Sri Jayewardenepura Hospital A Safe Haven For Criminals Like Gnanasara

Against a backdrop of the dangerous tendency of people taking the law into their hands as evidenced by the violence at the Fort Railway station, the abysmal levels to which respect for rules and regulations has sunk is also evident by General Secretary of the Bodu Bala Sena (BBS) Galagoda Atte Gnanasara, sentenced to 19 years of rigorous imprisonment on four Contempt of Court charges over an incident that took place on January 25, 2016, being admitted to the Sri Jayewardenepura General Hospital (SJGH). The determination was on a case filed by the Attorney General against Gnanasara following a petition submitted to the Appeals Court by the Former Homagama Magistrate and current Colombo Chief Magistrate Ranga Dissanayake.

It has now become expected practice for politicians, high ranking officials and common criminals enjoying political patronage to get themselves admitted to hospital to avoid the inevitable discomfiture of a prison sentence. Gnanasara went a step further, getting himself admitted in advance to the infamous SJGH, currently headed by a quasi-Director, Dr. Susitha Senaratne, himself suspended from its Board by the courts.

In an interview with Derana TV Senaratne brazenly violated the ethical code with respect to patient confidentiality, revealing the type, size and location of a kidney stone and revealing the presence of blood in Gnanasara’s urine. As a registered medical practitioner it is unethical for him to do so. Moreover it is a serious come down in professionalism, given the important administrative post he holds.

Senaratne, who is not academically and professionally qualified to be the Director of a General Hospital, is an acolyte of Rajitha Senaratne, Minister of Health. He appeared on Derana TV attempting to defend the provisional admission of Gnanasara and divulging the monk’s condition to buttress his justification.

It is now well known that Gnanasara has made a practice of provisional admission to hospitals while awaiting court verdicts as a precaution against imprisonment. The “Gnanasara Method” of mocking the judiciary would not be possible without the complicity of hospital administration and the medical professionals treating him.

Gnanasara has apparently been diagnosed as having a ‘staghorn calculus’ in one of his kidneys, which is a long standing pathology that takes prolonged periods of time to develop and is not usually considered a surgical emergency. However, its surgical removal can be warranted depending on the symptoms such as pain, dilation of the ureters and back pressure on the kidney. Ganansara has only described pain, a subjective symptom that can be attributed to the kidney stone.

It is reliably reported to Colombo Telegraph that the ‘surgery that was to be performed’ on Gnanasara was initially scheduled for the 10th of August. Senaratne has stated that the ‘supposed surgery’ is to be performed on Monday the 13th of August.

It is also reliably reported to Colombo Telegraph that Gnanasara, occupying the most expensive luxury paying room at SJGH, is fitted with cardiac monitors while awaiting surgery to give the impression to those who are encouraged to photograph him and ‘leak’ his ‘serious state’ to the public to create a wave of sympathy to push for a presidential pardon.

It is common medical knowledge that a patient in need of continuous cardiac monitoring in a critical stage would not be fit for planned surgery such as a staghorn calculus removal. Therefore the status report offered by Senaratne and the obvious complicity of the treating surgeon as well as the administration of SJGH amount to an administrative-political pantomime to avoid justice from taking its course.

The troika of Gnanasara – Kahandaliyanage – Senaratne are veritable masters at manipulating situations to mock the judiciary. Senaratne deliberately avoided commenting on the security measures that should be implemented when a convicted criminal is housed at a government institution stating “I think the security must have been implemented” .

Observers within the hospital opined that the expertise Athula Kahandaliyanage and Senaratne exhibit at making a mockery of the judiciary indeed makes SJGH the perfect safe haven for criminals to be protected by other criminals. Colombo Telegraph previously reported the administrative corruption and attempts at contempt of court engineered and executed by the Chairman and quasi Director of SJGH with regard to the illegal appointment of its current ‘director’.

I suppose the next poor real patient that turns up will get the berth under the bed because this thug in robes has got the real bed.
And the smell the poor patient will have to endure! I wouldn’t wish it on my worst enemy.

