Retrieval Of Muslim Burial Rights & The Aftermath

At last, after nearly 12 months of agony and trauma, and close to 350 forced cremation of Corona-killed Muslims, President Nandasena Gotabaya Rajapaksa (NGR) had relented and issued a gazette notification restoring a controversially lost Muslim human right. Muslim community would indeed have a great sigh of relief, and there may be several among them, who would claim credit for this so-called achievement, including the five parliamentarians, who treacherously voted in favour of the 20th Amendment. 

What made NGR and his coterie of Islamophobic monks and advisors to change their mind? To start with, the initial decision to cremate all Corona-killed bodies was based on an untested and speculative argument that the virus would spread to humans through contaminated underground water if the said bodies were to be buried. It was music to the ears of Islamophobes on whose support NGR and MR’s government stay in power. Sheer speculation in combination with ethno-religious hatred of minorities defied all contrary views and advice from WHO, international human right groups, local and foreign intellectuals, and above all, internationally renowned experts on epidemiology.    

However, four things happened one after the other and compelled the regime to rethink. The most significant of these was the damning report by the UN High Commissioner for Human Rights, Veronica Michelle Bachelet, which was released on 27 January 2021. That report picked among other issues the one pertaining to forced cremation of Corona-killed Muslims and argued that it deprived that community one of its basic human rights. It is now a subject of discussion in Geneva at the UNHCR Council. The second event happened on 3rd February 2021, when Tamils and Muslims marched from Poththuvil in the East to Polikandy in the North demanding justice, equality of status and freedom from oppression. The spontaneity of that alliance between the two minorities must have sent an important message to NGR and his regime that the hackneyed tactic of divide and rule has passed its use by date. Life under this regime has become so deplorable and unbearable to minorities that they had no alternative but to revolt.  It is a matter of time even the majority would feel the same if situation in the country continues to worsen under this regime. 

The third event happened a week later on 10th February in the legislature, when Prime Minister Mahinda Rajapaksa responded to a question from a Muslim member and said that burials would be permitted. However, he stopped sort of clearing the air by not specifying whether he meant the burial of Corona-killed Muslims. Being an old fox in politics, and realising the danger of growing international pressure over this issue he might have said it to measure the pulse of his supporters and their reaction. That reaction was negative and almost instantaneous when one of his own ministers contradicted him. After that MR went quiet. The final event was Imran Khan’s (IK) two-day visit to Colombo on 23rd February. With regard to the cremation/burial issue this was a non-event, although to the less discerning it may look as if NGR had relented to please his guest. 

IK Visit

For centuries, Sri Lankan Muslims were made to believe by their religious leaders, politicians and public speakers that their community is part of a universal Muslim family or umma, which now accounts for nearly one-fifth of humanity. This universal family has fifty-seven Muslim majority countries, and all of them are members of an ineffective Organization of Islamic Countries (OIC), or more appropriately, Oh I see. Although the Sri Lankan members of this family are a small minority, they were told, as one of their political leaders did recently, that the supranational solidarity built on the edifice of Islam is a God-given strength and will be a protector to Muslim minorities in times of crisis. 

In fact, Muslims the world over were fed with this canard, but the reality is otherwise. With the disappearance of the Ottoman Caliphate followed by European penetration, conquest and colonization of Muslim lands, and with the growth of secular nationalism, the idea of a supranational umma had given way to the emergence of watan or nation, and the spirit of nationalism superseded the spirit of Islamic unity and Muslim brotherhood. 

When IK expressed his concerns over forced cremation, and felt elated later when MR provided that vague response in the parliament, Muslims believed that supranational solidarity has relevance and is working for their benefit. Yet, when he did not mention even a word about this issue when he was in the country all expectations were dashed and the community felt utterly disappointed. 

