Take A Leaf From The American Playbook: Indict The Rajapaksas: Accountability, Accountability & Accountability

Forty one (41) pages; thirty seven criminal charges and one other conspirator, three basic elements of the indictment the Federal Grand Jury issued to Donald Trump, former President of the United States of America (USA). One time Commander-in-Chief of the Armed Forces of the USA; rightfully elected former President and the current front-runner of the Republican Party for nomination for Presidential Elections scheduled for November 3, 2024. A country of laws instead of mere men and women, America can hold her head high; her Constitution and its fundamental components intact not only in written words but also in action. 

There are more ways than one the indictment of Trump could be viewed. Firstly, it could be interpreted as a sad day for the country and her people, for their Commander-in-Chief is under federal criminal indictment is no trivial matter. Whichever way Trump is trying to make it a joke, it won’t hold any water. Especially when some charges have been made under the Espionage Act, retention of ‘top secret’ or ‘classified’ documents pertaining to national security becomes a serious charge and if proven on the side of the prosecution, finding guilty as charged may not all that be out of the question.

Nevertheless, Donald Trump aside, as we are not discussing the pros and cons of the case that is now before the Florida jurisdiction in the USA. What is cause for celebration is not the indictment of one of the worst leaders that the world had to live with as he was rightfully elected in terms of the electoral collage system America. Americans and the rest of the world were condemned to witness the Trump Presidency in the last decade, but the fact that holding him accountable before the law is a matter for celebration. Donald Trump remains twice impeached and to date twice indicted. His past business dealings are still being talked about as immoral and unethical; before he became President, despite his numerous failings, he was not indicted nor found guilty by a court of law in America. The cruelest irony that visited him in the most bizarre fashion is that he had to become President of the USA to be indicted before a federal court and the indictment is directly related to the way, shape and form in which he (mis)governed his country.

The substance of governance, core elements of corruption, unforgivable extent of nepotism and glaring incompetence in the overall management of state affairs have all unclothed a system of governance which the people at large would not put up with in the short-run. In a democracy, where the leaders of government are elected periodically, voters hardly wait for the next election to oust the incumbent. In addition to the idiosyncratic conduct of the leaders, the other most important factor that goes into the very nucleus of the decision making process of the people is the prevailing economic condition. Most of the Presidents, Prime Ministers and other members of the Cabinet of Ministers invariably get thrown out. The voter’s vengeance is beyond control and could be ruthless.  

This sociopolitical progress has been proven very persistent in every democracy where elections are the only manner in which government leaders are elected and rejected, whichever the case may be. But what sustains the longevity of a state without a calamitous collapse of society in question is the sustainability of institutional arrangements provided for by each country’s constitution and a strong and unwavering judiciary. In fact, of all three pillars of government, the Executive, the Legislature and the Judiciary, the Judiciary becomes the most pivotal and decisive pillar in that whether the Executive of the Legislature goes astray, such deviation and desecration committed by either the Executive or the Legislature could be checked and balanced in favor of justice and fair-play by a strong and intrinsically robust Judiciary. Yet if and when the people’s trust and confidence in the status quo is fractured and found to be demanding alternate measures, the stoicism, wisdom and psychological stature of the leaders come to assume a unique and unquestionable character.    

The institutional infrastructure and quality of leadership in the two countries we are discussing here are really not comparable. Yet a fundamental similarity is present. That similarity resides in the crisis in Sri Lanka and near-crisis state in America. Whereas in America, the institutional infrastructure is so powerful and built to withstand any and all conceivable dangers, Sri Lanka is decades, if not centuries, behind a powerful and rich economy like the United States of America. 

