The Need for A Genuine Change In Governance

Does one need to possess foreign citizenship to practice basic rights of life, liberty and free expression in Sri Lanka?

The meaning of national sovereignty

This question has become particularly relevant given steeply increased abductions and disappearances in recent months. If Frontline Socialist Party’s Premakumaran Gunaratnam (aka Noel Mudalige) had not claimed Australian citizenship, what would have been his fate or for that matter, of his co-abductee Dimuthu Attygalle? We do not need to search far for this answer. The still unknown whereabouts of other disappeared individuals, including a detainee who was abducted from the court premises itself, stares at us in response. This column has said more than once; the Government cannot simply shrug off these incidents and profess to a bland denial of the same. In the heavily monitored and militarized society that Sri Lanka has become, despite the ending of active conflict three years ago, bare denials do not suffice. They merely become acutely laughable.

So what pray, is this ‘sovereignty’ that Ministers and public officials, are fond of pontificating on? Is national sovereignty limited to the right of local politicians to abduct, kill, torture and slander people, to plunder and lay waste to the land? What rights does the common person possess, minorities or majority? As the Supreme Court has affirmed in countless (now useless) judgments, even a common criminal has the right to be dealt with in terms of the law. This is a basic principle of legality. So while the public has sufficient common sense not to treat Gunaratnam quite as a ‘gentleman’ as one Minister was heard to loudly warn, legal procedures need to be observed. Yet the law is degraded almost irretrievably, the courts are rendered passive and judges are reduced to mere bystanders. To horribly pervert Winston Churchill’s ringing call to the English people to suit the local context, never before was so much power wielded by so few and so blatantly against the common good.

And it is this very Government which, through its discarding of the law and of the Constitution, has opened up this country to internationalization of its internal affairs though its political leaders may roar to the contrary.

Explanations are masterpieces in foolishness

Furthermore, the explanations offered by government authorities are themselves baffling. For example the statement circulated to all diplomatic missions by the Ministry of Foreign Affairs this week following these most recent abductions is a veritable masterpiece in sheer foolishness.

Its main thrust is that Gunaratnam was deported from Sri Lanka as he had breached immigration laws by overstaying. So now are we to believe that every individual overstaying his or her visa or using a passport issued in a different name to that which appears on his/her birth certificate, would be liable to be bundled up, abducted by armed men in a white van and spirited away from the country? Is there not a legal procedure available in precisely these circumstances? Why is the Ministry of External Affairs so conspicuously silent on this point, though the same would be immediately evident to any common man or woman on the street?

The Government belatedly attempted to justify its actions by claiming that Gunaratnam’s spiriting away was because of a request made by the Australian High Commission and that similar compromises had been arrived at with other countries, for example, in the case of fishermen trespassing beyond Sri Lanka’s territorial waters. However, this purported justification raises more questions than answers. Could this heavily controversial abduction cum deportation be likened to the case of a few fishermen lost at sea? More to point, are we to believe that the law has been circumvented purely because a diplomatic mission, which has remained remarkably if not cannily quiet on this entire imbroglio, has requested it? Perhaps that is stretching credulity too far.

And by the way, it was not so long ago that a prominent ex-militant turned political supporter of this Government was permitted to use a forged official passport with Government blessings in his efforts to enter the United Kingdom some years ago. The moral outrage that we see on the part of the Government in regard to Gunaratnam’s (alleged) actions is therefore scarcely convincing.

An explanation that invokes disdain

The statement by the External Affairs Ministry is ludicrous in other respects. Quite apart from the near desperate attempts to ferret out minute contradictions in the version of events given by Gunaratnam and Attygalle, the delay (ranging from 12 hours in one case to close to a day in the other) in making a complaint to the police, is said to be damning. As the Ministry would have it, ‘it was obvious that a genuine abduction would have been reported to the police far more swiftly.’