One cannot blame IK for this, because the primary purpose of his visit was to strengthen the China-Pakistan Economic Corridor (CPEC) of the One Belt Road by bringing in Sri Lanka into it and make it a China-Pakistan-Sri Lanka Economic Corridor (CPSLEC). All MOUs that he signed in Colombo was to achieve this objective. He was therefore not going to jeopardise the strategic partnership with Sri Lanka and China by rekindling the cremation issue. Moreover, how indifferent is IK towards the plight of Muslims outside his own country is best demonstrated by his prolonged silence on the plight of Uighurs in China. The same accusation could be levelled against Rajapaksas who also have not shown any sympathy towards the sufferings of Tibetan Buddhists under Chinese occupation. Both these leaders do not want to anger their Chinese paymaster. To local Muslims however, this is a stark reminder not to build any hope on supranational solidarity. If this solidarity has any meaning today, Palestinians would have had their country long time ago, Rohingyas would not have been killed, raped and expelled from Myanmar, and Uighur Muslims would not have to endure what they are going though now in hundreds of Chinese brainwashing camps.

Poththuvil to Polikandy pedestrian march was an eye opener to anti-minority hardliners in the government. It was spontaneous and the participants ignored all legal and security hurdles erected by the authorities and they did not support any political party or movement. All they did was to raise their voice against continuing injustice and oppression. Tamils and Muslims decided to ignore their past differences and became united as one family of victims. P2P obviously sent a clear warning to NGR and MR Government that it is a matter of time before even the majority community would organize such a march if the current crises are not tackled systematically. The country’s economy is in tatters, ecosystem ruined, foreign policy bungled, sovereignty compromised and peoples’ living conditions plummeted.  

MR’s Politics

Mahinda Rajapaksa is a veteran in parliamentary politics unlike NGR, who only knows how to command and enforce. MR chooses the right words and messages when he visits Tamil and Muslim areas and is a master in the art of divide and rule. He is aware of the dangerous direction in which his government is heading because of the stranglehold Buddhist supremacists have over government policies and implementation. It was as President that MR declared in 2009 after winning the war that there would be no more Sinhalese, Tamils or Muslims in this country but only Sri Lankans. Today, he is the Prime Minister of a government that caters mostly if not only to the needs of the Sinhala majority and that too to its Buddhist sector.  Therefore, it is reasonable to assume that his response in the parliament to a question on Muslim burial was a politically calculated move to see whether he could initiate a change in the mentality of hardliners.

However, the real credit for NGR’s gazette notification should go to Bachelet’s report which is now being debated in Geneva. Muslims have no one else to thank but this brave lady, who has her own experience of living under a military regime in which her father was killed. Her report has forced the hands of the President and his government to give back to Muslims the right taken away from them. By relenting on this issue NGR and MR must have managed to convince their hardliner monks and members of NGR’s Viyathmaga that a new and reformist face need be shown to the world if the regime were to escape from Geneva with minimum damage. The President’s gazette notification is yet to be put into action.   

Muslims in the Aftermath         

Having got their right restored how will the community plan its future? Although the final push came from outside, the community should not underestimate the domestic pressure exerted by local civil right groups, compassionate members of the Sangha, Christian prelates, Tamil leaders and secular rationalists. To Muslims, that implies that the battle for democracy, justice, equality and freedom must be fought and won internally and jointly with other communities.  

Having lived for over one thousand years with no fundamental issues and quarrels with fellow communities, why did relations suddenly turn so sour in recent times? This question was repeatedly discussed in previous contributions to this journal, which need no repetition here. What was said in essence was that the Muslim community, without realising the long-term consequences, began entertaining ideas that led to self-alienation in the name of protecting its religious and cultural identities. That self-alienation, because of its incompatibility with the dynamics of pluralism, eventually led to isolation and ultimately to rejection by others. 

What is needed therefore is a new strategy to seek solidarity with the growing forces of domestic opposition that run right through all communities at the moment. Unfortunately, the opposition has a strong distrust of Muslims, because of the treacherous behaviour of their political leaders. Muslim community would not have been driven to this tragic situation and forced to endure the agony and horrors of cremation, had its political representatives not voted for the 20th Amendment. It was a treachery of unfathomable depth with unimaginable consequences. To save the community from further disaster, the entire Muslim leadership should be rejected as a first step and at the earliest possible opportunity, and replaced by a new team of Muslim men and women, who would identify themselves not primarily as Muslims but as citizens, join a broad coalition of Buddhists, Christians and Hindus, and make future struggles a joint one. 