Donald trump lasted one term- just four years- but is threatening to repeat his remarkable election in 2016. By entering into politics via the Republican Party, Trump has single-handedly manged to drive the it to the right-wing fringes. The dog-whistles he used in order to get elected by hurling every insult possible in respect of the grave immigration issue, concocting a slogan such as ‘make America great again’, he appealed to the base instincts of White America. Promising to build a  wall along the southern border, getting Mexico to pay for it and mishandling of classified documents bordering on treasonous demeanor for a leader of a country, Trump succeeded in condemning the Republican Party and its traditional and well respected conservative leadership into ignominy. Whether the Party would renominate him for President and whether they would elect him again as President is a another issue. After refusing to accept the results of elections, He attempted to cause irreparable damage to America’s democratic institutions by galvanizing his own cohorts to an uprising on January 6, 2021; his efforts were thwarted and the American political and social infrastructure endured that bizarre and despicable attempts.

Therein lies the difference. Sri Lanka simply does not have within itself such strong and steadfast social and political infrastructure that could sustain her democratic ways of life and governance. Furthermore, America is armed with the necessary constitutional infrastructure to withstand a maddeningly corrosive inroad caused by a fellow like Trump. He was not only impeached twice; he was indicted twice too. To criminally indict an former President in a federal court is unthinkable in the Third World. But it did happen in America. Trump being indicted twice speaks volumes for her accountability when confronted by unprecedented events such as Trump’s meddling with classified documents and his propensities to engineer riots and insurrections that fundamentally challenge the very foundation of the American Constitution- democracy.

When the Rajapaksas were defeated in 2015, the basic pledge that the then Opposition placed before the people was accountability of the Rajapaksas in respect of the plausibly provable allegations of corruption. They ruled for four years from 2015 to 2019; the Rajapaksas became more powerful than ever so much so that a younger brother, Gotabaya Rajapaksa became President by a very decisive margin at the elections.

President’s powers were enhanced by way of the infamous Twentieth Amendment. Gotabaya became a virtual dictator and instead of ruling a country through democratic means, he began governing the country by way of decrees. Every possible bad decision and every possible imprudent policy was introduced and executed. Corruption in the government machinery became much more entrenched and any avenue outside the Rajapaksa family-system was blocked, closed and prohibited.

Today the Rajapaksas are technically not in power; but for all purposes and reality, they still control the government’s switches. Why? Because there is no accountability. Accountability should not be demanded as a matter of extracting revenge. On the contrary, accountability is the most fundamental mechanism available for the average citizen in any civilization. 

The birth and short-lived Aragalaya in 2022 was a direct reaction and response to that breakdown in our civil system. One might argue that it was a protest against the unbearable hardships caused by the economic collapse; the economic collapse certainly accelerated the process but lack of accountability on the part of our rulers was the central cause. How can we right that wrong status? How can we be more comfortable in the enterprise of day-to-day living?

We have the legal and constitutional infrastructure to deal with such exigencies but the will on the part of our leaders is scarce and almost absent. 

Those who pledge a total reversal of the journey that Ceylon as a country and one people trod in the past seventy five years may rise to top of the election ladder. And if that is not likely to happen, all patriotic people must make it sure that it does happen. Temporary and superficial band-aid solutions such as IMF relief and availability of petrol, diesel and cooking gas is not going to be of any lasting measure. 

Once again, the purpose of prosecution of the Rajapaksas and his political cohorts  should not be treated as extracting revenge. If our leaders are to establish any modicum of transparency in governance, if they are to be trusted and taken into confidence by the people, it is incumbent upon all our current rulers to show that that they are credible and trustworthy. The moment the people lose their faith and trust in their leaders, anarchy and all other accompanying repercussions would follow and collective mayhem and chaos would be the ugly result.

It is rather difficult to rebuild that element of trust in our leaders once it is lost. But a genuine and sincere effort will always be welcome, it is a prerequisite in order to set a fresh beginning and it is still not too late. If our leaders are committed to doing the right thing there are only three goal-posts that they need to pursue: Accountability, Accountability, Accountability.

            Some nurture a romantic image of the Rajapaksas as being successors to the SWRDB-Sirimavo legacy of anti-imperialism. CBK tried the rhetoric before she contested the election in 1994 but slipped out of it pretty fast.
            The imagined ‘bond’ with China was circumstantial, with no ideological link. US pressure since 2009 pushed MR towards China for support.
            China does not care two hoots about anybody’s ideology as long as business is trouble free.

