Rizana, Shirani And The Lankan Reality

“Why couldn’t you at least get my child’s body down?” Rizana’s mother queries the government (BBC – 11.1.2013)

Rizana Nafik was beheaded at 11.40 am on 9th January 2013. Two hours later, at 1.40 pm, Minister Dilan Perera informed the Lankan parliament that “the government has done everything to save Rizana and she will be released soon” (Gossip Lanka).

That bizarre development was not an anomaly; it was an expression of the way the Rizana Nafik case was handled by the Rajapaksa administration. Just five days before Ms. Nafik’s judicial murder, the Ministry of Justice issued a statement announcing that Ms. Nafik might be pardoned: “The Saudi Arabian Ambassador said Rizana may be granted a pardon in response to a request made by President Mahinda Rajapaksa to Saudi King Abdullah Bin Abdul Aziz….. The Saudi Ambassador said President Mahinda Rajapaksa and the Sri Lanka Government had made a great effort to get Rizana freed and the information he had received was that she may receive a pardon soon” (Daily News – 5.10.2013).

The regime’s sanguinity was rather curious because Ms. Nafik’s impending execution was no secret. Several international human rights organisations, including the Amnesty International and the Asian Human Rights Commission (AHRC), warned about it publicly. Had Ministers Rauf Hakeem, Dilan Perera or their innumerable officials bothered to check the newspapers or the internet, they could have found out about Ms. Nafik’s impending execution and thus refrained from sprouting such asininely insensitive lies.

That indifference is the crux of the matter: the Rajapaksa administration was not really bothered about Ms. Nafik’s fate. While politicians and officials used her plight to flay around, the government refused to pay the lawyers who lodged the appeal against her death sentence, as the AHRC revealed. The regime’s priority was not to make a real effort on behalf of Ms. Nafik but to put up a show.

The barbaric murder of Rizana Nafik exposes the sordid reality of the Rajapaksa development miracle just as the trajectory of the impeachment motion unveils the iniquitous actuality of Rajapaksa justice.

The Rajapaksas, like all megalomaniacs, think big and abhor dissent. Their idea of development is a series of showpieces, from expressways to satellites. It matters a little that this magnificence is a façade for an economy which is debt-ridden and directionless. The boast of creating a knowledge-based economy is empty rhetoric; apart from the megalomaniac projects of the Rajapaksas, the only growth sector is tourism of a certain variety which aims at turning Sri Lanka into a haven of rest and recreation for the rich and the infamous. This brand of tourism, instead of creating employment opportunities, destroys the livelihoods – and habitats – of entire communities.

The men and women, who labour under extremely difficult, often dangerous, conditions in foreign lands, form one of the mainstays of our economy; their foreign remittances keep Sri Lanka afloat. As a collective, they are indispensable to the very survival of Sri Lanka. As individuals, they are of little account to a nation which prefers to ignore the moral-ethical debt owed to them. (In this sense the situation of Lankan ‘House Maids’ is somewhat analogous to that of tea-pluckers of Indian origin – another group of workers celebrated in the abstract and ignored and despised in the concrete).
Had Ms. Nafik been a Sinhalese – especially a Sinhala Buddhist – the majoritarian fanatics would have used her plight to fuel their anti-Muslim campaign. By now they would have been on the streets howling against every single Muslim man, woman and child in Sri Lanka. Had Ms. Nafik been executed in a non-Muslim country, Muslim fundamentalists would have mounted their own campaign, decrying this judicial murder as an anti-Islamic conspiracy. Since Ms. Nafik was a Muslim judicially murdered in a Muslim country, her life and her death are of no use to fanatics of all religious persuasions. Even the mainstream Muslims seem extremely circumspect in expressing their outrage because many of them benefit from the petrodollars of Saudi Arabia’s Wahabi rulers.

Ms. Nafik’s judicial murder is a timely warning to those who want to reactivate death sentence in Sri Lanka. In justifying archaic and brutal forms of punishments, there is a certain commonality between the Saudi Wahabis and those Sinhala supremacists who lament the absence of ‘Raja kale danduwam’ (ancient forms of punishments). The horrors of Wahabist Saudi Arabia constitute a warning of what the JHU and Bodu Bala Sena types will do in the name of Buddhism if ever they become dominant in Sri Lanka. Fanatics begin by attacking the ‘other’ and end by consuming their own. And Wahabism is as unrepresentative of Islam as the JHU or the Bodu Bala Sena is of Buddhism.

