What You Need To Know About Ahimsa’s Case Against Gotabaya

The daughter of Sunday Leader murdered Editor Lasantha Wickrematunge, Ahimsa filed action against Nandasena Gotabaya Rajapaksa in the courts of Los Angeles, California on 7th April requesting a Jury trial and compensation. 

Wickrematunge v. Rajapaksa Why was a complaint filed?

Ahimsa Wickrematunge has been seeking accountability for her father’s murder for over ten years. Despite the hard work of the investigating authorities in Sri Lanka, there have still been no charges filed against those responsible for Lasantha’s death. For these reasons, Ahimsa and the Center for Justice and Accountability (CJA) decided to bring this civil suit in the United States. Even though the suit will not result in any jail time, it is an opportunity for Ahimsa to have her father’s case heard in a court of law, and to have an impartial judge rule on Gotabaya Rajapaksa’s liability for his murder.

Where was the complaint filed?

The complaint was filed in Los Angeles, California before the U.S. District Court for the Central District of California.

Was defendant served with the papers?

Yes, the defendant was personally served on April 7, 2019 in Montrose, California (within Los Angeles County). Service was performed by a private investigator from Ideal Investigations, with support from the Mintz Group.

What are the issues raised in the complaint?

The complaint alleges that Gotabaya Rajapaksa was involved in the extrajudicial killing of journalist Lasantha Wickrematunge as well as the widespread and systematic targeting of other journalists perceived to be critical of the Rajapaksa government.

What laws are referenced/What is the legal framework for such a complaint?

The case brings civil claims under two federal statutes: the Torture Victim Protection Act (TVPA) and the Alien Tort Statute (ATS).

The TVPA, passed in 1991, allows U.S. federal courts to hear claims against individuals who, acting under the actual or apparent authority of a foreign nation, committed torture or
extrajudicial killing. Under the TVPA, both U.S. citizens and non-citizens may file suit. The perpetrator must be served with the lawsuit while they are present in the U.S. in order for a court to have jurisdiction over the individual.

The ATS, passed in 1789, allows foreign victims of international human rights abuses to sue the perpetrators in U.S. federal courts for violations of customary international law. U.S. courts have applied this law to hear claims involving crimes against humanity, torture, extrajudicial killing, war crimes, and other serious human rights violations.

Neither of these laws require U.S. nationality to pursue a claim. However, the Defendant must be within the jurisdiction of the U.S. for a case to be initiated.

What is the defendant’s obligation now?

The defendant has three weeks from the time of service to respond to our complaint, by either affirming or denying the facts we allege or by filing a motion to dismiss. If he does not respond, the case can still proceed without him, and the court will assess the strength of our claims against him.

What is the legal process in such a case?

Gotabaya Rajapaksa has now been served and is therefore put on notice about the case. He must respond to the complaint and may obtain a lawyer to represent him in court. Should the case continue, both parties will have an opportunity to depose witnesses and obtain evidence from one another. The case may eventually go to trial, and the plaintiff will be required to prove the case before a judge or jury through the testimony of our client, witnesses, and experts in court.

Will there be criminal sanctions?

If the judge or jury determines that Gotabaya Rajapaksa was indeed responsible for the crimes in the complaint, the case will result in monetary damages. Unlike a criminal case, it will not result in any jail time. However, we hope that our case, if successful, will support the criminal investigation in Sri Lanka and eventually lead to criminal accountability.

Will this case prevent justice being pursued in the Sri Lankan courts?

We fully support the need for fair and independent prosecutions of attacks against journalists in Sri Lanka. Unfortunately, such cases have not yet materialized. If and when such prosecutions become viable in Sri Lanka, our case will not prevent these cases from moving forward. Instead, our hope is that our case will serve to support the ongoing investigations and future prosecutions of the attacks on Lasantha, Keith Noyahr, and other persecuted journalists.

Are there any similar cases filed in the United States that have provided justice for victims?

