The ‘Sil Redi’ Project

The former Secretary to the President Lalith Weeratunga and the former Director General of the Telecommunications Regulatory Commission (TRC) Anusha Pelpita were declared guilty by the High Court under Section 386 of the Penal Code of ‘dishonestly misappropriating’ a sum of Rs. 600 million belonging to the TRC by remitting the said sum to a bank account of the Presidential Secretariat to be used for the purpose of distributing sil redi during the last Presidential elections. They have each been sentenced to three years rigorous imprisonment, a fine of Rs. two million and either the payment of Rs 50 million in compensation to the TRC or a further two years of rigorous imprisonment. Many people including the media have asked me about this matter and I feel I should make my views known to the public.

To say that this conviction and sentence has shocked the country would be an understatement. The judgement itself states that neither Lalith Weeratunga nor Anusha Pelpita had appropriated for their personal use any of the money used to purchase sil redi. From my point of view, they only carried out legitimate instructions issued to them by the President of the country. The verbal instructions given by me in this regard have been recorded in the form of minutes placed by Mr Weeratunga on correspondence with officials of the Presidential Secretariat. On 20 March 2014, Mr Weeratunga wrote a minute to the Senior Assistant Secretary of the Presidential Secretariat outlining eight projects that I had ordered funded through the President’s Special Development Fund during the year 2014.

The sixth item on this list was providing ‘material aid’ to the devotees observing sil at temples on Poya days. The other projects on the list included funding for the IT section of the Kotelawala Defence University and assistance to construct houses for low income earners in the former ‘border villages’ etc. On 12 May 2014, in yet another minute to the Senior Assistant Secretary Mr Weeratunga had stated that I had given instructions that sil redi be distributed to devotees observing sil on Poya days. This was long before the declaration of the presidential election. The purpose of the President’s Special Development Fund which had an annual budget of Rs. 1,000 million and was started in 2012, was to fill the gaps left by other ministries and to meet requests made directly to the President. The Coordinating Secretary for Religious Affairs of the Presidential Secretariat Ven. Watinapaha Somananda Thera was in charge of implementing the sil redi project.

At the latter’s request, the Economic Affairs Ministry carried out a survey through Samurdhi Niladharis to identify the requirements of sil redi at temples countrywide. The suppliers were instructed to hand over the sil redi to a main temple in each Divisional Secretariat area from where they would be distributed to other temples. This was a project implemented countrywide, involving 11,021 temples. This was aid supplied to the temples, not to voters. After the sil redi reached the temples, the Chief Incumbent monk became the sole authority who could decide when, how, and to whom the sil redi would be distributed. No time frame was imposed on the temples to carry out the distribution. They could have been distributed either immediately or even a year later at the discretion of the Chief Incumbent of the temple.

The mode of distribution did not enable the beneficiaries to be selected on political grounds. School uniforms are also distributed towards the end of the year and cannot be withheld even if an election was on. Nobody would suggest that the receipt of school uniforms during an election would influence the result of the election. The sil redi was also general state aid distributed across the board to Buddhist devotees just like the school uniforms. In fact the suppliers of school uniforms to the government had been mobilised for the sil redi project as well. The sil redi was not meant just for adults of voting age but for daham pasal students observing sil on Poya days as well. It was stated in the judgement that the sil redi parcels contained a label which read “Mahinda Rajapaksa methithuman Mahinda Chinthana prathipaththi walata anuwa yamin karana daham pandurak”. (A religious offering made by Mahinda Rajapaksa in pursuance of Mahinda Chintanaya policies.)

This was only a label stating the provenance of the sil redi, and in any event, is not in violation of Sections 72 and 68(1)(e) of the Presidential Elections Act No:15 of 1981, which deal with the display of printed matter during elections. Section 77 of the Presidential Elections Act on ‘treating’ voters, also does not apply to this case because the sil redi was handed over to temples without any time frame for distribution and were provided to all regardless of the political affiliation of the temples and the devotees. Lalith Weeratunga and Anusha Pelpita were never charged for election related offences even though this is being portrayed as a case relating to the misuse of public property during election time. Under Section 164(4) of the Criminal Procedure Code, the charges brought against the accused have to clearly state the law under which the offence said to have been committed, is punishable.     

