The American Midterm Elections Vis-à-Vis The Sri Lankan Constitution

The American Midterm Elections saw the Democrats taking hold of the House of Representatives. This means that they will have great voting/vetoing power in the chamber, overriding and/or reducing a Republican President Trump’s policies concerning health care, taxation and immigration. Trump yet retains the executive power. Although Republican, he is thoroughly socialist in many issues and has given due diligence to his constituents. The economy is booming and from updated airports to nutritious school lunches, many things in the US have balanced out for the better of the nation. The congress, in true constitutional fashion will learn to compromise and work with the Republican President, and democracy would have been served yet again. 

Enter Sri Lanka: Money of the struggling Lanka Masses was spent on Midterm elections so that their representation could have been balanced out in Parliament. Did the midterm elections where the Sri Lanka Podujana Peramuna (SLPP) scored the highest votes, obtain any higher voting/vetoing rights in the Sri Lankan parliament? Did the SLPP take over the house? No, the parity of voting solidly remained with the United National Party (UNP) who were hardly voted in nationally by the people. Indeed it has been proved time and time again that it is there to serve Western capital and not the capital of the hard working Masses of our land. The midterm elections should have put things in better democratic perspective, but it did not. It is away from the democratic principle the country should be governed by. The newly-fangled articles of the Sri Lankan constitution drawn up by the UNP is therefore illegitimate. It is deeply flawed. Dissolution of the parliament was the only solution out of this conundrum. President Sirisena did the needful. 

The West will retaliate. We know that the Western interests cannot be pushed away too lightly. We will be squeezed out with sanctions against us. Yet, the West too is struggling with their economies, and it is their trade that we seek out in the end. However they gave us little to no help during our time of terrorism, and the West is not letting up in their demands for Sri Lanka’s divisions into federal mergers and states, hence weakening our success as a nation.  

Yet, even with the recent change of Lankan government, there is a hardly a push towards China by them, unless we are sanctioned against.  Even the UNP gave in to the Chinese interests in the land. The new government via Sirisena and Rajapaksa will certainly follow the same pattern of the previous one, except that they will say NO to Federalism. They will surely work with India, but minus any impeding land bridge that Wickremesinghe was eagerly awaiting to architect. Balance of payments would be met with adequate and fair taxation, and a step back from rabid investments via land deforestation, pollution from unnecessary industry, and outsourcing of menial labor jobs to the Middle East – one of which the Masses pay dearly for their so-called free benefits.

Yes, we will be a little bit away from Western interests and move in just a little bit more with China. Will that bother the West much? We are certainly not an oil-producing country which has to be truly controlled for its interests. Therefore, we can deduce that it is the need for West to uphold their show of control and saving face. After all people like Wickramasinge showed them he was all for boosting up their sense of entitlement.

In short, all Sri Lanka wants is to be a united land, with a sense of tradition and history for the sake of posterity. Even the Tamils have realized this. They, that caused a lot of havoc for our land for the sake of a certain chauvinism, will certainly not want to see the land disappear into another Puerto Ricco or Diego Garcia for Western oligarchs to retain their wealth. Even Tamils know that the land has to retain some flavor of ethnicity for it to be viable for their age-old interests. The times Puerto Rico and Diego Garcia were converted into the hell-holes by the West, environmental destruction and rights of natives were not too much of a conceptual understanding to the Western mind. In this day and age, we need to approach Trump and other Western leaders to better compromise trade and loyalty deals. We have to reassure them of our sincerity. It is believed that President Trump hasn’t a clue about what is happening in Sri Lanka as he is concerned about trying to balance out his midterm issues. It is felt that the foreign policy towards Sri Lanka has been left to follow the Obama-Clinton structure. 

If they don’t listen to us, a few years of austerity measures will do wonders for our land. (One would caution about going excessively with China due to retaliation from the West). When Sirimavo took over government in the 70’s, life was tough. However, if she was allowed to remain, her socialistic-nationalistic government would have built the country up slowly but surely to simple and dignified heights. Instead, the capitalistic-minded UNP took over a country too soon, with no non-renewable resources like oil (the very item that creates capital so easily for other countries). It created gross inflation that produced a 1% elite and 1% aspiring elite. The rest of the Masses fled to labor-camps in the Middle East for sustenance.

