Sri Lanka’s Alleged War Criminal & Human Rights Violator Elevated To Field Marshal

General Gardihewa Sarath Chandralal Fonseka ( known as Sarath Fonseka) was elevated to the rank of Field Marshal by the President Maithripala Sirisena yesterday. He is the first Sri Lankan to be honoured with the highest rank in the Army.

“he was the Army Commander during the war and particularly during the last days and weeks of the war which ended in May 2009. Several independent reports, witnesses and evidences including the report by the UN Panel of Experts have alleged that international human rights and international humanitarian laws were breached during the war and in particular at the end of the war. It is alleged war crimes were committed. The man in charge of the army that’s accused of all these was General Fonseka.” Suren Surendiran, the spokesperson of the Global Tamil Forum told Colombo Telegraph.

Fonseka joined the Sri Lanka Army in 1970 and served as the Commander of the Army from 6 December 2005 – 15 July 2009. As commander, he oversaw the final phase of the Sri Lankan Civil War, which resulted in the total defeat of the militant Liberation Tigers of Tamil Eelam organisation. He also survived an assassination attempt when an LTTE suicide bomber attacked his motorcade in April 2006. Following the end of the war Fonseka was promoted to a four star rank in the Sri Lanka Army, becoming the first serving officer to hold a four star rank.

In November 2009, Fonseka formally announced his candidature in the 2010 Sri Lankan Presidential Election. Following his election defeat, Fonseka was arrested on 8 February 2010, and the government announced he will be court-martialed for committing “military offences.” He was found guilty of corrupt military supply deals and sentenced to three years in prison. After serving more than 2 years in prison, Fonseka was released on 21 May 2012. As per the pre-election statement, President Maithripala Sirisena, gave him the Complete Presidential Pardon and acquitted him of all the charges against him on the 22nd of January 2015, restoring his Civic Rights.

According to a leaked US diplomatic cable, the US government had once cancelled Fonseka’s invitation to attend a Chief of Defense conference in Hawaii due to U.S. concerns about his involvement in human-rights violations during the conflict with the LTTE.

He was also accused of attacking and killing many journalists during his tenure as the Commander.

¶1. (C) On November 2, Foreign Minister Bogollagama called in
Ambassador regarding reports that the U.S. Department of
Homeland Security had requested that Sri Lankan Chief of
Defense (CHOD) Sarath Fonseka come in for a “voluntary”
interview with the U.S. Immigration and Customs Enforcement
office in Oklahoma City on November 4. (NOTE: Fonseka is a
Legal Permanent Resident (LPR) in the United States and has
family and property in Oklahoma. He currently is in the U.S.
visiting family and re-establishing his LPR status. END
NOTE.) Bogollagama said the interview was a matter of
“urgency and relevance” to the government of Sri Lanka (GSL)
and asked for information to “help us understand and
formulate a proper reaction.”
¶2. (C) Ambassador recounted recent developments regarding
Fonseka, including cancellation of his invitation to attend
the recent Chiefs of Defense conference in Hawaii due to U.S.
concerns about his involvement in human-rights violations
during the conflict with the LTTE. She also explained that
as a green-card holder, Fonseka was required by U.S. law to
confirm his status as an LPR. But as regards the DHS request
to see Fonseka on November 4, Ambassador said she did not
know the specific reason for the invitation.

¶3. (C) Bogollagama said what concerned the GSL were reports
that a DHS lawyer had allegedly told Fonseka that the purpose
of the interview was to gather information about the possible
involvement in war crimes of SL Defense Secretary (and
president’s brother and U.S. citizen) Gotabhaya Rajapaksa.
He said the GSL was very concerned about using Fonseka as a
source for “prying” into the actions of the government in Sri
Lanka and was seeking “immediate action” to prevent anything
further from happening on November 4. He claimed that their
sources (presumably the law firm Patton Boggs, which embassy
understands has been hired to represent the GSL) told them
that DHS had investigated war crimes in the past.
Bogollagama said any questioning of Fonseka about SL
“official” information would be frowned upon by the GSL and
“could seriously impact our relationship.”