CJA has successfully brought a number of cases in U.S. courts seeking justice for human rights abuses that occurred in Bosnia, Chile, China, El Salvador, and Somalia, to name a few examples. The following are two examples of recent victories:

In 2012, a U.S. court awarded Somali torture survivors $21 million against General Mohammed Ali Samantar, Somalia’s former prime minister and minister of defense. Samantar had presided over countless killings and torture of civilians in the 1980s. The case was the first to ever hold a Somali official accountable for human rights crimes committed under the Siad Barré regime. It also established the precedent that foreign officials cannot claim immunity for acts of torture, extrajudicial killing, or other universally recognized human rights violations.

In 2016, a jury found Lieutenant Pedro Barrientos Nuñez responsible for the murder of Chilean singer Victor Jara and awarded Jara’s family $28 million. In 1973, Jara, famous for his outspoken messages on social equality, was tortured and murdered along with hundreds of others by the military under the Pinochet regime. Former soldiers finally broke their silence in 2009, and a number of officials were indicted in Chile. However, because Barrientos had moved to the U.S., the Chilean courts could not reach him. The decision in CJA’s case, along with the prosecutions in Chile, have finally provided judicial acknowledgement of the government’s role in his murder.

      I have no doubt, this would not let Gotler to be free with his renunciation of americal citizenship. He will rather have to count with lot more high profile cases being filed against him in the days to come.

    I do hope Ahimsa will one day be presented with the justice she is desperately seeking. Only she will know the pain and torment she has undergone in this quest. We should also not forget how Iqbal Athas narrowly escaped death after his expose of the MIG-27 deal in 2006. He detailed his harrowing experience during his speech at the launch of Sri Lanka’s Center for Investigative Reporting – earlier this year.

    1. I suggest that Ahimsa has been made a live bait for political gains by the UNp/ TNL and other politically interested to de-rail Gothabaya Rajapakse’s political initiatives.

The ‘prosecuting’ individuals and process has no chance of success because Mr Gotabhaya Rajapaksa was not a commanding officer of any military force, he was just a bureaucrat who had no ‘official’ capacity to carry out acts of the alleged nature.

    If this case could succeed, why can’t we pursue the descendants of Portuguese, Dutch and British Jews ho murdered millions of male Sinhala resistance fighters and raped millions of our women and stole our land and other resources? Africans have examined the legal processes involved and have given up pursuing the descendats of those mass murderers for obvious reasons. They (or us) have not been compensated for those crimes.

    In Wickramatunga’s case, curiously, the army chief at the time (Sarath Fonseka) who has hinted in many ways that he had reasons to ‘punish’ the stupid Wickramatunga is not being pursued!

    Wickramatunga was a fundamentalist Christian fraud that was destabilising Sri Lanka and Gotabhaya was a brave ex-soldier who was risking his life to save the coutry from Prabakaran’s menace. He had no control over armed thugs, Fonseka had. If you want credibility on the issue, pursue Fonseka.

    Acts of Rajapakses have brought us into the category of Bosnia, Chile, China, El Salvador, and Somalia. No one should blame Ahimsa W for what she did. If my father was killed brutally on the road using a tool used to kill animals, I would personally go behind the killers and the backers to take revenge if the police and the state is not doing that. Why did they kill LW so brutally, when an unidentified gunman (sniper) could have done it very easily without any trace. They wanted to teach a lesson to the others who try to go against them.     I hope that evidence led in this case will cause justice to be dispensed.

