The Republic Day

Today, the 22nd day of May is the 53rd anniversary of the Republic of Sri Lanka. It is not a national holiday.  The government has chosen not to celebrate it. It has instead preferred to honour the 4th of February, the day on which, through the good grace of the British monarch, Ceylon graduated from a Crown Colony into a British Dominion. I do not seek to belittle the efforts of Mr. DS Senanayake and Sir Oliver Goonetilleke who, in the midst of a world war, succeeded in securing for Ceylon that self-governing status. Our neighbour, on the other hand, celebrates its Republic Day, 26th January, with spectacular cultural pageantry, while also marking August 15th as Independence Day.

On 12th May 1946, King George VI, by an Order-in-Council issued at the Court of Buckingham Palace, provided a Constitution “for the Island of Ceylon”, and expressed the “sympathy” of His Government “with the desire of the people of Ceylon to advance towards Dominion Status”. On 10th December 1947, a Bill passed by the British Parliament and assented to by the King provided that “as from 4th February 1948, His Majesty’s Government in the United Kingdom shall have no responsibility for the government of Ceylon”, and “Ceylon shall be included in the definition of ‘Dominion’ in British statutes”.

Contrast that with the events that followed the general election of 1970. On 19th July 1970, the elected members of the House of Representatives met at Navarangahala, a theatre hall in Colombo, on the invitation of Prime Minister Sirima Bandaranaike, and proclaimed themselves the Constituent Assembly. In the months that followed, under the direction of the Minister of Constitutional Affairs, Dr. Colvin R. de Silva, they proceeded to draft a new constitution. On 22nd May 1972, in the presence of a large and representative gathering that included the Judges of the Court of Final Appeal and the Supreme Court, the adoption and enactment of the new Constitution was certified, and the Free, Sovereign and Independent Republic of Sri Lanka came into existence.

What took place on 22nd May 1972 was an exercise in autochthony. The government of the day had a comfortable two-third majority in the House of Representatives. With that majority, the government could have comfortably proceeded in the conventional manner and replaced the 1946 Constitution with a new Constitution that declared Ceylon to be a Republic. But, for the architect of the new Constitution, it was unthinkable that the Dominion of Ceylon should break its ties with the British Crown and declare itself a Republic through the exercise of powers granted by the British Crown through the 1946 Order-in-Council issued from Buckingham Palace. As the new Constitution declared at the outset, “Sovereignty” is in the “People” and is inalienable. Sovereignty no longer flowed from the British Crown. From the perspective of Dr. Colvin R. de Silva, it was through an essentially revolutionary process that the people of Ceylon should completely sever their connections with the British Crown.

Dr Colvin R. de Silva was uncompromising; nothing would divert him from his revolutionary journey. It was a bold, idealistic, even romantic exercise in autochthony. Mr. JR Jayewardene, the Leader of the Opposition, shared the excitement of the exercise. He expressed himself thus:

If, however, the victors and the vanquished – the vanquished on this side – agree to make common cause in enacting a new basic law by means of a legal revolution, there is no law that says you cannot do so.”

While I did not agree with some of the features of the 1972 Constitution, I was privileged to have played a small part in helping to steer the process successfully through a minefield of legal and constitutional obstacles, and the wholly unexpected insurgency that broke out like a whiplash in all its fury on 5th April 1971.

Why do we choose to ignore the 22nd of May – the anniversary of the day on which this country made that unique unilateral Declaration of Independence, and emerged as the Free, Sovereign and Independent Republic of Sri Lanka ?

    I believe it is now contrasting 3% JVP and the rest who voted for the NPP government. They appear to have internal issues relating to capacities and capabilities. This was my opinion at the time: if Jeppo became leaders, how would they ever work with other parties? They acted as if they were the only clean party capable of achieving great things, despite the fact that citizens mirror the actions of politicians.
    Most of the lies they told prior to the election have since become hearsay about salt production and other topics. Handunetti is completely naked before the press today.

        I understand the pain of a patient who refuses to undergo a series of gender operations.
        The same is true for our MAHARJAA, whose abusive politics devastated this hell hole during his reign. We harvest the consequences today.
        Most of his deliberate actions created an environment in which criminals could easily breed. Today, the same man cannot even walk well, but the abusive nature is still not entwined.