But is this assertion made under the mistaken impression that we are living in some other hemisphere of the world? In the shadowy circumstances of these abductions, it is a miracle that a police complaint was even made in the first place. Nitpicking over the delay of a number of hours in making the complaint is likely to be laughed off by the ordinary citizen possessing an objective mind, let alone diplomatic missions.

The statement calls for objectivity and fairness to be shown in assessing allegations against the Government. That is only reasonable. But on that same principle, explanations issued by state authorities must themselves be fundamentally commonsensical for that same courtesy to be observed in turn. Disdain can only be the natural result when commonsense is lacking. It is no excuse to maintain, as some commentators have done, that the incumbent in the office of the Minister of External Affairs has no say in the issuing of such inane statements given the peculiar political realities of the day. If so, the Minister should ask himself the question as to whether there is any point in his remaining further at his post.

The entrenching of naked dictatorial power

These abductions and disappearances also teach us certain unmistakable lessons of their own. The Lessons Learnt and Reconciliation Commission (LLRC) was condemnatory of similar happenings during its time period of inquiry. Yet after its Report was handed over to President Mahinda Rajapaksa, these incidents have increased exponentially. What further proof do we need that this Government does not intend to take serious note of the LLRC’s Report?

The LLRC recommended that Sri Lanka should enact an offence of enforced disappearances. This predicates the necessary step that such an offence would carry with it, suitably serious penalties. There is a wealth of international and comparative law standards that can be drawn from, for this purpose. However, as against a Government that denies even existing legal safeguards, sophisticated law reform becomes a mockery. Even the time tested writ of habeas corpus is futile to all intents and purposes against outright denials of defence authorities. The duty of the State, in the minimum, to properly inquire and investigate abductions and disappearances is disregarded. It is heartening that some calls are being made to this effect by religious leaders but more public outrage must be evidenced.

Notwithstanding, it is a sobering reflection in this Sinhala and Tamil New Year that ‘state terrorism’ is now clearly projected at entrenching dictatorial power in the hands of a select (elected and unelected) few in Sri Lanka’s defence and political establishment. Unlike earlier, there is now no war or internal conflict to offer even as a minimum excuse. Greater social, economic and political devastation can only inevitably follow. In the absence of vociferous public opinion demanding a genuine change in the way that this country is governed, (or the lack thereof), such a consequence is merely a matter of time.

How many abductions during the last year? How many disppearances? Are all these from the thin air? All this Tiger talk is getting dull now. Please stop this hate talk. You only look silly.

    My question is why is this Govt just giving free publicity to these characters like Gunaratnam? We would not have even heard of this man and as Pinto Jayawardena says it well when she observes that we have more sense than to treat him like a gentleman. But even ‘un-gentleman’ should be treated on the law. And what about Dimuthu who – whatever can be said -has been a diehard political activist?

    The Government should pull up its socks and stop letting the Defence Secretary behave as if he is running the administration. In the meantime, let those of us who are still sane applaud courageous writers like this.

    Kishali, It is more likely your researchers are misinforming you. Or have you run out of ideas to write? If neither of them is the case, please check your pill stock, you are taking the wrong ones. What society are you talking about? The military having defeated the blood thirsty terror gang are now ivolved in development activities. They are helping in infrastructure development, house construction, cultivation etc in addition to demining and still sorting out remnants of the LTTE despots. The large force we have in the country is not something you have to worry about. Yes the war is over, but just because you feel bad for what you may have done, the government cannot lay them off that quick, it takes time. But it is nowhere near a militarised society as you would like to tell the guys who pay you.

    National sovereignity is limited to the peace-loving nationals of the country. Examples of likely exclusions are, the frustrated diaspora who are hell bent on destroying the country and the so called journalists who write tosh for diaspora´s dosh.
    You may have been away fro the country for too long or living in too posh a life in Colombo when on holiday. But bomding, killing, torture etc ended in the country three years ago. You can join if you want, we will celebrate again in a month’s time.