That does not matter as the room will not be available for a real patient that is willing and able to pay.

Even if this man in Robes behaves like all the last sub human, please treat him with kindness. He should have gone through allt he hatreds during his child growth. May well be, he was abused by own parents or within his circles. Nothing comes out nothing.

His emerge should be the fault of the society.
Fault of the lawlessness in this country.
Fault of the lack of disipline in the society.
Fault of the sanga community that have long been in their slumber but louding something else than what lord buddha really preached.
Fault of lanken religious affrair ministry.
Fault of Buddhawansaor any book that give them the sangaya to seek impunity in Sangahood.
Fault of people’s gulliablity .. not having trained to see it right before leaping.
Fault of many other things that you guys cant see as you just add your two cts worth.

May buddha s real teaching be healed this society not allowing GHANSARA to rise up and destroy it to the core.

        You are telling the truth.

But how many of us would get it.

Even songs or tabloids being spread viral today either via SM edia or pvt TV senders create new problems. THERE is no quality at all. Songs being composed by low level men spread them raw to the nation. THe langauge being used s like streets mongers langagues. No decency at all. Nothing given to think bit further. Earlier days, the songs made the role of HINDI songs to the poor of the poor in srilanka.

We perfectly know even tiny issue could be a major issue depending on the person’s specific physiological or healing potential.
But just removing so called stones in kidney today can be made through a Laparoscopy so that the patient can go home within hours. I am from Europe and i know what I have been telling to you very well.

So it can be possible, that the headlines being made supportive to this man in robes are just planned to help him this way since the man is convicted criminal.
He knew all these would come this far for sure.
We want the kind of examples being set to protect this nation. Else, everyone could do anything and everything let doing things as they like it.

Our people always attacks the result not making efforts to know as to why a bugger of this nature came into being during the high days of Mr Medamulana- not just this man s activities but all other Mahsona or other forces came into being through abusive ness of politcians near to Rajakshe family. Now against, era is about to be dawned, that the bugger MR would be in demand people to get raped and abused by him. People are so wired, they love getting raped than be given some human right to them. THat can be seen as the problem in today society.

      1) Most respectable, seen within lanken soils, Malwathu or other chapter monks stays as if they were fed with clay at the time this bugger ran amok being part fo Rajapkshe underground net work. Darga city style riots should not have been the case, if this buggers mouth piece found some sort of taming to lanken law and order, if at all we have them in this country

      2) We always have ministries and ministers that live on tax payers funds, but do they do the due in terms of religious affairs. And as to why they kept silent that long not having brought any reforms to correct same repeating in this country. We know we had a facists dominated adminstration under most abusive Rajapksahe family, but responsible ministers cant just excuse having said that only

      3) We have to improve our disipline and nature we have to react if we see unfairness and lawlessness in this country, this should come through the school and university and institute level education from the begining on. We need national level policies not to change with the change of govt to build this society.

All About Buggering: Leelagemallige Akkige Malliye, it is creditable that you say, 3) “We have to improve our discipline and nature… blah, blah, blah”. First of all, you have to be disciplined enough to respect others – even your opponents. Do you think that you can do it by saying, Our people always attack the result not making efforts to know as to why a bugger of this nature came into being during the high days of Mr Medamulana? I don’t think so.
        .
May I ask whether you know that the dictionary meaning of the word buggering is the penetration of the anus during sexual intercourse? Do you know anyone who has been subjected to this sort of assault by MR? Perhaps you know. Perhaps you or Leela or both were buggered. I do not put such actions past MR. If MR or anyone of his comrades buggered you, read no more and make a short comment saying ‘I was’ or ‘We were’. I will apologize and withdraw my comment.
        .
Another explanation could be you or Leela or both were ‘buggered sideways’, meaning you or Leela or both did not know it, but found later that you were buggered. This is the worst-case scenario. It is unlikely that this happened, considering size of the friendly weapon, but it is quite possible.