        1) It is USELESS as you suggest for Sri Lanka to “Take A Leaf” from any “Playbook” when we have a corrupt BASL (Bar Association of Sri Lanka) and CA Sri Lanka (Institute of Chartered Accountants). I state this with responsibility. Wrongdoers in politics, private sector and others have a FIELD day in this context. For want of space I will briefly give two egregious examples.
        .

        2) It is deplorable that the BASL is REFUSING to hold to account an attorney-at-law who has ‘Certified and Attested’ a shockingly FRAUDULENT ‘Power of Attorney’.
        .

        3) CONFLICT OF INTEREST which is a major cause of CORRUPTION is ingrained in the psyche of most Sri Lankans. An example is the Managing Partner of an audit firm being the Chairman of a state bank. He is a Past President of CA Sri Lanka. Another example is a ‘Partner’ of an AUDIT firm being the Vice Chairman of the Ceylon Chamber of Commerce. No one questions how an auditor could be INDEPENDENT when coalescing with business chambers.

        4) Those concerned in BASL and CA Sri Lanka know if they PRISE OPEN one unlawful case, it will lead to a tsunami of exposés.

          6) This is far from ground reality. It is evident that the US is demonstrating two sets of laws – one for Trump and another for the cognitively impaired and doddering Biden and his wayward son Hunter Biden. This is clear to any OBJECTIVE observer. Not for a moment am I saying that Trump is exemplary or faultless.

          7) Almost all the mainstream US media together with the US Department of Justice and FBI are covering up BIG time for Biden. For example, why is the federal indictment of Trump on classified documents SILENT on the ‘Presidential Records Act’? Why is there SILENCE on Biden taking classified documents when he was NOT President? These are examples of two sets of laws in the US.

                  Your inability to grasp any of the fundamental principles employed in any procedure followed, is eloquently present in every word you utter here. A man or woman taken to court and asked to witness under oath of a perceived crime one committed only if one is caught with material evidence. Crime is one, committing crime in court is another one. But Western law insists that the same level of crime be punished at the same level. In Langkang, as in the Sinhala folk story, a lean Tamil man is thrown to an elephant to tear in order to save a fat Sinhala Buddhist Politician from his crime. About five Tamils were white vanned & shot and their vehicles were stolen and burned by rowdy Hitler King’s gang in order to put their murder of Lasantha on unknown LTTE activists. We don’t have to waste time to create a dent in the way justice is implemented in the present world, to minimize the appearance of the crimes taking place in Langkang courts and police stations. (Ranjan Ramanayake is still under grip for once he tried to expose the Langkang courts jugglery. But the CJ, Buffoon De Silva who declared he falsified Old Rowdy King’s robberies is still free). Few days ago, a Tamil home aid was tortured and murdered in the police station, in front of witnesses.

                  These style crimes by the Sinhala Only Justice system are quite normal or rather everyday events. But life goes on for suffering Tamils. If you have watched nature movies, you can understand how life goes for people, if justice is denied in whatever world they live in. In those movies suddenly a violent lion or lions would appear from nowhere and chase all the peacefully grazing animals. They all would run in all directions in chaos, to save all their life. But one of them would be caught and it would cry death cries. Stopped by the painful sound, all others would stop running and turn and watch. Their eyes show that they were in pain by not knowing a way to save their loved one. But soon the animal’s cry will be silenced. Lions would move away with their cruel murder behind. The hungry animals start to graze back wherever they stop their stampede. In the West they give a chance to perpetrators to tell the truth and seek an acceptance in society back again. The West believes in the fairness and effectiveness of their justice system, so the criminal is allowed to say his/her version in the court as per his/her conscience. The worthiness of this procedure is very difficult to understand for Langkang chaffs. They only follow Kasiappa, Pilimatalawwe systems.