According to the New Yorker, the Saudi King too had refused clemency to Ms. Nafik. Had Ms. Nafik been judicially murdered in the West or India, the likes of Wimal Weerawansa and Champika Ranawaka would be screaming from rooftops, with full Rajapaksa backing. But Colombo is unlikely to do anything to anger Riyadh because the Rajapaksas need Saudi support in international forums. Riyadh has consistently supported Colombo on human rights issues; Saudis voted against 2012 UNHRC resolution on Sri Lanka.

In the first half of 2012, 136,245 Lankans left their motherland, the miracle of Asia, in search of employment, according to the Central Bank. So long as living costs increase and jobs remain scarce, women and men will have no choice but to risk their lives in someone else’s country to keep their families alive. Until this reality is faced and remedial measures are taken, there will be other Rizanas. Eventually one of them will be a Sinhala Buddhist and the Sinhala fanatics, who are drunk with triumphalism after ‘defeating Tamils’ and are longing to put the Muslims (and the Christians) ‘in their place’, will have the excuse they need to unleash the mayhem of their dreams.

Life in Post-impeachment Sri Lanka

Had the Rajapaksa regime been really interested in saving Rizana Nafik, it could have paid the lawyers who were fighting her conviction. Had the Rajapaksa regime been really interested in seeking justice, it could have conducted the impeachment trial in a manifestly free and fair manner.

But that is not the Rajapaksa way. The Siblings are not interested in doing the right thing; they just want to deceive the public into thinking that they are doing the right thing.

That is why there is no point in appealing to Speaker Rajapaksa or writing to President Rajapaksa. The impeachment is their war; they used their parliamentary-serfs unleash the impeachment, in order to bring the judiciary to heel. The Rajapaksas believe that this country belongs to them by the right of conquest, that they own Sri Lanka because they defeated the LTTE. Even a marginally independent judiciary has no place in this Rajapaksa Sri Lanka. That is why they brought impeached CJ Bandaranayake and did so with such venomous vigour.

The Rajapaksas are not the whole of the problem; but they constitute a large part of it. Removing them will not resolve the Lankan crises. But the Lankan crises cannot be resolved so long as they remain in power.

          Obama plan is ON as the Americans are fed up of stupid oil wars. The plan is in 30 years US will not be importing any oil and the technology has been in use from the 90’s. Right now in the EU the electric car which runs at 60mph is very popular and there are stations everywhere to recharge.
          Visit China they have very popular homemade electric cars.
          Our question is will you work for ½ the pay and spread your legs in another’s home??

            first of all this so called 40-50 years is a rough estimation based on current supply & demand scenario ,so i wouldn’t take this magical number as the gospel truth .where does 50 % of saudi oil go ? who cares !

            when you have no any other option left in your own country and the system let you down , for survival sake one has to take drastic measures , I suppose not for the half pay even a lesser pay cheque will do , in desperate situation desperate measures ought to take , i just wonder who are we to decide and pass derogative comments on some unfortunate poor women’s fate ? do we have the moral right to question the poor/innocent woman’s choice when the system completely broke down ?
            I’m not in favor of this degrading human slavery trade , but one has to ask who is going to put the food on the table for them ?

              It takes 2 to tango. From what you say you sound like a shark that thrives on human misery or does your boss make that killing.
              As a kid of 9 my pop took me over to the East German Ambassador at Colombo. With a tear in his eye the ambassador said during WW2 as a kid of 6 he ate grass for 3 weeks and he survived while his 4 year old brother died. That’s what makes Germans a self-reliant proud people and the largest exporter of high tech to the world while you guys are called lazy Modayas (taraha venda epa we are both born in the same place but it’s your thinking I reply.               I purposely did not say who purchases the 50% and we are in that region for 40 years running our chemical enterprise for the whole of the Middle East and our local signatory is none other than the chief of police. When young Asian girls escape to the church (where one of our members is a trustee) with the problem mainly from the unemployed Arab homes and we assist them to leave the land without much of a fuss that is sufficient proof for me to have an opinion.     The poor girl’s execution was forgotten the next day.Vamsa and his minions were eating Kiribath on the street and serving to paasers-by on 12th night not far away from Fowsies’ fotress! Shame! Shame! In India they cancelled all tamashas including Army celebrations for the rape/death of the pre-Medical student. We should have declared a day of mourning for poor Rizana. but look, our people are distributing ‘sweets'(read Kiribath)instead. What culture? Schik!

