The Mangala-Chandrika-TNA Constitution

By Dayan Jayatilleka

Dr. Dayan Jayatilleka

The UNP leadership and Chandrika Kumaratunga are trying perpetrate an unnecessary but quite drastic, risky surgery on the Sri Lankan body politic. They seek to effect such change to the Constitution that cannot be limited to reform through the procedure of amendments. But what could such change be?

There is no Sri Lankan commitment to a new Constitution made to the Human Rights Council. Thanks to our neighboring friends, the only reference to a political solution is to the implementation of the 13th amendment, which is far more modest than that which is envisaged by a new Constitution. So it perfectly possible to leapfrog accountability/transitional justice and move directly to the political resolution item of the Geneva resolution, by implementing the 13 amendment, with necessary modifications and improvements.

The government’s contention that there is no reason for the Joint Opposition to oppose the government’s Constitutional project, is another example of the Constitutional bond scam now in play. Firstly the Rajapaksa administration’s joint communiques of May 21st and May 23rd 2009 with the Government of India and the UN SG Ban Ki Moon, and reproduced in the UNHRC resolution of May 27th 2009, did not promise to implement “13 Plus” still less “go beyond 13A”. Of the two communiques only the one with India mentioned 13A and that too was only to “implement the 13th amendment”.

President Rajapaksa promised 13 Plus and to go beyond the 13th amendment, and therefore new Constitution. But as anyone who has had a 13th birthday knows, if anyone asks your age six months after that, you reply “13 plus”—which in no way means you have gone “beyond 13”. You are “beyond 13” only on your next birthday, i.e. when you hit 14.

The question is why not go that painless route? The answer logically is that the government seeks a change that goes beyond a reform. Why would the government do so?

Indeed this is the point that Gamini Jayawickrama Perera has recently made when he reminded an audience of the vast strides the North Western Province made during his tenure as chief minister, and pointed out what was possible within the present system, asking pointedly “If I could do it why can’t you?” However, that pragmatic place doesn’t seem to be where the UNP leadership is coming from. Equally obviously the government does not intend to go in for a new amendment of a scope and scale which could be passed by only a two thirds in parliament without recourse to a referendum.

Just when you thought things couldn’t be morally worse , you learn that Mangala Samaraweera does not intend the new Constitution to be trade-off for getting us off the ‘war crimes’ accountability hook. When asked by the foreign correspondents whether the US and UK leaderships may no longer insist on the implementation of the Geneva 2015 UNHRC resolution, the Foreign Minister replies disgustingly that “ even if they don’t insist, we insist” on implementation. This means that the government’s agenda is not ‘quasi-federalism OR Special Courts on war crimes’, but ‘quasi-federalism AND Special Courts’, except that the sequence has changed and its federalization first, Special Courts second.

What this means is that there is a deal between the Ranil-Mangala-CBK troika (which has a pathetically few ‘official’ SLFP loyalists), the TNA’s Sumanthiran-Sampanthan duo, the Global Tamil Forum/the British Tamil Forum, and a handful of Western states with important Tamil Diaspora vote banks (and colonial hang-ups). What’s in it for Ranil and Mangala are (a) the prospect of permanent electoral support (and perhaps funding) for the UNP from the Tamil community in Sri Lanka and overseas, and (b) a transfer of power from the President to the PM and the UNP which would remove the roadblocks to and facilitate the smooth implementation of their re-colonization project of the transferring the ownership of the geo-strategically vital island of Sri Lanka from us, the people, the citizens, to them, the foreigners.

Do not understand why DJ is continuously given preference in CT. Hevonkyvwabtsvto.misrepresent facts and mislead public. How can Mangala-Ranil-Chandrika-TNA bring.A constitution of their choice without majority support of the parliament. In fact, the government has announced they may go for referendum as well.
It is by these mischief makers more divisions are brought amongst the people of different races.

Still it is true that the New Constitution is a red herring and distraction of the moda masses from the corruption, financial crime and money laundering by the leaders of Miracle of Modayas!

I think Mr. Sambanthan and Tamils also understand this: What the use of having a New Constitution with the same old Corrupt and RACIST politicians in the Parliament of Morons??????????????? We need special court to try corrupt politicians and Economic justice first.

To hell with releasing the Tamils from bondage. Any constitution that doesn’t make Mahinda president for life and then Namal then Namal’s son then ….. is not worth the paper its written on.

Mahinda is the best thing that ever happened to SL and the sole purpose of the rest of your life should be to make Lankans understand that.

        Native,

It is only a limited few who understand ‘Farce’ the way you and I do. Most others are happy to swallow old rope, because being literate without intelligence and overall knowledge to question, can be an extremely dangerous thing.

