Top Customs Officer Defrauds Over Rs. 755 Million In Tax Revenue, Releases Extremely Harmful Palm Oil To Market

An additional Director General of Customs has being involved in a massive scam where he has allowed a leading businessman to import palm oil, unfit for human consumption under a false description, which has also resulted in the Government losing over Rs. 755 million in tax revenue.

The palm oil, weighing in thousands of tons has been released to the domestic market, and is absolutely prohibited by the Food Act for human consumption, an investigation has revealed.

This massive fraud has now been taken up in the Court of Appeal (CA/201/2016) by the Public Interest Litigation Activist Nagananda Kodituwakku, based on the Governments Analyst reports filed in Court by the activist where it was revealed that the said Customs Officer has surreptitiously concealed very adverse reports issued by the government analyst, which confirms that the samples examined by the Government analyst contained 23% fatty acid and the said officer has done so to facilitate the importer with a wrong classification of the commodity given to evade payment of the fiscal levies.

Further analysis of the samples examined by the scientists also filed in Court, also confirms that in crude palm oil fatty acid content shall not exceed 5% and in the refined palm oil it shall not exceed 0.1%.

The analyst reports states that ‘… any vegetable oil which contains high amount of free fatty acid (as the case of this particular product) is highly liable to oxidation and could generate various oxidized products that could harm human health. For instance, end-products of lipid oxidation could be mutagenic and carcinogenic and that the lipid oxidation has role in in the pathogenesis of several pathogenesis such as neurodegenerative, inflammatory, infectious, gastric and nutritional diseases in humans. Therefore, the particular product that has been claimed by the importer as Crude Palm Fatty Acid’ is not suitable for human consumption…’

In the meanwhile the Malaysian Palm Oil Board has also confirmed that there is no such product called Crude Palm Fatty Acid in the palm oil industry and that their investigation conducted into the matter had revealed what the importer claims Crude Palm Fatty Acid is palm oil blend with fatty acid (the process surreptitiously done to evade payment of fiscal levy at a higher rate).

Further to the Customs investigation now being conducted into this matter, 24 containers of adulterated palm oil has been seized by customs. Now the importer, relying on the falsified report earlier given to his favor by the Additional Director General, makes every attempt to have these detained shipments released from the Customs custody.

Therefore, the rights activists furnishing this information requests the Court to make an Order compelling the Director General of Customs to confiscate all 24 containers of adulterated palm oil not good for human consumption and to destroy them in public as a deterrent to other such importers, who import similar substandard food items absolutely disregarding the health and safety concerns.

    PAlm oil must have certain specifications. the person knew it, abused it and is getting the help of the custom officer too.

      This is why the SL Customs do not want the ‘customs ordinance'(law) changed to water down their powers under the pretext of encouraging criminals. They (Customs) is a den of crooks and when they wield the power they can have a piece of the crooked deals like this palm oil scandal. Once their authority is diminished they cannot extort money and corrupt the system. No importer is allowed to do an honest import by the customs. They will somehow try to extract some money from the importer by creating an issue. They will also take samples (to take home) from every container they inspect be it milk powder or cow-dung.

    Customs and immigration are a menace.I am seventy years old Sri lankan Singaporean.We always had Sri lankan maids and pay $500 pm with food and accommodation.Our last maid from Kandy built a house finished the contract n went bacK.So we wanted to try a new girl and wanted her to come to Singapore for an interview.She had a return ticket, cash $500 and all the requirement to be a visitor.in the meantime we had an Indian maid to do the chores.But they didn’t allow at the immigration saying that she has to go for a course of 40 days and returned her.in Singapore, the Govt.gives an intensive TRAINiING so that they are well settled even before they issue a work permit.This sort of policiesj is an impediment for the progress of the country.Singapore,insists that a salary of min.500 pm is paid and Sunday is compulsory off n proper room should be given unlike miidle east.The Govt policies must be designed to help people to develop n not to help Govt servants to bully poor girls and make some money by the Govt servants.At the end we had to hire a maid from India denying an opportunity for a Sri lankan maid and her familys progress.

Recently I applied some fertilizer but nothing happened to the growth of the plants. These fertilizers have no fertility any more. The whole system in this country is in an utter chaotic situation. To rectify we must begin with computerization and linking of the whole administrative structure of the government, installing surveillance cameras in government institutions, tightening checks and balances and audits. And they must begin from the Customs becuase this is the place where all sorts of illegal operations take place and all poisons enter the country. Just by rectifying the activities at the Customs government can improve tax income, reduce health costs and ultimately improve GDP.

      There is a history of bribe taking in the customs department which goes back to early 1970.

      Irrespective of race and religion, all were in it together. In some cases the bribing parties had access to the officers rota, so that they could time their arrival.

      I was told the customs at Thalaimannar was a den of bribe taking thieves before the ferry service was terminated.