But now, a Neo-Lankan system has been born again. Rajapaksa is much toned down. He has sorely learned from the overreaching follies of his previous presidency. Sirisena will take the ultimate lead. He has shown true courage and shines as the great patriot of Sri Lanka. It is a truly a blessed event that has dawned upon us. We hope it will prevail.

        You are distorting facts. The SLPP won only about 40% of the votes, hardly a landslide in spite of all the noise they made. So they couldn’t have taken over the govt, except by cheating , as they have done now.

Senate race is still close, Today Arizona went to Democrats on recounting and FL results have been suspended, The last reading 48 to Dems and 51 to Republics.Overall the voting pattern is clear that people did not want Trump,s fear psychosis, racial division, unconstitutional actions and more than anything wanting Muller to complete investigation. Ramona please do NOT compare US with Lanka if you need help here is the list to compare Yemen, North Korea, Somalia,Venezuela.       I wrote this article about 5 days ago…..i thought CT was not going to publish it….so I used parts of it for comments on other articles.

      Whatever the US midterm voting results are, the Democrats will have greater representation in the House of Representatives.

      The reason for midterm elections in Sri Lanka is to constitutionally balance out the rights of the people via parliamentary representation. Otherwise it is a colossal wastage of country money.

    A US President will never dissolve a House / Senate or will be allowed to do so, (what your pay masters MS/MR are doing right now). But there is always a possibility of Trump being impeached. That is called the beauty of true democracy. Did you understand what I just typed Ramona. Your argument regarding Lanka is nothing but Trumpian.       Majority of parliament did not go constitutionally with the midterm results where SLPP won by a landslide. Therefore President was legitimate in dissolving parliament.

        the clearance for the president having no hidden agenda to appoint a prime minister from the opposite party.

    High praise indeed for Mrs B, an uneducated housewife who came to power on a sympathetic vote & was influenced by all her cronies & stooges in her so called socialist reforms. She cosseted to despots like Gadafi, Mugabe, Idi Amin & let the Chinese in, despite the ‘non aligned’ stance. The country went backwards with her misguided economic policies & if she continued, the country would have ended up as another Zimbabwe long ago.     We cannot compare the US system to Sri Lanka. A PResident cannot dissolve Congress. Division of powers are very clearly written. He is one of 3 equal branches of government. Senate as it stands is as follows: Republicans gained 3 so far in ND, MO and IN; all 3 are conservative Red states with conservative pro-gun, anti abortion conservative Democrats. Yet Tester the gun toting Democrat survived in Montana. Democrats made 2 shocking gains in Nevada and in Arizona, where the senate race was called yesterday. In Florida, with overseas ballots which are overwhelmingly Republican MILITARY votes, chances are Bill Nelson will lose to Prick Scott the Governor unless there is a miracle. So That means R+4 and Ds +2 =net gain of 2 for Rs in the Senate, a fool proof small majority. House whupped Rs with almost half of Trump Republicans who voted for the disastrous tax cuts LOSING. Educated people voted overwhelmingly for Democrats. So far they have GAINED 37 seats and even Mormon Black Mia Love might lose in Mormon Republic: Utah.

    The Democrats will lose again if they behave like the Republicans. Trump’s Tariffs are hurting his base conservative White CHRISTIAN farmers. Even in the Confederate state of Georgia a hardcore Republican seat went to a single mother anti gun lady from the Democrats. It was TRUMP who turned off women in the suburbs and white women defected. Losing that seat is like when Felix Dias B lost Dompe or if a Senanayake loses Dedigama. Trump hates darkies and prefers Norwegian immigrants. He hates Chinese and Indians. He hates everyone except his own family.

      Yes, the US president will not need to dissolve congress because the division of powers very clearly written. Sri Lanka’s constitution on the other hand is too far below par, with plethora of lawyers kept on hand to analyze and scrutinize each letter of the construction. Ultimately, it is left to the President to take control and do the needful.

    And the Democratic Congress has no intention of compromising over core demands; rather their main duty is to act as a check on the worst impulses of the man in the White House. It is a constitutional duty that a supine Republican leadership had shirked.

    I thought the 19th amendment was done before the LG elections.So how could the LG elections make it illegitimate.If you had a child in your first marriage the fact that you got a divorce and married again,does it make that child illegitimate.Also it was not the UNP baby only.Sirisena also suppied the sperm to fertilise the ranil egg.Now he wants to divorce ranil.Ramona,you and i know how difficult and nasty a divorce can be creating mental breakdowns,financial losses,children affected etc etc.What was really illegitimate was mahinda trying to creep in through the backdoor.