The duo’s dissappearence (Atygalle and Mudalige/Kumar/Bomba Gunda/Mr.Comic Relief/and as he was known at the Peradeniya university, “Leninge wum-attey” (Lenin’s left testicle)), was only linked to their launch of a new party. If not for the incident, nobody would have known the launch of the party. Nobody would know the existence of the party today. So they orchestrated and choreographed it well but played it poorly. They could have played it a little better by at least biting Atygalle’s nose or painting a sexual organ on her face. But as the JVP and their past-present cadres prove amply, they can’t even play a short drama. The duo were not tortured or killed or slandered and as LankaeNews says it was an “innocent dissappearence”. So Kishali, know your facts before you write.

    If anyone cared to monitor the movements of this buffalo called “Max Silva” one would really find that this donkey is really a pig with internet enabled. You can’t go near it because it stenches like a cesspit, you can’t look at it because it looks like a heap of feces and urine, it lives in the toilet pit of Modawansa, all this I discovered reading the filth it writes! No one so far could disprove Buddha’s doctrine, after death and for countless number of years this lying rascal piggy beggar would definitely be born in a hell full of feces to swallow!

      I am told that the book you are searchng, namely, ”How to become decent”authored by one H.E.Prabakaran’is available in H.E. Karuna Amman’s office library.They were great friends as you know. As you seem to be a great supporter of H.E. Karuna Amman’s government you may get it sooner than anyone. I will try to get it thorugh my old contacts with him when he bombed Dalada Maligawa, killed Buddhist priests in Aranthalawa, massacred 600 policemen in Kalmunai etc.Failing to get it from H.E. Karuna Amman you may try H.E. Kumaran Pathmananthan or H.E Daya Master or H.E George Master, if they have not hidden them to show their religious veneration of your government.

Mahinda & Gota never visited the war front always Mahinda inquiring the progress of the war from SF(very words of Mahinda I can remmember Sarath whats happening now from unknown hide outs).

          Jim Hardy, get over this Fonseka bandwagon, will you? Fonseka was a senior officer in the army when Ranil almost handed over the N&E to your pal Prabha for good. Why didn’t he challenge Ranil and fought the war to finish up the lot, or had he just got a brain transplanted when MR became the leader?Please don’t say it was a peace-package, it was not. The LTTE went on a killing spree, running a de-facto government while the Army was watching from sidelines. This Sarath was the same Fonseka who signed papers to withdraw fifty thousand troops from the Jaffna peninsula in 2000 as there was no political leadership in the country.           Sri Lanka Military Budget or MOD budget for 2012 is $2.2 Billion dollars.

          3 years after the end of the war. Education, Health and Housing sectors combined is less than the MOD..

          Such a waste of our hard-earned taxpayers money !!!!

          Don’t worry about defence budget. We bought a lot to piece meal the lot three years ago and now we have to pay them off. You couldn’t have fought a successful war and win without Hicorps and other weapons dealers. Yes they cashed in but the war’s over. Defence budget will be high for another couple of years, until we get somewhere in loan payments.The AmneLTTE International, HRW and other terror friendly gangs went bashing Sri Lanka for Menik farm IDP camps those days but now they are quiet because the camps are no more. Three years may be but the war they fought was a 30 year one, it takes time to clear things up.

    I am afraid you are wasting your valuable time by compiling a list of Max Silva’s consistent and puerile vomit which must be stinking to him but, the man he is, and the likes of him obviously seem to wallow in their own vomit. He will not change unless he voluntarily decides to see a psychiatrist. CT is encouraging his mental imbalance by providing a platform for his antics—perhaps for a bit of diversion from serious politics! The likes of Max Silva cannot look at anything except through the looking glass of the LTTE. For each and every comment/discussion, he must somehow laboriously bring in the LTTE and Tiger Terrorism. He talks more about the LTTE than even the LTTErs. –like an atheist who talks more of God than the believers. The LTTE now is a dead snake. But there are still elements in the Tamil Diaspora and the Sinhala community doing dances with that dead snake on their necks–some to frighten, some for pastime, and some to cover their own stink. Unfortunaely, they change the course of a needful and constructive discussion and a way forward for the good of Sri Lanka as a whole. In this ‘tamasha’, the country bleeds losing its direction!

