Sharing Responsibility In Sub-National Governance

The government is reported to be preparing legal amendments to ensure the conduct of long postponed provincial elections. Elections to the nine provincial councils have been postponed since 2017 when the government at that time decided to amend the law pertaining to the conduct of provincial elections. But they never completed the process, which gave them the excuse not to hold the elections. Thereafter no government had sufficient interest in holding elections to the provincial councils by completing the process of changing the provincial council election law. The result is that today the devolved provincial council system is run by appointees of the central government. Little do they recognize or accept that they are violating the constitution by technical excuses.

According to the media, Minister of Public Administration, Provincial Councils, (Professor) Chandana Abeyratne stated that Parliament had approved the mixed proportional representation system for provincial elections under the Provincial Councils Act No. 17 of 2016. However, the implementation of this system requires the approval of the Delimitation Commission’s report, which was defeated in parliament effectively blocking those elections. Consequently, there have been calls to revert to the previous electoral system for conducting the Provincial Council elections. Under the previous system, elections would be held according to the provisions of the Provincial Councils Elections Act of 1988. In these circumstances, instead of further delaying the election can be held under the existing law and be modified subsequently.

Minister Abeyratne has indicated that a proposal regarding this matter would soon be presented to the Cabinet. Following Cabinet approval, necessary steps will be taken to conduct the Provincial Council elections by August 2025. Hopefully, the NPP government will not follow the path taken by previous governments which upon winning national elections fought shy of contesting at the local and provincial levels. Those governments feared testing their popularity at the local level polls as they realized that they were not bringing to fruition the many promises they had given. The present government also is finding it difficult to keep its promises regarding charting a new path of economic development, reducing the cost of living and increasing production in the immediate term.

Main Promise 

The strength of the present government, however, is that it is keeping true to its central promise during the election campaign. The government is widely seen as implementing its promise to bring corruption and wastage of resources to a speedy end. Corruption and wastage were seen by a large section of the population, presumably the big majority if the election results are gone by, as the key reason for the country’s economic collapse in 2022. The current debate on the privileges and benefits accruing to the former presidents and prime ministers of the county is due to the government’s efforts to deliver on its election-time promises in the immediate term. Unlike previous governments which lost popularity soon after winning the elections, the present government continues to be popular due to keeping to its main promise.

The government has promised to hold the local government elections as soon as possible in the first half of the year. This would also be in deference to the decision of the Supreme Court that these elections should be held as early as possible. The local government elections have been postponed for over two years due to the unwillingness of the previous government to test its popularity with the people. The local government elections fell due at the time of the economic collapse of 2022 so it is not surprising they were postponed. The government feared a landslide defeat. On this occasion, however, the government is likely to do well at the elections as the opposition political parties, including those in the north and east, have become weak due to in-fighting.

If the provincial council elections are held in the aftermath of the local elections, the government will once again have the advantage due to the momentum of its victories. The question with regard to the holding of provincial elections is whether the government is committed enough to the cause of devolution of power to actually want to hold those elections. There continues to be a widespread opinion among people of all strata that the provincial councils are unnecessary white elephants at best and potential threats to national security at worst. However, the government has been categorical in stating that they will hold those elections because this is part of the constitution which they are pledged to uphold.

Full Implementation 

The basic rationale for the devolution of power is that in a multi-ethnic and plural society, such as what Sri Lanka and Switzerland are, it enables each community to enjoy decision-making power in the areas in which they are a majority. In a situation in which one community is much larger than the others put together, it also prevents the larger community from imposing its views on the others to their disadvantage. Unfortunately, there are many examples from Sri Lanka’s post-independence history of this phenomenon. These include the denial of citizenship to the Malaiyaha (upcountry Indian) Tamil community at the very dawn of Independence in 1948. More recently, it was seen again during the Covid outbreak in 2020 when the bodies of those who died of Covid were compulsorily cremated even though this went against the deeply held religious sentiments of the Muslim community.