The reason why money had to be obtained for this project from the TRC is because on 14 October 2014, the Chief Accountant of the Presidential Secretariat sent Lalith Weeratunga a note stating that the allocation of the President’s Special Development Fund for the year 2014 was Rs. 1,000 million and that Rs. 400 million of this had to be given to a project of the Kotelawala Defence University and that there was insufficient funds for the sil redi project. Lalith Weeratunga replied to this with a minute on 15 October 2014 instructing the Chief Accountant to release the money to the Kotelawala Defence University and that the money for the sil redi project will be obtained from the TRC to be reimbursed later. Mr Weeratunga had written to the Director General of the TRC on 30 October 2014, stating that it had been decided to obtain financial patronage (mulya anugrahaya) for this project from the TRC.

Thereupon, Anusha Pelpita Director General of the TRC had prepared a board paper for this purpose on the same day seeking the approval of the board, (a) to allocate Rs. 600 million to the Corporate Social Responsibility budget of the TRC as an extra budgetary allocation, (b) to approve the donation of Rs. 600 million to the President’s Special Development Fund and (c) to spend this amount from the corporate social responsibility budget of the TRC. This paper had been presented to the TRC board meeting held on 15 December 2014 and all three proposals had been unanimously approved by the Commission. The money from the TRC had been remitted to the Presidential Secretariat account on 5 December 2014.  On 29 December 2014, Lalith Weeratunga sent a note to the Chief Accountant stating that the money from the TRC should be reimbursed as soon as the allocation for 2015 is received and that at least Rs. 200 million should be paid back in the first quarter of 2015.

According to Section 22F(3) of the Sri Lanka Telecommunications Act No: 25 of 1991 as amended by Act No: 27 of 1996, the board of directors of the TRC can authorise any payment in the performance of its tasks. Sections 218, 115, 65, 66, 68, 93 and 94 of the Financial Regulations of the Government of Sri Lanka also authorises ‘Chief Accounting Officers’ (who in the case of the Presidential Secretariat was Lalith Weeratunga) to transfer money between government agencies under his authority on the basis of reimbursement. Regrettably, the written evidence presented to courts in the form of Lalith Weeratunga’s minutes giving instructions to the Chief Accountant or the Senior Assistant Secretary of the Presidential Secretariat in relation to this project have not been considered in the judgement delivered by the High Court.

The prosecution brought 21 witnesses to prove their case against the accused. The High Court has not taken into account the evidence provided by prosecution witness No: 13 Hewage Emali Priyanthara, No: 20 Ruwani Saumya Gunaratne, No: 15 Rev. Watinapaha Somananda Thero, No: 04 Saputhanthrige Chandra Jagath, No: 14 Mallika Kanakanamlage Jayantha and prosecution witness No: 5 Amarasinghe Lekamge Don Gunaratne (the Chief Accountant of the Presidential Secretariat) on the grounds that they had worked with the accused in the Presidential Secretariat and the TRC and were also connected to the sil redi project and that they had been partial (lediyawak) or sympathetic to the accused. These were witnesses called by the prosecution – not the defence – and their evidence had been provided to courts under oath.

This has very serious implications for state employees at all levels. If for example an employee of the Customs Department is taken to courts for allegedly violating procedure, the only way to prove or disprove that such a violation took place is through written and verbal evidence from within the Customs Department itself. If in such cases, even the testimony of witnesses brought by the prosecution is not taken into account on the grounds that they had worked with the accused and were therefore partial, the accused government servant will have no defence at all.  Another matter of grave concern in the case of Lalith Weeratunga, is that the handwritten instructions given by the highest State official in the land to his subordinates have not been considered by the courts.

If this becomes a precedent, no State employee charged in a court of law will ever be able to prove his innocence. The unanimous approval of Anusha Pelpita’s board paper by the TRC board of directors on 15 December 2014 has also not been taken into account  in a situation where the authority with exclusive power to utilise the funds of the TRC is the TRC board of directors. This will have serious implications for all private sector and state sector bodies that are run by boards of directors. The severe sentence imposed on Lalith Weeratunga and Anusha Pelpita is not because they enriched themselves through corrupt means but because they carried out the instructions of the head of state to distribute sil redi to temples in pursuance of the government’s obligations under Article 9 of the Constitution to foster and protect Buddhism.

Under our constitution, the direction and control of the government is the responsibility of the cabinet of ministers (including the President) and the public service is expected to work in good faith to achieve the policy objectives of the government. Therefore public servants who carry out lawful instructions issued to them by the President and the Cabinet should be protected if there are no serious allegations of corruption against them.

      If I may say so I was shocked not having seen them convicted criminal marching to Welikada but the manner FORMER president has been abusing people s fund for visiting prisons.
      Surel he has allocated funds for his travels. But if he is WISER, why not former president like many other formers better use them for the benefit of the poor of the poor whose numbers are over 30% of the population.
      If leaders would not behave exemplary what we would give to our youth ?