Media in SL are a funny lot. Apart from being slanted themselves, they can boost up an individual without giving much thought to the damage they could cause. As for me, that Nugegoda rally some months ago was good enough evidence to classify DJ as an imposter, not a serious political analyst. No serious commentator would wish to be identified with a political movement such as that.

In fact, there is one electronic media station which also gives DJ a lot of air-time to spew forth his crap. Regrettably there aren’t clever enough anchormen in that programme to take him on, question him and beat him at his own argument. They ask questions, he gives his answer, and they never contest it with a will to defeat him before moving on.

When you buy a pack of cards, there is a joker. In the CT pack of writers, there is a joker, too, for entertainment. It is true that in a land where the average IQ is 79, some thinks that the joker, too is a card like the Ace, King , Queen etc.

Yes, removing the joker, will certainly help those with low IQs.

This man and his energies are like a knife with both edges being well sharpened. Now the man s nature has been twisted since nothing of his efforts caused to silence the rulers. Nor does he earn the place as dreamt ” mama thamai miniha -I am the person to help the external politics of the country-no body else”, Mr Sirisena et al will never listen to DJ or the like but will radically go against his et al. That is seen as not digestible to these devious men today, that is why he comes with the kind of verbal diahrrea again and again. The man is said to be caught by his 4 walls not having any invitations except the 2 usual programmes being carried out by killies sender. However, even Sajith Premadasa will loose his appease to this man by end of 2019. Wait and see how these men would end up by next election.

This is for the Tamils and TNA, Just wait Dayan, I will come back to you

Gamini Jayawickrama Perera rightly boasted “If I could do it why can’t you?”

Well If Wayamba could do it” Why not North or Eastor both?

It was an acknowledge fact that the Northwestern Province (Wayamba) had made vast strides when Jayawicrama Perera was the Chief Minister.

Wayamba at that time was leading the Provincial Councils and had achieved the status of a Role Model.

The Tamils actually did all the spadework for the devolution and somebody else is reaping all the benefits.

It was a missed opportunity for the Tamils.

The remnants of the defunct Northeast Province were jealously watching the unfairness of all this and gritting their teeth and waiting for the opportunity.

Yes the opportunity did come for the Tamils but years later.

But alas when the time came with the establishment of Northern and Eastern Provincial Councils

What did we do? It is a sad story! We bungled and resorted to the blame game and the Tamils had become masters in the blame game and nobody could meet us in this game.

Both the Northern and Eastern provincial Councils are competing for the last place. Sometimes it was the Northern province and on other times it was the Eastern Province, but the last two places were permanently reserved for the Northern and Eastern Provincial Councils and the Northern provincial council is spearheading in the “blaming game’.

The Northern Province had never tried to make use of even the little opportunities opened by the 13 A in spite of The well known Tamil proverb ”Vallavanukku Pullum Ayutham”.This could be translated as “for a mighty even grass is a weapon”!

The way out for the Tamils is within us

Your Rajapakse govt; did not do anything to bring the Singhalese and Tamil communities together. Why dont you give this govt; a chance?

    • 5
      16

“Give people a chance”. Rajapakse did more to bring Sinhalese and Tamils together than the Tamil racists like the Ponna brothers, Chelva and Sunda. This govt or any orther government cannot change the mindset of the Tamils with their hatred for Sinhalese, therefore, a settlement is not possible at present. Best option is to disregard the grumbling goons and proceed with major challenges facing the motherland; economic, environmental, social. Hopefully, then, the grumbling goons will disappear in to the wilderness and assess their usefulness.

        Lal.

Remember that 80% of the population in Sri Lanka are Singhalese. Any solution to bring the communities together has to come from them.
Ponna/Chelva tried for a democratic solution and failed and that is why LTTE ended up taking arms.

Comrade, you claim that you have done P.hd. Is this P.hd on hypocrisy?

The Mangala-Chandrika-TNA Constitution has come-up because your dictator who sacked you twice could not do anything with his two third majority.

You boss doesn’t know any politics but he is good in stealing others properties and wealth.

Can you tell the university where you have done your P.hd?

    You are a boru leftist.

When you were with dictator Rajapaksa you were telling that the socialist countries are useful and helping your dictator.

Now you say that Mangala is not suitable to seek the help of Trump who is a real capitalist.

The reason why India is messing with Sri Lanka’s constitution is that Tamil are Indian people (Indian subjects). The reason why Briton and the West messing with Sri Lanka’s politics is, because Tamils were their Coolies (indentured Labours).