There is a possibility that the government will not see the devolution of power as an aspect of improving governance in the country. The government has taken the position that it is committed to the equality of all citizens and that it is a non-racist government that will oppose racism and extremism in all its manifestations. As a result, the government has not given any emphasis to ensuring ethnic or plural representation in its decision-making bodies. This was seen in the composition of the cabinet of ministers, in the choice of deputy ministers and more recently in the appointments it made to the Presidential Task Force for a clean Sri Lanka. The representation of ethnic and religious minorities and of women was either zero or disproportionately low. The issue of ethnic, religious and gender representation in decision-making authorities at the central level needs to be reconsidered.

In this context, the holding of provincial council elections will ensure the missing ethnic and religious representation in decision-making, albeit at the provincial level. The provincial council system was designed to accommodate the long felt need of the ethnic and religious minorities for a share of power in governance in the areas in which they predominate. The 13th Amendment calls for the establishment of the provincial councils as elected democratic mechanisms. The provincial councils are not mere decentralized bodies that ought to be run by the central authorities. The 13th Amendment also calls for the implementation of land and police powers. By implementing the provincial council system according to the constitution, the government will do much to strengthen the trust of the ethnic and religious minorities in the constitution and rule of law, and strengthen the national reconciliation process which is the surest guarantee of national unity.

      Nathan, This government was voted in to be there for several years. Let them do the needful to improve the nation. If doing well, they may be there even for another term, who knows. Hoping that President will eventually abolish the Executive Presidency and become the Prime Minister in Parliament.

      This is true. There is no guarantee under unitary system. Even it is possible that Rajapaksa or Ranil may come back again within five years. It is a democracy decided by Buddhist Sinhala only.

        Other than a few Sinhalese, the rest are not in favour of sharing power and territory with Tamils in a fair and effective manner. NPP will find excuses for not conducting provincial council elections.
        NPP solution to Tamils is administrative decentralisation to pradesiya sabhas. Even if they do so, they will not only not grant police and land powers but also withdraw several amendments made by previous governments to sabotage devolution. Recently police form Anuradhapura arrested MP Ramanathan Archuna in Jaffna. If Tamils had full police power, this arrogant act would not have been committed. Anuradhapura police would have to ask for permission, which will not be granted by Tamil police as Arjuna Ramanthan had not committed any offence. Demanding the reason from police officers the reason for questioning him is not causing obstruction to the duties of police.

          Arjuna was stopped by the police for driving with VIP lights on without authorisation. If you have watched the video showing how he dealt with the police at the time and still think that he was not obstructing the police in the performance of their duties, then you must be a biased person.
          His arrest was fully justified and all right-thinking people will agree.

Law should be EQUALLY applied, regardless of race, language, caste , position……. etc……… etc. It is up to the person to prove his innocence in a court of Law. What if soon, he is thrashed by the very same people who elected him ???? Will he be going to Police ??? Whether a Policeman can pronounce his name or not doesn’t really matter, as long they get it write on the paper. I’m sure there are Tamil policeman who cannot pronounce Sinhala or Muslim names.                 Sitting on chair of leader of opposition on the first day is not arrogance. Only bigoted biased individuals think that way. On the first day in school, as they arrive pupils sit wherever they like and then only seats are allocated by name. This is the same in parliament. On the first day there was no leader of opposition and that seat can be taken by anyone till the election. Just because swollen headed and imbecile Sajith Premadasa did not like it, you cannot blame Archuna Ramanathan. When a Tamil defies the order, Sinhala racists do not like it and start attacking. This happened to me in UK, when I stood up against Sinhala racists, they started attacking me. Fortunately this happened in UK and they could do nothing other than tuck their tails between their legs.

            I do not what happen to Dr. Aruchuna Ramanathan and police officer on that day, I understand the police officer could not even Aruchuna’s name correctly in his complain and the case was postphoned to Feb 3rd 2025. Who is the judge. IS it LJ?

            This is the status of the police. When I was travelling from Airport to Jaffna, the driver was stopped by police in the mid night and the driver have to pay a sum (Rs. 500 or Rs 1000).