      MR has been the only leader who has visited ALLEGED criminals or CONVICTED criminals in country’s prisons. THERE HE HAS MADE HIM A TOP OF LIST but the message he has been passing is VERY WRONG…. beyond understanding.
      Now on, CRIMINALS would start discussing on the topic for sure.

        Why should he be passive in politics when the country is in utter turmoil. Maybe other presidents didn’t have the heart to look aftet the country even when they were out of the office.

      I am shocked that it took 2 1/2 years to do a simple prosecution. Just shows how slow the process is. Made to understand that this was one of the cases given priority and was called no less than 30 times and still takes almost 3 years. Bloody shameful system.

      Damn good lesson to all govt employees specially the members of the forces, Police and Secretaries to Ministries that you should do the right thing and not lick bums of politicians.

      Hope the govt servants will now wake up and start using whatever the intelligence they have and think for a moment before executing orders from politicians. They will not be there when you are in trouble !!!

FCID needs to check their family members and close relations actual wealth .

        It took 2 1/2 years because of Dealdaasa Rajapaksha. Lalith Weerathunga and Anusha Palpita directly produced before high courts instead of Magistrate Court to get the bail under the guidance of Dealdaasa Rajapaksha.

      I have noticed this for the few days and I feel lanken in general have been misled by media.

      No good about the verdict has been in press, but it has been open to discussion further.

      Was this the case for all other verdicts made on other citizens. Here just becasue these men were known to the public they have been given the focus.

      I think it is unfair, here, to criticise on this.

      Former leader has been doing very wrong thing, but WE CAN EXPECT HIM TO REACT CORRECT WHEN LOOKING AT HIS SECOND TERM in which he behaved as if he is the only person to have done much tot he nation, and that led him to the highly abusive MAN of the nation.

      That was not just because of your take part only, but the colletivity succeeded.
      Whatever said and done, it was the last part of the war.
      Almost every leader did their part. No special pride I may have about you, but when considering your behaviours not being able to stay educated, and civilized, you have done all harm to the nation but after the war is no longer there.

      From your point of view stealing and robbing public funds is legitimate, and both culprits knew it was illegitimate and unfortunately you used them. They were well aware of the illegitimacy of this transaction.

      You should dip into the billions Rupees and dollars of public funds stolen by you, your family and cronies, and dip into that to save and pay the fines of your henchmen. They shoyld be thrown out of the prison hospital, given prison clothes, to wear, prison food to eat, and put on hard labor.

    People voted for you not for the love of you, but your courageous decision to defeat terrorism in the country. This help save many lives including your and your brothers. But, you have destroyed the country. You and your families wasted the hard money of people for your own uses.     Breaking News

    President Maithripala Sirisena is considering appointing former Deputy Minister of Tourism Development and Christian Affairs Puttalam district MP Arundika Fernando to a new ministerial position after he apologized to the President yesterday.

    His apology comes a day after President Sirisena sacked him from his position using executive powers vested in him in Section 46. 3 (a) of the Constitution, for making statements in support of former President Mahinda Rajapaksa.

    The former Deputy Minister had met with President Maithripala Sirisena yesterday for a private meeting, the details of which were not made known to the media.

    Lalith Weeratunga has told fox news that he will be the 2020 Presidential candidate. Immediately upon swearing in the President LW is going to appoint Anusha Palpita as the PM. GR as the Minister in charge of white vans NR minister in charge of women’s affairs YR as the minister in charge of mass media and sports Chichi rajapaksa as the minister in charge of Rocket science and Mr 10-percent BR as the minister in charge of finance, and lands in malwana, matara, and gampaha. WR as minister in charge of Justice and floating armory.

    Let me assume what you said is true and the decision to distribute the sil rethi was made long time before.

    The allegation was this sil rethi from state funds was distributed at time of the elections. to influence the people to vote for Rajapakse. That is a reasonable allegation because of the timing. May be it was never intended that way but still that is how many are bound to think. There is a Tamil saying when you drink milk under the palmyrah tree people will say you are drinking toddy and you are a drunkard.

    This is where the problem is, prior to 1981 before the presidential system was introduced, just prior to parliamentary elections the Government is dissolved and state is run by only a caretaker Government. During this time no one can abuse state privileges and being only a care taker Government no special things can be done such as reducing prices for essential commodities, waving tax on importing vehicles and so on definitely aiming to lure or entice the voters seeking an unfair advantage by the party in Government.

    Even My3 Government is guilty of this when the prices of imported vehicles is now reduced just before the forthcoming elections and this too is a election related offence. The only solution is to President by law should step down about two months before the scheduled Presidential elections and when there could be no way he has powers to use state privileges to his reelection.

