The True Beginning Of The Rajapaksa Fall

January 8th was not really the date of the fall from grace of Mahinda Rajapaksa, former President of the Democratic Socialist Republic of Sri Lanka. That marked, no doubt, his electoral defeat. But his false image never died. It continued with the “Mahinda Sulanga” phenomenon. Leaders fall only when their public images fall. With the verdict of the Bharatha Lakshman murder case delivered on Thursday 8th September 2016 the tragic fall of that image of the former Sri Lankan dictator begins.

Former Mahinda Rajapaksa’s and Gotabaya Rajapaksa’s key backer and Minister, Duminda Silva, and four others were sentenced to death. The rest of the 15 defendants were released.The case was heard before the trial –at-bar comprising High Court judges Shiran Gunaratne, Pathmini Ranawaka and C.B.S. Moreis.

It was a sultry day and clouds were gathering in the outside sky.

mahinda-and-dumindaThis has been one of Sri Lanka’s highest profile cases as big guns of the former government were involved. The gruesome murder itself that took place in the open streets shocked the nation. The murdered and the convicted murderer had both been Mahinda Rajapaksa supporters but they hopelessly fell out over the issue of the UPFA government’s decision on the Kolonnawa Organiser. The personality acrimony had been developing fast and Mahinda Rajapaksa took the side of Duminda. According to testimony the two met on the streets and the brawl broke out into murder. Duminda had gone ready with his pistol.

Shortly after, Duminda rushed himself to Sri Jayawardena Hospital and, reportedly, among the earliest visitors were both President Mahinda Rajapaksa and powerful brother Defense Secretary, Gotabaya. That had been one of those numerous acts of impunity on the part of the former President. Mahinda still continues that behaviour visiting convicted jailbirds of his former government. Not the model behaviour of those with Presidential status. But the incident made it clear to everybody that the two powerful would back Duminda right along the way. As another typical MR ‘shaping’ tactic, Bharatha Lakshman’s wife got the job of a Presidential coordinating secretary! Among the prestigious panel of such advisors were political fall-outs, musicians, and astrologers.

MR, perhaps, believed that the whole matter could be hushed up this way. There was no serious attempt to bring this up to court until the new Yahapalanaya government came into being. That confirmed speculation that the government was doing its best to cover up Duminda. Hot gossip lines kept ticking: It was alleged that the hospital staff had been all transferred that night when Duminda arrived to enable the latter to put on a new costume and commence an elaborate act. He had claimed brain damage as a result of the “accident.” Government arranged to despatch Duminda away to Singapore for “special treatment.” That was at taxpayer expense and it did take a long time for Duminda to return, “cured.” When he eventually returned and attended court he claimed he had amnesia and couldn’t remember anything that occurred on that dreadful day in the streets. Duminda became the butt of Facebook jokes. The Rajapaksa government’s reputation got a bad assault. But a President who thought he would never be beaten in elections didn’t bother. The 18th Amendment was in his pocket.

The obvious MR/Gota backing for Duminda was made even more clear when MR with Gota’s consent appointed the “cured” Duminda as Supervising MP for the Ministry of Defence. In the circumstances, that was an appalling decision. First, to make an obvious murder suspect a Minister and a Supervising MP in the very Ministry that oversees the police! This act demonstrated, once again, Mahinda Rajapaksa’s overwhelming sense of impunity. He just didn’t care about accountability or appearance. He was a cocksure President. He didn’t bother about the dignity of his high office where manifest appearances of justice and fair play are crucial. “Justice and honesty must not only be done but must manifestly appear to be done,” particularly by those in the highest offices of state. But have you seen our former President caring about such courtesies?

Despite all these acts of horrible misdemeanour Mahinda Magic still lasted and it had been easy for MR to draw crowds at Mahinda Sulanga meetings and Pada Yaathraas. Most people didn’t believe in all the bad gossip about him and his cronies. “They were all exaggerated,” they thought. Let’s tolerate the man who “won back the country.”

On the other hand, the Bharatha Lakshman murder verdict represents no fancy gossip; but court verdict. It is also a cue for many of the other alleged crimes entering the zone of fact.

Yahapalanaya, at last, seems working. The justice system is made to work after at the dark age of its abuse and political massaging. The peoples’ doubts and scepticism about Rajapaksa behaviour have begun to be confirmed. True, there is more that must come for the Rajapaksas to go tumbling to I don’t know where.

