Supreme Court Gives Historic Ruling: Unanimously Shoots Down Sirisena’s Unconstitutional Gazette To Dissolve Parliament

In a historic ruling, the seven-member judge bench of the Supreme Court, headed by Chief Justice Nalin Jayalath Perera, unanimously decided that President Maithripala Sirisena’s Gazette to dissolve Parliament is unconstitutional.

The verdict stated the President was not allowed to dissolve Parliament before four and a half years under the provisions of the 19th Amendment to the Constitution.

Chief Justice Nalin Perera also said that if President wants to dissolve Parliament before four and a half years there must be a resolution passed by 2/3 majority in Parliament

Justice Sisira de Abrew presented different reasons for the decision but made the same judgement, making it a unanimous decision.

Although the proceedings were scheduled to begin at 4 PM, the judges took their seats at 4.55 PM to deliver the judgement and delivered the judgement immediately.

“We trust that the President will promptly respect the judgment of the courts. The legislature, judiciary, and the executive are equally important pillars of a democracy and the checks and balances that they provide are crucial to ensuring the sovereignty of its citizens,” UNP Leader Ranil Wickremesinghe said, after the ruling.

      Dear esteemed Supreme Court,

      Thank you for considering all the evidence, readon and constitutional law in arriving at your historical decision against the First Contitutional coup against the parliament elected by 100 percent of the people of the republic, by the insane president precinctly predicted by the late Dr. N M Perera in 1978, during the constitutional debate on the Executive Presidency.

      Can you also rule that the President Sirisena is insane, and is a danger to the Democratic Socialist Republic of Sri Lanka?

      Thanks god, it became the reality. Not just we but olevel going school children did not expect any other vedict in this regard since one question among the multiple choice question on the subject had been ” that parliament in today context can only be dissolved in 4.5 years since the govt came into being”
      Now we are evident that, so called political veteran about lanken politics, none other than the man by name, GAMARALAGE SIRISENA as the ruling president with over 51 year lanken style politics, and him being the one to have led the 19th Amendment to current constitution, being passed by 220/225 seated parliment to have violated it basically.
      How come the kind of acts being brought to reality, if the person’s mind set is not connected with any pathological changes ?
      Latter is the next to be heard in the court in next days, since a petitioner has made a case assuming that our president should be mentally sick. Not just one mistake but him to follow one behind the others, even if his ABUSIVE advisers may have misled him…. to end up this way is beyond all RESPECT.

      Does anyone in the country – one single person in 22 mio would have the same respect to this man if they are health minded ? answer is no.

        It will be interesting to pose the question to the 5th graders in Sri Lanka, and see, what their answers will be Given, the correct information, they all will most likely, get it right, especially reading the 19A Perhaps, the so-called ‘doctors” , ‘intellectuals’, Laksiri, Fernando, Dayan Jayatillaka and GL Peiris, should take tuition classes from the 5th graders

        Dear Laksiri,
        I don’t think that accepting the verdict is not enough. You should accept that you backed a political coup by a group of criminals who wanted to capture the power illegally. By supporting this illegal group you proved that you support bribing and racism. I am defending Ranil’s government but I don’t agree that Ranil should be replaced with a man whose hands are in blood.

        If you used common sense and reason, from the very beginning, instead of being distracted by the bull shit from Sirisena, Mahinda and “Drs” Dynan and GL Peris, you could have come to the same conclusion as the Supreme court, as many have arrived at, before the Supreme court verdict.

        The data supports the Heliocentric model of the planetary system

      It is a very opportune time for the majority to take the responsibility to massively reform campaign financing and oversight responsibilities, especially in the backdrop of the bribery issues and the altitudes to which they sky-rocketed as we saw (and the President himself exposed) in the last few weeks! It reflects how lucrative and money grabbing the politicians have become, and how much of wealth the previous regime has hoarded and have available for these nefarious “investments” towards future expected gains, if only they could grab power again, by hook or by crook.
      .
      Oversight and campaign finance reforms are not just critical, but they are also bi-partisan and non-racial issues that can be handled quite well in an unbiased, transparent way. If the majority among the majority miss this opportunity to very firmly act on this NOW, and instead let the politicians, predominantly extremist, rogue and racial rascals, call the shots again unrestrained, there will be no purpose in crying over spilt milk after the next election, whenever that may come.

      As I mentioned elsewhere “ there is no education in the second kick by a donkey”! If you guys didn’t learn after the first round of Rajapakse governance, we all face the reality of a second, third, and more kicks that we all then only deserve!