                Yes Bribe Taker is a Sinhalese Police Man. Bribe giver is an ordinary Tamil driver. Why didn’t you put a case against the police man who asked you to pay bribe? I know many of the Tamils were arrested for carrying a bomb after the Sinhalese policeman keep the bomb in the vehicle or his bag. They can produce video evidence as well in Courts. Even the Sunday leader Editor Lasantha was murdered in a day light. Still justice denied. Even Rohana Jayaweera was assasinated

                I drive from Jaffna and Colombo and back frequently. It is not like getting stopped at Bambalapitiya. When you are stopped at some place like Anamaduwa and threatened with a traffic violation, if I like you, refuse to bribe, they will book me, keep my license until I go before the courts. This means I will have to travel again to Anamaduwa for the hearing perhaps a couple of times. It is easier to pay the 500 rupees rather than go through with this hassle. Fortunately, so far, the policemen who have stopped me have been kind probably because of my age. They have let me go.

            Srilanka police is well known for fabricating cases to implicate people. As far as Tamils are concerned, they behave like supremacist racists. Arjuna Ramanathan was elected as MP on 14th of November. This incident took place more than two months later. If the parliament did not issue permit to use VIP lights, then it is the problem with officials there and not with the MP. When he was asked to stop, he stopped and asked them for the reason. He identified himself as an MP. Is an MP not a VIP ?. Is this not enough for not proceeding with the case. Instead of that they went on harassing him for which he showed his displeasure by arguing giving explanation. Those who are biased are the ones who say that he obstructing the police in performance of their duties. In this instant it is clear that police have taken the law to themselves. Revenge is being taken on this Tamil MP who has told Sinhala racists off.

              In another incident, police have gone to courts to prevent any demonstration by unemployed graduates during AKD visit to Jaffna. They went to serve the court order to the organisation. When leader of the graduates said that he cannot understand Sinhala and refused to accept it, police officer tells him that if he refuses to accept, he will be arrested. Is this not high handed action of the police. It was his fundamental right to demand that the court order be served in a language he knows. Governments may change but Sinhala supremacism will not.

Two days back, I saw what happened in Jaffna (AKD’s visit) and his memorable visit to Piribahakaran’s hometown ( Wadamarachchi), which no other President dared to visit. Did you see the reception he received there? It was very promising to me. I hope to push AKD to deliver what he promised there.

              First a correction to what I wrote. Actually, he was stopped by the police for driving with VIP lights on in a manner that inconvenienced other drivers.

              During the altercation with the police Archuna tacitly admits that he had no authorisation for the VIP lights by saying that he will obtain such from Parliament, so, at least technically, even if all MPs are entitled to VIP lights–though I am not sure about this–he had no right to them.

              When asked to produce his driving license, instead of doing so he continued to talk to the police officers in abusive language although they spoke to him very courteously throughout this confrontation. He was under the delusion that an MP when going to Parliament could not be stopped by the traffic police and that his duties as an MP overrode those of the police. They would have just let him go if he only had cooperated with them.

              This idiot is a persona non grata even in the Jaffna Teaching Hospital and the fact that you have chosen to defend such a racist clown peaks volumes about you.

                  What do you mean by driving with VIP lights on which caused inconvenience to other drivers. These lights have only one switch, either on or off. They do not have regulators to make light beam moderate or intense. Do not try to cover up police for this act. I am sure that police will never stop AKD for using VIP lights. This happened to me in UK twenty years ago. Police overtook my car and stopped me saying that I am driving with flash lights on which is inconveniencing other drivers. I told them I am only using normal front lights and got them to check it. After checking they asked me why is your lights so bright. I said that you have to ask the Ford company who made it that way. They accepted my argument and let me go. If this happened in Srilanka, police would have framed charges against me, when they find that I am a Tamil. It is the duty of an MP to attend parliament. This is a clear case of police preventing an MP from performing his duties. Do not try to protect supremacist racist clowns in the police.