The final reality was the Govt was even unable to get the body of the slain girl for burial in her own home. Let it not be said Islamic rules are the body must be buried within hours. The body of of that much beloved and respected King Hussain of Jordan was kept for days to enable many foreign VIP’s to come and to enable the security and other logistics involved.

    Europe gives so much religious freedom to immigrant muslims than their own christians eg in the UK christians cannot wear a cross to work but the muslim women can wear their head gear; In most work places there are special places constructed for ablution and prayer yet UK receives the blunt of the blame from asian muslims who have no palestianian blood.
    Lankan Professors G.L. and Dayan were boasting that they were in the forefront of promoting palestine to the UNESCO.

    Tissranee Gunaratne, we agree with you. Remember Rauff Hakim, Rishard Badurdeen and even the President are frequest visitors to Middle-East countries. President is a lawyer while Rauff Hakim is an educated person. One ponders how these two men were not aware or ignorance of the 1944 Philadelhia Declaration and the 1998 Declaration on Fundamental Principles & Rights at Work which has reinforced the Preamble to the 1919 Constitution of the ILO, especially the objectives relating to the protection of the interests of workers who are employed in countries other than their own. Moreover, the Resolution on a fair deal for migrant workers adopted at the 92nd Session of the International Labour Conference in 2004 stated that a fair deal for all migrant workers require a right-based approach in accordance with the existing labour standards and ILO principles. In addition, ILO is part and parcel of one of the structures of UN which endorses the Universal Declaration of Human Rights and two other treaties, viz, the International Covenant on Civil & Political Rights and the International Covenant on Economic, Social and Cultural Rights. Here is a case of Rizana, a poor village girl, entered Saudi Arabia as a less skilled for seeking fortune at the age of 17 years on account of her poverty. She does not know their language. She was denied to have the access of having a lawyer or with the Sri Lankan Embassy. As President MR was actively engaged in Trade Union activities also, he would have been aware of these international Regulations. Is it not a shame on MR and other Ministers for being silent on this grave issue. Why can’t he take adequate steps to ban Housemaids being sent to Mid-East countries. Why can’t he improve the existing natural resources in Sri Lanka to find employment for such poor girls seeking employment in foreign countries, risking their lives. One tempts to think that Sri Lankan politicians are enjoying at the expense of the sufferings of such poor villagers.

      Citizen: According to ILO reports the sewing girls and tea pluckers get paid low too and he does not bother no government has bothered and they both create foreign exchange and they are all complying women. The value of your dollar is low to assist the importers and his holidays. Now he has brought in some curbs because the country is broke and calls for devaluation and nothing to do with their wages.       Rizana and the PC MP Madawala from waragoda are both dead but both of them are very young. These lives could have been saved if the current regime would have worked citizen friendly. Today the rulers have been brutal as no times in the lanken history.

      Rizana s incident was long known and they the Saudi authorities as Ranajan Ramanayake CLEARLY pointed out – let srilanken authorities to prove that Rizana was innocient in the killing of the baby.

      The most distinguished feature of the current regime is they just waited innocent people to be victimized to take proper actions. Even after they offered their lives – proper actions are far from reach.

      Human right organisations should pay the closer attention and these rulers should be brought before the investigations.

