Weaponising Of The Law

The saying “Eternal vigilance is the price of liberty” is often attributed to the founders of the United States, Thomas Jefferson, Thomas Paine, Abraham Lincoln, among many others, though Lord Denning in The Road to Justice (1988) stated that the phrase originated in a statement of Irish orator John Philpot Curran in 1790. The phrase is often used to emphasize the importance of being vigilant in protecting one’s rights and freedoms. Recent controversies involving religion are giving a warning signal. Ethnic and religious identity are two powerful concepts by which people may be mobilized the world over. This is a phenomenon that seemed to have subsided in Western Europe due to centuries of secular practices in which the state was made secular and neutral between ethnicities and religions, but is rising again.

For a short while last year during the Aragalaya, it seemed that Sri Lanka was transcending its ethnic and religious cleavages in the face of the unexpected economic calamity that plunged large sections of the population back into poverty. There was unprecedented unity especially at the street level to demonstrate publicly that the government that had brought the country to this sorry pass had to go. The mighty force of people’s power succeeded in driving the leaders of that government out of power. Hopefully, there will be a government in the future that will bring the unity and mutual respect within the people, especially the younger generations, to the fore and the sooner the better as the price is growing higher by the day.

The rhetoric of ethnicity and religion being in danger is surfacing once more. President Ranil Wickremesinghe who proclaimed late last year that the 13th Amendment to the constitution would be implemented in full, as it was meant to be, and enable the devolution of power to be enjoyed by the people of the provinces, including those dominated by Tamils and Muslims, has gone silent on this promise. The old order to which he is providing a new economic vision is clearly recalcitrant on ethno-religious matters. As a result, the government’s bold plan to set up a Truth and Reconciliation Commission as promised to the international community in 2015 to address the unresolved human rights issues of the war, is reportedly on the rocks. The main Tamil political parties have made statements that they will not legitimize or accept such a mechanism in the absence of a genuine devolution of power. Politics must not override policies.

Hurtful Sentiments 

The sense of threat to ethnicity and religion looms too large once again for forward movement in conflict resolution between the different communities that constitute the Sri Lankan nation which is diverse and plural. Two unlikely persons now find themselves at the centre of an emotion-heavy ethno-religious storm. One is a comedian, the other is a religious preacher. Both of them have offended the religious sensibilities of many in the ethno-religious Sinhala Buddhist majority community. Both of their statements were originally made to small audiences of their own persuasion, but were then projected through social media to reach much larger audiences. The question is whether they made these statements to rouse religious hatred and violence. There have been numerous statements from all sides of the divide, whether ethnic, religious or political, denouncing them for their utterances.

Both comedian Nathasha Edirisooriya and pastor Jerome Fernando have apologized for offending and hurting the religious sentiments of the Buddhist population. They made an attempt to remedy the situation when they realized the hurt, the anger and the opposition they had generated. This is not the first time that such hurtful and offensive comments have been made by members of one ethno-religious community against members of another ethnic-religious community. Taking advantage of this fact the government is arguing the case for the control of social media and also the mainstream media. It is preparing to bring forward legislation for a Broadcasting Regulatory Commission that would also pave the way to imprison journalists for their reporting, impose fines, and also revoke the licenses issued to electronic media institutions if they impact negatively on national security, national economy, and public order or create any conflict among races and religions.

In a free society, opportunities are provided for people to be able to air their thoughts and dissents openly, be it at Hyde Park or through their representatives in Parliament. The threat to freedom of speech and to the media that can arise from this new law can be seen in the way that the International Covenant on Civil and Political Rights (ICCPR) which is the world’s standard bearer on civil and political rights has been used and is being abused in Sri Lanka. It was incorporated into Sri Lankan law in a manner that has permitted successive governments to misuse it. It is very likely that the Broadcast Regulatory Commission bill will yield a similar result if passed into law. The arrest and detention of comedian Nathasha Edirisooriya under the ICCPR Act has become yet another unfortunate example of the misuse of a law meant to protect human rights by the government. Pastor Jerome Fernando is out of prison as he is currently abroad having left the country a short while before a travel ban was delivered to him.

