Pro-MMDA advocates expressed concerns of severe pushback by the All Ceylon Jamiyyathul Ulama aimed at thwarting efforts to implement necessary reforms to the Muslim Marriage and Divorce Act (MMDA).

In a meeting held by 12 Muslim Ministers and MPs at the Parliament over a week ago, it was decided that necessary reforms to the MMDA will be tabled before the Cabinet for approval through a joint cabinet paper submitted by the Minister of Justice and Minister of Muslim Affairs.
Among the important and much awaited reforms were the increase of minimum marriage age to 18 years for both males and females, and removal of the word ‘male’ for Quazis which would lift discrmination and exclusion of women from being awarded the status and awarding a judicial status to Quazi courts and appointing those with an Attorney-at-law qualification specializing in Muslim law, as Quazi judges.
But Colombo Telegraph reliably learns that ACJU has been lobbying among Muslim political leadership during the past few days behind the scenes, to thwart implementation of the reforms.
The need for MMDA reforms come in the wake of horror stories emerging from various parts of Sri Lanka, where women and children have been discriminated, abused and violated of their fundamental rights due to the archaic legislations included in the MMDA.
In one such recent instance, a 16-year old from Kandy had been forcibly married off to her rapist as determined by the Quazi court against the wishes of the victim and her parents, only to realize the rapist is married with a child.
Meanwhile, Sirisena loyalist Salley has been actively lobbying alongside the ACJU to scuttle the MMDA reforms – with meetings scheduled today with several Muslim MPs. Senior Journalist Munza Mushtaq in a tweet today said Salley has informed Justice Minister Thalatha Athukorale to not proceed with the MMDA reforms without consultation and recommendation of Islamic clergy.
Those who have been advocating for MMDA reforms over the past several years point out certain factions are engaged in violating fundamental rights of Muslim women by invoking adherence to Islamic law. They point out that blocking reforms in the name of Islamic law is in fact un-Islamic, as these factions seek to proscribe ‘what is not proscribed, in the name of Sharia’.
Pro-MMDA reform activists are calling upon all groups to celebrate the diverse opinions within Shariah and ensure justice is done by all citizens and they are also calling upon the President, PM and Ministers of the Cabinet to act swiftly and take measures to reform archaic discriminatory laws.

2. The draft Bill and Cabinet Memorandum will be submitted for Muslim MPs for their consent before it is submitted to the Cabinet of Ministers
3. The MPs who were present resolved as follows:
1. Age of Marriage: Agree to provide for 18 years for both men and women without a difference
2. Registration – validity / invalidity : Registration and Nikah are mandatory to validate a marriage
3. Mata’a / Compensatory gift – lump sum compensation – Agree to Mata’a for Talaq, Khula and Faskh. Compensation for Faskh is possible only if it is proved that the wife has been compelled by duress exerted upon her by her husband to seek a Fashh in order to avoid paying Mata’a
4. / Mazhabs. Agree to keep the sect in tact subjects to following amendments:
Parties to a Muslim marriage belong to two different sects, can mutually agree to be governed by a particular sect in the declarations made by them
One or both parties to a Muslim marriage do not belong to any sect, or where the parties to the marriage belong to two different sects but they have not mutually agreed to abide by the Muslim law of any particular sect in the declaration made by them, all the matters relating to the said marriage shall be governed by the principles of Muslim law, without being confined to the law governing any particular sect.
5. as Qazi – Agree to remove the gender discrimination by removing the word “male”
6. Role of male Wali. – Agree to keep male wali, provided that in the event of the Qazi happens to be a women, when there is no wali for the bride, a male Qazi of another jurisdiction can be invited to deputize the female Qazi of a particular jurisdiction. (Present position is that wali is required for all women other than those who have been married before while women can get Quazi approval and marry without Wali)
7. of Quazis and Upgarde of Quazi courts – Agree to elevate the institution of Quazi to the status of a court, be recognized as an integral part of the Sri Lankan Judiciary and to enhance the status of a Quazi to that of a permanent and full time Judicial Officer of such class and grade as may be determined by the Judicial Service Commission. The amending legislation to provide that persons to be appointed as Quazis, Temporary Quazis and Special Quazis, should be Attorneys-at-law having a sound knowledge of Muslim law.
8. Lawyers Appearing at Quazi court : Do not agree to representation by Attorneys – at –Law in the Qazi courts. Either party can be accompanied by any individual during their court procedures but lawyers cannot appear in Quazi courts to represent clients in their legal capacity.
9. Polygamy with conditions: Agreed to keep the polygamy with conditions applied as follows ( This will almost curtail the polygamy)
Quazi approval required based on following conditions for subsequent marriage:
Adequately looking after wives
Adequately looking after children
Adequately looking after future wife
Financial capacity to look after all
Inform present wife/wives
Subsequent marriage contracted without Quazi’s permissions is punishable by imprisonment
If wife doesn’t give permission, wife can apply for a divorce.
Polygamy without Quazi’s approval and without fulfilling the conditions cannot be solemnized and registered. Such marriage should be invalidated.
10. Consent / Signature of Bride – Agree to provides for Wali as well as bride to sign
11. Kaikuli /dowry, – Agree to provide for recovery of kaikuli to be expended to include Mahar and movable and immovable property
12. Role of Women – Agree to provide for adequate representation for males/ females in MMD advisory board, Board of Quazi’s, Appointment of women registrars
13. Maintenance – Agree to take out of the jurisdiction of Quazi court and bring under the District Court
14. All matters agreed upon by consensus – Agree to include all other matters agreed upon by consensus by both Justice Saleem Marsoof et al and Faiz Mustafa et al