¶4. (C) Bogollagama passed to Ambassador an Aide Memoire,
which noted that allegations against the defense secretary
affected the vital interests of the GSL and had already
occupied considerable time and attention of both governments
at the highest levels. It noted that the SL president had
formed a panel to consider the matters raised in the U.S.
Report to Congress on Incidents During the Recent Conflict in
Sri Lanka and claimed that any information Fonseka had gained
in performance of his official duties had the status of
“privileged information.” It closed with a request to the
U.S. State Department to inform DHS that “there is every
reason for the interview proposed for the 4th November 2009,
to not take place,” and noted the GSL’s view that DHS “should
forthwith desist from any endeavor in this direction.”

¶5. (C) We do not know how much of the story about DHS’s
request to interview Fonseka is real and how much may have
been fabricated by Fonseka himself to score points against
the Rajapaksas. Whatever the reality, the prospect of U.S.
officials questioning Fonseka regarding Gotabhaya Rajapaksa’s
actions during the conflict clearly is of great concern in
Colombo and puts the leadership in a tight spot. While the
Rajapaksas are keen on eliminating or neutralizing Fonseka as

a potential presidential candidate, who could split the
Singhalese vote, they do not have an interest in him being
pressured as a war crimes accomplice, who might be willing to
provide testimony against the Rajapaksas. They would like to
see Fonseka go quietly into retirement as a war hero who time
has passed, but the general appears to have other plans. END

¶6. (SBU) BEGIN TEXT OF AIDE MEMOIRE (grammatical and other
irregularities are preserved from the original):

The assistance of the US State Department is sought
concerning an unwelcome intervention by the US Department of
Homeland Security (DHS), in a matter of grave concern, that
has the potential to complicate the existing dialogue between
the friendly Governments of Sri Lanka and of the United
States.

The Government of Sri Lanka is informed that Sri Lanka’s
Chief of Defence Staff General Sarath Fonseka who at present
is in the United States, has received a letter calling him
for an interview with the DHS Immigration and Customs
Enforcement on Wednesday, November 04, 2009 at 3:00 p.m. in
Oklahoma City, Oklahoma.

In addition, on the 28th of October, General Fonseka had
received a telephone call from a DHS Attorney to the effect
that the intention behind the request for the interview is to
use him “as a source against human rights violations done by
Secretary/Defence”. It had been clarified during the
telephone conversation that the reference to
“Secretary/Defence” relates to Mr. Gotabaya Rajapaksa, the
Secretary of the Ministry of Defence, Public Security, Law
and Order of Sri Lanka.

It is pertinent to recall in this regard that Mr. Gotabaya
Rajapaksa’s duties as Secretary of that Ministry required his
dealing with a situation of a grave onslaught that threatened
the integrity of Sri Lanka and which was launched by the
LTTE, an organization proscribed by several countries
including the United States, for its terrorist activities.
The allegations therefore leveled against the Sri Lankan
Defence Secretary affect the vital interests of the
Government of Sri Lanka and have occupied considerable time
and attention of the respective Governments, at the highest
levels. In fact, the US Ambassador in Colombo has already
been briefed of the decision taken by the President of Sri
Lanka to appoint a Panel to consider the matters raised in
the US Department of State 2009 Report to Congress on
Incidents During the Recent Conflict in Sri Lanka. This
decision by the President stems from Sri Lanka’s unbroken
commitment as a democratic nation to the Rule of Law, under
which allegations are first assessed as to whether they
possess any substance meriting further inquiry.

The Chief of Defence Staff is a high level position within
the Sri Lanka Government. General Fonseka is on an official
visit on behalf of the Government of Sri Lanka. He traveled
to the United States on a diplomatic passport for prearranged
appointments with senior personalities of the State
Department and other US Government Agencies. Moreover,
whatever General Fonseka may have become aware of during his
service with the Government of Sri Lanka and in the course of
his duties, has the status of privileged information. He has
no authority to divulge or share this information with third
parties, without the prior approval and consent of the Sri
Lanka authorities.

Given the above, it is hereby requested for the US State
Department to inform the Department of Homeland Security that

November 2009, to not take place. The Government of Sri
Lanka is of the view that the Department of Homeland Security
should forthwith desist from any endeavor in this direction.