Selective Targeting 

The state media reported that a “Police officer said that since there is information that she was a person who was in the Aragalaya protest, they are looking into the matter with special attention.”  This gives rise to the inference that the reason for her arrest was politically motivated. Comedian Edirisooriya was accused of having violated the provisions in the ICCPR in Section 3(1) that forbids hate speech. Section 3(1) of the ICCPR Act prohibits advocacy of hatred that constitutes incitement to discrimination, violence or hostility. The international human rights watchdog, Amnesty International, has pointed out that in the case of Ms Edirisooriya that for speech to be illegal on the grounds of being hate speech it requires “a clear showing of intent to incite others to discriminate, he hostile towards or commit violence against the group in question.” Amnesty International also notes that “When the expression fails to meet the test, even if it is shocking, offensive or disturbing, it should be protected by the state.”  

Ironically, in the past there have been many instances of ethnic and religious minorities being targeted in a hateful manner that even led to riots against them, but successive governments have been inactive in protecting them or arresting their persecutors. Such targeting has taken place, often for political purposes in the context of elections, in blatant bids to mobilise sections of the population through appeals to narrow nationalism and fear of the other. The country’s political and governmental leaders need to desist from utilising the ICCPR Act against those who make social and political critiques that are outside the domain of hate speech. The arrest of Bruno Divakara, the owner of SL-Vlogs, under the ICCPR Act is an indication of this larger and more concerning phenomenon which is being brought to the fore by the Broadcasting Regulatory Commission bill.

Weaponising of the law refers to the manipulation or exploitation of legal systems and processes for personal, political, or unethical purposes. It typically involves the strategic and intentional use of laws, regulations, and legal procedures to gain an advantage or achieve specific goals. Governments may use the legal system to target and silence political opponents or dissidents. This can involve filing baseless lawsuits, conducting politically motivated investigations, or selectively enforcing laws against specific individuals or groups. Taking on undemocratic powers in a variety of ways and within a short space of time is unlikely to deliver economic resurgence and a stable and democratic governance the country longs for. The Sri Lankan state will hopefully evolve to be a neutral arbiter in the disputes between competing ethnic, religious and partisan political visions of what the state should be and what constitutes acceptable behavior within it.

      Nimal, reportedly Gajendrakumar is arrested today in Colombo 3 , also banned from travelling. ( I consider this as a favor to the community ). Will they place him, Ali and Jerome together in one cell ????? Did you here about an African businessman who was in Lanka for investing was put in Prison after he lost his passport. Though the embassy provided one he is still in prison to satisfy local corrupt politicians who wanted to grab the deal . Apparently a group of South Korean businessman who were in Lanka , left country blaming local politicians, bureaucrats demanding kickbacks, bribe, ……….

          The state, the government, Ranil, Mahinda, Gota, Gamanpilla, Ranawake, …… opposition, functionaries, police, …. are trying to make a hero out of Gajendrakumar Ponnambalam, otherwise he has not much support among Tamils of North East. This they hope would divide Tamils into million political parties (not that the Tamils need any incentives or stimulant, … ).

          I watched the entire video clips as to what happened to Gajendrakumar Ponnambalam MP.

          When Ponna’s aides noticed two unidentified men are among his supporters they demanded the men to produce IC. The men refused. According to Ponna one man had a gun tucked in his trousers. Remember according to news Ponna’s dad Kumar Ponna was killed by two policemen in civil about 23 years ago.
          Now the Minister of Public Security is trying to fib out of the situation.

            Getting the country out of this debacle and giving the people a break is not that difficult, if the people in charge have genuine intensions and get straight to solving the problems ……. but their own self-interest takes precedence over the people’s/county’s.

            Our problems are political – establishment/set-up – not economic.

            The problems have to be solved ……. while this man being the president ….. that man being the leader of the opposition ……. that man a minister and so on: all eminently unsuitable. Those, in the end, become more important than the problems ……. or the people/country.