      A few Tamil Customs officers too had become millionaires over a period of time.

    As long as The government is not willing to change the age old failed system in the customs where only a corrupt portion of the country’s population is going to keep minting money even at the cost of peoples lives ,this country is heading to be doomed.

    This could be the industrial palm oil , usually these crooks mix it with coconut oil and sell it.

    There is no proper body to monitor the meat industry we may be eating all the sick and dead animals ,for that matter any food we eat is not monitored .

    People must understand not to let prejudice be the price to pay for their health, there is so much bigotry against certain community who have strict conditions in consuming food, all these anti religious sentiments spread are mostly by some third grade Pharmaceutical producers who are linked with some of the food marketers ,who operate and control in top mafia style racketeering Remember ,most medicines never cures ,they just suppress the symptoms, so it is important for such companies to feed us with poison.
    The Government needs a strict monitoring body for food imports and also put an end to smuggling , can you imagine how much we have been losing in revenues ? Singapore has the best duty system that can be looked at to make changes , if you introduce duty and taxes only on special goods that really need it and introduce a flat GST on all other goods and also make it a regulation to get the produce imported to be pre-approved and to get the product checked everytime it comes into the country may help .

    Dutiable goods, which incur both GST and duty, are:

    Intoxicating liquors
    Tobacco products
    Motor vehicles
    Petroleum products

    Another important message to the consumer , remember to be careful when you eat anything that is deep fried .

    Deep frying needs a lot of thick cooking oil , industrial palm oil is cheap and can fry a huge quantity at a very low cost.

    I have no faith in any of the officials to regulate and monitor what we eat. It is time the public demand to set up a non government organization by appointing retired professionals from the veterinary and medical field and other related to do spot checks and also to make sure that the food standards that are violated are heavily fined ,including imprisonment.

    Do not let yourselves to be taken for a ride by those pointing fingers at one particular group ,unethical businessman will always have a boogey man to distract your attention.

    But this does not mean that all those traders and food chains (small and big) are all saints , every community has its own black sheep .

    Most Sri Lankans do not even know what are ethics anymore when it comes to money .

    So remember when eating anything that is fried not only deep frying , any type frying to demand to know the type of oil they use.

    It is time we stop these bloodsuckers to prosper at the cost of the unsuspecting citizens of this country, whose health and life is at risk.

    Demand standards for your food, it is not charity ,you are paying for it, It is your health and life, remember if you do not care no one else will.

    All custom officers are crooks, just check the houses they live in with there income & bonus. The cost of living is high because importers have to pay 10-20% to these guys. eventually the consumer pays in increase prices.

    The time has come to the Bribery Commission to call for the Declaration of Assets ans liabilities Form of all the Custom Officers and the Immigration Officers. The Form is annually filled and handover to their authorities. It has to be kept sealed and opened only on an allegation is made. Now this is more than enough to open an inquiry not only against the man involved in the above scam, but of all the Custom Officers and Immigration officers. Then the Bribery Commission will find by comparing the fist Form given at the time of their appointment and with the latest Form. The form[declaration] should be given on or before the 30th June every year regarding the assets/liabilities as at 31 March in that year. If these officers have not given the declaration it is a separate offense under the bribery act 1994. In addition to this, the Bribery Commission should send the Form 5 [ in which these thieves have to reveal all their assets including the assets under the spouses’ an children’s name]to these thieves. Then they have to reveal their assets in it. There is a clear legal mechanism for both the methods. It cannot be explained here in short. However, now the Bribery Commission has to initiate inquiries into their assets, and no doubt, all will have to be prosecuted for unexplained wealth. These crooks should be sent to jail for 100 years like in the famous Vat case. The best punishment is of course to hang these cannibals publicly at the Galle Face Court. Bdw, hanging them is just a provocative expression, but the Bribery commission cannot now be inactive over this. It has the power. Make use of it for the sake of the country and its poor innocent people, children including unborn. Please, this is over to you all, Hon. Dilrikshi Wickemasinha, the DG Bribry Commission, the Chairman and other two [Commissioners] Members. Please act mmediately.

      Years ago the average Kappang of Customs men was in the range of
      Rs.100 to Rs.500 per Customs Entry – on disputed cargoes. With Inflation running riot, it became Rs.1,000 to Rs.25,000. The Open Economy opened the flood gates of Customs corruption. Used Car imports saw the Kappang scale of Customs-crooks going into the lakhs to millions per vehicle. A Customs Officer friend told me the monthly take of their chief was Rs.3 million and the man was in charge for over 5 years – that was ten years ago. They had to share their spoils with the Chief/s. Now the media reports Customs men demanding Kappang going into hundreds of millions per single case. The Rewards System, aimed at reducing the Customs bribery culture has failed dismally.

      Sri Lanka has one of the most corrupt Customs systems in the region (in the world?) where political leaders, Customs Chiefs, Smugglers/Racketeers/Drug traffickers dominate their own landscape.