    Well I should say that FM Fonseka has done more to world peace than what the entire US Armed Forces have done in recent years, wrt eliminating terrorism. US does not want to end terrorism. It create terrorists, planting them here and there to play for their cause. Whereas FM SF not only eliminated the scourge of terrorism from Sri Lanka but also eliminated the creator and disseminator of human bombs to create havoc in Sri Lanka and everwhere else during the last 30-years. That itself is a remarkable achievement. Americans can only brag and talk (i.e. their trademark)and spread misinformation, yet they have not even scratched Al-Qaeda or IS despite their big talking generals and arsenal. What a shame that Butenis wrote this kind of crap. She should have learnt at least how to do a job properly. US is just a big joke when it comes to dealing with terrorists

      Sadly, wishing not to steal the thunder of our highest ranking military officer, there are a few, credible local charges that FM Fonseka never answered. To name a few, the misuse of the satellite phone at his disposal, his overriding of the Army Procurements to benefit his son-in-law’s company, the alleged mistreatments of the lower ranking females for his sexual gratifications and more. These are serious accusations for a Field Marshall to sweep under the carpet.

        Somebody with no idea how the processes works at high places has written this. Army Commanders or anyone at that level signs papers that were put to them by their very high ranking senior staff officers. It is the staff officers job to ensure business is done by the book and properly regulated, and that Commanders are properly covered. That’s what the senior staff offciers are paid to do, and not to attend to cocktails and get drunk or socialising, as lot of civilians think that what they do.

        For small sums of money, Commanders would not go through audit process themselves (it’s not their job), particularly at a time when issues of much larger magnitude are there to attend to, such as maneuvering strategies, how best to protect soldiers lives at the battle field and how to coordinate war strategies with other services commanders. Don’t forget SF was shown at war operations centre close to front line every week during the war, and it showed where this man’s focus was. Had it been a collosal amount like that of a MIG-29 purchase, there would have been different ways of doing such audits.

        In this particular case, if somebody has not done the home work and not notified the Commander ina timely fashion, then the fault lay there. Ofc the Commander would ultimately take the responsibility for their subordinates errors, that is what has happened here.

        That said, please note that under SF’s signature the Army has made a recommendation and even they might have provided substantiating reports. Where the suplliers identity was declared is a matter of detail, but it should have been provided. Usually, brokers names or minor directors of companies are not named. Naturally, if inappropriate business is suspected then it is up to the staff officers to investigate such matters and report.
        The actual purchase and the prior scrutinizing of the purchase as to where the supply comes from is the responsibility of MoD Procurerment Committees. If they failed to spot the connection to SF’s s-inl, as it was in this case, or if they have turned a blind eye to anything improper that they ought to have discovered, then it would have been the fault of MoD functionaries.
        It is common knowledge now, that the Chairman of the Procuring Committees was GR himself, and there was kind of company that he had formed to transact military purchases. Thus if anyone should have been prosecuted for this alleged misdemeanor, for approving an inappropriate business offer on the grounds of connections, then it should have been GR as he was the head of procurement.

        It so happened, that when the cards were down, GR and all the other people involved in this sad case (for the General) pretended to be clean, and they loaded all the accusations on the General, to discredit him as he was target of victimization by Rajapakshas. In effect, the real culprits got away scot free; and they became the accusers, prosecutors, judges and jury and the gaoler, all rolled into one.

        SF took his humiliation as a man, whereas all the sinners celebrated with Kiribath. At the end their bad Karma has returned to devastate them and their reputations, and whatever good name they had earned from the war efforts, they had gone down in the sewage drains; this is natural justice. See what happened to the accusers, and those who bore false witness, the humiliation that they and their families have received in the recent months. Their credibility is lost for ever.

        This is a real life example of what happens to those that dig graves for others. It’s a good lesson to be learnt, especially by our big, foul mothed politicians and crooks at high places.

          Bo, I admire your loyalty, but being in denial of documented criminal acts is not the answer. He must have done something right to have spent all his adult life in the Army and rise up in rank to the top. He did his contribution to win the war but so did several others, namely the Chiefs in the Navy, Air Force etc. You cannot blame the subordinates for the misdemeanours as the buck stops at his desk and he should answer. if he does not read what he signs then he is incompetent and surely not fit for his job.         What an ignorant man you are. Go and read the American Civil War, or the War between Royalists and Puritans in England, or the story of the Reformation years in England. These are supposed to be civilized people, killing their own kind because one group have taken arms against the State. Don’t try to be Dhobi whitewashing others dirt.
        It is their own kind they have been sending to Vietnam or Gulf or Afghanistan in recent times, to be killed and maimed and to disseminate death to people that rightfully live in their own countries. Have you not heard of what happened in the deep south in the more recent past and even currently black and under privileged people are always facing the guns of the state. Rulers that treat their own people for their personal gain and projection of power are dastardly.