Thank you for your comment- EDWIN RODRIGO -. But you proved us again you cant comphrehend English. You just make every effort to show off your English could be the best. But all is clear you are just a stupid person who knows neither English nor anything.
For your double check I have added the quoted info from the dictionary here below: Bugger means nothing else most ugly person in UK. We dont need to go into its connotary meanings.

          bugger
          ˈbʌɡə/Senden
          BRITISHvulgar slang
          noun
          1.
used as a term of abuse, especially for a man.
          verb
1.penetrate the anus of (someone) during sexual intercourse
          .
As you know, English words have several meanings. So, in the context of my POSTS above, what i meant is nothing else than he is a bad person.

But those who in sex industry may interpret theterm as something lot to do with Intercourse. We understand it very well Edwin, you always come with the kind of derogatory terms, that hs been smilar to the NY streets bitches too.

2.cause serious harm or trouble to.
          exclamation
1.used to express annoyance or anger.

Having a cannula does not make some one very ill. When a patient admitted to a hospital, it is a common practice to insert a cannula in case, need of a intravenous antibiotics, or a saline or blood transfusion. Don’t even address as poor sod. This man who is in yellow rob who calls him self a monk, Is a thug, who has insulted the Buddhism. He is a real disgrace, to Buddhism. He should be in Jail now, not in a hospital bed.

Same to you ! As is the case with MR on the PUBLIC stage is no good to use wrong wording (unta kelawanawa, mata kelawanawa or the like sinahala filthy- the most abusive pulic mouth peace is inherited by Wimal weerwanse – his go that viral- which is everywhere, people would love the tone and rhythms at once) , you too as a sepatagenarian – the very same should be be valid to you too. Today the society is fallen to all ends thank to the wording being used without leap. In our days in SL, two three decades ago, whatever was telecasted or broadcasted contained high sinhala wording. Be them thorugh songs or recites, what transitted to our ears were like honey. Please listen to old songs of Mohideen beg, Nandamalini or Amradewa and other singers then. But unfortunately, artiste plus politician bond seem to have destroyed almost everything by date. Soceity is fully turned out to be a hell back in my home country. Be it in public transport or anywhere you are, low level songs or current day are in air. So how can a society improve its real values ?

I will never be like that indecent harming even to an ant, but sometimes, I have to not being able to see it repeating. My mother has asked us ” paninanta pera sitha balamu – is of 100% validity in my life settings – those were the wiser quotes from my diseased mother”:

                      And happy weekend !

when would you grow up ? What more goals you have yet to achieve ? If my info are right, you should be now in late 60ties. But your provocative comments are similar to that of Grade 5 school going children. Just see you in a mirror man, if not today when ? Always believe, you can do lot more to lanken society than to any other place with the decades long experience you may have collected as a dometic worker in Saudi.
We understand your frustration. That cant be far from what we hear from some women just returning to country. You hate entire folks thinking entire world is guilty for your victimization. – just becuase your destiny was robed off by Arabs. You may have lot more to share with us – how you have been abused by those ARAB rich men. Ghansara is captured by kIDNEy problems today, but you may have been caughtby uknown kind of health problems by today.

We would never see this man would do his home work well. Once upon a time he came with cleopatra or a girl who had then been abused by him. Then again about other sex fantasies he may have tried out with lanken housemaids living in Arab region.

I read somewhere, this man should NOT be a teenager to allow behave so .

Current govt has made a BIG plea asking lanken Engineers to return home.

Edwin Rodrigo who narrolwly passed out from Pera in the days of Prof Kumar D

I thought Venerable Gnanasara Thero was put in the Slammer for calling our learned Judges P*******ys and P*******ys.
Even that was based on an ” I will tell on You” like incident in our Primary Schools, which happened in the Magistrates Judges Premises .

      “Is that a Criminal Offence?…”
Yes it is and that is why the court did not have much choice. The court had to look at the charges brought by the AG’s office. Either they had to let him free as not guilty (which could not be done as the crime happened in front of a sitting judge) or find guilty and sentence accordingly.
The courts did him a huge favor by declaring that the sentences on the four charges to be served concurrently reducing it from 19 to 6.