    If such a system is not created certainly ‘drinking milk under a palmyrah tree!’

    It is good that you came up with your version of this particular case. Thanks for clear us neatly. In fact, the golden era of Sri Lanka’s recent history was nothing but your 10 year ruling. From eradicate terrorism to boost the economy to uplift the living standards to infrastructure development to town beautification to building high ways to expand the IT industry to various other things, you were instrumental. More than anything else, your effort to keep the national security intact should be greatly appreciated and will be with Citizen Perera’s mind for a long period of time. However, I must say, in the law and order, you were not impressive. (But the current buggers are worst. Select and hunt is what they do. Otherwise how Rajitha, Apachi mala etc., are going scot free. And Ravi K, Arjuns, the other two letter man, RW? Then, panama papers man Champaka? Killing the democracy, democratically is yahapalana motto it seems).

      By large you hve been most abusive by all nature to see what MR did was fine. To the economy or in other areas, he ended up making it a mess. Recently faced floods and Gabage dump related disasters woudl not have been the case, if MR had performed it well.
      Today, thanks to the DUO we see some JUSTICE is being served to the nation.
      In the rest of months to come, they will have to bring all the other culprits including those who lived on the black money of Rajakshe ( i mean the guys of your nature) to the books.

    After reading the whole Blah blah, it appears to be, for the first time Sinhala Only Jurist court had thought in proper direction and delivered a judgement. The entire explanation is a convulsing cook up. There is nowhere any reason why this person is not called for inquiry while GLP called in just to suggest the suicide jacket, which was suspected planted by army, was purported to transport Wellawatte.

    It is not just these two crooks, but the entire staff that put together 2015 Budget in November 2014 had to be charged with election violation.     As the 2014-2015 all Budgets were frauds, so a 1000 million was sitting on TRC without proper time table to spend it. This is called slack building to misappropriate with fake explanation eventually. Budget staff has to be called into explain the 1000 million, as the country was borrowing additional money to pay borrowed monies that time.

    Then a 600 million was spent on unwanted Sil and it is being compared to school uniform, which is an annualized, well regulated, well substantiated, well budgeted expense for normal understanding(I do not know how much is school uniform Budget). These people have to be whipped with New King’s Thirukural to make them come to common sense when they say these things in a country which call it secular. Here, a religious expense has been made without the relevant religion’s ministry getting involved in it or provide an appropriate budget.

    There is nowhere an explanation provided of existing procedure of one fund being transferred to other project. There were no stabilizing mechanisms were established in TRC if it had faced emergency and additional draw back was the fund was never replaced as the government was expected to lose in election. Treasury officials has to explain in the court why such a serious loophole existing in budgetary procedure to transfer funds from one project to another without proper procedures.

    Continuing on the minute game, there is no minute has been submitted by the crooks punished of how the timing was set to distribute. This appears to be apparently a technique to defeat any possible audit if they were really distributed any time at all. How can a 600 million government fund go without proper dating of distribution? That alone suggest the minute on that matter probably conveniently not written down but passed all down below with word of mouth. This suggests the court has to order for the audit of distribution and punish all the crooks involved in that too.

    Continuing on the fund transfers from one department to another, after all as there was no distribution date so even if the Sil-Reddi is important expenses like school uniform, releasing the fund could have waited until the distribution date was fixed, as it was not an emergency like the Hambantota tsunami, where emergency fund needed unexpectedly.

    The entire explanations suggest, from top down to bottom it was a clear game. The entire gang has to be produce at the court, investigated and punished. But Yahapalanaya is punishing selected ones only to advance its political game too.

    Your sell by date had gone just after the end of the war. In this case the court was convinced that the people’s money of Rs 600 thousands were given as a bribe but right thinking people had abandoned you long time back. Even without the convincing evidence of the prosecution your notoriety is such that you were incapable of doing anything good to the masses and therefore the obvious was the fact. The looters and fraudsters who benefitted from the corruptive government of yours will work for your return but they are in a minority. You would have better used that money to feed the poor and malnourished and that would have convinced many you were a people’s man and the convicted government servants needn’t go through the humiliation of serving prison.

    But in this affidavit, you’ve accepted that funding was remitted on December 5th 2014. But the TRC board unanimously approved on 15th of December. Man, I feel sorry for your inabilities to cook the TRC board meeting date to before Dec 5th 2014.

    This should not be viewed by the Government as a box-ticking exercise to placate the Council, but as an essential undertaking to address the rights of all its people.