But this case gives a definite signal that, one by one, it will all come. The Thajudeen case? The Lasantha Wickrematunge case? We are living in exciting times-indeed!

    Wonder what the UNP Leader and the PM of the Yahapalana Government said about the Conviction of of ex UNP member and the Pin Up Boy of the Elite Colombo set, Mr Duminda Silva?.

    Because SLFP mouth piece “Begal Yapa”, as Mangalan Web Paper calls the hon Minister, says his boss, Bodhi Sira did the right thing prosecuting Duminda..

    And Yapa thanked the President for driving Duminda to the Gallows.

    I think the Y PM is busy trying to protect his Yahapalana Partners Diaspora and Sambandan by trying to cover up the LTTE attack on the Yahapalana Muslim Ambassador in KL.

    That is what I gathered from the Hindu this morning, by the statement of Mr Seeman , whom the the PM Baalanda Ranil tried to fix for the attack.

      This is what happen when idiots are elected as the president of the nation.

      This happens in developing world… but they still call it democracy. All gulliable masses have no idea about the gravity of corruption and abusive records even before he was elected.

          What is very interesting is the way Hiru TV reported the verdict. It announced that 5 accused in the “Mulleriyawa incident” including the 11th were sentenced to death. No names, not even Premachandra, was mentioned! Of course, Hiru TV belongs to Duminda’s brother. Not that other news media don’t have their own agendas.

      This gentleman’s writing has become more and more incoherent by the hour. Like the “Boy on the Burning Deck”, he should be congratulated for holding his guard-post for the deposed MahaRaja, I bet for fear of losing his head (or more likely his monthly income) or both if he stepped out. Judging by his inability to string together a meaningful sentence, I guess he has lost his direction, not sure whether to keep defending his lost fake national heroes or to defect to Yahapaalanaya. One thing for sure, his speech has become slurred and messages fragmented, I wonder if the gentleman is delirious with high fever.

    Hey guys, even if the verdict is now there, but I still have thousands of questions, as to why MR et al stood by Duminda keeping him in a hospital in Singapore. Whose monies had then been spent ? And the court sessions were told that DS has forgotten almost everything in that way, the govt led by MR avoided him sitting inthe sessions why ?

    Head injuries were displayed on the national TV senders by lanken appropribated doctors should need to be investigated – since if they had been that liars manipulating the public that way – how can we lanken medical professionals to rely on lanken approbation ?

    Many in the know of this gunfight in day light in the drug-infested
    Wellampitiya area know Kudu Duminda was not injured at all. Yet, he was encouraged to undermine the entire Police and legal process to “escape” to Singapore – to avoid the extreme heat of the affair in Cbo then. A bogus story was woven to say he was badly injured and was, in fact, dying. My foot!!

    The money of the ordinary man in the street was used in the multi-millions to meet the hospital bills of this drug-trafficking gangster and hard core criminal. What the Rajapakse Bros may not know is the US-Govt DEA – and Interpol – were taking careful notes of the entire episode. In their books MR and GR were in the centre of the growing drug-trafficking market in Sri Lanka.

    What respect to the law and confidence in decent governance do you think the ordinary man in the street will show. Even today it is said
    the Case will go to Appeal and get dragged on for decades – with Kudu Duminda out in the open doing his thing.

    Stay safe Down Under, dear chap. Your mowbima is coming crashing down sooner than you think by the follies of her own “leaders” For God’s sake, don’t blame the Tamils or the LTTE for that.     When reading, I felt like being narrated about a film that had been already watched. Thank you Shyamon

    Every thing that occurs in this world are similar to the ones that happen to an individual in his life. There are ups, downs, challenges, trials and tribulations and then overcoming etc.
    Somilarly “MR JUSTICE” also passed through a very bad period (අපල කාලේ) and it seems the “He” too starts to overcome the bad period and starts to see some silver rays through the darkness that prevailed.
    Thanks God and who ever is concerned to restore the JUSTICE in its due place at least to this extent. But we have a long way to go.

