The Mangala-Chandrika-TNA Constitution

The UNP leadership and Chandrika Kumaratunga are trying perpetrate an unnecessary but quite drastic, risky surgery on the Sri Lankan body politic. They seek to effect such change to the Constitution that cannot be limited to reform through the procedure of amendments. But what could such change be?

There is no Sri Lankan commitment to a new Constitution made to the Human Rights Council. Thanks to our neighboring friends, the only reference to a political solution is to the implementation of the 13th amendment, which is far more modest than that which is envisaged by a new Constitution. So it perfectly possible to leapfrog accountability/transitional justice and move directly to the political resolution item of the Geneva resolution, by implementing the 13 amendment, with necessary modifications and improvements.

The government’s contention that there is no reason for the Joint Opposition to oppose the government’s Constitutional project, is another example of the Constitutional bond scam now in play. Firstly the Rajapaksa administration’s joint communiques of May 21st and May 23rd 2009 with the Government of India and the UN SG Ban Ki Moon, and reproduced in the UNHRC resolution of May 27th 2009, did not promise to implement “13 Plus” still less “go beyond 13A”. Of the two communiques only the one with India mentioned 13A and that too was only to “implement the 13th amendment”.

President Rajapaksa promised 13 Plus and to go beyond the 13th amendment, and therefore new Constitution. But as anyone who has had a 13th birthday knows, if anyone asks your age six months after that, you reply “13 plus”—which in no way means you have gone “beyond 13”. You are “beyond 13” only on your next birthday, i.e. when you hit 14.

The question is why not go that painless route? The answer logically is that the government seeks a change that goes beyond a reform. Why would the government do so?

Indeed this is the point that Gamini Jayawickrama Perera has recently made when he reminded an audience of the vast strides the North Western Province made during his tenure as chief minister, and pointed out what was possible within the present system, asking pointedly “If I could do it why can’t you?” However, that pragmatic place doesn’t seem to be where the UNP leadership is coming from. Equally obviously the government does not intend to go in for a new amendment of a scope and scale which could be passed by only a two thirds in parliament without recourse to a referendum.

Just when you thought things couldn’t be morally worse , you learn that Mangala Samaraweera does not intend the new Constitution to be trade-off for getting us off the ‘war crimes’ accountability hook. When asked by the foreign correspondents whether the US and UK leaderships may no longer insist on the implementation of the Geneva 2015 UNHRC resolution, the Foreign Minister replies disgustingly that “ even if they don’t insist, we insist” on implementation. This means that the government’s agenda is not ‘quasi-federalism OR Special Courts on war crimes’, but ‘quasi-federalism AND Special Courts’, except that the sequence has changed and its federalization first, Special Courts second.

What this means is that there is a deal between the Ranil-Mangala-CBK troika (which has a pathetically few ‘official’ SLFP loyalists), the TNA’s Sumanthiran-Sampanthan duo, the Global Tamil Forum/the British Tamil Forum, and a handful of Western states with important Tamil Diaspora vote banks (and colonial hang-ups). What’s in it for Ranil and Mangala are (a) the prospect of permanent electoral support (and perhaps funding) for the UNP from the Tamil community in Sri Lanka and overseas, and (b) a transfer of power from the President to the PM and the UNP which would remove the roadblocks to and facilitate the smooth implementation of their re-colonization project of the transferring the ownership of the geo-strategically vital island of Sri Lanka from us, the people, the citizens, to them, the foreigners.

          Mahinda is the best thing that ever happened to SL and the sole purpose of the rest of your life should be to make Lankans understand that.

          Only thing is, you should wear a different hat from Nugegoda to give your words gravitas.

          I suggest Friedrich Gulda hat – when he gave up clasical music and went off to play Jazz that’s what gave his work gravitas.

        It is only a limited few who understand ‘Farce’ the way you and I do. Most others are happy to swallow old rope, because being literate without intelligence and overall knowledge to question, can be an extremely dangerous thing.

        Media in SL are a funny lot. Apart from being slanted themselves, they can boost up an individual without giving much thought to the damage they could cause. As for me, that Nugegoda rally some months ago was good enough evidence to classify DJ as an imposter, not a serious political analyst. No serious commentator would wish to be identified with a political movement such as that.

        In fact, there is one electronic media station which also gives DJ a lot of air-time to spew forth his crap. Regrettably there aren’t clever enough anchormen in that programme to take him on, question him and beat him at his own argument. They ask questions, he gives his answer, and they never contest it with a will to defeat him before moving on.

    It was an acknowledge fact that the Northwestern Province (Wayamba) had made vast strides when Jayawicrama Perera was the Chief Minister.

    Wayamba at that time was leading the Provincial Councils and had achieved the status of a Role Model.

    The Tamils actually did all the spadework for the devolution and somebody else is reaping all the benefits.

    It was a missed opportunity for the Tamils.

    The remnants of the defunct Northeast Province were jealously watching the unfairness of all this and gritting their teeth and waiting for the opportunity.

    Yes the opportunity did come for the Tamils but years later.

