The independence of the courts appears to have been affected ever since President Maithripala Sirisena launched a verbal attack on the arresting and remanding of army intelligence officers, with even Mount Lavinia Magistrate Mohammed Shahabdeen falling under pressure and releasing Army Intelligence Officer Premananda Udalagama on bail despite his involvement in the assassination of Editor of Sunday Leader Lasantha Wickrematunge.

Udalagama was released on a cash bail of Rs. 50,000 and three sureties of Rs. 500,000 each.
The court order comes just weeks since President Maithripala Sirisena launched a verbal attack against the arresting and remanding of Army Intelligence Officers who have been involved in various criminal activities including being linked to murder.
On October 14, Udalagama was also released on bail by the Gampaha Magistrate Kaweendra Nanayakkara even though he was identified as the culprit who attacked former editor of the Rivira Newspaper, Upali Tennakoon.
In July, the CID arrested Udalagama in connection to the Wickrematunge murder. The Army Intelligence Officer was also identified as the person who abducted Dias, the slain editor’s driver. Udalagama had kidnapped Dias because in his intoxicated state, Dias had gone around making allegations to the effect that former Defence Secretary Gotabaya Rajapaksa was behind Wickrematunge’s assassination.
Wickrematunge, a strong critic of the government under former President Mahinda Rajapaksa was killed in January 2009 while he was on his way to work.

He says the german coalition government has massive problems and differences within them – but party leaders solve all these problems behind close doors. He says the german president is appointed by the bundestag (don’t know what the hell that means) and not by the people. By the way ´my friend said the german president does not eat hoppers in the night either. The suspect taken into custody in connection with killing of Sunday Leader Chief Editor Lasantha Wickrematunga was identified by the man who was driving Mr. Wickrematunga vehicle at the time he was killed. This was in July this year.
The suspect was remanded until August 3 by Mount Lavinia Chief Magistrate Mohamed Sahabdeen.
The suspect Prem Ananda Udalagama served as a staff sergeant in the army intelligence unit. He was arrested on the 15th and then remanded till the date of the identification parade.
The witness identified the suspect at the identification parade held in the presence of the Mount Lavinia Additional Magistrate Sulochana Weerasinghe.
On October 15, 2011 during Mahinda Rajapaksa regime, the Police Department announced the prime suspect in the murder of Lasantha died of a heart attack. On July 2019, 2016 the CID informed court it had questioned 3 suspects over the missing diary of Lasantha.
Now comes the shocking news the suspect Udalagama has been given bail under pressure from President Sirisena. If this is true it is a shameful act not worthy of a President committed to Yahapalanaya. It is bad governance. These days President Sirisena is defending ex-military men who face corruption and murder charges. Unless a person is considered dangerous to be allowed in open society no suspect should be held in remand. In Sri Lanka people consider remanding as due punishment for what they have already judged on hearsay before courts do it and derive great pleasure out of it. This particularly applies for past financial misdeeds. What president said is perfectly correct. There is politics behind this remanding drama.
Even LTTE suspects presently under very long remand periods without trial should be released on bail without delay. I am totally at a loss to understand if we could release 12,000 LTTE surrendees and KP why not this small number. What a wastage of prison resources. President Sirisena has destroyed his image as an honest and upright politician, an image he painstakingly built during the past 22 months in just under 5 minutes of his high pitched speech. According to Attorney-at-Law and Civil Society activist J.C. Weliamuna “the Military Intelligence has a huge vested interest. They did an outstanding job during the war but after that they helped consolidate a political party. State funds and the Military were used to consolidate the Rajapakse regime.