Minister Rajitha Senaratne is behind this whole affair of protecting criminals keeping them at Sri Jayewardenepura Hospital. No this is not a big problemt today so that could harm him that much. However, their supproting men can abuse the situation, since the person is now convicted criminal. Stones being found in kidneys or in the duct connecting urethrus.. can easily be removed within hours.
Of course if his healing potential is normal. If he is a diabetes patient, that can take longer than usual.

This article mixes up so many issues. The administrative irregularities within SJGH is one thing. The admission of GG to it is yet another. The pinnacle of all this could be the Minister of Health. As indicated in the article, I too suspect that this is a prelude to a presidential pardon. Sri Lankan President can pardon a chap for an offence long before it really taken up in a court of law and that power was once exercised by President DB Wijetunge. I suspect that under these conditions GG might get a blanket pardon even for ones that “investigations” are going on.

Yes this is possible but what message does it send to the people and the world when this guy abused the judiciary under the roof of the courthouse?

If a rouge monk can be pardoned by the President for the abuse of the judiciary, what credibility is there that justice will be served in war crimes cases? Any one will be held accountable?

      • 0

Precisely. Leave alone war crimes, all other crimes. This why I mentioned in a comment of the previous article that the news item that GG was given a hefty sentence is not that newsworthy and that any ruse to scuttle justice or any any impending attempt is definitely newsworthy. At the correct time GG is hospitalized and even doctors produce artifacts to show how serious is his illness. Where are we heading?

      Jim the Dimwit:
First things first: he is NO Venerable bhikku he is just a Jail Bird already charged and sentenced criminal.

“Bhikku has blamed govt and the lawyers representing the govt. “
That is because of his ignorance and stupidity. He still does not understand that what he did breaks the law big time.

“sue back all those involved for big time comphensation. “
      On what grounds?

“BBS civilians should take over this case.”
      What’s stopping you?

” It may be LAwyers supporting spy agencies with the support of INGOs are behind.”
Are you this stupid? Should this matter? He was charged and sentenced for the crime he committed.

He looks really ill. I hope he recovers and gets pardoned from the president, and comes out to preach peace among the communities – that is the best thing he can do to the country. If this monk dies of his illness or put behind bars for years, it is not going to reverse his past wrong-doings. Had the law and its enforcements taken care of his aggressive behaviour during the initial stages, damages could have been avoided and the monk too would not have to end up at this – His aggressive behavior was interpreted as heroism was not his mistake

Yes in the first pic he looks pale and weak and the doctor says he is passing blood in the urine, he could have a kidney problem as the doctor says or [edited out]
If you have money even for a small illness people run to Singapore or Australia as they cannot trust the local doctors. Fathima you better remember him in your Friday prayers.

Burt, many already remembered and remember him in daily 5 times prayers it seems now. Definitely if I have the money I too would prefer to run to Singapore or Australia because in SL doctors are entitled to go on strike at any time as they wish. Starting with Duminda( far as I know), SJGH seems to be a transit camp for rich and influential criminals is another story as per CT

Fathima you must be out of your mind. Have you actually seen this Yellow robe thug, for you to say that the thug looks really ill. Any one can pretend to be ill for photographs. He has done enough damage to Buddhism. In Fact the sentence is too low for him. If he is pardon for his crimes, all the other hooligan monks, will carry on acting the same way as this ugly over weight, fat, Thug.

  • 21
    2

Amazing. He is in the hospital bed still wearing his robe, obviously for the cameras. Take that robe out, and he is a common criminal and this is a Buddhist speaking.

Also, did anyone notice the smart phones these monks carry? A serious mockery of Buddhism.

Time to change the system and outlaw anyone serving a prison sentence to be admitted to a private hospital.

Some doctors have sunk to the level of coolies in Pettah.
They are a new politico sycophants who disgrace the Hippocratic Oath.
Monks like Gnanasara too are a new breed, a disgrace to the teachings of the Lord Buddha.
In Myanmar a similar monk Wirathu has been banned from preaching.