Historically, Muslims have developed a tendency to keep away from getting involved on issues that do not directly affect them. Regretfully, this tendency has a religious root, which will be a subject for another discussion. Civil societies in the country also have a perennial complaint against the community on this matter. That has to change. As citizens of this country Muslims must show their commitment to issues that affect the whole nation. When other communities and organizations organize events to highlight such issues Muslims should be part of such events. The cremation controversy may be over, but there are others that are waiting to explode. Without joining hands with other communities Muslims would face endless problems especially under this regime.

But on the other hand they are removing the head covering rights of Muslims by a Muslim Minister. We have to wait until the end of UNHCR session in March to see the real face of Rajapaksa’s

      YES, you are correct GATAM. By the Grace of God AllMighty Allah, it was Imran Khan’s intervention that made it happen.
      Pakistan is a very good friend of Sri Lanka for a long time. Mahinda Rajapaksa and the Rajapaksa brothers are very close friends of Pakistan and PM. Imran Khan. Therefore a good friend will always listen to his good friend than listening to “deceptive, hoodwinking and dishonest” Muslim politicians and Ulema. “The Muslim Voice” was hopefull that, by the grace of God AllMighty Allah, very soon the cremating issue will be resolved as a result of the intervention of Pakistan and PM. Imran Khan with the Sri Lankan political hierarchy during his official visit to Sri Lanka, Insha Allah. Alhamdulillah, the issue has now been resolved, Insha Allah. Sanakiyan , Rasamanikam, Rauf Hakeem, Mano Ganesan and others, including Ameer Ali propagating false claims will not accepted by the Muslim community of Sri Lanka. They love Imran Khan as the Pakistani people love him and have acknowledged his ability to have resolved this issue, Insha Allah.

      Dear Dr Ali,

      how can MaRa-GoTA ever make good for all wrong decisions they made regarding the COVID burial rights until yestreday. Now with the new gazette the rights of muslims will be given, thanks to the pressure excercised by visiting Pakistan Premier. So called, people s friendly, President and Premier should be very ashamed that an external leader had to involve in that humanitarian debacle bringing the uneducated crimnal brothers back to their senses.

    Thought it was 7 or 8 not 5 MPs who were traitors to your cause. Also unlikely (though I have no exact figures) that 350 Muslims were denied the right to burial out of the 475 total deaths to date. Just to correct the figures only.

        My comment on numbers in the article, was a verifiable assertion. Simple “False or True”. But strangely it had (so far) 3 dislike votes 50%. Why “Not true” – then say so to justify. Thanks SJ for your comment.
        But then can we blame Sri Lanka voters for voting for the absurd (at their level) when CT readers supposedly at a higher level will not accept verifiable facts and not discerning between fact and fiction. If no comment showing disinterest is acceptable but this….?.

    SL is using Muslim burial as a bargaining tool to win support from Muslim countries at the UNHRC.

    If burial was allowed from the start it wouldn’t be a bargaining chip.

        Then read again Fathima’s comment. Please bring the sentence in that he is saying “Aanduwa wants to be friendly with Muslims”. He is basing his comment on simple principle. UHNRC took the Muslims burial case to discussion. Muslim OIC has requested to allow Muslims to bury. Pak PM who came as Chinese messenger, to support Aanduwa in UNHRC, asked for burial of Muslims’ bodies. Why Aanduwa is agreeing to bury now when the external pressure is mounting, but discarded local Muslims requests?
        Please don’t concoct metaphors without understanding the basic subject.

        Imran Khan did not visit Sri Lanka to do a Cat walk for anyone or come to dictate to tge leaders how to run Sri lanka.
        He is a well seasoned politician NOW, not just an old Cricketer..