        Hello Deepthi,
        Congratulations on learning the Lessons from British Imperialism – Divide and Conquer. Thanks also for considering that Leela and OC are Intellectuals, or did you mean, Paul and me?
        As for Original Stuff, and typing etc. I was the first one to convert the Lama Bubble Helmet for Scuba Divers use. It was originally developed for Saturation Diving use. We did our Trials in Boddam Harbour and Cove Bay. We discovered all the pitfalls like making sure that the Bubble Helmet is pressurized and properly sealed before you descend into the Water (it has a very flexible Neck Seal).The BBC wanted to use these for Underwater Documentaries. However I was offshore at the time and my Colleague was sent down to meet David Attenborough and demonstrate the Helmets.

              I am already aware of your Engineering Knowledge. I can’t remember you ever using ChatGPT or other AI.
              My intention was just to point out that some of us have had experience with Complex Engineering Problems and are not just “mouthing off” about issues that we know nothing about. Plus it was funny and very embarrassing to my Colleague.
              Apart from that, if you were Lester you wouldn’t have been able to resist the “Bait”.
              However there are some very clever “undercover Trolls” that are able to take on different Personas in Social Media.     It is a day we all should mourn. Instead of saying British go home it should be British please come back. In comparison under the British Rule Ceylonese enjoyed better benefits much higher dignity than what we suffered under our own rulers. There were no mass killings massacres, tortures of the same intensity and severity the locals had to endure under British Rule in comparison to what we are enduring. People get killed while in Government care. British established world class health care, education system, judiciary etc. The Judiciary has gone to dogs. MPs those days were men of high distinction like Dr. N. M.. Perera, Dr. Colvin R De Silva and all.. Sarath N. Silva and Mohan Peiris as CJs drove the judiciary to gutters. Our own rulers robbed the country coffers forcing it to perilous debt. Except the notorious crooks everybody else is too happy to say goodbye including the present author to Srilanka.

        SJ, you are unaware that Britain still retains a fair amount of discipline not seen in many other nations. Eg. If what was allowed at Harvard for foreign students to protest in streets for anti semetism in uni. and land, if any did this in Oxford, there would be no waiting to be punished by the rest. They would chase them away to their own habitats. USA had to wait for Trump to punish Harvard. Not so in UK. The king has the commonwealth too which he serves well.

        HP is only saying that the British left behind a good health, education and legal system for us.. That was 70 years ago. You think it is fashionable to take swipes at the British . What if they examined your performance ?

        Our systems have all gone down . Just look at the smallness of the professors mind and you will know all about what happened to our education standards . How many text books have you written on the subject you are professor of ? If you have written anything, are they considered authorities ?

        I am sure SJs children and family are living in the bad West if not UK.

        As to British health standards – their private health services are top of the world. Ask Rohan 25 – 25 about Harley street , he thinks it is a caste !

          The British could not handle malaria and it took the Suriyamal campaign to deal with it.
          Rural healthcare was dealt with mostly by traditional practitioners and it took much after 1948 for health services to reach rural SL.
          The provided health service of some kind for the plantations as they did not want the slaves to die early, and that caused resentment among Sinhalese villagers.
          As for education it was not the Brits that expanded school education. that was why the North went way ahead of the rest, but for Colombo.
          The legal system was not for the poor man ever.
          Some of us imagine a glorious colonial past. My resonse was about that.

            There are plenty around who can vouch for the steady degradation of the NHS since the 1980s.
            Harley Street, I can name a few like the one who sowed up after an op leaving a piece of cloth inside the patient. That is where people go to waste their excess money.
            One gets many times better treatment in South Asia now for far less.

                Hello Deepthi,
                I have spent a lot of time in various Sri Lankan Hospitals and even though I know that the British NHS has declined, it is still “head and shoulders” better than Sri Lanka.
                I have visited Kandy Hospital, Gampola Hospital, Peradeniya Teaching Hospital, Cancer Hospital in Maharagama and the General Hospital a few miles from the Cancer Hospital.
                You would not see packs of dogs roaming through Hospitals in the UK. In Sri Lanka you have to provide your own bedding on Beds that are Florence Nightingale’s rejects from the Crimean War (1854). Beds are even located outside the Wards in the Corridors, permanently, not just as a result of unforeseen circumstances. Staff are overworked and have to work with systems inherited from 1948 practices. I won’t mention Salaries.
                Health & Safety Inspectors from the UK would have a fit if they visited any of the Sri Lankan Hospitals that I have.
                I could write a book about all the issues, not to mention the Abysmal IT Systems and the stacks of Files carried from Hospital to Hospital by Patients and Staff.
                I’ll stop my “Rant”now.