What a coward this clown monk is. He threatens publicly to kill vulnerable minorities and set fire to their property. He verbally assaults a woman seeking justice in a court of law. He abuses the magistrate in filthy language. But he doesn’t have the Cojones to accept accountability and face the legal consequences. He shits in his Siyura and dashes to a hospital for cover. The doctors should check if he actually has Cojones. Nothing is more damaging to Buddhism than monks who are both evil and cowardly. Now the two doctors from hell, Susitha Senaratne and Athula Kahandaliyanage, are part of a major scandal that is crippling what is supposed to be the flagship of Sri Lanka’s healthcare system – the Sri Jayewardenepura Hospital. Helping a fugitive from justice to evade law enforcement is a very serious crime. If the doctors’ reports about Gnanasara’s medical condition are not based on facts as implied in this article, it is indeed a clear case of contempt of court and obstruction of justice. These doctors’ brains have descend to their bottoms.

Prisons must be upgraded to have all the health facilities.

Though people have some respect for Rev. Gnanasara they have some disrespect as well for inappropriate way of communicating his message.

That disgraces not only the sangha community but also the Buddhists.

He must undergo the jail term or till an appeal free him.

    Contempt of Court.
Here is what I gathered from the Law Books of a A list Democracy, which does business in English.
    And does it well.
Contempt of Court is the Crime of offending the Authority or Dignity of the Court.
Like Police Officers , Magistrates and Judges are expected to be able to to resist the Sting of Insults directed at them.
So it is not necessarily Contempt of Court .to swear at a member of the Judiciary.
The Test is whether the Conduct had a Tendency to reduce the Authority of the Court.
Or Interfere with the orderly and proper Administration of Justice.
It is a Common Law Offence that can result in a Prison Sentence.
Venerable Ganasara Thero only used the words Pakaya and Ponnaya which are common day to day terms in our Dalit Dialect of the poor Sinhala Buddhist people…
Ant wasn’t t even directly ,directed at the Magistrates in the Court Room.
    Besides,
Are they really serious Swear Words, that has the Tendency to reduce the Authority of the Court and Interfere with the orderly and proper administration of Justice?.
And the poor Thero got shafted to the tune of 19 years of Rigorous Imprisonment .
One has to Shoot a Cop or a Magistrate to get that sort of punishment in that Nation…
Pity poor Venerable Ganasasara couldn’t hire a Gun Lawyer Like the Vellala Kid from Kurunduwatta who accompanied the Junior Comedy Minister of the UNP Rajana Ramanayaka…,…

      KAS
Even after discussing the case for two days you have not been able to grasp the underlining factors which gave rise to the charges, hope this will help.

“Civil contempt often involves the failure of someone to comply with a court order. Judges use civil contempt sanctions to coerce such a person into complying with a court order the person has violated.
Criminal contempt charges, on the other hand are punitive, meaning they serve to deter future acts of contempt by punishing the offender no matter what happens in the underlying proceeding. Someone incarcerated for criminal contempt cannot secure their own release by deciding to comply with the court.
Judges use different factors when deciding whether to hold someone in civil or criminal contempt, including the nature of the underlying court proceeding (criminal or civil) and the severity of the contemnor’s behavior.
      Criminal Contempt Charges
Criminal contempt charges become separate charges from the underlying case. Unlike civil contempt sanctions, criminal contempt charges may live on after resolution of the underlying case.
One charged with criminal contempt generally gets the constitutional rights guaranteed to criminal defendants, including the right to counsel, right to put on a defense, and the right to a jury trial in certain cases. Charges of criminal contempt must be proven beyond a reasonable doubt.
However, incarceration for contempt may begin immediately, before the contempt charge is adjudicated and the sentence decided. Depending on the jurisdiction and the case, the same judge who decided to charge a person with contempt may end up presiding over the contempt proceedings. Criminal contempt can bring punishment including jail time and/or a fine.”