            We are solving leaders’/rulers’ foolish vanities, insecurities, ambitions ……… than country’s/people’s problems.

        Why cant our SIVURU HORAS (sinhala buddhist monks) learn at least 1% of his, while continue to be a monk ? We have business managers disguised as monks, we also have killers and contract killer hiding behind MONK s costume. We also have king of crimes hiding behind SIVURA. All these came in to being in the times of Rajapakshes. They only thought reaping voters (harvest).

        People are dumb today. Hit them twice. They once thought that Rajapaksa was the handmaiden of this unfortunate nation, but today they have come to face it unexpectedly by supporting Rajapaksa. Nevertheless, there are a significant number of people in the society who will never change their attitude away from Rajapaksa. Similar to the Sinhala Buddhists who are delighted to see decorated elephants. These so-called Buddhists never thought how much harm they were deliberately causing to giant animals. All this is repeated but under the heading of “non-violent Buddhism”: contradictory thoughts in every way.

      I’m not much bothered by AKD and Vijitha Herath not being there. One possible reason is that Ranil is capable of ordering all those who were in Rajagiriya in contravention of the court order be locked up. Somebody has to be able to move around freely to direct further protests.

This is the problem with all this digital technology – these minute differences. Here it has been cut – but that doesn’t account for 17 seconds!

    Another rather insipid analysis that avoids revealing confronting names or events. The author mentions Natasha who did stand-up comedy to a small audience which was in no way offended by her comments. Yet the dirty media recorded and broadcast the “sensitive” part to the population in general, thus sowing hatred and discrimination. So who is to blame? Natasha or the media? She had absolutely no intention of creating havoc among people. She merely wanted to entertain a small audience who seemed to enjoy her skill at wit and sarcasm. Therefor she cannot be guilty. Yet, the unlawful and wholly illegal manner in which political dissenters are targetted (she had been at the Galle Face Aragalaya last year) and incarcerated is abominable and totally appalling, given that Gnanasara and Rathana (for example) have been openly and with full intent advocating hatred and discrimination against a significant community of millions in full view and addressing the nation at large. While the author seems too scared to mention names, the double standards being practiced by the criminal justice system beholden to the political class is beneath contempt.

    If there was any such transcending, it was only like a cobra and a mongoose floating on the same log in a time of flood. If JP was thought or hoping that it was going to be some thing more permanent, he lacked wisdom.

    President also was supporting the aragalaya and became president. The teaching is about integrity or honesty – that you don’t play by your own set of rules… and success doesn’t count unless you earn it fair that the truth matters

      Secular practices like gassing Jews simply because they were Jews?
      Spain and Ireland were till quite recently as much beholden to the Vatican as Iran is to the Mullahs.
      In UK, “God save the King” is self-explanatory. Even we don’t invoke any gods in our anthem.
      But, to be fair, the Europeans, though they may have symbolically non-secular laws and practices, never use them to discriminate against those they don’t like, whereas we get more and more illiberal every year.

      The biggest fight of our nation should be to marginalize the MYTHS out of this country. In developed world, it is existent to 5-10% however our people are after it, as a number over 90%, going limits. That has now become the most lucrative business of various fraudesters.

    These “Dramas” are staged from time to time to keep the public engaged in “Entertainment” as well as to play the “Political Game” of “FORGET” and “CHEAT” the “TRAUMA” created by “UNCERTAINTY”; “LOSS OF HOPE”; “DISBELIEF IN LIFE HEALTH”; “ECONOMIC DOWNFALL” etc.

    In another turn of events, there are some “NEW ENTRANTS” to the “GAME” who need “Quick” and “Easy” ways to capture the attention of the public. To some of them, the size of the “Crowd” is not that important because the “MEDIA” (most importantly “Social Media” like Youtube, Whats App, etc) is readily available and most importantly makes a “Quick Buck too on the side. So it is a “NEW ENTRANTS’ GAME” – the “BALL” kicked around is made of “Religion and “Race” – the subjects that “AROUSE” and “CHALLENGE” the social/cultural value systems of the people.

