Sri Lanka Young Journalists’ Association has lodged a complaint with the Judicial Services Commission requesting a probe into the dubious conduct of Kurunegala Magistrate Sampath Hewawasam in the case heard against Dr. Shafi Seigu Shihabdeen.
Magistrate Sampath Hewawasam’s dubious intentions came to light when it was revealed his wife Hiroshinie Hewawasam, is an employee of the Kurunegala hospital, working under racist hospital Director Dr. A M S Weerabandara, when the Magistrate dismissed the State’s withdrawal of the three-month detention order against Dr. Shafi and further remanded the Doctor last week.

Ideally, the Magistrate should have stepped down instead of presiding over the case against Dr. Shafi but he chose to take the case up despite glaring conflicts of interest and now it is said that he even manipulated evidence that painted his pal – Dr. A M S Weerabandara in an unflattering light.
Soon after the Kurunegala Magistrate further remanded Dr. Shafi – despite the CID B report clearing him of any wrongdoing – details emerged of the Magistrate manipulating evidence presented before the Court last week in order to paint Dr. Shafi in a guilty light while ensuring his partner-in-crime Hospital Director Weerabandara escaped any criticism.
In the interconnected web involving racist hospital authorities, racist area Police including the Kurunegala DIG Kithsiri Bandara with free access to media spun the web of lies to trap Dr. Shafi. Now it appears the parties invested have taken every measure possible to ensure their tracks are covered, but to no avail.
The Police had received some 615 complaints regarding ‘sterilizations’ by Dr. Shafi and almost 468 had been lodged following the hysteria on sterilizations. Eventually the number of investigatable complaints had dropped to 11 and further probing had revealed only three of them could have been effectively investigated.
The nine other claims were fabrications of the Hospital Director Weerabandara to which includes falsified hospital records, concerns lodged as complaints and adding tubal ligations that were consented to, as those performed without consent.
This complaint against the Magistrate comes against the backdrop of another investigation launched by the Special Crimes Unit of the Police, to verify the ‘sterilization’ allegations made against Dr. Shafi as per the instructions of the Acting IGP.

Once Shafi was targeted Dr. Weerabandara got the staff and patients in filing cases and forging documents. In this web of lies the judge and police joined to create mass hysteria. Now that CID has found out it was all fake , these shit heads are trying to cover up their lies. This is pretty much the same as in Thaj case where the police, forensics, doctors, judge, AG Dept all were in nexus, in covering up the murder.A innocent doctor and his family are used as sacrificial lambs for self serving politics. This is a local but good example for the reality that everything human do will never be exempt from biases of the people involved. This is a well established generality even in cut & dry science.
In this particular case of Dr Shafi, it is very clear from the very beginning that the case had no legal basis & was brought in by a group of people who had common social bonds varying from racism and party politics to socializing together. The magistrate should have obtained advice from a doctor, at least the JMO of Kurunegala regarding surgery required for sterilisation, during a caesarian section, and/or for sterilisation only.
He could have also interrogated a few of the women making allegations.
It appears that he has been ‘carried away’ by the general hysteria generated by ill informed & racially motivated laymen.

But there seem to be moves afoot to throw out the CID’s exonerating findings & hand the matter over to another police body for re-investigation. I only hope I have misunderstood the report in the Daily Mirror this evening. Otherwise, it looks as tho the forces that are behind these accusations will not rest until Shafi is behind bars for a good long time or — with even monks howling for his blood, and a Head of State who’s casting his net wider and wider — at the end of a rope.

Until CID gave evidence, we thought Shafi sterilized Sinhala mothers. Until last Sunday Observer published the real documents with proof, we believed US boots will be on our soil. We believed the 83 page agreement. Don’t these journalists have a conscience? Have they completely sold their soul to the devil? They are playing with people’s lives, specially innocent children.