                  As you are a SLFP-Slap Party- EPDP acquainted person, the justice delivered world over appears to be at the same level of Langkang, fake. It is not your fault alone. That is the exact reason, when in the current sitting (53) of UNHRC, when Langkang rep proposed a Truth and Reconciliation Commission, the whole Tamil world unitedly opposed it. In the matter you know the truth, you are trying to oppose and by the same way on matters Tamils know better (for 75 years) than you, Tamils are opposing the procedure. The difference is you are standardizing the world with the truth you found out from SLFP-SLPP-EPDP. But Tamils go the opposite way; they insist that the more refined world justice system be used to deliver justice for them, but not the Langkang. It is only clownish that you cry that “Truth, the Whole Truth and Nothing but the Truth” is still employed in courts.

                  By showing your clownish attitude you are attempting to create a dent in the justice system employed world over but substantiate the Sinhala Jury Only system which uses double standard, one allowing the Sinhala Buddhist political elites to lie in the court and walk out while torture, rape and murder the weak Tamils inside the police station, in the 4th floor…… in the name extracting truth under PTA, CTA ATA, Emergency declaration like draconian acts. In your cruel-level heart, it appears the woman’s death in the police station is nothing but a plea deal to Hunter is injustice to the world and the world has darkened by that action. No one should be punished less because of his father’s status and the same way no one should be punished more because his father is a president. Father can be demanded to be more open to the public but not the son. On a day so many muggers in NYC subway get away even after the police arrest them. Then why not Hunter? It is difficult to comprehend for you because the culture you are part creating and enjoying, where a president’s son plants a 900 sovereign gold ring on his pet dick, publishes the photo proudly while Langkang’s average was falling on the feet of the world over for a meal. You cannot lower yourself to the truth.

                  There are many methods used in the Western world to have the truth depart in a humanistic way from the perceived. Then there the Langkang methods of torture, rape, killing to force innocents to become the sacrificial goats to save the Sinhala Buddhist government and Kandy Bald head bosses. Your conclusion is that Langkang methods are more modern to the one used in advanced democracies where ‘Truth, the Whole Truth and Nothing but the Truth’ are still in use. You sound like you never read the Kannagi story or read but couldn’t understand the fundamental lesson in that. Anyone can tell a lie and anybody commits a mistake depending on that, but human civilization is growing, studying the lessons from those epics, and all over the world deliverance of justice is also growing.
                  What I am trying to say is some people have hope on the doggy mischievous talks and when they see they are failing, they put up dramas that it was because they like the humor so much. Absolute fraud (lie) in each word.

          To me, SINHALA man or the like idiots are the real curse of this nation. My friends in SL(many of them are graduates) have spoken with a cross section of srilankens coming from all various walks last week and said, that people are not pro-JVP even if they are fond of some public stage presences of JVPrs. And they further said, it was the same JVP that lasted also earlier. People just enjoy their crowds, but when it goes to use the ballot, people dont vote for the murderers.
          Only alternative would be a conglomeration of good young politicians representing various thoughts of our people. Our people are far from JVP one sided principles.

        What these parasites want most is to restore their feudal status as landlords. “Hamuduruwo” means “master”, after all.
        Even in the case of the disputed temple, a monk is alleged to be offering illegally acquired land to tenant farmers.

        During Sajith time as Buddhasasana Minister he closed down around 146 vihares due to resource crunch. I am not suggesting that Vihares should be closed down on the contrary the old ones should be kept open, and send the saffronistas including Mahanayakes to meet people and beg for funds and stop Army and Saffronistas building new ones.

        The politicians are unable to feed the poor, Ella and his racist followers are on spending spree on brick and mortar.