          That’s why Sirisena took over, isn’t it. But then unelected Ranil retook over. If Rajapaksas were having a hard time fulfilling balance-of-payments, Ranil is having an even worse time, even with the intended mergers, partitions and land-bridges included.

            The UNP got a very good majority at the 2015 general election.That is why they have so many MP’s,i think 106 in the current parliament,7 short of a outright majority.All that has got frittered away in 2 years due to ranil.He thought he was above sirisena because he had more MP’s.When sira did not want ravi karunayaka appointed as finance minister,he insisted on it.Then there was the bond scam.he thought sira will look the other way,but he instead insisted on a commision to inquire on it.All this ruptured the relationship between the two.

              Agreed! But it was Sirisena’s party NDF, that scored the most votes in 2015. Ranil and co. who orchestrated the turn of government, took their chance to take over the house. Sirisena couldn’t have gone the UPFA way because he was countering the Rajapaksa policies. So, in the end it means, that UNP used the nationally democratic votes of the people that elected another UPFA-type candidate (Sirisena), to coerce and bend him to Ranil and co.’s will. Something very illegal there.

    i think you went to US when you were a schoolgirl if i’am not mistaken.Since then how many times have you visited sri lanka and for how long?Your heart seems to be in sri lanka while your feet are in US.You are thoroghly confused about the rights of the masses and talking like sirimavo and her disastrous cabinet of marxists in the 70’s.This is 2018 and i know more about the masses than the pajero driving MP’s because i’am always with them in public transport and cafes.When are you going to come to srilanka and get a idea of what the country is like since you were a schoolgirl?

      My interests run far deeper than what you say. As per you, you are certainly doing a good deal. However, the “masses” you speak of, are a fraction of the overall masses, and who live in the cities. These people rely entirely on entrepreneur class to create jobs for them – all their ancestral lands were taken over by investors, now and in the past generations.

      UNP scenario: kill the entrepreneurship of the self-sustaining small holder farmer, fisherman, butik shop owner, tour operator, etc. Commercialize all, and create a Lankan billionaire class. Create dependency of the Masses on conglomerates of these billionaires……..environmental destruction, culture and heritage destruction, mergers, partitions, land-bridges, part of the commercial process. Neo-cultural heritage to take over. Social experimentation and engineering on the Western paradigm to emerge (short –term boost for Western capital).

        agree with you and i don’t like the UNP policies.i have always felt that They should have duties on imports so that local entrepreneurs can supply some of the local market.Ideally i would like someone who has a middle path policy between sirimavo’s and JRJ’s which were extremes.Probably sajith might be the person.

          I would agree with you except that UPFA+SLFP alliance won the house in the 2018 Midterm (LG) elections. So UNP and Sajith should not hold the house according to constitution. UNP might have done it by dubiously prior to the 2018 Midterm elections, but democratically and constitutionally, UPFA must hold the house now. Best if Jayaratne can come back and play the subservient role to the President so as to balance out the powers as in the constitution prior to the interim one created by Ranil. I would suggest Gammanpila as PM.

    people elect their representatives not to run the country,but to clean the drains and repair roads etc at LG elections.Lot of UNP’ers and others who are neutral would not have even gone out to vote because they are quite happy to see some deserving people getting elected to do these kind of chores for them,but when it comes to overall power structures like provincial councils and parliamentary and presidential elections which are at a higher level than LG elections they will balk at thugs and murderers getting into politics and will come out in full force and vote them out,like what happened in 2015.To compare LG elections to US parliamentary is simple minded.

    btw,your photo in 2012 you seem to be sad and melancholy.Anything sad happened in that period?

      Heavens! You mean that Lankan Parliament has no equivalent national democratic voting system like the LG, to vote Parliament members in? That is indeed a travesty of justice for the Lankan masses! Lankan constitution is a deception. It has been put into place by Western powers so they can intimidate and control us. And our Lankans dare not challenge it feeling that they will be called stupid doing so.

      Can’t believe that the winners of the LG (the SLPP-SLFP in this case), are the deserving people to do all the much needed country chores. And yet, and unelected UNP sits up there holding the money of the masses and selling the country to all kinds of foreign enterprise. Btw, UNP never won anything in 2015 (just the Colombo sector). It was Sirisena’s NDF (a branch off from Rajapaksa’s UPFA) who won presidential and provincial elections.