    He thinks he is a big shot in SAARC but it is all for home consumption, and Saudis care nothing for him. All the requests for clemency that Daily News (government’s mouth piece) alleges that he made were probably not made at all, and they were I think to appease the locals.
    What makes me livid is the utter silence of the usually vocal Muslims when one of their own daughters is being slaughtered by the Saudis who still live in the middle ages. Disgraceful conduct by Sri Lankan muslims or muslims anywhere else in the world.
    I suppose this is where the current SLK govt is dragging us into. The similarities are there. It won’t be long before, people who intimidate citizens living in their homes peacefully by having street parties in front of their homes, will drag them out and set them alight in the streets. Or just salughter them williy nilly because they dont want to be yes men/ women. Will I see a repeat of the 1983 violence committed against the Tamil citizens by thugs and violent Sinhala gangs who were egged on, instructed and manipulated by Sinhala political leaders at the time. Here are the similarities with Saudis when it comes to dark ages.
    The ogre in Kelaniya who rushes off to save hundreds of cattle being slaughtered by Muslims wants to lay down his life for the goats and calfs. But the same goat (I mean the ogre) instructs his gang of illiterate thugs to go and slaughter all the elected local goverment agents, alas while sitting at their meetings. It is good fortune the facts came out just in time, at the sacrifice of only one of the victims.
    So, the point I am making is SLK is very much akin to Saudi Arabia when it comes to cruel leaders and politicans and practices of the middle ages. The perpetrators of these practices are the ones like the ogre at Kelaniya who is willing to do any dark deed for his master, because that is what a good slave should obey his master. Might I add that some of the judges and jury, including the President of the PSC, who conducted the impeachment hearing were the ones who went to join the street party gang inf ront of CJs home. There goes a splendid example of the impartiality of the PSC, and evidence of what I said about the repeat of 1983 violence on citizens orchestrated by our political leaders.

    Seven years is a terribly long time waiting to be executed. Poor girl must have suffered terribly even before she was killed. Many activist protested but the govt only engaged on a low key. The chance to save her must have long past. It should have been done in the early stages.

    Especially the interpretation of sharia could have been challenged by our clerics. The need for two wittnesses is absolute, otherwise no verdict can be given. Also the the lack of a medical inquiry and legal representation for the accused.It seems our embassy does not know what is happening to its own people. By the time they get to know it is long past. Also we are not firm enough and try to please these brutish regimes to the detriment of our own people. Having a muslim ambassador in saudi is mistake as he may not engage fully on our behalf.

    At least at this stage govt must have an agreement with the saudis regarding the conditions of employment, renumeration and a means of being immediately informed and intervening in any legal process involving sri lankans.

    Until then stop the recruitment of housemaids to saudi and bring back those who want to return. Money is not everything and our womenfolk are more precious to us than the rials and dollars. We must ensure their dignity and safety instead of degrading them to the level of chattel and toilet cleaners for rich arabs. Better to be poor than be enslaven or dead.

    The real problem is racial hatred in Sri Lankan(Sinhala) minds.After committing all these blunders and years of bad governance still he will win any election if held tomorrow for the only reason of spearheading sinhala supremacy.Removing Rajapaksas is only a temporary solution like taking painkillers for cancer.

    While saying he got down ONE MILLION TOURISTS LAST YEAR……which I calculated in order to achieve that figure there should be 2,600 (12 full flights) per day of tourists should land EVERY DAY 365 DAYS LAST YEAR.
    I went to Katunayake Airport for six days last two weeks and did not even see 30 Tourists landing per flight.

    The removal of the CJ is not something new in the world, it happens in the world, including in the United States. However, some eliments may use this opportunity to bring chaos into the country, in order to achieve their ulterior motives. Remember, few eliments were fuelling the civil war and benefited by the war, but not the Tamils or Sinhalese. We must not let that happen again. The president appointed the CJ, now the 2/3 of the parliament wants her to leave the office. If I was the CJ, I would have resigned once the parliament decided to remove me from the office. Taking this matter to the UN is not advisable. Even the CJ is blameless she must let go for sake of the country. The country has been fighting for thirty years, people are free from fighting for only three years. Just wait for few more years, be patient, you all went through the bloody war for thirty years for nothing. I know very well about the parliament members, can we change those leaders mindset overnight? No we can’t. I am also well aware how Rajapaksa brothers are dominating the country, but I can live with that at the moment. We just finished the war, lets give enough guidance and time for them to act, if things does not change then we have a plan for them too. The President himself did not go to China to eliminate the LTTE, but he was adviced to go China so the other countries will run to him to help, including India. The extremely talented Sri Lankans will direct the country into the right path. If you think, the show is running by Rajapaksa brothers then you are very wrong.