        Unlike Our Muslim Politicians who feed them , their families and close allies, Imran Khan is a Gentleman , honest and been a great soldier , he did not become President like in Sri Lanka , where Muslim Voters are Willing not to just become Sheep anymore but become goats, willing to vote in crooks who openly fatten themselves leaving the poor Muslims families of 4 to five to live in 1 perch land with not enough to eat , while they live in palaces and stuff themselves.

        ===Imran Khan’s visit had nothing to do with burials, but a official visit , he knows better not to interfere with internal issues of any Independent nation, if he does , then he will have many to use it as an excuse to meddle with his Country’s internal affairs , you do not need brains from head to toe to figure out this simple political mechanism.

    This is an enlightened opinion and I wish to add along with the leadership, the political parties and the politicians should also be rejected.

    What Dr Ameer Ali says about Muslims is also true for Tamils and Sinhalese as well.

    We shall send all of them to the dustbin of history.

    Then, to save the entire country, a new team of Sri Lankans without any racial or religious labels joined to form a common front and struggle to establish a secular democratic and progressive just society throughout the length and breadth of our beloved nation.

    How come there were leaders of the calibre of AMA Azeez and TB Jaya?
    Has there been any Tamil leader of the calibre of Sir P Arunachalam since the 1930s?
    There have been outstanding leftist among Muslims until the 1970s, matching the Tamils.
    What about Hill Country Tamils? Any non-left names after CV Velupillai?
    A Aziz was a far more secular plantation workers’ leader than any CWC leader and was close to the Left.

    Gazette once published the process of burial cannot be stopped by anyone for any reason. It appears the approval for burial is only in paper and in practice its not there. This is another very clear example to UNCHR how this Govt operates. The one law one country in their manifesto is only a slogan, in practice Many Laws for different communities. That too takes another turn when it concerns non-majority, the rule of law is bent into eight so that those who commit crimes against the non-majority go out of courts “Nidos Kota Nidahas”, which has become the slogan of the judiciary in SL.

    Newest trend I note is attacking Sajith Premadasa as an inefficient opposition leader. This is not the case. Sajith is an educated person unlike the SJB grade 8 failed MPs. He is young and he thinks differently and in a very civilized manner. He is practicing a decent, democratic and law abiding politics which most thugs and kudu medias in SL do not get it. The younger generation is behind him and day by day he is gaining more support.

    Today the most important duty of the Muslim community is to inform all the international bodies that the burial approved by the Govt is only in paper to hoodwink UNHRC and not in practice.

    Last few days we put forward here a call that Tamils & Muslims should take the help of Sinhala Moderate (Gentlemen) to call for the justice from UN & UNHRC. The idea of going to UNHRC is not new for learned Sinhala Gentlemen; they saw it in 1989. But for them, that time the expected relief didn’t come from UNHRC (earlier Commission); but came from the raging war of LTTE. Once the Vaalaiththodam Sr. was gone, Sinhalese unanimously elected CBK to bring peace. But CBK undertook “War for Peace”. By this re-focus on war, Sinhala Buddhists’ hands got strengthened and they passed 18A. At the end of the war Tamils went to UNHRC. Sinhalese Buddhists brought in Royal Family as their modern monarchies. But this did not wipe out a smaller crowed that voted with Tamils and Muslims for Just-Compassionate Government, the Yahapalanaya. The reality is the Tamil and Muslims leadership only went for alms, not a real government, so they too easily got dragged by those traitors demanded again a Sinhala Buddhists leader. We suggested CV as the candidate. There was no reasonable suggestion from Muslims or Tamil leadership.