    We are very happy not because five were sentenced to death. But the justice which was fast asleep was awakened. In this case,The Iron Lady Hirunika should be commended for her fearless fight for justice. But the true justice means that she too be punished for her involvement in abducting a person if proven.

    very interesting thing regard to the media was the Hiru news, which claims to say the truth even at the expense of loosing anything (පැත්ත ගියත් ඇත්ත කියන) did not know the names of those five who were given the death sentence in this high profiled case. Lol

    The glee over Rajapakse’s fall is not really because justice has been seen to be done. There are many a politician awaiting justice in this country, take it how you want it.

    What is apparent is that Rajapakse – haters, for reasons known only to themselves, cannot be content with proceedings but must continue to abuse him and his family. This may be the culutre, as can now be seen by the abuse hurled at other presidents past and present, but this is not justice.

    Not everything President Rajapakse stood for was a bad thing, and many of the errors of the previous government carry on to this present day. Mr. Ranil Wickramasinghe has given credit to President Rajapakse for ending the war. There is much more.

    My challenge is this : find a good leader, and I will vote for him. If I, and the innocent 13 million voters are not given a good choice of candidates like they have in the United States, then no one can be faulted for choosing one over the other.

    It’s a relief to know that political crimes in this country spanned a brief 9 years and that all those responsible will be punished.

    Indeed, it heralds an optimistic message to the country and puts an end to some speculations. Like this, they should bring all perpetrators, regardless of their ethnicity, creed, status and religion, to gallows and give justice to victims irrespective of their ethnicity. Only then, they could stop Yahapalanaya, being become the butt of every joke.

    With the end of LTTE terrorism, Sri Lanka could not clean up well the mess that it had inherited from its past. MR did his best but there were a lot of loop holes, mishaps, mistakes, shortcomings, errors in his post-war plan. As we all know ‘post-war development’ was not a cake-walk but MR succeeded on some projects but some ended up in failure. The negative aspects were represented by various parties like Duminda Silva, Sajin Vaas, Mervin Silva, and several others who later joined the Yahapalana team in order to free themselves from their ‘dirty’ past. These people helped MR government to finish the war against LTTE terror when powerful politicians like RW, Kiriella, Ravi Karunanayake ridiculed it.
    As many Sri Lankans say, MR was a sensitive politician who did not try to put anyone behind bars without a valid reason. He reluctantly jailed General Fonseka but I believe the ‘move’ was politically and strategically very important and a ‘must’ for the country though it was considered a morally incorrect decision. Many intellectuals agree with MR given the fact that what happened in neighboring countries such as Pakistan and Bangladesh, after wars. Today we know the outcome of what happened but we will never know the outcome of what could have happened if it were not done. The general feeling is that if General Fonseka were elected to Presidency in SL even RW would not have been spared! A friend of mine who is close to RW said that General Fonseka who called RW ‘Sir’ at the beginning of the presidential election campaign of 2010, started calling him by his first name towards the end of it. Why; he had not won yet but he had sensed a glimpse of it! Today, as a cabinet minister his only job is to attack MR and we, tax payers pay 72 million rupees a year + a 700 million rupee luxury car+perks just for that.
    I am writing this as an addition to what Vanguard has mentioned in her/his comments; if RW and MS are doing the opposite of what they had promised to the Sri Lankan electorate, if Sri Lankan diplomats are beaten up by LTTE hooligans abroad (imitating Duminda, Saajin, and Mervin) and if there is no reliable alternative leadership in the political vicinity in SL, what are we left with as an option? People would remember MR’s virtues and good deeds, and he will obviously be their next choice!

      MR won the war because of the help and international shield provided by India. The West supported the war on the premise that Sri Lanka will grant a political solution for the Tamils. MR was a thug outside and inside of politics. He surrounded himself with thugs and fraudsters. Intimidation, thuggery, murder and embezzlements were rife in his administration. Basically he was not a statesman and he will never be one. You need to come to terms with this reality. Some people possess blind loyalty towards this mother of all gangster.

    “Exciting times indeed” – very apt and appropriate.

    The wheels of Karma are turning, and this verdict which would be welcomed across the length & breadth of our blessed land, should at least now, show the many followers of the former regime, that The Rajapakses were not only corrupt, they were CORRUPT TO THE CORE.

    What made MR to appoint murder accused now death sentence convict Duminda Silva as the Monitoring MP for the Ministry of Defense is anybody’s guess.

    Birds of a feather flock together, hence with so much of blood in their own hands MR & Gota including every other member of this family did not care “TWO HOOTS” of whatever their countrymen thought, of what they were doing.