    In 1974 Prabarkan assassinated Alfred Duriapapah. 35 years later after much bloodshed Prabarkan himself is killed.

    The govt of the day established a commission headed by a legal luminary of an European extraction – Justice Sansoni to investigate and report on the causes of the violence.

    The Commission reveals information on a series of assassinations, bank robberies and arson attacks starting 1972. It directly connects the responsibility for the violence on TULF and the Tamils.

    So these Tamils started the war crimes assisted by India. After 35 years of numerous attempts to stop Tamils from creating and spreading violence its forcefully ended.

    Last year the UNCHR was like Rat infestation full of Tamils. What do they want? Accountability for the last 5 mins of violence that lasted 35 years.

    So forget accountability how the[Edited out] Demala started it all and escalated . They want the killer of Prabarkaan punished.

    Is it only me that finds something really wrong how these Tamils think and operate?

        What I understood from listening to his comment that it was a general threat to his opponents.

        He must have known what went on there. Had he disclosed everything that he knew he would have incriminated himself as well as many in the armed forces.

        I am not sure punishment would serve any purpose. Let him confess to what he knew and what he did or didn’t do during his career including 1987-91.

    The ill-educated Fonseka suffers an incurable history of super-ego. Charges of individual and mass killings against him are numerous, including the charge of being behind the killing of a very young Tamil boy. His quid pro quo with the Sirisena regime, inter alia, was to be elevated to this post. He is virtually dying to be the first Field Marshall in the country. But is he not aware this title really goes to those countries that have armies going into the millions. It is time someone reminded him Idi Amin, who eventually became a laughing stock throughout the world, too idiotically decorated himself with all sorts of military titles.

    It is not his vain personal glory Fonseka should concentrate on but how to pull the country out of the rut his former friends have inflicted on the entire country. This he can do, if wisely done, through the medium of his so-called political party.

    As to the dignity and public acceptance of this monstrous comedy, the fact that most heads of diplomatic missions invited for the function openly chose to ignore the event should pump sense into this brute of an uncultured man he is being absolutely silly. Whether he likes it, accepts it or not he remains accused of serious HR and War Crimes.

The euphemism for civilian deaths.

Ranil and Sirisena both did not want Fonseka to become an MP replacing Katagoda and hence bribed Fonseka with the field marshal post. Further, Sirisena has bribed 26 SLFP corrupt politicians with cabinet and non-cabinet positions. Is Sirisena a man of Priciples? Big NO!. People doubt about his sincerity now. Sri Lankans are the most unfortunate people in this world to have such leaders. Sirisena also seems to have a very serious inferiority complex that people have found out from his recent utterances about his meetings with the Queen and the British PM. This is not a good sign for a leader of a country.

    Just like any other war any where else in the world, the war in Sri Lanka too resulted in death of civilians. It is the stupidity of Mahinda and his egoistic brother Gora who said there was zero civilian casualties which gave room for the west to bash Sri Lank on civilian deaths. We all know he was a dumb ass (still he is).

    The country was faced with a do or die situation, the ruthless LTTE had to be defeated. It was the environment created by war which allowed the elements in military to carry out human rights violations not only in the north and the east but across the country. In order for the peace to return the war has to be ended. Only way to end the war was to defeat ruthless Prabakaran led LTTE which was fighting for nothing less than separatism.

    In the process civilians did die. There is no denying that fact. How many civilians died is debatable it needs to be investigated and records must be set right. This should have been done immediately after 2009 but we had a leader who more interested in robbing the country and basking on the glory.

    The leadership provided by them Gen. S Fonseka was instrumental in ending the war. The man himself has said that he is ready to assists in any investigation. It is a cowardly act to brand the commander of Army a war criminal who has ended a terrorism from a country through a legitimate military offensive, 1st time in the world maybe only time in the world.

    The killing has stopped peace has returned which is what all of us yearned for 3 decades. The solution to lasting peace must be found which is why we voted the ass out of business.

    The west distort the facts to suite their own agenda. While they use fancy words to justify all the atrocities committed which has resulted in millions of deaths as a result of their actions across the world from Asia to middle east and the chaos prevailing now in the middle east as a result of their political agendas.

    We have to give credit to MR for standing up to the bullies and giving political leadership to end the war. that same ego is what made him to be defeated in the election as he was not able to envisage the needs of the people.