    There are many more. there are importers of textile ,garment accessories , Cosmetics, food (processed & Fresh) wh bring 40 to 50 container loads almost every week , (some may even have drugs in it who knows) we may be losing at least from 10 to 15 Million dollars in revenue each month its a speculated figure that can easily be confirmed within the said range .
    Then what about other damages and again financial and loss of lives and suffering of people ? the economic mess ? the food and cosmetics imported in large quantities have no proper and necessary safety health approvals , importers who bring food and cosmetics that are proved to be harmful to humans should also be prosecuted for 2nd degree murder,and for conspiracy to harm the country and its stability and should be thus brought under the preview of the Act of terror and be branded as murders and terrorist,,, what and what these crooks are up to , even loads of money is brought into the country and sent out in the containers.

    Some of these oil and cosmetics and also transshipments.

    How on earth is The government planing to eradicate poverty ? improve the economy ?

    how will the genuine business man survive ? Please do not use any of the borrowed funds on economy until you have completely eradicated this smuggling menace, start by grilling the smallest proxy of the whole operation , that is the warf clerks , these are the biggest crooks who are the main suspects in the whole operation, take them in and grill them non stop for weeks and you will be shocked to find out the real numbers of revenue you are loosing.

    There use to be a master smuggler from down south ,he us to smuggle in ship loads , and today his children do it in more sophisticated style,

    The have garment factories as front, they smuggle in raw materials and sell most of it on black, wont be surprised if drugs come in it too, then the export of the finished products is used for money laundering .

    But how come you can never nails these crooks ? Simple , if you see their life style , their houses , the buildings they own , you may really wonder if they own some offshore oil business ,only such people can afford such luxury.

    But if you look at their bank accounts it will show it overflowing with huge overdrafts and loans , but you will never hear them go bankrupt, because this is the way they make the black money white , they just keep paying the bank interests.

    Mst bank officials are so corrupt they are part of the operations.The Government has to stop everything else and go after these guys ,like in India you should tart visiting the houses of people who live in super luxury houses , drive super luxury vehicles, and start investigations.

    This government has no excuse , it is also extremely funny and extremely suspicious how religious groups never ever talk of the huge smuggling racket and the illicit business such as what has been exposed in this article ,or drug smuggling , money laundering.

    They are forever bickering of other religions , attacks on simple traders of other faiths , fake unfounded , with no proof at all of their conspiracy theories of feeding the majority females with sweets to make them infertile and amazing most of the people of this country with the high rate of literacy believing this crap .

    To Date none of the defenders of Race and religion have ever voiced their anger over any of the crimes related to smuggling and drugs .

    The government must pass a new legislation against smugglers , if proven all their assets should be confiscated and not just pay a few fines . and get away . this should include the confiscation of assets of everyone involved in the racket .

    If The government seriously introduces strict laws , they can hire a lot of retired men and women with knowledge of hygiene , laboratory knowledge and experience and also not forgetting the new graduates who can be recruited as interns, they are struggling to survive , they can be paid by the certificates you issue and the vendors can be trained too.

    It is understandable the implementation is going to be the greatest challenge in Sri Lanka’s history , but it is not impossible , let it take its time ,but start somewhere , and with the amount of revenue you will be saving the cost that you may incur to establish the law will be negligible, it is nowhere going to cost you in millions of US dollars , which is the current loss the country is facing ,in the past am sure it must have been more.

    If you keep saying in the negative how to enforce on so many vendors ,even the roadside ones ,you will never get anywhere in your good governance, you need to come on strongly and sincerely .

    Let us see how much you are committed to the welfare of the people. This is to do do with human beings health and life.

    Most of the Importers and traders have zero knowledge about the food safety and the danger of chemicals used in unmonitored processed food and Cosmetics. Look at the way some fake aesthetics doctors got away ruining the permanently the lives of some people.

    How long will this highly literate Community which was recognised by the world as 70 % rate in 1977 -78 and placing it in number one status then and today we are, am sure 100% . and yet we are unable to subdue the misleading elements of bigotry ,liars ,thieves and smugglers and drug lords who fund these elements to mislead the people and distract them away from their ruthless and unethical income.

    If The government can not subdue these elements and question everyone who are living in super luxury the means of acquiring it and question bank officials who have been very lenient towards clients with very low credibility and also they must question why recoveries of huge loans to some customers have not been done and why they have permitted continuous long periods without reviewing , you need to see if such business men are really contributing to the economy of the country or they are just meeting the monthly commitments , if they are generating jobs , contributing financially to the economy , paying taxes properly computed and not adjusted . This will expose a lot of errand business that is damaging the economy of the country , instead of addressing these issues if you borrow funds and start disbursing, it will be like water the sandy sands of the deserts .

    I think enough is enough of all these dramas of blaming it all on a couple of scapegoats.