    But now it is payback time. It is a very well known fact that MY3 & Ranil does not interfere in anyway, in any process of law that is conducted, unlike prior to January 8th 2015.

    Hence we would see some very independent legal procedures and judgements in the future too, but are there officials in our Judiciary who are corrupt and would turn a few written lines by them to misconstrue facts into fiction and vice versa.

    To conclude this verdict would be sending some shivers up many other’s spines and the best they could do would be to go jump into the Kelani River.

      Now wait for the Appeal , if the Judiciary acts accordingly even though it was not Unanimous , hopefully the 3 Judges in the Supreme Court will Uphold the sentence dished out yesterday.
      There will be no repeat of evidences and witnesses unless some new evidence had been cooked up to delay the Sentencing ,
      This is where the 3 Strong Supreme Court Judges Need to prove to the country that they will pass the sentence to the best of their knowledge and ability.
      Hopefully they will not be bought by the Wealthy Crooks and the ex Leaders.

      In the past it was the Jungle Law prevailed in our Lanka .
      The judgements were served to please the dictators of the time none other than the EX PREZ AND HIS MERRY MEN AND WOMEN.

      Hope the time has changed and the JUDGEMENT AT THE APPEAL COURT WILL BE THE TRUTH BUT NOTHING BUT THE TRUTH.

      These men and women who are facing the diabolical situation of crimes of Money Laundering , drug dealings , stealing should SUE THE MEDAMULLA FAMILY FOR DRAGGING THEM INTO THIS SITUATION.
      THEY SHOULD BE ASHAMED.

        This is a good idea. In the same vein those who were made to do the same and more, like stealing children for criminal activities, should also sue those living overseas who dragged them into doing such diabolical acts. All in fairness.

    Mr KETTIKARAN. Duminda cannot be out until the appeal is heard. He is firmly in. This is not an arrest but a conviction and the convict has to stay inside the cell. This is for your information.

Why is there a demand to get jobs in the Customs service, Excise, Police, Prions service over other departments? The underworld often uses surrogates to fill the prison cell while the accused bribes himself out – at least, for brief periods.

      BTW, if DBSJ or someone competent writes an article on that warfare at
      Welikade where armed forces were illegally brought in favour of one group of underworld drug-traffickers and criminals against the other. In this feud between the two main gangland groups, where the hand of a very powerful Defence official was patent, over a 100 were killed. All this was suppressed then. It is time to unearth all these now so that the people know what was done by evil men in power then in the name of governance, law and order.

    Gota and Mahinda must be charged next for aiding and abetting and for cover-up. I guess they were also behind the Laasantha Wickremasinghe case. Cannot imagine how many people think that Gota is suitable to be the next President. Are our levels so low?

    Hi All,
    I will bet my last bottom Dollar that Duminda will eventually be saved my Ranil. Otherwise his best friend’s sister the Neuro surgeon Dr. Maheshi will be in big trouble. She is the one certified that Duminda was shot and later before the trial said his condition was very critical. Whereas in private she was telling the Colombo elite circle that Duminda is just pretending and there was no head injury.

    The author if this article, I believe is a civil servant of Her Majesty’s days in then Ceylon and now living in down-under perhaps yet a citizen of one of Her Majesty’s Realms. The picture that he paints is the typical old school thought how the wheels of justice is slowly but surely turning against Rajapakse or better known as Jarapassa. To me writing about him is a waste of time. But there are other interesting things in that episode which people who supported the rainbow revolution must be mindful of, as people living in the present instead of living in the past.

    Through these columns I would like to tell him that picture in Sri Lanka is much more complicated than you and I think. The way back in 1964 to 1966, a woman in Anuradhapura complained in writing to the IGP that her son was to come on holiday but did not turn up wanted the matter looked into. She further stated that she did not trust the Anuradhapura Police. With that came what is known the Kalattawa murder case where the accused were found guilty and paid the supreme price. Today if a woman were to complain then woman may disappear within 24 hours.

    In the days of Her Majesty we did not hear any scandal involving a Judge, specially those who try accused for serious crime. But in this particular instance, certain web newspapers reported the divided judgement in advance, say months ahead. The predicition made, came true with pronouncement of the Judgement. So the reputation of the bench is now subject to question. After all were the allegations made of partiality in the web newspaper are true after all? This is bad.