            There was not any kind of Buddhist prayer places in Buddha’s time. He was Hindu until his Sammathi. He did nothing but revived the Dravidian Hinduism which was hijacked and corrupted by the invaded North Indian Aryans around 1000 BCE. Extremely very few Hindu sculptures are turning out in Indus Valley Civilization though many other buildings are there. This made some Western archeologist to believe that Dravidian had no religion at all. Few terracotta Pasupathi seals were found in the ruins of that civilization.     In Sri Lanka only if the Police and the Judiciary act according to the rules and laws of the land there will be any progress. Unfortunately, both these groups are inside the pockets of the politicians. The rules and laws applied by the Police and the Judiciary are biased. They are based on political connections, different punishments for different people for the same crime, and at times a leaner punishment is given if the person found guilty is politically connected. There should be an independent body with powers to prosecute Senior Police Officers and Judges whose decisions are independently reviewed after the decisions are made if found to have violated any rules or laws they should be brought before the Supreme Court and legal actions must be taken and their civic rights should be withdrawn. Only then this country will progress.

        In any country from time to time the constitution changes. However, it’s the Police and the Judiciary that follows and maintains the rule of law. Unfortunately, both these institutions have failed miserably. Take even the bribery and corruption cases filed against the Rajapaksa family by the former AG – the present Chief Justice, these cases are being withdrawn by the present AG. Either the present AG is a slave of Rajapaksas or the Chief Justice does not know his job and continues to sit as the CJ.. What a crap!.

What about prosecuting the vast numbers of diaspora who provided funds for the LTTE terrorists? Since monetarily-supporting ISIL/Taliban is – correctly – prosecuted as financing terrorism, then you’d better believe all those diaspora dollars should be traced back and those supporters taken to courts.

    For enlightening article that sheds light on how a civilised country should operate with US as an example.
    In Sri Lanka’s case however, there are few fundamental issues that are preventing our country from operating as it should.
    1. Unlike the American constitution, our constitution has not written to protect and empower the citizens.
    2. The justice system is still an extension of the colonial code that was written mainly to protect the colonial masters. It has been adopted to continue to serve the ruling class (who have been acting as neo-colonialists) since the so called independence.
    3. The military and the police too are continuing to operate in the same mode they operated under colonial rule. In other words they do not look upon citizens welfare and safety as their primary purpose, rather, they continue to protect the upper classes only.
    4. The divide and rule system introduced by the British is still in place, our leaders have continued to proliferate with even more vigor.
    5. Our people have also not bothered to change our mindset towards one another. We continue to operate as selfcentred individuals who don’t give a hoot about the next person.
    In a nutshell we are running our country in a highly primitive mode, much like we are living in a jungle where survival of the fittest is the order of the day.

            Nimal, this is just to share my own experience of living and working in the U.S for almost two decades.Though a citizen, for personal reasons I decided to relocate to India where I got my free education. (after being denied in Lanka). To me, there was never a sign (hope) of any colored person becoming a President in the U.S. But that changed with the entry of Obama and now we have Kamala as VP and Vivek as Republican candidate. Now we see the same in U.K too. Other than West, countries like India, Singapore, Malaysia . . . . . many others have had minority elected to highest positions. So, I will “never say never” (except for Lanka) a Black/ Afro American or any other colored person getting elected . On a personal note, I’m greatful to my adopted country for providing (and my family) not just unlimited opportunities but freedom,rights, among many things, which were denied in my own mother land.

          The US is capable of change , in a positive way, internally. But, the blacks still are poorer than, say, Asians. And, once you are poor, you can only get poorer, like the black homeowners who can’t afford high municipal taxes. The system is biased against the weak. Perhaps the whites were wise in limiting Chinese immigration in the 19th century. If they didn’t, we might have had two Chinese super-powers by now.

