form samurdhi but they do not understand it. These benefits are connected with political connection via Grama sevaka and the local MP etc so they have to be on the side of the governing regime. Unfortunately situation will go on until there is something similar to arab spring or people became more educated and less depend on the government hand outs and political appointments.

    The PSC has once again exposed its lack of contitutionality by attempting to deny even basic requirement required by law such as representation by lawyers etc. Govt persists in this charade making the entire country the laughing stock of asia.
    We now have Chief Justice Yapa, Justice Weerawanse et al sitting in judgement over the CJ of the SC. They are making their own laws as the trial proceeds. This is the result of handing over the country to Mahadanamutta and his Golayas.

    The whole thing is a sham. Why don’t the opposition members withdraw from the PSC in protest and take no further part ?. In that way the predictable condemnation of the remaining government members all together playing judge, jury and executioner ( a pathetic foregone conclusion !)will have zero credibility both locally and abroad.

    It is simply arrogance on the part of the PSC to carry one despite the call from the SC to delay until the issue is ruled upon. The speaker can then reject it if it goes against the govt. and recommence proceedings.

    Today’s behavior was reprehensible, but who in this govt. cares?

    It was better for the opposition to stay put rather than leave as then they will not be able to lodge their disapproval within the PSC to the kangaroo proceedings.

    Again what the international community say is not of interest to the Govt. which does not care a toss about that either.

    Let’s see how this plays. The CJ is sticking to her guns and she has a super lawyer well versed in the technicalities of the law to stick to the law in all her actions.

    In Sri Lanka, “CHIEF JUSTICE SANS JUSTICE”! If it is so, what can the ordinary citizens expect from the GOSL. The way the PSC (7:4)is handling the arbitrary and fabricated Impeachment, it is quite evident that Hon. Chief Justice will be recommended to be removed from her position and also from the judiciary. Why, – the only reason is that she did not give the recent verdicts to the aspirations of the Rajapakses. If she has given the verdicts in their favour, today her son would be the owner of a LAMBORGHINI the prestigious sports car as a gift direct from Bologna in Italy or a Ferrari from Italy! Anyway, by hook or by crook the 7 GOSL MPs will make the CJ guilty. So, why on earth the Opposition members are hanging onto this PSC. They should resign honourably. Whether they are there or not, the verdict is already given from the Temple Trees to condemn the CJ even though the whole world knows that she is innocent. The only way to save her is to pray to our Gods that the President of Sri Lanka will not come back from USA. Then, the CJ will be the Ad Hoc President. Let us make Bodhi Poojas or any other religious performances according to our beliefs to get rid of this devil who ruin our country. Don’t ask the Gods for another Tsunami as that will only help the present rogues.

    I think going into courts to question Perogrative powers of the Parliament is some kind of time taking tactics of some body or an poly to create further tention between Judiciary and the Legislation. It’s better
    to look at the back ground of the lawyers who file those petitions. I can guarantee they have a money source coming from overseas.

      Isn’t it more likely that the West is paying your puppeteers, who are citizens of those countries, to carve out this land into pieces (including oil fields) and give to their companies? Isn’t it true the powerful families in the West are staking their claim on all natural resources in this country, including water. Isn’t that why your puppeteers are taxing people on those resource, so they can save those resource for their paymasters?     President and the Speaker are the brothers of the one who is blocked by the CJ in amassing ill-gotten wealth to the tune of Billions if not a Trillion. So, the verdict is very clear. Added to this, another is the Defense Secretary and one son is an MP and the Parliament has over 2/3 yes men to the Executive. All the relatives and all the in-laws and their close friends are holding all the important positions in Sri Lanka. Whereas the Chief Justice has only her bravery, honesty, loyalty, integrity, smiles and a few Opposition supporters and lawyers plus 95% of the helpless citizens of Sri Lanka and 3 or 4 mass media institutions to support her. Only a miracle can help her and if it happens, the CJ will be the President. This is the fear that the looters have.

    Srilaka has already become a failed state.The country is full of comedy when ever the government increase every thing the masses consume or use.People are silent except for few protest by some near the fort railway station.Look at Jordan a country govern by a monarch,when the government increase the fuel and gas prices Jordanian took to the street in numbers. Here there is no mass resistance only submission to the will of this family rule. We have no real leaders who won the heart of the people.We expect the General to fill the gap.Of course in his fight for justice and democracy in the country he should be away from Sarath Nanda Silva who is more akin to a stinking garbage.

    What I don’t understand is… 1) why didn’t PSA give time to CJ until SC clarify the six appeals relating to the standing order 78A. 2) Why didn’t PSA give 6 weeks to CJ to submit her reply to the 14 counts of impeachment? There is a standard rule by law for any case the accused should be given 6 weeks, where by CJ was given only 10 days. 3)If the above two minor requests were not granted by PSA with the 7 to 4 (7:4) majority, could you ever think when it comes to CJ impeachment verdict, will they ever give a fair verdict even if she proves her innocence and prove she is not guilty.

    Best thing I think is to forward the outcome of today’s PSA ruling to Asian Human Rights commission, Commonwealth Courts, UN and international courts and to get their opinion whether the CJ should proceed with this trial further.
    How can you get a fair trial from 8th grade drop outs, who doeswn’t understand a damn of English, leave alone Law, under the belt of a dictator to give a fair verdict.
    If I were the CJ I will immediately stay away from wasting my time facing these crazy baboons who make the SC a mockery to the world.
    Everybody should rally around the CJ and put a stop to this crazy PSA (PISSA) trial.
    Enough is enough listening to this lunatic parliament bulshit jokers.

    This lady was appointed by political leader chandirika without having any experience to be the position.when she came to supreme court from back door by violating the court tradition that only experienced person to be appointed to supreme court with the concern of chief justice but chandirika did not get chief justice conceern.it was very clear that many expert attorneys came to supreme court and challenger the appointment. this lady did not have principle of applying the law when it comes to constitutional or political motivated matters.look the simple example many cases where she delivered basically,fundamentally and factually wrong judgment to secured wrong doing people at the time chandirka rule the country under most corrupted political leadership where public properties are sold to family friends and others for getting under cut and when did not pay deals are terminated. last judgment and extended of president terms beyond two terms have no what so ever legal merit.so how can this lady can keep supreme court in the country when she did not apply properly the law on consistences basis?it is time for her to go and time to clear this corrupted court system in the country for better tomorrow for people and moves the country economic development policies.People did not appointed attorneys to run the nation but the parliament and president by mandate

    When ever this man goes to witness a cricket match where the SL team
    faces the final the SL team loses the match because of this man of bad
    omen. Now he takes the revenge on the CJ for not delivering the order
    in their favour, this is an injustice. All these government politicians
    should be killed and if they live it would be more and more problem to the people. Don’t these corrupted politicians feel shame just chasing
    a woman, bloody bastards. Bloody Wimal Weerawangsa an uneducated bugger
    is been included to hold the inquiry, damn shame, this paraya bugger
    licks MRs ass and got the minister post. I think it is advisable that
    all unions get together and fight against the impeachment of the CJ and
    if necessary to strike until the government resigns including the big
    MR bugger. The opposition is lifeless until RW is there, he too licks
    the ass of MR for survival, he should have been killed long ago and
    it is a shame to have an opposition leader like him, all these
    corrupted MPs should be killed by the people of this country. I hope due to this injustice not only to the CJ but to the suffering people of
    this country. If this paraya bugger continues as the big man of this
    country it would be an untold suffering to this country as a whole.
    There should be a revolution in this country to get rid of these buggers
    and I hope very soon it will take place by the help of god.