    Readers may remember that I, few days ago, posted those UNHRC HC’s words with my comments. At his level, The Commissioner is not saying something that absolutely unfounded. In fact, there are many more classic example of Lankawe hoodwinking with Appa Diplomacy techniques, out there. One is this case verdict. Chitanta and Yahapalanaya politicians has committed dangerous crimes wherever they slept, wherever they sat, wherever they stood and wherever they walked to. But Yahapalanaya is hiding all those and filing cases on petty thefts and vehicle misuses. The punishments are essentially hospitalization. (Not for the criminals’ mental conditions, though landing them in metal facilities for life time too would be an appropriate punishment for these incurable high crimes.)

    For amazingly enough, right after Commissioner Prince Zeid read his statement, Lankawe’s New King repeated his famous motto that “No leader, No commander, No soldier will be touched by anybody” in SLFP’s 60th annual conference. Then he ceremoniously signed the OMP bill to be gazetted. One may think if this guy is “Pinching the Child and rocking the baby”. Not really. This guy is really, really rocking High Commissioners’ cradle to keep all the issues dormant until the Ranil can have the five villages land in Hambantota surrendered to China and have obtained the protection confirmation from China against the Commissioner.     CPA Saravanamuttu has released a statement saying that OMP can be contested by anybody as unconstitutional. He argues OMP should not be connected to New King, and he wants an appropriate minister to take care of it. But the New King purposefully hurried on that to defeat OMP’s purpose.

    I am so surprised that none of the Mahanayakes advised the former President MaRa to volunteer as a witness and tell the truth to courts when the case was going on. The case involved religious practices. I consider Budhism as one of the great religion.

    Was the ex President strongly adivised by Wijeyadasa Rajapakse former Justice Minister and Buddhism Affairs Minister what to do when the case was going on ?

    I am sure the current Mahanayakes will put country’s laws in par with the religions if not above. The judge who passed the judgement followed the laws under the current constitution.

    So, Mahinda R., you think it all right to have a huge ” President’s Special Development Fund” to assist those who appeal direct to you, at the expense of hardworking guys who avoided wooing politicians. But this was money belonging to the country, not to you personally.

    Mallaiyuran and Handunetti’s wife were right in how they responded to that November 2014 budget. Whether it was before or after Maithri came forward as the Common Candidate, I can’t remember. By then, I was desperately hoping that we could have a change of regime, but when I heard the Budget Proposals I despaired. It was all handouts.

    I was disappointed that almost the first thing that the new government did was to reduce petrol prices. Now at last we hear of genuine concern for the environment. Plastic bags are still being given by most, but the public have begun to understand the need to change life-styles.

    So, what we now gather is that more than four years after winning the war (what a relief it was to hear that VP was dead, although I refused to allow a class of teachers – who included Tamils – to watch it all on T.V.), Rajapaksa was not looking for ways of reconciling, but wanted to hand out sil redi, make special allocations to the armed forces, and, well, helping border villages SOUNDS all right: I’m sure they were given a torrid time by the Tigers, but were they not one of the irritants that led to . . . – this becomes too complicated!

    Could some smart pupil of the author of this (I mean the erudite Gamini Lakshman P.) please study all this and see if Rajapaksa cannot be incarcerated?

    This will be a very strong statement for the appeal. Did the accused utilize the money for their personal use like in the case of Bond Scam? The answer is a clear ‘NO’.
    What’s the majority of Sri Lankans (Buddhists) think about this verdict? The government tax policy does not help the poor at all but in most Western countries the tax policy has been designed to help the lower income groups!
    We know that MR’s decisions are always straight forward and have helped the poor Buddhists whereas other so-called leaders have not cared about them. Please remember that the Sinhalese (specially the Buddhists) in Sri Lanka have been undergoing tremendous difficulties ever since the Portuguese captured the Maritime Provinces in 1505. Under the Dutch and the British they were deprived of all their rights and still there is no one to speak on behalf them. This is a country where freedom fighters are called terrorists and terrorists are called freedom fighters.
    SWRD, Mrs B, and MR are seen as leaders who tried to address this issue of deprivation by bringing in various socio-political and administrative changes. There was resistance in the past, and there will be resistance in the future too. However, the changes will definitely occur! That’s called democracy! In short, no country can be governed according to the whims and fancies of foreign agents living disguised as ‘natives’ in that country. Many of them have Sri Lankan names mixed with Portuguese, Dutch, or British surnames or first names. Look at the comments made by some people here! Is there a single word worthy of attention in their comments?
    The only issue in the ‘Silredi case’ is the timing (election time)! That is the only point which needs a logical answer. Here, MR has given sufficient facts and figures to argue on that matter.