I’m not discussing about skilled or professionals who migrated to the U.S . I have met many people with minimum education,unskilled with many other disadvantages,getting into to U.S ( by way of Lottery Visas and other means ) are much better off today.     Other than the Evil Emperor’s Nariyah nature, discussing his other qualifications or disqualifications he may or may not possess can’t divulge any new path to the future of Langkang. If so, what magic (difference) his Nariyah nature can bring on the country’s political stability or economic development, which no leaders of the past 75 years could make any, but with no exception of any one of them, but they all drove it down? The Nariyah nature, in the past, did not strengthen him politically, but it helped him to pull the wool over the eyes of foreign diplomats and leaders over Tamils’ issues. So once before too, without properly being elected, but convincing the diplomats of India and America on reconciling with Tamils, he juggled with power by grace of India and America by regime change. I doubt the future appreciation of the exchange rate of his Nariyah currency, though there are still organizations like the IMF that have pledged to be fooled by him, in the worlds’ diplomatic deals. With both legs broken, Langkang can no longer walk alone, without the world’s support. But in the last 25 years the world’s need for Langkang has changed tremendously. Superpowers cannot be certain of their might in the Asian waters, unless they win over the Langkang land.

    While having a drink with a few friends during my annual holiday in SL just before the elections which brought GR to power, a junior Police Officer who had been tagging along, appeared to be highly impressed with GR as a man of action who could, literally, shake the country off the lazy, lethargy & the corrupt to make SL ‘great’ again. When I asked him of the allegations of corruption, such as the MIG deal & cronyism, his answer was that, it was MR & not GR. So the question was, would GR take action against his brother? There was no direct reply but he was certain that GR with his ‘viyathmaga’ intellectuals, would reform the country. No doubt this guy believed it & so did most of my friends. They were happy the way GR ‘decisively’ acted to prevent the COVID spreading but it did not take long for GR’s actions to go pear shape. The blind faith was such that the average citizen didn’t want the Rajapakses to be held accountable, as gratitude for ‘saving’ the country, & now its all water under the bridge. No politician would ever want to open a can of worms because they all have some of that dirt on their hands as well.
    If Karma is true, then we can expect justice, otherwise, they all lived ‘happily ever after’. I hope RW would at least persuade his mate, MR, to give back some of the loot voluntarily because what has been laundered would never be traced.

    In 1950, Kalhi Krishnamurthy, the most beloved writer of Tamils, world over came to Ceylon, to experience the uniqueness of Jaffna Tamils’ culture. Language, hospitality………… in 1950s Don Stephen’s anti Tamils crusade was at its peak. Kalihi was humiliated at the immigration, because of his popularity in the Tamils’ world by his unmatched service for Tamils, by his so powerful writing. By the 1970s, even Langkang’s education was scrapped off as nothing at the world academies. But the gradual dwindling of its recognition of glories of British was no problem for the Sinhala Buddhists. Ceylonese had unsubstantial arrogance about their welldoing status of those days, specifically, comparing with India of that time. They had little or no respect for Kalhi, the Mount Everest personality in writing, because he was an Indian Tamil.

This kind of prediction can hold good even beyond the Evil Emperor’s demarcation line 2048 for the rebirth of Langkang.

    This situation, which was created by Kadirgamar, was once considered a windfall to Lanka, but it’s involuntary lock up for Langkang and unintentional kidnap of superpowers. From the time of 1975 NAM, Tamils have been trying to appeal to IC about Sinhala Buddhist Genocide of Tamils in Ceylon. So, whether any big country wants to press Langkang, or they want to ask any questions about Langkang’s fundamental rights violation of Tamils, and on the other side this lock up condition if it can bring any fruit to Tamils in gaining some relief from Sinhala Buddhists oppression, irrelevant of any of these, Tamils like the international activities in Langkang as they perceive this as a natural- physical protection for them.

But the superpowers, by the nature of their relationships with one another, cannot come with blind agreement to smooth their relationships overnight and or free Langkang on the spot.