No native Sinhalese has asked for a new constitution. Just get rid of the 13 amendment, send all the bad Tamils(those who don’t assimilate with Sinhalese) to Tamil Nadu, simple!!!!

DJ makes a mockery of himself.

“President Rajapaksa promised 13 Plus and to go beyond the 13th amendment, and therefore new Constitution. But as anyone who has had a 13th birthday knows, if anyone asks your age six months after that, you reply “13 plus”—which in no way means you have gone “beyond 13”. You are “beyond 13” only on your next birthday, i.e. when you hit 14.”

He makes a mockery of himself. Even a 13 year old knows better about what it means when he says he is 13+ to a time based specific question. But a shameful ex-diplomat argues that anyone who is 13+ has NOT gone “beyond 13”. He wants to stop the clock in order to make himself a laughing stock.

Thank CT for exposing the Rajapakse supporters to the country and beyond.

On what basis did the Colonial masters demarcate boundaries of the provinces? Or were they from the days of the Kingdoms of Sri Lanka? Just curious if Mr. Jayatilleke could educate me on this.

Why have inherent bureaucratic inefficiencies, corruption, entitlement systems at such multi-levels? Is it cost effective and does it make sense to break it to so many different governments at Provincial levels? What criteria were used?

Doesn’t it make more sense to have revenue generating units at the smallest local levels to spread democracy? But then do we need corrupt elections and expensive elections at all levels like in the US where Sheriffs, Judges etc are elected at local level?

If racial exclusivity is going to be the criteria, what will happen to minorities in majority areas?

    Could you provide information?

The US states systems was a result of Colonization by different groups of Euro-white settlers; different states came about at a different time. No difference in a White person in Alabama and Georgia in the South but they exist as different states.

A guy in NY or NJ exist with different State identities but possibly same European tribal heritages. Different parts of the US were settled by different ethnic tribes of White Europe. In places like Minnesota(Scandinavian), people have different last names from Georgia for example or South Carolina(anglo). Then you can add the plantation economy and the civil war and inherent racial discrimination by law in the Southern states to the mix.

India has different criteria, and seems to be based on ethno-linguistic regions. Malayalis vs Tamils. Andra vs. Kannada vs Bengali etc.

How is SL going to be split for federal purposes? What sources of revenue will be local vs federal?

Education? Will Tamils be charged out of state tuition for attending Sinhala eelam area top universities?

    Thanks

    • 5
      0

“If racial exclusivity is going to be the criteria, what will happen to minorities in majority areas? “

Federalism is way of agreeing to disagree. The minorities in one state becomes majority in another. How one majority, A, treats its minority, B, in one province becomes an example to majority , B, in another province do the same to its minority, A. There may be a third minority in some provinces. For example, Muslims with their distinct religion form minorities in Sinhala and Tamil speaking provinces. They want cantons as in Switzerland where “linguistic strife and ethnic hatred remained unknown in Switzerland”.

Local PCs will solve problems closer to local population. They are united as a nation but develop as different linguistic or religious groups. This way no one community suppresses another and no one is harmed. Peaceful co-existance is guaranteed that will pave way for development and prosperity. In fact Switzerland is one of the successful system and people enjoy the highest standard of living.

    Rubbish as always.

All proposals for the devolution of powers to Tamil areas have been designed to decentralize merely administrative function to all provinces. This does not resolve the Tamil question. Any meaningful proposal that will be reviewed favorably by Tamils should deal specifically with the social and economic problems faced by the people of the Tamil provinces and not by the people of Sinhalese provinces. Unlike the Tamils, the Sinhalese people have not faced the devastating impacts of discrimination or watched hopelessly as their homes, streets, schools, hospitals, farms, industries and churches and temples deteriorated and fell into disrepair or were destroyed by bombing and shelling. Therefore, devolving the same powers to both the Tamil and Sinhalese provinces is not politically expedient. It is imperative that the ultimate aim of devolving powers to Tamil areas should be to permit its inhabitants to participate freely and directly in the planning and reconstruction of the war-torn areas and in projects designed to alleviate their social and economic problems.

The one man Cuban Communist party, Thero De Silva has now ended up hanging on CBK’s Munthanai. CBKs is/and was his arch enemy all these time, irrelevant of where was Mangala for him. . But, it is not a surprise as this Cuban Communist has had written article in CT advising Ranil how to win Old King. He is, now, eagerly longing for Mangala’s and Ranil’s down fall. Thero was person liked to see Old King destroyed; now working to achieve the other way to happen. For him, to remain be entertained, he needs to see, the falling down of people, continuously. A peculiar, filthy, mentally retarded taste. The truth behind it is he a person emptier than Castro. Further, in that, he is not alone, but we have the history of Lankawe diplomats and politicians, who are, after Ceylon freed, be entertained only on destruction, Pain, and suffering on common people.

