Sri Jayewardenepura Hospital A Safe Haven For Criminals Like Gnanasara

Against a backdrop of the dangerous tendency of people taking the law into their hands as evidenced by the violence at the Fort Railway station, the abysmal levels to which respect for rules and regulations has sunk is also evident by General Secretary of the Bodu Bala Sena (BBS) Galagoda Atte Gnanasara, sentenced to 19 years of rigorous imprisonment on four Contempt of Court charges over an incident that took place on January 25, 2016, being admitted to the Sri Jayewardenepura General Hospital (SJGH). The determination was on a case filed by the Attorney General against Gnanasara following a petition submitted to the Appeals Court by the Former Homagama Magistrate and current Colombo Chief Magistrate Ranga Dissanayake.

It has now become expected practice for politicians, high ranking officials and common criminals enjoying political patronage to get themselves admitted to hospital to avoid the inevitable discomfiture of a prison sentence. Gnanasara went a step further, getting himself admitted in advance to the infamous SJGH, currently headed by a quasi-Director, Dr. Susitha Senaratne, himself suspended from its Board by the courts.

In an interview with Derana TV Senaratne brazenly violated the ethical code with respect to patient confidentiality, revealing the type, size and location of a kidney stone and revealing the presence of blood in Gnanasara’s urine. As a registered medical practitioner it is unethical for him to do so. Moreover it is a serious come down in professionalism, given the important administrative post he holds.

Senaratne, who is not academically and professionally qualified to be the Director of a General Hospital, is an acolyte of Rajitha Senaratne, Minister of Health. He appeared on Derana TV attempting to defend the provisional admission of Gnanasara and divulging the monk’s condition to buttress his justification.

It is now well known that Gnanasara has made a practice of provisional admission to hospitals while awaiting court verdicts as a precaution against imprisonment. The “Gnanasara Method” of mocking the judiciary would not be possible without the complicity of hospital administration and the medical professionals treating him.

Gnanasara has apparently been diagnosed as having a ‘staghorn calculus’ in one of his kidneys, which is a long standing pathology that takes prolonged periods of time to develop and is not usually considered a surgical emergency. However, its surgical removal can be warranted depending on the symptoms such as pain, dilation of the ureters and back pressure on the kidney. Ganansara has only described pain, a subjective symptom that can be attributed to the kidney stone.

It is reliably reported to Colombo Telegraph that the ‘surgery that was to be performed’ on Gnanasara was initially scheduled for the 10th of August. Senaratne has stated that the ‘supposed surgery’ is to be performed on Monday the 13th of August.

It is also reliably reported to Colombo Telegraph that Gnanasara, occupying the most expensive luxury paying room at SJGH, is fitted with cardiac monitors while awaiting surgery to give the impression to those who are encouraged to photograph him and ‘leak’ his ‘serious state’ to the public to create a wave of sympathy to push for a presidential pardon.

It is common medical knowledge that a patient in need of continuous cardiac monitoring in a critical stage would not be fit for planned surgery such as a staghorn calculus removal. Therefore the status report offered by Senaratne and the obvious complicity of the treating surgeon as well as the administration of SJGH amount to an administrative-political pantomime to avoid justice from taking its course.

The troika of Gnanasara – Kahandaliyanage – Senaratne are veritable masters at manipulating situations to mock the judiciary. Senaratne deliberately avoided commenting on the security measures that should be implemented when a convicted criminal is housed at a government institution stating “I think the security must have been implemented” .

Observers within the hospital opined that the expertise Athula Kahandaliyanage and Senaratne exhibit at making a mockery of the judiciary indeed makes SJGH the perfect safe haven for criminals to be protected by other criminals. Colombo Telegraph previously reported the administrative corruption and attempts at contempt of court engineered and executed by the Chairman and quasi Director of SJGH with regard to the illegal appointment of its current ‘director’.

      We perfectly know even tiny issue could be a major issue depending on the person’s specific physiological or healing potential.
      But just removing so called stones in kidney today can be made through a Laparoscopy so that the patient can go home within hours. I am from Europe and i know what I have been telling to you very well.

      So it can be possible, that the headlines being made supportive to this man in robes are just planned to help him this way since the man is convicted criminal.

      Having a cannula does not make some one very ill. When a patient admitted to a hospital, it is a common practice to insert a cannula in case, need of a intravenous antibiotics, or a saline or blood transfusion. Don’t even address as poor sod.     Doesn’t the Sri Lanka prison system have a medical facility? If we do why isn’t the prison taking custody of him and then transferring.
    This guy is occupying a bed that an actual patient could use. Which is morally not right and makes a joke of the justice system.

      Some go up when calling srilnaka as developing but we perfectly know how hosptials function even today, failing enough beds for even serious patients.

    Even that was based on an ” I will tell on You” like incident in our Primary Schools, which happened in the Magistrates Judges Premises .
    And not in the those High Court Judges Courts ….
    In other words an assistant Solicitor General and the Black Maria Drivers dobbed the Thero in…
    And the Venerable Thero got 19 years RI to to break Granite ..