Muslim Law is not unique only to SL but is in practice in many countries where Muslims are a minority. In India, Muslims are governed by The Muslim Personal Law (Shariat) Application Act, 1937. This law deals with marriage, succession, inheritance and compulsory savings tax/charities among Muslims. The Dissolution of Muslim Marriages Act, 1939 deals with the circumstances in which Muslim women can obtain divorce and rights of Muslim women who have been divorced by their husbands and to provide for matters connected therewith. These laws are not applicable in Goa state, where the Goa Civil Code is applicable for all persons irrespective of their religion. Laws which cannot be implemented under Roman Dutch Laws since these laws are unique only to Muslims, and thus must be implemented as separate Laws, uniquely identified as MMDA.

The members of the ACJU are mere scholars of Islamic Jurisprudence. They are not, repeat not, ‘Islamic priests’. There is no priesthood in Islam. These members are not consecrated or ordained in any way. A more descriptive name for this group would be the Sri Lanka Association of Islamic Scholars.
The primary role of Islamic Scholars (Ulema) is to guide and advise the Ummah on matters pertaining to Islamic laws.
Unfortunately, the goal of the ACJU has evolved over time to be perceived as ‘Muslim Priests’ which would then place them on-par with the Buddhist, Hindu and Christian Clergy. It is a matter of deep regret that, apart from the non-Muslims, many Muslims too who should know better continue to inflate the egos of the ACJU members by referring to them as ‘clerics’ and ‘clergy’ and showing them the kind of reverence normally associated with ordained priests.
It is therefore not surprising that the ACJU are now beginning to perceive themselves as ‘Enforcers’ of Islamic law in Sri Lanka and ‘Leaders’ of the Ummah.
These scholars have no God-given right to insist that Muslims adhere to outdated laws. They only have the right, by virtue of their academic achievements, to advise and guide the Muslims regarding such matters. If a Muslim breaks a divine law, he or she is answerable only to the Almighty, not to the scholars of the ACJU.
If the ACJU and their political puppets continue to scuttle the MMDA reforms, then the Government of Sri Lanka must ensure that it does not continue to discriminate it’s Muslim citizens by granting them the the option to marry under the General Marriage and Registration Ordinance (GMRO) regardless of whether or not the MMDA undergoes future reform.

MUSLIMS IN SRI LANKA HAVE TO MAKE CHANGES IMMEDIATELY, Insha Allah. “The Muslim Voice” is happy that the Muslims and Muslim politicians are thinking “PROACTIVELY”. “The Muslim Voice” is only trying to kindle the “aspirations and ispirations” of the Muslim community concerning this ACJU and Rizvi Mufthi in order to bring about a change and create a new “honest and dignified culture” within in the Sri Lanka Muslim Community. “THE MUSLIM VOICE” WISHES TO KEEP THISE ISSUES WITHIN OUR SELVES/OUR COMMUNITY AND GOING TO THE POLICE TO MAKE COMPLAINTS AS SUGGESTED BY YOU WILL COMPLICATE MATTERS FOR ACJU AND RIZVI MUFTHI. LOOK AT THE QUESTIONS RAISED AT THE PSC AND THE TV REGARDING THE TYPES OF EXPENSIVE VECHILES USED BY OUR ACJU MOULAVIS?
“THE MUSLIM VOICE” has been asking “DUA” from God AllMighty Allah after every daily prayers and Jumma’s since the manner in which the so-called Mufthi Rizvi, the incumbent president started to flirt with politicians and made a “MOCKERY” of the “HALAL ISSUE” to amaze millions of rupees for his personal gains and benefits with the support of “DECEPTIVE/MUNAAFIK” and “HOODWINKING” Muslim politicians and some professionals. The ACJU and Rizvi Mufthi has still NOT answered the question raised by “The Muslim Voice” regarding their relationship with the Mahinda Rajapaksa regime during 2005 -1015. The ACJU received a large block of land in Colombo 12 from former President Mahinda Rajapaksa when they were politically flirting with the UPFA/SLFP government and no one knows what happened to this block of state land that the ACJU got from Mahinda.
The ACJU and Rizvi Mufthi should answer the questions raised by “The Muslim Voice” before talking about other matters.