        Berty,
Where ever you are , you must be in a seriously legalistic country, where Judges take this Swearing really seriously.
As I understand ,one Assistant Solicitor General, Two Magistrates and a few jail Guards in the Black Maria dobbed the Thero in.
Unless they heard the Venerable Thero threatening to blow the heads off of the magistrates, , calling them Pakiyas or Ponniahs is not Criminal
        Is it?.
Any way thanks for the heavy Legal Essay on Contempt.
Based on your legal opinion, the UNP Junior Minister with the funny mouth is in big big shit…
        Isn’t he?…
Wonder what this Yahapalana Appeal judges give him?..
Because unlike the Venerable Monk, the “Acting” Junior minister threw a tantrum and punched the wall of the Court Room too, according to the Media Dudes.
But then Ranjan has the best Legal Brain in Colombo standing next to him.
i don’t think even those Appellate Judges will want to take on the Vellala kid Abraham in Court…

      KAS,
Courts of Law in many countries are different from courts in many third world countries..
All are seated on the same level, except the judge who sits on a platform raised one foot above.
The accused and defendants are seated with/next to their lawyers.
Anyone using unparliamentary language is/are cautioned by the judge, and removed if the offence is repeated.
The public who are seated are liable to be removed for any disturbance caused.
Lawyers who have no connection with cases being heard are not present.
Our Lankan courts are a places of noisy behaviour by lawyers & clients.

An eye opener to judicial community?

It seems to be a valid argument but how can a disciplined community, especially the Buddhist monk community bear up when a member goes to such low language to reveal even a truth?

Why can’t he be punished by the/a monks code of discipline (sangadhikaranaya); which seems to pivotal to maintain the standard of Mahasangha & thus enhance the dignity of the whole population?

Dear apologist and well wishers of Ganasara including Wanni,Chamba, Hela…….etc. Just see the news. A monk was brought back from U.S where he was evading, to Thailand to serve a sentence more than 100 years, Ganasara of course is admitted to a hospital with life threatening disease???(with the help of politicians) and a group of monks have released a statement warning the govt to release Ganasara. They have mentioned ” do not try to achieve what westerners failed?????”, you really do not understand the fury and wrath of the monks and if we decide to go out in the streets there will be carnage” Now readers can understand why Thailand is today not in the same situation as Lanka. They too have two party system with interference from military off and on for years. But still they are much better off than our retarded Lankans.

His b***s carriers (max, soma, Hela, ….. Cjhampa, …) claim he has been fighting for the rights of Sinhala/Buddhists especially against Muslims. He is clad in saffron and rages all the time. These qualities alone more than enough for him to qualify as “spiritual leader”.

There is a good chance of him being appointed the Chief of Moral Police if the National Hang Man is elected the president of this island which means you will have to obtain permission from him if and when you want to make love to your partner, wife or your mistress.

next to doctor/ spokesman Senaratnae it is Jim who seems to know the nitty – gritty details (including medical history) of Ganasara. Buddy time to provide your services and counseling (if not ask your therapist or psychiatrist) to Ganasara on PTSD ( witnessing innocent victims suffer in his hands), Phobia (mostly non Buddhist) , Anxiety ( like politicians for power, wealth, fame) , OCD (obsession for crimes and compulsive law breaking) , Adjustment disorder (though an adult some times behaving very childish like backyard school bully) and then there is personality issues and possible social/performance/ separation anxiety issues which is too long to discuss. Good Luck.

Ddon’t know why so much Euphoria because this Monk got shafted by the Yahapalan Appellate.
Venerable GananasaraThero lost his clout as soon as Dr Ranil came to power, although the Thero was part of the Winning Team.
    That is another story.
Ambassador Kessup, who is originally from Hindia said the other day, that the US will not allow the JO to come to Power in Lankaw.
As the Current Government has a lot of unfinished Business..
He was addressing the hierarchy of the UNP at a private function in Colombo , our future Port City..
    That is a serious statement..
Not one like the Thero calling a couple of Yahapalana Magistarates Ps & Ps..
I read about it in a Lanka Web Page which is a 24/7 credible new service ..
If it is true, the Yahapalana suckers and supporters have nothing to worry.