    At a time, Ceylon was considered, like nowadays Singapore, neutral, peace loving and cared only about its internal politics and the country’s prosperity by improving education. After the Kadirgamar’s reintroduction of Langkang to Western powers for the purpose of wars & money laundering, whether Langkang has been forced into the warring circles by external forces or it inserted itself into the warring fronts by corrupt individuals like Kadirgamar, but that kind of analysis is fruitless because in any case, the net effect those actions is same, i.e., Langkang cannot have itself released on its own. Filling up the international flights’ Business class seats with high profile diplomats and shuttling 5 or 10 times between countries apparently does not bring any yield in the mentality of the nations. Further Superpowers so far have not responded to the Tamils call for help. It does not mean they are only fake human right activists or bogus peace propagandists or dishonest democracies. Interfering in Langkang and freeing Tamils is not a $400B arms and 60000 soldiers for them. Rather, it could turn out to be a blow to their future leadership. So, releasing Langkang out of the current situation could be possible only by natural events happening that will make Langkang no longer useful for superpowers. Then what about Tamils’ justice?

    I recently had a chance to read quite a bit about how the Argentinian prosecutors, Julio Straserra and Luis Moreno Ocampo, held the country’s former military juntas to account back in 1985. These investigations happened not too long after the juntas held power. They had the support of the elected president, though they still faced many hurdles from the deep state military supporters.

    Sri Lanka should be compared to such countries, not to the US, which as a global hegemon claims exceptionalism; warts and all, the US institutions can still survive a disruptive charlatan like Trump.

    In Sri Lanka, many years have passed since atrocities and war crimes were committed by the SL regimes, whether against Sinhalese in the South in the name of crushing the JVP or Tamils in the North in the name of crushing Tamil militants. Will any elected government have the courage to do such investigations and hold the perpetrators to justice? Will they be able to find prosecutors like Moreno Ocampo, who was later at the ICC? Will they still be able to find living people willing to testify against the perpetrators?

    Accountability for corruption and destroying the country’s economy is a separate prosecution that can happen under any regime in SL if the prosecutors have some basic courage, but people need to bring real evidence, not just rely on hearsay.

        How ironic you are making this comment on the same day Hunter Biden made a plea agreement with the prosecutor, a Trump appointee, on no-payment of taxes and acquiring a gun while he was a drug addict. In their addiction phase, people do a lot of disgusting things, and Hunter Biden is paying for it now in terms of reputational costs, public videos, and plea bargains.

        If there was any real corruption, the prosecutor would have charged him with it. Beyond the unsavory influence-peddling using his family connection to the then Vice President as part of lobbying, there may not be anything illegal except in the febrile imagination of some, particularly Republicans.

        Non-state actors can be handled appropriately; in most cases, there has already been summary justice and many have been killed. The state has to be held to a higher standard if the country is to make progress and not revert to more violence, chaos, and economic decline.

    Mahinda and Gotabaya are directly responsible for war crimes and crimes against humanity. Gotabaya gave orders to Shavendra Silva to kill surrendered LTTE political wing leaders. One of the soldiers at the front line recorded this massacre by saying, “they were not shot dead, they all were beaten and hacked to death”. Shavendra Silva and Kamal Gunaratne with other commanders were involved in unspeakable crimes on Tamils. The crimes were committed with only one aim, kill and maim maximum number of Tamils before the war comes to an end. And they succeeded in that by slaughtering more than 169,000 innocent Tamil men, women and children under the name of “Humanitarian rescue mission”, World’s first of this kind. Therefore, the entire Srilankan political and military elite at that time must face the an international investigation and must be punished severely for their crimes. This is only the first step though. The next step will be a permanent solution based on a federal set up to let Tamils live as free citizens. The same army which enjoyed and thrilled massacring Tamils during the war is still living among us in the North and East. These murderers must leave our places. Let Tamils run their own administration, which will safeguard their land and their heritage.

        OK if Sri Lankan Tamils are purely descended from South Indian invaders and immigrants, then please explain the fact that it is the present-day Sinhalese who share 70% DNA with South Indian Tamils and Sri Lankan Tamils share only a 17% DNA with South Indian Tamils. How come? Many of the present-day Sinhalese castes as well as their upper castes and aristocracy are all of recent South Indian immigrant ancestry. Strang most of the anti-Tamils are also from these people.