    Sarah Fonseka must be given due respect. He is not a war criminal, we have to commend the current government for bestowing him with the Field Marshal rank. It is a small victory for him for all the injustice he has to endure in the hands of jack ass MR.

        Solution to the national problem was not to divide the country and allow 1/3 of and land mass and nearly 1/2 the coastal belt to be ceded to VP.

        I agree there was a problem which was a result of marginalization since independence. But one should not forget there was marginalization prior to independence too.

        We did not have leaders who were visionary, I think we are yet to have truly a visionary leader. However with what we have to work with a solution may be found with some pressure from the concerned 3rd parties. At least we have the 2 sides talking to each other now.

        I would solely put the escalation of grievances of Tamils to violent conflict in the hands of India, 1st they created Tamil separatist movement then when we had the opportunity to end it before escalating in to such high’s they prevented us from doing it by dropping dhal and forcing JRJ to sign a treaty which is not implemented yet as it was forced upon us. The Singhala majority did there best to keep the fire burning. We see that even today with former president there is a sizable majority who support that kind of approach. they are narrow minded self centered people. The challenge is to transform the mindset. There are lots of educated scholars who are doing a commendable task in doing this. The change in the stance of JHU is testament to this. It could take bit longer but it will happen. The communal minded lot will be cornered and their numbers will become a minority.

        Indians only assisted us when it became a problem for them, however we have to thank whole lot of nations other than India for ending the war including the very same west which changed their perspective on freedom fighters who they called as rebels till 2001. Do you hear the world “rebels” any more ? no it has been slowly phased out of the vocabulary of major news channels.

        At the end its all politics a small nations like ours cannot afford to be entangled in a meaningless conflict which neither side has any gains.
        War is over lets try to find solutions, let the crimes be investigated and a way forward be found.

        It is called Posttraumatic stress disorder (PTSD). I share your concern but we should not forget the other victims of PTSD. In the North and East there are many civilians, ex LTTE cadres and other combatants who suffer from PTSD. The soldiers were volunteers. In the North and East many had no choice.

        All the victims need help regardless of their background.

    Whether SF is a hero or a villain manifested by the peak and trough he has had to tread through this far- whether promotion or punishment afforded to him by his Sinhala leaders. One side places him at Zenith other puts him Nadir. The roller coaster ride really is a joke, because the promotion doesn’t seems not purely being judged based on merit but politics, as a person found being guilty and prisoned by Military Court, not only acquitted but elevated to a level that no one was to be before. If it is a promotion to please SF and make him put his political ambitions on hold, the current mob, nothing better than the previous, but seek achieve the same goal through moderate ways and means.

    On the other hand, although Tamils faced the brunt of his actions, when two alleged war criminals contested for Presidential election in 2010, they voted for SF. Maybe, he, as far as Tamils go was a lesser evil than MR. But, that didn’t help him with receiving more votes from majority. More crimes you do, better chance you have to win an election.       Probably VP had already promoted himself as the only Tamil Field Marshall ever to hold the military rank.

      His supporters believe he deserved much more than what Fonseka is decorated with as VP was the only one to command his own air force, navy, police, army, ….. courts, …… dead squad etc.

      What is the difference between Fonseka, VP and Idi Amin? Idi Amin too was/is a Field Marshal.

    FM.Fonseka led an army that defeated an internal rebel force,indeed terrorists bcz of the way they got about their business, of about 6 to 9 thousand force strength, which Fonseka did with the help of about 6 countries who armed the Sri Lanka army with heavy weapons viz planes,tanks,heavy machine guns etc etc. Whilst the rebels did not have tanks, planes etc,yet, from a military point of view, the rebels kept the SL army at bay for several years, fighting the army with weapons and tanks they captured from the SL Army, staging some spectacular and daring attacks in the process, a couple of times with light plans they themselves assembled to drop bombs on targets in Colombo! Needless to say the SL Army was indeed facing a very bad situation losing camps and ground. Then steps Gen.Fonseka into the scene,specially brought in from USA by his army colleague Gothabaya who considered Gen.Fonseka a good tactician and the rest is history!And what followed there after between friends is also history – bad history!!
    The question now is whether, in the light of all this, does Gen.Fonseka really deserve the FM ship for defeating a rebel force fighting a civil force??? Credit must go to him for defeating a rebel force which all the countless number
    of Brigadiers,Generals of all ranks ,who with the might of a well armed army could not do until Gen.Fonseka ,living in retirement in USA, did the job.Ergo