“government does not intend to go in for a new amendment of a scope and scale which could be passed by only a two thirds in parliament without recourse to a referendum When Dr. Jayampathy proposed of changing constitution up to limit of without referendum, Joint comedies opposed it, thinking they are going to lose something good from chewing but Tamils may escape with at least a minor benefit. I stop here and ask Thero will write articles, after this, advising the government to change the constitution only to the level of to avoid referendum? (I am not a supporter of constitution changing- that is different subject) He is only double talker with his twistable tongue. He will not accept that challenge.

This means that the government’s agenda is not ‘quasi-federalism OR Special Courts on war crimes’, but ‘quasi-federalism AND Special Courts’I do not know who made an agreement with Thero as either this or that, But TNA’s December,2014 election statement stated that both were promised by CC for them in order to support him. In the past, Thero, who has been claiming to save Lankawe from the axe of UNHRC in 20019, showing a feeling that he has had hope if CBK could really do it at by giving partial rights to Tamils. Because she has said last week, she does not want war crime investigation but, Constitutional amendment.

Here is how Thero defining the context of it for reader. Just when you thought things couldn’t be morally worse , you learn that Mangala Samaraweera does not intend the new Constitution to be trade-off for getting us off the ‘war crimes’ accountability hook. But that is not he really means. Here is his mind except that the sequence has changed and its federalization first, Special Courts second. Here he says both were always there. The meaning of it is the plan to get the resolution withdrawn and cheating on constitutional order has been changed. He saw it when the extension talk started to come out, Chandrika who lost her job of babysitting of Hillary Clinton has dipped her nose in this. That is the time he thought, it is not anybody else, but CBK is the only person who can hide what happened at UNHRC after May 23rd, 2019. We don’t have to believe Mangala or put even 0 marks for his talk outside Lankawe. But the order change is the ghost scared Thero to run up to CBK and hang on her Munthanai to save him.

One of the Troika was in a Foreign Liquor Shop the other day , browsing through the special deals on Scotch Whiskey.

Keeping the suckers Sira and his his golayas in line, must be harder than helping to draft this Batalanda Constitution, which is going to not only partition the Nation on Ethnic lines, but also into Dalit and Elite Provinces.

Batalanada Ranil’s UNP couldn’t win Government for two decades.

These Two Decades were the most important era of this 2500 year old Civilization.

Even with the Tamil Terrorists waging a brutal war for thirty long years, , the Old SLFP and the Rajapaksa bravery, managed to bring the Country in to mid Income level in the Third World.

This Troika which is mostly influenced by the supporters and even participants of the same Terrorists has already paralyzed the nation.

No Development of Infrastructure. Only re jigging the Public Debt to make money for the mates.

And bribe the suckers in Kotte to get the new Constitution past the post.

If Chandrika, Mangalan, Batlanda Rani, Diaspora , Sambandan , Abraham, and the West are allowed to f**** up this 2500 year old Nation, through this Batalanda Constitution, it will be a sad day for generations of our innocent poor rural inhabitants, who are the great majority to rue .

      KASmaalam K A Sumanasekera

“If Chandrika, Mangalan, Batlanda Rani, Diaspora , Sambandan , Abraham, and the West are allowed to f**** up this 2500 year old Nation, “

Honestly you do not need Chandrika, Mangalan, Batlanda Rani, Diaspora , Sambandan , Abraham, and the West to f**** up this island.

You should start blaming the public racist Anagarika Dharmapala (the homeless one) for making the false claim of Sinhalese being part of Aryan people (related to Hitler).

Your ancestors who sailed from South India on Kallathoni opted to become Sinhalese and Buddhists for economic and demographic reasons and now converted to Sinhala/Buddhism for political reasons.

However much you kick and scream you remain a South Indian Kallathonie and your nation(?) is in South India.

Please stop giving us the usual crap 2500 years year old nation.

For your information there was no Nation in this island 2500 years ago and different tribes controlled different parts of this land. So please stop kidding yourself and insult Dr Siran Dereniyagala.

        Dear Native,

Don’t be ridiculous.. You mean our King who knelt in Mihintale to welcome Lord Buddha is a Kallathoni?.

A Dharmapala saved the cattle going to dinner table in most Srilankan Households.

You lot in contrast, have been hunter gatherers, and killing and eating our rare wild life is your culture.