    The only way to ensure the Sinhala Buddhists ruling the Ekkiya Raj is by frying the all three communities by racism. Unless Sinhala Buddhists ruling the so called Sinhala Buddhist country is annihilated, nobody will be in piece. This basic contention has to be understood by all, especially, by Muslims and Sinhalese. Reasonable number of Sinhalese wants democratic country and willing to liberate them from the Telegu Nakakes, who are ruling from 1948. In fact Sinhalese wanted that and that is why they handed over Kandy to British under Kandyan accord, in 1813. But, by tricks, Telegu Nayakes retook it from Britain. Now the Kingdoms have to go back to the 1619 status; Kandy to Sinhalese, West & South Cost to Malabari mixed shore side Sinhalese; and the Tamil lands have to return to Tamils. Then only proper democracy can be established. That is the only way to stop Sinhala Buddhist Nayakes ruling the Ekkiya Raj. This is not a proposal for regime change to reinstall runaway Kadaies of old UNP. This is proposal to return back to 1931, a mechanism to genuinely use the universal Franchise for all three communities, instead of Sinhala Buddhist only Franchise. Tamils have to explain these aspects to moderate Sinhalese. That will enable Muslims to get on the board.

    Singhalese, Tamils and Muslims has to go together to UNHRC, as we said earlier, not to bring Vaalaiththodam as the new EP or the world’s greatest liar Mangala as PM, but to seek justice, which UNP and SLFP has denied to Sinhala, Tamil & Muslims Community. Sinhalese can argue at UNHRC for the JVP time murders, in first time Aanduwa killed 20-40 thousand and second time 80-120 thousand. And/Or they can support Tamils on their argument for Mullaithivu War Crime/Genocide. Tamils too can return that favor to Sinhalese. Sinhalese need to ask for government change, not regime change. They need to call international experts drawn constitution, not another Soulbury’s. Tamils will be asking for minimum self-determination, but Singapore-Malaysia deal. Tamils have to conduct their election with their election laws. Courts with their own system. This way Buddhists are not losing even an inch. They will be always free to visit Tamil Buddhist shrines, vacationing, trading….. in North East. If Sinhalese wants to stop the world Super Powers bringing their atomic war to the small island, they need to peacefully hand over the Tamils self-determination rights and proper along the side of Tamil. Greedy to rule Tamil will make they ruled by again by a Super Power. It’s time to wisely avoid another Kandyan Accord under China.

      What is it that is more dangerous, 450 buried dead bodies OR 80,739 positive cases polluting the ground water through their excreta, bath water, phlegm etc. everyday for the entire period of their infection. This is through the septic pits, drain water, hospital waste etc. All these end up as ground water in the surrounding land.

      Medical facts are very clear. It is guaranteed that none of this can carry the virus nor infect any person. Dr. Sudharshani Fernandopulle has also said so in Parliament.

      If this is not the case, all the neighbours of the Minister of Health would be Covid positive by now as their groundwater would surely be full of the virus given that she was polluting these waters during her quarantine period of nearly one month.

    As of 27th February 2021 the total number of Covid-19 deaths in Srilanka = 460
    Percentage of Muslims in the population = 9%
    But
    Percentage of Muslim Covid-19 deaths = 350 out of 460 = 76%
    That is an over representation of Muslims in the Covid-19 death toll in the order of 8+ times!!

      Do you suggest that more Sinhalese deserve to die?
      If you followed the comments, I reported an observation that Many Muslims hid their symptoms for fear of identification as Covid-19 infected and the consequences.
      Had the Muslims been dealt with fairly, the country would have had a commendably low death rate.

        How in the world can you interpret what I have written as suggesting that more Sinhalese deserve to die? Its the Muslims have made the burial issue into a religious fanatical circus, attacking Sinhalese and Buddhist priests and launching a massive hate campaign against the Sinhalese and Buddhists, while the issue has absolutely nothing to with the Sinhalese or Buddhists, but a genuine fear of the virus the whole world shares. This genuine fear is based on the lack of scientific proof that the virus actually dies completely with the patient, which is what is needed to prevent introduction of SARS-Cov-2 into the soil by burials. There’s ample evidence that SARS-Cov-2 survives for months outside the host. So its a legitimate concern. Prevention is always better than later attempts to eradicate the virus. Its my stand that its the Muslims who have dealt unfairly with Sinhalese and others who oppose the introduction of the deadly SARS-Cov-2 virus into our soil through burying of SARS-Cov-2 infested corpses. Muslims even assume that burying is a right! Its not. At any cost protection of life, including animal life goes above showing metta to a practice that facilitates spreading of a deadly virus.