                  It is technically correct that as a matter of parliamentary privilege, an MP travelling to Parliament should not be impeded. But, it is a sign of an immature oaf that he should drive with VIP lights on when going through a city so far away from Parliament. This man shows immaturity at every turn. I would not want to defend such behaviour. He is an insult to the position he holds. He has threatened to resign. It would be good if he does so. He has so far indicated no policy as to his politics apart from self-importance

        John Nott was the Defence Secretary back in Margaret Thatcher’s day. He died at 92 recently. I remember watching him being interviewed by Robin Day on the BBC.

        dtg and n.f – I have been asking the question from NPP why it cannot bring a motion in Parliament to strip all the CIVIC RIGHTS of all those found GUILTY by the Supreme Court, of bringing the economy of the country down to BANKRUPTCY. Those found guilty include Mahinda R, Basil R, Gotabahaya R, Nivad Cabral, Prof. Lakshman, and four others of the Central Bank. Leave aside an answer, there is no mention of it. Didn’t the NPP get a mandate to deal with these CRIMINALS? It got more than asked and expected.

        Look at Donald Trump. He is purging all those in the AGs and FBI who participated in the investigation of the 6th January 2020 uprising purportedly engineered by Donald Trump. It is reported that “E-mail” letters have been sent to all those Law Enforcement Agents. I don’t approve this type of “Tyrannical” action.

          Not a good idea, Douglas. Every Parliament will go about convicting its opponents as Trump will shortly do in the US. Parliament does have this inherent power. The English Parliament is sometimes referred to as a Court. It has contempt powers. It can convict. But, in a democracy, this procedure is seldom resorted to in modern times. We should not go on the path you suggest.

      JVP has a long history of politics and they made coalition with the traditional typical political party and had ministerial posts for some time. They were against to devolution of power as well. It is true that they are much better tan Mahinda family rule and Ranil Family rule or Premadasa family rule but they have to prove that they are good at solving the problems.

        If you look at the JVP past history with an impartial and clear mind …….. you’d notice, the JVP takes the characteristics/traits of its leader.

        AKD was not the leader those times.

        Today, the JVP would have a completely different outlook/character with a leader other than AKD – perhaps with the only exception of Nalin someone; the doctor guy who is similar to AKD. Imagine what the JVP would’ve been with Wimal Weerawansa or Kumar Gunaratnam as the leader.

    The need for Provincial Councils [JUST TWO ]was there when the Indian Government got involved in SL politics in order to SAFEGUARD the Tamil Speaking SL citizens. It should have been North and East of SL together as ONE province. Lots of bloodshed would have been avoided if that had been implemented in late1980s. SL TSC aren’t interested in Provincial counils if the current GoSL is going to treat every one as equals. The key REASON for the ECONOMIC COLLAPSE was DUE TO NOT treating the TSC as equals. There are so many cases [ Bribes,MURDERS/ Scams(Bond/sugar garlic Visa etc etc) awaiting for JUSTICE. Bring in Constitutional Amendments in order to EXPEDITE these PROCESSES.

    Come rain or shine , postponed elections will be held by this government
    because they have nothing to lose . Sirima showed the way to extend her
    term by two more years and J R J doubled it up when he got the power
    by hook or crook and from there the next batch of rulers all came with the
    same greed for power at any cost to the public . I personally won’t extend
    my support to them because of the way they ignored to include a Muslim in
    their cabinet but overall their performance so far seems to be going well
    with the majority if that is what their target is . They don’t care about losing
    by doing what needs to be done and I think that is exactly what Dudley did ,
    ready to go home , doing his shopping and driving his car . I lived in that era
    so , A K D and the lot no magic to me . I have travelled with W Dahanayaka
    and Panini Ilangakkoon in train and later with Mano Wijeratne on private bus .
    I share this experience here just to let those who see the new magics of new
    guys are just repeats that’s been forgotten even by the party Dudley belonged to .
    It’s a shame on them , not knowing their past in full . You forget your past then
    forget your future too .