Unlike other customary laws applicable to Kandyans, Jaffna Tamils etc, the Muslim legal system is based on strict religious principles that date from the 7th century AD. Throughout history, religions have been the cause of conflict between communities, nations and groups of nations. In particular, ongoing religious fervour has been at the root of many sectarian conflicts that have evolved into full-blown wars that presently cause terrible suffering to innocent people caught in its ferocity. Sri Lanka is currently experiencing the rise of an extremist “Sinhala-Buddhist” religiosity, perhaps with political aspirations at its centre, while the country was rocked to its core on 21st April in a thunderbolt from hell, with local accessories and collaborators in surprising numbers. These developments do not bode well for the nation’s struggling masses, who are plundered by a political parasitic mob on one hand and a potential civil war being actively fomented by nefarious elements, further aggravating the innocent victims’ suffering. I believe that there should only be one law for all citizens, applied fairly and equitably.

Read the Quran, on the Earth spread out like a carpet, mountains pegged, sun going around the earth and setting in murky waters, Adam and Eve etc., etc. Very scientific in the 7th Century, not in the 21st Century.
Use reason. Read Ibn Rushd’s works. Ulama are not the people of knowledge, only Philosophers. See what Quran 3:6 says.
The Bible is not much different.
With the great flood, there was not much water to cover the lands. Even today, if all the icecaps and glaciers melt, the sea levels will only go up by 211 feet.

I here people of certain western countries are complaining that their religion christianity is being Weaponized. IT is known that Islam was against the spread of Communist philosophy as well as it is being used now in Asia to achieve political goals.
It is muslims who blew up killed 300 or so Catholics and maimed 500. Now, that is a complete silence.
Digana, and recent anti-muslims backlash is by foreign powers. Even Sivu-Hele aka Thun-sinhale needs one set of laws. It is not the job for protestants to say to muslims you need the laws amended. Even there are Christians in the world who run polygamous colonies, approves child marriages or incest and spread inbreeding.

Fundamentals of Islamic Jurisprudence cannot be changed. Certain issues may be revised. We are not Islamic sholars and not in a position to justify or criticize. Other religions may have man made laws and open to interpretations, amendments and revisions. We don’t become experts in medicine or engineering my reading Google web pages and we cant become religious experts for sure by reading google whatever religion we possess. Even Muslims don’t comment on the divine laws.

More than the Law, the main problem here is the poverty level of these people, these people don’t have a proper income, not a permanent house to live, and the females doesn’t do a job, and on top of it, the curse of the South Indian culture of having to give DOWRY, this is the biggest problem and this is totally unislamic
The mid income or higher level people hardly hear anything about MMDA, qazi courts or anything else, it’s always the poorest who are suffering due to this unislamic dowry system
So what the government and the Islamic clerics needs to do is lift the economic levels of these people and secondly and most importantly root out the curse of the dowry system, This will solve 90% of the problems without the need to amend any laws

Muslims should not be allowed to have Muslim laws in Sri Lanka. As an ex-Muslim, I can assure you that Muslim laws and cultural practises do not afford women any rights at all. If we allow Muslim laws in Lanka, then eventually Lanka Muslims might start having honour killings just like in Pakistan and Afghanistan. Do you think I’m exaggerating? Just look at the trend of Muslim fundamentalism in Lanka. Just a few decades ago, there were no goni billas in Lanka. Now, if you go to a very public place like Galle Face, you will see dozens of goni billo. The trend is very clear! Muslims are becoming more radical in Lanka. One way to stop that trend is to eliminate laws like MMDA and to educate Muslim children properly

So called Muslim leaders and Muslim masses,
Please note that if you all do not agree for the following, there will never be any reconciliation among other races living in Sri Lanka ;
1) No polygamy.
2)No black colour full body cover.
3)No full face cover at all.
4)No underage marriages.
5)No Shariah Law
6)No Arabic language in Public
7)No madrasah
8)No loudespeakers to call to prayers
9)No Halal food
Among the others, Kandyan law and Thesaalamai law are also to discarded. If you all cannot accept to come under one law in one country, you all will face consequences and there will not be any reconciliation among the majority races in Sri Lanka and instead there will be no trust among other communities as only the suspicion will prevail.

was shocked to hear this news and also disgusted ;we have already created lot of tension due to political party named after the community and now There is a new Ullama Party .
This is outrageous , while We the Muslim community is yet struggling with the worst crime done to.humanity under the label of the community’s religion , without finding ways to heal the wounds and eliminate suspicions and fill in the spaces , unfortunately these Ullamas are creating more issues.
Can the ACJU kindly advice the Muslim and other communities of Sri Lanka if the New Ullama Party that signed the MOU with a political party is a part or is the ACJU ? and also inform the public that you do not represent all Muslims in Sri lanka , like The Dawoodi Borah and Ismaili shias, local Jaffari Shias , Local NDM , Thoweed Jamath, Jamath E Islam Hub ul awliyas aka Sufi Thariqas (no.offence meant , pls correct me if necessary) and The Ahmedya Muslims. if I am b