    The Government in power too has got “Willingly” involved and entered the “Game” not as “Spectators” and “Correctional Officials” but as “Umpaires” and “Judges”, and “Punters”. For them (the Government in power) is “Make Hey while the Sun Shines”.

          The person you are paying attention to is a fool for his behavior.

          This was not said about anyone, many of us did it to him. It seems incomprehensible to him. What is clear is far from such mindsets.
          However, it might take a few more decades, he just doesn’t see it right. That’s the nature of that category.

    Pardon my ignorance, what does hate speech or ‘prohibits advocacy of hatred that constitutes incitement to discrimination, violence or hostility’ relate to Natasha’s act? In my understanding, she made a joke of what would have been the topic among new mothers during Buddha’s time, in the current context. After all, how sure are we that Buddha walked soon after birth? Seriously, isn’t it all folklore, just like Jesus creating the world in 7 days, unlikely, but we all go along with? As for referring to Buddha as ‘Suddodhana’s podi eka’, may be offensive to some but don’t we swear by naming god or Jesus? Anybody heard of jokes about the Mary with the cherry? Or would fanatic Muslims find it unacceptable at the thought of getting Buddhist virgins in their harem when they go to haven after ‘jihad’ due to a shortage, the supply quota filled by pious old girls of Buddhist Ladies College?
    Anyway, now she is tied up with ‘aragalaya’ protestors who tried to bring down the govt., therefore, an assumed terrorist. No wonder the saying ‘the law is an ass’, it can’t get more stupid than this.

    Weaponising of the law was not started suddenly now. It was started long ago with the influence of Fundamentalism. It started with PTA by JRJ and now his pedigree RW continuing successfully. All the Reginonal and International players including India, China, USA are in this game and SWRD, JRJ, Mahinda Rajapaksa and Ranil W all are implementing those games.

    The current political world is very different to what it used to be universally; people been better educated and capable of been more independent in their endeavors.
    Unfortunately, the “powerful” current politicians are a different breed, old fashioned and mostly corrupt.The ordinary people have been duped and taken for a right royal ride.
    Fortunately the country is blessed with an educated younger generation capable of doing a much better job politically than the present lot of opportunistic crooks if given the opportunity.
    The solution is a new constitution with age limits and term limits to elected office for new blood to take over the political realms and get rid of the culture of impunity prevalent since independence.

    The essence of the ICCPR is the principe of equality. If this fool of a pastor who thinks he is a prophet is guilty of preaching falsehoods, what about the hatred spewed by fools like Gnanasara Thero against others. Why is he doled out when it suits the Sinhala Buddhist chauvinists when it is necessary to mobilise the 6.9 million goons. Unless this Sinhala Buddhist chauvinism is curbed and the phenomenon of evangelical churches sprouting up controlled we are in for trouble. Why cannot the established churches expose these evangelists as false prophets? It is their duty to do so. Likewise, the “Maha” Sangha should stop the spreading of hatred by those who falsely profess the religion of kindness and peace preached by Gautama the Buddha. Unfortunately, it is the Maha Sangha which has scuttled every effort at ethnic peace.

      We cannot take it upon ourselves to decide who is fake and who is genuine in organized religions. The Anglican Church for instance has land holdings way out of proportion to its membership. The Vatican’s wealth, and that of many temples, is legendary. The establishment complains because the newcomers are poaching their customers.
      The correct way would be to prove criminal fraud in the case of miracles and donations, but that should apply to all equally. No religion should be more equal.

What would have happened to Natasha had she asked a bald head, “Man, come here, are you a prodigy of born to the lion?” Then why the comedian Mahanama is honored and carried on a palanquin for making the same comedy, but Natasha is selected to be sent to prison? Ponnambalam opposed in Parliament when Comedian Sabanayakar told the Justices of SC must be called to Parliament and disciplined for criticizing the “rogues or the Excellence of parliamentarians”.