                  I completely agree with you LS. I’ve been visiting many hospitals across Europe for our projects, and I’ve made comparisons.

                  I also accompanied my mother to Lanka Hospital, Coombo and several other hospitals in Sri Lanka before she died about 9 years ago. Also, during the covid cirisis period, I was forced to have my PCR tests at Nawaloka Hospital, and their services do not meet the high standards in Europe.

                  Even if NHS services are not the best in Euorpe, their standards are far superior to those of Sri Lanka’s so-called “private hospitals.”
                  I find it beyond despicable that a man would hide in WILPATTU jungles and repeatedly make silly statements without pre-check.

                  Compared to the average European citizen, Sri Lankans have significantly lower standards and general knowledge of their own health care information. As you may be aware, people in our nation, like those in other South Asian nations, continue to believe in invisible forces whenever they suffer from heart, cancer, or mental illnesses.
                  I was well aware that some patients did not give their diabetes and cancer enough thought; if they had been more informed, some of them might have lived for a few more years. Sorcery, astrology, and foolish Hindu, Buddhist, and Sinhala beliefs prevent patients from seeking medical attention from western doctors until their condition worsens. The astrologers and Kovil’s owner should be held accountable for the mess they made.

              Maybe its sour grapes but your contempt for UK & Europe is quite obvious. Have you experienced the NHS? Before you believe in all you hear, carry out a fact check. Medical standards in UK are high & if a surgeon left bits inside the body after an operation, is very unlikely to get away with it unlike in SL.
              Waiting time for minor surgery may be long but I will depend on the NHS in my old age.

                Have you wondered why it could not handle COVID-19 better than most Third World countries?
                I know several who are on long waiting lists for serious ailments simply because their life is not at immediate risk.
                I know people who came over here for private medical treatment because they could not bear the waiting for much longer.

              deepthi silva, not true that malaria was blamed on the gods. It was very carefully sorted out when there was an epidemic, and the medicines available then were given. Later with more sophistication, preventive measures were added. SL is not supposed to have epidemics any more, though individual foreigners bring in.

                If Sri Lanka can eradicate this species, Aedes aegypti mosquito, then there is a chance of reducing these outbreaks. But that will not help with Influenza and other Viral Infections spread by Humans.
                On my first visit to Sri Lanka in 2013 a Poster declared “Welcome to Sri Lanka, Malaria Free” My Sri Lankan Daughter in Law said it should read “Free Malaria”
                I am fairly sure that there is still a low level of Malaria. My Brother in Law was treated for a mysterious disease and was given these Medicines – Malarone and Qualaquin (Malaria Treatments) together with another that I couldn’t read. He was also given the usual Ayurvedic Juju – tiny white pills.
                I spent quite a few years in West Africa and I’m very familiar with these Medicines. We took Chloroquine either Daily or Weekly as Preventative Treatments. Occasionally a staff member (newly arrived) would actually contract Malaria and be given an Intensive Course.

                  It was another Scot that received the Nobel Prize, Robert Ross, born in India that elucidated the complete Life Cycle of the Parasite. In my visits to the Regimental Cemetery I saw quite a few Graves of Soldiers, their Wives and Children that probably died of Malaria or similar Diseases.
                  As for “the country being declared malaria-free by the World Health Organization in 2016”, I have my doubts, but only concrete evidence will show if I am right (or wrong).

    I understand the pain of a patient who refuses to undergo a series of gender operations.

    With ACTRESS Malinii Fonseka’s passing, all parties and their leaders currently have the opportunity to unite and protest the incumbent government’s savage public statements. Not every decision made by former leaders should be viewed as being against the will of the people. For instance, it is not appropriate to criticize the nation’s movie queen for receiving money for her medical care, but JVPrs made it more public than they could. I believe that when our politicians make public statements, they shouldn’t be like sharp swords. That can only incite hatred rather than peace and contact everything.