    Further, there were also rumours that both Premachandra’s and Duminda Silva’s were powers to reckon with in Kolonnawa. They made demands on Jarapassa and he could not bear it. The story goes that Jarapassa knew the impending fight and had hoped both of them would die in the fight. Unfortunately only one died and the other did not. The visits to the hospital by both the Jarapassa’s to see Dumi were not made out of sincere motives but out of necessity. Both the heavy weights knew enough of dirty linen of Jarapassa. That is why Jarapassa had to “shape up” both factions and expect both of them vanish in thin air out of their own doings.

    If Dumi had murderous intentions to do away Bharatha from the beginning any intelligent being should ask why was he not made the first accused, instead of the eleventh? That is consistent with the fact that they were in a fight, instead of lying in ambush. But there are other pieces of evidence that both of them knew that they would be meeting there opponents in battle, which makes the rumour which I state in the previous paragraph more credible.

    I can write more. But I appeal to the writer to be more relevant to the Sri Lankan context in the wake of machinations of the highest degree if he is analyzing a Sri Lankan situation.

    What is very interesting is the way Hiru TV reported the verdict. It announced that 5 accused in the “Mulleriyawa incident” including the 11th were sentenced to death. No names, not even Premachandra, was mentioned! Of course, Hiru TV belongs to Duminda’s brother. Not that other TV channels don’t have their own agendas.

    Nothin happened to Mahinda Rajapakse yet. He called the elections two years in advance. He is depressed on that.

    This guy was a drug lord and killed another who had the same playing field. So, he is caught now. Even if he was not caught, one day his own conscience would get him because he knew he did that.

    The truth is that Bahratha Luxman was himself a thug, a murderer and a drug peddler. He was a strong ally of the SLFP under Sirima and CBK. Gota feared that Bahratha Luxman might use the underworld to bump off MR or Gota himself or both. So the Rajapaksas looked for a handyman and the ideal was found in Duminda Slva another Criminal. Duminda Silva accomplished the job and the Rajapaksas went overboard to save him.

      There was this story immediately following Bharatha’s killing of either Hirunika falling heavily for one of the Princes or the other way about. This clearly was not to the liking of the boys’ mother, who could not stand a daughter-in-law from the slums of drug-infested Wellampitiya.
      And, Duminda was made to step in to “solve” the problem – with guarantees nothing will come to him if the Contract was carried out. To Duminda, a rival to Bharatha’s kudu rajya this is a chance to kill two birds simultaneously. He jumped at the idea.

    Shaymon, old friend. When you quote the Holy Bible, quote it succinctly and specifically. Because it is the pure Word of the Living, all-powerful God, the Lord God of creation. In Prov. 26:27, it says, “Whoever digs a pit will fall into it, and he who rolls a stone will have it roll back on him”. And Ecl. 10:8 says, “He who digs a pit will fall into it, and whoever breaks though a wall will be bitten by a serpent”. These verses apply to those who are engaged in corruption and wickedness, not anyone doing legitimate work, such as digging a field or repairing a wall. Of course, you are correct in your analysis of the disgraceful way the former “strong man” and his clique conducted themselves in the past. We are all grateful that the first major break-though in Law and Order has happened at last, and the judiciary has necessarily taken time to build a fool-proof case against this culprit, as they will do against all others.

    Incidentally, Shaymon if we ALL lived by the Laws of God (The Ten Commandments) our lives will be almost heavenly!! My point is, that ALL laws, Roman-Dutch, U.S laws, etc are all based on these basic tenets of the Biblical Ten Commandments, given about six thousand years ago.

    Vanguard, You want cadidates like those in the US ? What a crazy thought! Both have reams of allegations of corruption, one even of murder !! Politicians evrywhere are very similar. Only difference is in the presentations made out to the public.

    I have said many times, Rajapakse Presidency was not a dictatorship. Some people disappeared, some journalists were harassed, at the end of the war there were mass killings in the North (unfortunate), but this is not what qualifies as a dictatorship. A dictator does not participate in free elections and voluntarily step down! Bharatha Lakshman murder was not the reason MR stepped down. MR being a lawyer by training, he always had respect for the law. Unfortunately, the same cannot be said of some of his associates, such as Duminda Silva. Obviously Duminda Silva was never fit to be an MP, that is the real issue here.