    Lasantha’ case, beyond the concern on humanistic sympathy to his family, beyond general thirst for justice, has a special concern to Tamils. That is the reason Tamil political right activists & politicians should pay attention to this case. Aanduwa manipulated the October 26th coup case at SC and CoA to save all Coup partners. It managed the entire case with a simple injunction. Then it had forced all 122 MPs to withdraw the quo warranto to save all partners in the Coup. But its agent Tilak has been using the coup injunction as a fair verdict of Sinhala Jury Only Justice system in UNHRC, in March 2019. In fact, the justice for Coup case was completely blocked in SC and COA by Trio to save themselves. So instead all Coup partners, that the trio must have received capital punishment from SC, now back on their seats. Further it appears the loss of was manipulated to steal Opposition Party leadership from Tamils too. But Lasantha like high profile cases against the War Heroes who carry out Tamil Genocide with full impunity tell what the real status of Sinhala Jury only verdicts. 25 Tamil Journalist are killed during the peak time. 45 were affected. But, I understand, not even one Tamil journalist went to apply for compensation from the Affected Journalist Compensation Process. Everybody knows why. Whatever happened to journalist in past, still the truth is only journalism and free media can bring out Tamils’ plight. That is why Tamil politicians and activist must pay attention on how Lasantha’s case progress in getting his family the justice.

    The abduction and murder of number of journalists and human rights activists including Lasantha were never brought under justice during the Mahinda Presidency or under the presidency of Maithiripala Sirisena & Prime Minister Ranil period. The governments in power over the 10 year period never showed an interest in finding the justice to the victims because those who planned and executed those crimes are very powerful and they are protected by majority of Sinhalese people as well. Almost all those victims are branded as LTTE sympathisers by those murderers. The real reason was that Lasantha brought the corruption deals carried out by those who were in power. Now they are the richest after sucking the blood of poor Sinhalese and Tamils.
    You will never get justice in Srilankan courts for these murders.

    Lasantha’s family have been relentless in their pursuit of justice, for the brutal murder of their love one. It is very impressive the way they have kept this crime in the limelight all these years. Shame on the present leadership for not solving this murder, along with so many others, and bring hold the criminals accountable.

        SK, I agree that the two major parties each imposes Hobson’s choice on us. However, we’re not totally helpless. If we are indeed forced to acknowledge the inevitability to vote either UNP or Rajapaksa nominee, we can still give the guy only our THIRD Preference: the FIRST and SECOND must go to two of the fifteen or so others who will contest. Among them, there will be a couple whom each of us has some faith in. Vote for them. It doesn’t matter our each voting for a different guy who will not get anywhere near winning.

        Depriving the winner the chance to say that he had more than 50% First Preferences is what we should aim at. Educating 13 million registered voters is plain impossible. Forcing a Second Round of counting will cause at least half the voters, on the post-election night, to understand that in 2025 we could meaningfully have Third, Fourth, and Fifth hopefuls contesting.

Ahimsa Wickrematunga obviously lost her father too early. Although his was a quick death, he lived with vivid knowledge of the risks he ran.

              Similarly I too have my own views and doubts about his Presidential suitability.
              But I certainly having a high regard for his professional abilities and frankness and commitment on the issue about defeated candidates nominated as MP’s..
              The former CJ’s position that ‘it is not of national importance’ canot be condoned and Nagananda’s objection to that is justified.
              I also admire him for his determined campaign and stance about Parliamentarians unjustly profiteering by selling their duty free cars.
              As for your suggestion about targeting the 2025 elections, I prefer to not delay that task till then but to get it over ASAP in 2020 itself.

    The Ahimsa vs GR and the Roy Samathanam vs GR have somethings in common.
    The US government, as prosecutor, will keep in mind that GR is from the Lankan Elites without political borders. The case may bring other Elites and/or skeletons to the forefront.
    US knows the loyalty of the ‘Sinhala Speakers Only’ Lankan Armed Services.
    The US government has to note the absence of media coverage regarding GR return. Who has the power to impose this self-censorship?

    Nearly a decade ago, I told many people that they should use ‘unorthodox’ methods to hold SL war criminals accountable. Even with a civil case, if the case goes through and a judgement is entered, and GR doesn’t pay, the next time GR tries to visit the US, bounty hunters can be hired to wait for him at the airport and take away any of his personal property in order to ‘collect’ the judgment. For instance, if he parks his car and goes into a home, the bounty hunters can legally break into the car and seize it.

    This has happened to some wealthy deadbeats in the US. GR should know that he will be hounded for the rest of his life for his crimes.