      Abimanu, I’m not an educated person, but I noticed most of the educated people are blind. When they are going to start to talk or comment at least? If they have spoken out, no Rajapaksas or even this kind of Max Silvas. Max Silva’s comments are reflecting a layer of Sri Lankan society ( Kind of English speaking) . I’m actually enjoying his comments. He/She is exposing Rajapaksa mentality. ” Uneducated uncultured rascals” or ” carnival of fools”, but unfortunately we are ruled by them. These people will never understand the value of Kishali kind of writings, but still worth to listen them. I noticed lots of Max’s comments were not approved or edited out in the past. What I suggest is ignore his/her comments we should try to focus the subject!

    Furthermore, the explanations offered by government authorities are themselves baffling. For example the statement circulated to all diplomatic missions by the Ministry of Foreign Affairs this week following these most recent abductions is a veritable masterpiece in sheer foolishness.

    Its main thrust is that Gunaratnam was deported from Sri Lanka as he had breached immigration laws by overstaying. So now are we to believe that every individual overstaying his or her visa or using a passport issued in a different name to that which appears on his/her birth certificate, would be liable to be bundled up, abducted by armed men in a white van and spirited away from the country? Is there not a legal procedure available in precisely these circumstances? Why is the Ministry of External Affairs so conspicuously silent on this point, though the same would be immediately evident to any common man or woman on the street?

      Vasu, You have got your knickers in a knot as well, haven’t you? You have just swallowed the line as released by Mudalige/Gunaratnam/Bomba Gunda/Lenin’s wum-attey (as we used to call him at the university). He was abducted but released only after molesting him a bit, as he himself says. Anyway, he was no longer a Sri Lankan but a foreigner as he gave up the Sri Lankan passport when he changed his name last. He was living in Sri Lanka without a valid visa, but wanted to launch a political party in a country where he has no right to live in.Just imagine what would happen if you did that in Pakistan? or even in Britain? You can ask those thousands languishing in immigration camps in Heathrow.
      Deporting as soon as he was found was the best course of action to have taken than feeding him using our poor tax payers’ money. External affairs ministry is quiet because perhaps there’s nothing they want to know about a nutcase like this guy.

          Jim Hardy, Surely my comments can’t be similar to yours, I don’t give a toss about Lenin’s wum-attey or the lost soul of Nathikadal. Also one adult in you is enough to be childish on this forum to ask questions like you do. Simple answer to your first question is, Gota, Basil, Dulles are citizens of Sri Lanka. They may have citizenships in other countries but they are legal citizens of the country, and like most other 20 million, they do have a right to do politics in the country where they are citizens. Mudalige’s problem is, not only he is no longer a Sri Lankan citizen (so he automatically lost the right to live in the country, let alone doing politics), but he didn’t have a valid visa to stay in the country temporarily.
          Abduction story is the political lifeline of this Mudalige/Lenin’s Wum-Attey guy’s new party. Apparently, they were abducted and treated like royals, apart from the tiny bit of molestation of the guy. The story has to be more convincing than that, if you want anybody else to believe it. You are banging on and on about what the guys said,and the third rate web-rag LankaeNews says, but the abduction story makes absolutely no sense.

          When Fonseka’s suicide drama happened, the war was on full swing. Whether Fonseka had a lucky escape or not, the war was going to be fought as the government planned and won, it was all on the cards!