You are in good company now, with the Yahapalana Cattle eaters and the Goat Eaters in Srilanka.

It is politically not correct to name names .

All I can say is our Yahapalana sucking elite are the only Sinhala Buddhists who can afford mutton.

          KASmaalam K A Sumanasekera

“You mean our King who knelt in Mihintale to welcome Lord Buddha is a Kallathoni?.”

Don’t be silly. There is no evidence to prove Buddha visited this island. It was Kanchipuram Monk Mahanama’s spin as part of origin myth of Sinhala people.

” A Dharmapala saved the cattle going to dinner table in most Srilankan Households.”

Was the public racist Anagarika Dharmapala (the homeless one) a vegan? And you want me to believe that Sri Lankan households are free from Devilled Beef, Beef Kotthu, Beef Curry, Pepper beef curry (kuruma), Beef Mustard Curry, Beef & Tamarind Curry, Dry beef curry, ……………. ?

We know you bull all the time, now you have gone too far.

          I say Sumanasekera,

“You are in good company now, with the Yahapalana Cattle eaters and the Goat Eaters in Srilanka.”

If some have to be killed, is it not better that it is cattle and goats that get killed and not human beings as was the case just a couple of years back??

      I say Sumanasekera,

This so called “Batalanda Ranil” is being awarded a honorary doctorate from Deakin University. Obviously they recognize him more than what our own men do; and that includes you.

It is regrettable that people like you had no comment to offer when we had a totteringly useless man as PM a couple of years back, whose main contribution was being a burden to the exchequer.

    Sinhellese are messed up;
”Though a so-called Buddhist nation, Sri Lanka has over the last twenty years
produced an extremely high murder rate and perhaps one of the largest rates of
suicide for the whole world. Sri Lankan Buddhists are all familiar with the five
precepts; yet over the same period Sri Lankan Buddhist males have become one
of the largest consumers of alcohol in the world. Politicians who have issued
liquor licenses for party donors who can give Rs 1,000,000 for election funds
have fostered this. The result is that even in small towns there are more liquor
stores than rural banks. Youth and unemployed men are often incited to join party
parades on the promise of huge quantities of booze. Sri Lankan Buddhists have
become huge consumers of meat; vegetarianism is touted but it is the rare exception
than the rule. In a famous temple in Kandy one of the monks in charge of
coordinating almsgiving for monks, insists that the lay devotees supply chicken.”

Hi Dayan, what a nonsense and utter rubbish you were writing? What any sensible person could expect from a person who is in the company of Weerawansa, MR and Jackal Opposition.

Your above analogy is absolutely flawed, man even one second after 13 is 13 plus not beyond 14. It’s like Weerawansa’s 2/2=0, and what MR being Ex President said about the proposed Chinese Steel Mill and oil refinery in Hambantota – heat from the steel mill would reached Nuwara Eliya, and vapour from the oil refinery would reached Badulla, Bandarawela and Monaragala. Man, what do all of you think, people eat punakha and grass, man there is a steel mill and a oil refinery on the outskirt of Colombo, did people experience anything bad from them.

What all of you want is power by any means – hook or nook – nothing more or nothing less but power to make merry and rob the people for good. People are not fools, and the boru shows all of you doing with MR and cabals looted money wouldn’t last for long.

    Dr. Dayan Jayatilleka

Can you answer why you had joined an Eelam professing party in your early days? We all know you are a unscrupless person. You are an opportunist. You do things what is suitable for the moment. Just get lost you fool. You can’t fool all the people all the time.

“What’s in it for Ranil and Mangala are..” Dear Dr. Dayan I think you hit the nail on the head.

Are we in for a triangular tournament between the RW faction, the people of this country and the other political parties, especially the Joint Opposition?

And on the 13th amendment, Wikipedia says:

“On 29 July 1987, Indo-Sri Lanka Accord was signed between Indian Prime Minister Rajiv Gandhi and Sri Lankan President J.R. Jayewardene which stated the devolution of powers to the provinces.[3] Hence on 14 November 1987 the Sri Lankan Parliament passed the 13th Amendment to the 1978 Constitution of Sri Lanka and the Provincial Councils Act No 42 of 1987 to establish provincial councils.[4]The amendment aims at creating provincial councils in Sri lanka and enable Sinhalese and Tamil as national languages while preserving English as the link language.

However there are practical problems in devolving land, police and financial powers to the provinces and the Government has stressed that the structure that is implemented should be aceeptable to all parts of the country.

In February 2016, the Chief Minister of Sri Lanka’s Northern Province, C.V. Wigneswaran sought India’s direct intervention in implementation of the amendment.[5]”