    I’m overwhelmed. All what I can say is, there is still some sense of fair play and justice left in the social fabric of this country. The judiciary, thanks to the democratic reforms introduced after Jan 8, 2015, has not let the ordinary citizens of this country down. Posterity will honour and respect the 7 judges for the landmark judgement.

      It is this kind of judicial clarity, independence and fairness that can give not only the fair minded Sinhalese, but also Tamils, Muslims and other minorities hope that a reformed Sri Lanka as a united country is possible, and that Tamils don’t have to hark back to their earlier maximal demands.

      But it requires more such decisions by the courts, not one isolated case–however historic it may be–for the judiciary to gain the trust of the minorities.

Though Tamil Lawyers put forward highly complex and complicated debate to corner and destroy completely without any trace of Udaya Gammanpila or Communist Pakaya Vasu or other members in that gang, practically there was no case. Constitution was violated just like that by EP hoping that Ranil would never go to court fearing him too being dragged there on other dimensions. CB looting was staged with promises of impunity to each other, though New King broke it. New King didn’t expect that TNA turning out to be such formidable defender of democracy. New King is disappoint when TNA not taking Ranil’s precedent but going ahead and setting precedent to Ranil.
    Leader Pirapaharan sent back IPKF and thus Lankawe Sinhala Buddhist Imperialism was saved. Now Sampanthar broke the back of Royalties and once more the Sinhala Buddhist Imperialism is saved. Ranil’s Impunity to political criminals will again spread its wing and show the light of justice to Lankawe.

    After hearing of his dismal failure in front of Tamil lawyers, Udaya Gammanpila challenged to quit politics. Because he is a Sinhala Buddhist politician, we don’t believe in him honoring that challenge, but make it another Banda-Chelva pact.

    What a relief ! Thank you to the Judicial Bench that gave this ruling. Its a victory for the right thinking people of our Country and a slap in the face for those undemocratic scheming crooks. President Sirisena, now make good your threat, that if pushed to the wall you would resign and go back to Polonnaruwa and plough those neglected fields. We are all waiting to see you GO !

    Maybe you could make yourself useful in this way at least after taking Sri Lanka to the brink of catastrophe. Take your siblings with you as they would also need employment, and possibly some of your unlawful, unconstitutional , cabinet, led by MR. You had your day, and so did your family and some of those aging hangers on like GL.etc.

    Another aspect that we should not forget is the shameless actions of the Attorney General. First, he declined to give his opinion to the Hon speaker. Next, he shamelessly defended the President without any legal basis. He should be called before the Parliament and asked to explain himself.

    This is a serious set back for ProfGLP. Truth to tell, he was under pressure for sometime to get the Great Liberator back in the saddle. His advice has fallen flat.
    The golden rule is that Professors may Profess, but it is the Judges who Judge.

    Sirisena will wait for judgement from other two cases, one stopping Mahinda as Prime Minister & other challenging the sacking of Ranil as PM. After all, he can now say that Since Mahinda is not yet “Legally” removed as PM, he will await the judgement till Jan 2019 !

    He can go on as “One Man” Government & after all, he has nothing to lose when he will be merrily eating Hoppers day in & out & will Enjoy New year 2019 somewhere in Europe.

    But for Srilankans, Happy New year 2019 is gonna never born !!!

    Where all our Professor and (S)Ex CJ have gone after the judgement, their tails tucked in between the legs?
    MS has become a bad egg among all the politicians and through his blunder, the country will have to suffer a lot for quite for some time and it may take years to put the things back to normal. Only benefit he has done to the country is educating the people on 19th amendment to the constitution and also has given a push to clip other wings of the presidency.

    My anxiety since oct:26th Oct:2018 came to an this evening around 5pm.
    Hats off to the Supreme Court for their unanimous verdict. Thousands nay millions of Srilankans irrespective of race,religion and caste have justifiable reason to celebrate.

    But, there is A BIG BUT! MaRa and his cabal must be having something up their sleeve.For them its DO OR DIE!
    Sirisena may now declare I respect the SC. verdict BUT….
    The people will revolt if he tries his usual game!

    What is this Prof GL Pieris who is supposed to be an expert and written many books cannot give a correct prediction which even the street vendor who was NOT educated beyond grade 8 was able to tell me correctly what the outcome will be.

    This needs only common sense and obviously the answer is NOT in the text book which GL Pieris was spending sleepless nights searching every page in all the law books he had. Even after burning the midnight oil for so many days he got it wrong! When people on the street like my pavement hawker selling fruits told correctly the outcome with reasons. This hawker I think is more suitable to have sat on GL Pieris’s chair when GLP would have been selling fruits!!

    Thanks to this descision, now I can go once again with my head held high and say I am proud to be a Sri Lankan!!