    But alas when the time came with the establishment of Northern and Eastern Provincial Councils

    What did we do? It is a sad story! We bungled and resorted to the blame game and the Tamils had become masters in the blame game and nobody could meet us in this game.

    Both the Northern and Eastern provincial Councils are competing for the last place. Sometimes it was the Northern province and on other times it was the Eastern Province, but the last two places were permanently reserved for the Northern and Eastern Provincial Councils and the Northern provincial council is spearheading in the “blaming game’.

    The Northern Province had never tried to make use of even the little opportunities opened by the 13 A in spite of The well known Tamil proverb ”Vallavanukku Pullum Ayutham”.This could be translated as “for a mighty even grass is a weapon”!

This govt or any orther government cannot change the mindset of the Tamils with their hatred for Sinhalese, therefore, a settlement is not possible at present. Best option is to disregard the grumbling goons and proceed with major challenges facing the motherland; economic, environmental, social. Hopefully, then, the grumbling goons will disappear in to the wilderness and assess their usefulness.

    The reason why India is messing with Sri Lanka’s constitution is that Tamil are Indian people (Indian subjects). The reason why Briton and the West messing with Sri Lanka’s politics is, because Tamils were their Coolies (indentured Labours).

    On what basis did the Colonial masters demarcate boundaries of the provinces? Or were they from the days of the Kingdoms of Sri Lanka? Just curious if Mr. Jayatilleke could educate me on this.

    Why have inherent bureaucratic inefficiencies, corruption, entitlement systems at such multi-levels? Is it cost effective and does it make sense to break it to so many different governments at Provincial levels? What criteria were used?

    Doesn’t it make more sense to have revenue generating units at the smallest local levels to spread democracy? But then do we need corrupt elections and expensive elections at all levels like in the US where Sheriffs, Judges etc are elected at local level?

    If racial exclusivity is going to be the criteria, what will happen to minorities in majority areas?

    Could you provide information?

    The US states systems was a result of Colonization by different groups of Euro-white settlers; different states came about at a different time. No difference in a White person in Alabama and Georgia in the South but they exist as different states.

    A guy in NY or NJ exist with different State identities but possibly same European tribal heritages. Different parts of the US were settled by different ethnic tribes of White Europe. In places like Minnesota(Scandinavian), people have different last names from Georgia for example or South Carolina(anglo). Then you can add the plantation economy and the civil war and inherent racial discrimination by law in the Southern states to the mix.

    India has different criteria, and seems to be based on ethno-linguistic regions. Malayalis vs Tamils. Andra vs. Kannada vs Bengali etc.

    How is SL going to be split for federal purposes? What sources of revenue will be local vs federal?

    Education?Will Tamils be charged out of state tuition for attending Sinhala eelam area top universities?

      Federalism is way of agreeing to disagree. The minorities in one state becomes majority in another. How one majority, A, treats its minority, B, in one province becomes an example to majority , B, in another province do the same to its minority, A. There may be a third minority in some provinces. For example, Muslims with their distinct religion form minorities in Sinhala and Tamil speaking provinces. They want cantons as in Switzerland where “linguistic strife and ethnic hatred remained unknown in Switzerland”.

      Local PCs will solve problems closer to local population. They are united as a nation but develop as different linguistic or religious groups. This way no one community suppresses another and no one is harmed. Peaceful co-existance is guaranteed that will pave way for development and prosperity. In fact Switzerland is one of the successful system and people enjoy the highest standard of living.

    Rubbish as always.

    All proposals for the devolution of powers to Tamil areas have been designed to decentralize merely administrative function to all provinces. This does not resolve the Tamil question. Any meaningful proposal that will be reviewed favorably by Tamils should deal specifically with the social and economic problems faced by the people of the Tamil provinces and not by the people of Sinhalese provinces. Unlike the Tamils, the Sinhalese people have not faced the devastating impacts of discrimination or watched hopelessly as their homes, streets, schools, hospitals, farms, industries and churches and temples deteriorated and fell into disrepair or were destroyed by bombing and shelling. Therefore, devolving the same powers to both the Tamil and Sinhalese provinces is not politically expedient. It is imperative that the ultimate aim of devolving powers to Tamil areas should be to permit its inhabitants to participate freely and directly in the planning and reconstruction of the war-torn areas and in projects designed to alleviate their social and economic problems.

    I think , What Dr.DJ is claiming is, Mangala, Ranil ,CBK , Sumanthiran, Sampanthan and others including Maithri in the prsent governmemt are not smart patriots like him and all of them and their supporters are Kallathonis from South and North India.

    The next project in the pipeline by Dr.DJ I guess is to change the surnames of SriLankans that are of European origin. That means names like Silvas,Fernandos, Souzas, Hooles,Niles, Eliezer will be changed to names like Jeyatillekes, Rajapakses, Weerawanses, Gamanpillas.

    The “risky surgery” that Dayan mentions is more relevant to him than the issue at hand.It should really be attempted on his peanut brain so that he could at least think straight and realistically.But even members of the GMOA are not fit to do the job these days,given their obsession with all things SAITM ! Never mind the plight of the poor patient who is unable to seek treatment In a private facility.To hell with them and their pain.