      Yes it is and that is why the court did not have much choice. The court had to look at the charges brought by the AG’s office. Either they had to let him free as not guilty (which could not be done as the crime happened in front of a sitting judge) or find guilty and sentence accordingly.
      The courts did him a huge favor by declaring that the sentences on the four charges to be served concurrently reducing it from 19 to 6.

    Minister Rajitha Senaratne is behind this whole affair of protecting criminals keeping them at Sri Jayewardenepura Hospital. Even after Duminda Silva killed Bharatha, Duminda was kept at the same hospital with the help of Rajitha Senaratne and his wife who is a friend of the specialist lady doctor who looked after the criminal at this hospital..

      No this is not a big problemt today so that could harm him that much. However, their supproting men can abuse the situation, since the person is now convicted criminal. Stones being found in kidneys or in the duct connecting urethrus.. can easily be removed within hours.
      Of course if his healing potential is normal. If he is a diabetes patient, that can take longer than usual.

    This article mixes up so many issues. The administrative irregularities within SJGH is one thing. The admission of GG to it is yet another. The pinnacle of all this could be the Minister of Health. As indicated in the article, I too suspect that this is a prelude to a presidential pardon. Sri Lankan President can pardon a chap for an offence long before it really taken up in a court of law and that power was once exercised by President DB Wijetunge. I suspect that under these conditions GG might get a blanket pardon even for ones that “investigations” are going on.

This why I mentioned in a comment of the previous article that the news item that GG was given a hefty sentence is not that newsworthy and that any ruse to scuttle justice or any any impending attempt is definitely newsworthy. At the correct time GG is hospitalized and even doctors produce artifacts to show how serious is his illness. Where are we heading?

    He looks really ill. I hope he recovers and gets pardoned from the president, and comes out to preach peace among the communities – that is the best thing he can do to the country. If this monk dies of his illness or put behind bars for years, it is not going to reverse his past wrong-doings. Had the law and its enforcements taken care of his aggressive behaviour during the initial stages, damages could have been avoided and the monk too would not have to end up at this – His aggressive behavior was interpreted as heroism was not his mistake

    Time to change the system and outlaw anyone serving a prison sentence to be admitted to a private hospital.

    What a coward this clown monk is. He threatens publicly to kill vulnerable minorities and set fire to their property. He verbally assaults a woman seeking justice in a court of law. He abuses the magistrate in filthy language. But he doesn’t have the Cojones to accept accountability and face the legal consequences. He shits in his Siyura and dashes to a hospital for cover. The doctors should check if he actually has Cojones. Nothing is more damaging to Buddhism than monks who are both evil and cowardly. If the doctors’ reports about Gnanasara’s medical condition are not based on facts as implied in this article, it is indeed a clear case of contempt of court and obstruction of justice.     Though people have some respect for Rev. Gnanasara they have some disrespect as well for inappropriate way of communicating his message.

    Contempt of Court.
    Here is what I gathered from the Law Books of a A list Democracy, which does business in English.
    And does it well.
    Contempt of Court is the Crime of offending the Authority or Dignity of the Court.
    Like Police Officers , Magistrates and Judges are expected to be able to to resist the Sting of Insults directed at them.
    So it is not necessarily Contempt of Court .to swear at a member of the Judiciary.
    The Test is whether the Conduct had a Tendency to reduce the Authority of the Court.
    Or Interfere with the orderly and proper Administration of Justice.
    It is a Common Law Offence that can result in a Prison Sentence.
    Venerable Ganasara Thero only used the words Pakaya and Ponnaya which are common day to day terms in our Dalit Dialect of the poor Sinhala Buddhist people…

      Courts of Law in many countries are different from courts in many third world countries..
      All are seated on the same level, except the judge who sits on a platform raised one foot above.
      The accused and defendants are seated with/next to their lawyers.
      Anyone using unparliamentary language is/are cautioned by the judge, and removed if the offence is repeated.
      The public who are seated are liable to be removed for any disturbance caused.
      Lawyers who have no connection with cases being heard are not present.
      Our Lankan courts are a places of noisy behaviour by lawyers & clients.

A monk was brought back from U.S where he was evading, to Thailand to serve a sentence more than 100 years, Ganasara of course is admitted to a hospital with life threatening disease???(with the help of politicians) and a group of monks have released a statement warning the govt to release Ganasara. They have mentioned ” do not try to achieve what westerners failed?????”, you really do not understand the fury and wrath of the monks and if we decide to go out in the streets there will be carnage” Now readers can understand why Thailand is today not in the same situation as Lanka. They too have two party system with interference from military off and on for years. But still they are much better off than our retarded Lankans.

Buddy time to provide your services and counseling (if not ask your therapist or psychiatrist) to Ganasara on PTSD ( witnessing innocent victims suffer in his hands), Phobia (mostly non Buddhist) , Anxiety ( like politicians for power,wealth,fame) , OCD (obsession for crimes and compulsive law breaking) , Adjustment disorder (though an adult some times behaving very childish like backyard school bully) and then there is personality issues and possible social/performance/ separation anxiety issues which is too long to discuss.