It is for this reason that Priyanka was keen to meet her in jail as she is interested to find the truth. It is good for the naive or especially those who want to make capital of a situation to bash the common enemy, but if one is blind to syphon facts from the media will be detrimental to all in the future. I believe you are one of those little intelligentia, who are convinced that it was Ragunathan who killed Lalith Athulathmudali carrying his identity? Good for you. She is the most intriguing and peculiar-looking insect in the sides of Indian politics today, fighting for a breakthrough to enter the family business of poltics. She would do anything to score a few points. You are hilarious, do you actually believe in these things you say you do, or is it a symptom of the condition?     When one reads a well written article, the discerning reader immediately begins to appreciate and respect the writer, as he or she naturally identifies decency, knowledge, insight, analytical skill, skill of making comparative analogies, sicere debate etc.

    However, the prejudiced, violently indoctrinated and blind reader would probably look for how extensively, the writer deviates from the reader’s world-view and severely programmed mind, and then begins to repeat his invective on the others at large.

    The cases in point above, also want some notoriety. If he is unsuccessful in getting the attention he craves, in legitimate ways that have respect, he will resort to nasty methods. This is somewhat akin to a child, not getting his parent’s attention when he tries to show them a badly drawn picture, proceeds to break a vase or ornament, simply so that he gets the attention, even if it involves a public berating or condemnation…..

    Ms.Pinto seems to be writing from either London,Paris or New York or some other similar place,hence her total ignorence of what is happening or who actually is being disappeared or may be she has joined the diaspora caravan.
    Yes,there are dissapearences and they are not acceptable under the normal law and order situation. But before out right condemnation of the government they as journalists have an obligation to research,investigate and give us an educated opinion and a real time account of what happend instead of copying Thisaranee who’s rants nobody except the LTTE diaspora reads and praise.
    The dissapearences take place in many ways. Like you accuse the government may be a culprit but so far not a single journo has been able to come up with anything worth writing,only accusations even though some of those who claim to be abducted are free in the open. Then Underworld godfathers/drug barons conduct abductions for ransome which also come under dissapearences. Then rival gangs do it for teritory or payment or any number of reasons. Then there is a section conduct make believe self abductions to run away from debtors,some run away with their secret lovers and some times by children and spouses to grab some money from the spouses or parents by scareing them. some have even engaged in prostitution while climed to be disappeared.
    This is the reality today and hanging all this on the government by adding up all the numbers together will simply encourage who ever is contemplating such action in to thinking that this also will be added on to the government account. This is a very dangerous trend to which journalists contribute too, apart from providing false data to human rights wallahs and the likes who love to have go at the government. It is very clear that some jounalists do it only for that pupose.
    Like Sri Lanka got rid of the scourge of terrorism, she has to now get rid of the drug menace as well, using any means becoz if not,this menace will trample upon every right of all the people in this country for which some are clamouring for now.
    The elimination of this scum from society has to be done by someone and now, for the sake of the future of this country and I know it is a far from perfect solution but until someone come up with a better solution this is what we are stuck with. There is a risk of innocents get victimised but that is the price we have to pay and if not innocents will be victims anyway,jounalists here can help minimise the damage by either working with the authorities or exposing wrong doings or preferably both.
    In other countries journalists do expose their government wrong doings. And they are victimised too. They don’t take cover behind H/R and F/R and run crying to a western embassy for a visa. Even now there is a Yemani reporter in custody for months without charge for exposing drone attacks on Yeman and President Obama personally interfere and prevents his release.
    This is not a perfect world and we have to make make the best of it.

    Hey NAK, get your comments straight! It is not the duty of lawyers or journalists to investigate who is responsible for disappearances but it is the duty of the government. Have you forgotten that plain and simple fact.

    If you read Pinto’s columns in the Times, you will find that she is not writing from London, Paris or New York but from Colombo and that too, from her experiences from places even as far afield as Tangalle and Akkaraipattu.

    Please do not just minimise the matter by talking of these disappearances as if they are like the price of fuel going up!