    Lets examine the external threats for the country. The Indian government created the Tamil armed groups to keep Sri Lanka under its wings. However, India also understood that letting the Tamil armed groups grow beyond its control would be detrimental to India. This is the reason Prime Minister Rajiv Gandhi reached a very good political solution for the Tamils’ issues in Sri Lanka under the Indo-Sri Lanka agreement. Unfortunately the LTTE did not see what Rajiv Gandhi did, because of the Tamil diaspora. The 2002 ceasefire agreement between the LTTE and the Sri Lankan government also broken by the LTTE. A reasonable political minded person knows that Prabhakaran would not have fought against the Indian government without the help of the Westerners through diaspora. And also Prabhakaran would not have broken the 2002 ceasefire agreement with the Sri Lankan government without the help of the Westerners who pushed him to fight against India. If you can answer the following questions you will know who have most of the Tamils’ and Sinhalese’s blood on their hands. Who have been deliberately stopping the peace agreements? Who have been guiding the diaspora? Who have been fuelling “hate and bitterness” among the Tamils and Sinhalese? Who have been facilitating the funding to the LTTE, even though they had everything within their reach to stop money get transferred from the diaspora to the LTTE. The answer is Western political minds through their intelligence network.

    President MR does not have an answer for everything, but he has the ability to deal with the external threats better than any other leader. Therefore, Lets approach matters very pragmatically for sake of the innocent people who have died due to the bloody war. It is a new beginning for the CJ. The Chief Justice Shirani Bandaranayake has a huge potential. She has a lot to give for the country. She must get involved in politics and bring new ideas to the table. Lets people decide whether she is worthy or not. She must not go to the UN, but go to her people and put her ideas forward, in order to develop the country. She must not go to the enemies who divide others, invade others’ countries and kill millions of people to keep themselves on top. Do not go to the devil to get justice. I urge every Lankan to stop listening to the enemies who divide us, they use every opportunity to bring chaos into the developing countries to rule others. We must understand what is missing, then find a solution within us, looking outside will create more problem and chaos than a solution.

    The Westerners ruled and ripped off the Indian Subcontinent for more than 440 years, but they never done anything to eliminate the caste systems, gender inequality, and racial, language and religious discriminations. Because they knew it will continue to eat the Indian Subcontinent and keep the Asians under the West forever. Four hundred years is very long time, at least 10-12 generations. The West could have done a lot, but they deliberately done little. The Westerners have a lot to talk about the Indian Subcontinent’s failure than China’s communism, but they won’t talk about it, because it will highlight their deliberate misleading to keep the Asians under them, plus the Indian Subcontinent is not a threat to their dominant power, but China. “English are to blame for India’s backwardness” published by the Dominion Post, written by Philip Collins, on page B5, Dated January 5, 2013. The Dominion Post is one of the major newspapers in New Zealand. Not all the Westerners are naive or blind, there are people like Philip Collins who sees the Westerners’ evil side. The Indian Subcontinent has enough intellectuals to develop the Subcontinent better than China, but the system won’t allow the intellectuals to lead. Therefore, the intellectuals leave the Subcontinent and develop the Western Countries. This system was developed by the Westerners, in order to keep the Indian Subcontinent poor and weak.

    We fought against the Westerners to have our freedom, but we still trust them, listen to them and run our political system according to them. This is a huge disaster. The Indians are too scared to change the manufacturing sector, because they don’t want to allow another East India Company. However, they are happy to run a political system recommended by the Westerners. The Chinese are really smart, because they have a political system what is good for them, they did not choose a political system recommended by their enemies. We must stop listening and trusting our enemies. We must develop a system according to our culture and ideology, like the Chinese did, otherwise the Indian Subcontinent will be struggling forever. We must depart from the old system and bring some changes. Being part of the Commonwealth is only helping us to stay behind. Time for us to move forward, our policies are not helping the Indian Subcontinent to move forward as China. Am I recommending a communist system? Not at all, but we need some changes, if we come up with something good, India may even consider our system in the future. We must find a way to lift the whole Indian Subcontinent. India can’t try something new, because it is too big. Sri Lanka is a small country, we must try something new and help the whole Indian Subcontinent, otherwise we will be betraying our future generations.
