ACJU Lobbying Fervently To Scuttle Much-Needed MMDA Reforms From Being Implemented

Pro-MMDA advocates expressed concerns of severe pushback by the All Ceylon Jamiyyathul Ulama aimed at thwarting efforts to implement necessary reforms to the Muslim Marriage and Divorce Act (MMDA).

ACJU Rizvi Mufthi

In a meeting held by 12 Muslim Ministers and MPs at the Parliament over a week ago, it was decided that necessary reforms to the MMDA will be tabled before the Cabinet for approval through a joint cabinet paper submitted by the Minister of Justice and Minister of Muslim Affairs.

Among the important and much awaited reforms were the increase of minimum marriage age to 18 years for both males and females, and removal of the word ‘male’ for Quazis which would lift discrmination and exclusion of women from being awarded the status and awarding a judicial status to Quazi courts and appointing those with an Attorney-at-law qualification specializing in Muslim law, as Quazi judges.

But Colombo Telegraph reliably learns that ACJU has been lobbying among Muslim political leadership during the past few days behind the scenes, to thwart implementation of the reforms.

The need for MMDA reforms come in the wake of horror stories emerging from various parts of Sri Lanka, where women and children have been discriminated, abused and violated of their fundamental rights due to the archaic legislations included in the MMDA.

In one such recent instance, a 16-year old from Kandy had been forcibly married off to her rapist as determined by the Quazi court against the wishes of the victim and her parents, only to realize the rapist is married with a child.

Meanwhile, Sirisena loyalist Salley has been actively lobbying alongside the ACJU to scuttle the MMDA reforms – with meetings scheduled today with several Muslim MPs. Senior Journalist Munza Mushtaq in a tweet today said Salley has informed Justice Minister Thalatha Athukorale to not proceed with the MMDA reforms without consultation and recommendation of Islamic clergy.

Those who have been advocating for MMDA reforms over the past several years point out certain factions are engaged in violating fundamental rights of Muslim women by invoking adherence to Islamic law. They point out that blocking reforms in the name of Islamic law is in fact un-Islamic, as these factions seek to proscribe ‘what is not proscribed, in the name of Sharia’.

Pro-MMDA reform activists are calling upon all groups to celebrate the diverse opinions within Shariah and ensure justice is done by all citizens and they are also calling upon the President, PM and Ministers of the Cabinet to act swiftly and take measures to reform archaic discriminatory laws.

Full list of MMDA reforms agreed by Muslim MP’s:

Clergy is the problem in all places. They want to control the masses according to their opinions and decisions as they fit not the actual religion this is happening in Christianity, Buddhism and big time in Islam.

Removal of the word ‘male’ for Quazis which would lift discrimination and exclusion of women.

Removal of the words does not stop divorce , Accept corrections and you’ll improve counseling first. You must not give up in the middle of the journey. May you have grace to travel onward. change in behaviour the process is slow in growth.

    ACJU, Ulama and Muslims,

    There is no surprise here.

For the Ulama , the MMDA is perfect.

It is perfect , because the Quran and Hadith, as interpreted by them, treats girls and women perfectly, the way they were apparently treated, by the Arab tribals, during the 7th Century.

Unfortunately, it is their selective interpretation.Turkey, at is 99 percent Muslim, with a Sufi tradition has differ sets of rules.

Are the Ulama following the Wahhabi Salafi Ideology as described in the Hadith of Najd?

How do the Ulama know that the current Quran is the correct Quran? Or, the correct Hadith?

Test it against the data, and modern scientific and genetic findings.

Check the verses spread out like a carpet, mountains pegged, Sun setting in dark Murky waters, Adam and Eve story etc.

How can you justify the MMDA as divine, when women and girls are treated as chattel?

This is about the Hegemony of the Ulama. In the 12th Century they banned the philosophy books of one of the greatest Islamic Scholars and Philosophers, Ibn Rushd, using the rulers. Today, they are using the politicians, even non-Muslim politicians.

MMDA is a travesty of justice for women and girls. They are treated as Chattel.

Amarasiri, I had written to earlier to stop writing about Muslim Law and Muslims in general since you are a web scholar and muddle up everything. To know the rights and wrongs of MMDA you should be a scholar in Islamic Jurisprudence in MMDA field. And you always come with Hadith of Najd. This Hadith tells about people who will hijack Islam like the Shia had done. May be you are a Shia or belongs to some rotten sect whose games are going against Islam.

        ralli hamid,

Thanks for recognizing Amarasiri as a web scholar. As a web scholar, Amarasiri has at his disposal, all the information contained in the whole World Wide Web, including the Quran, the different translations, the Hadiths, The woks of Islamic Religions scholars, Islamic Scientists, Philosophers, mathematicians, geographers etc. in addition to the works of non-Islamic Theologians, scientists, mathematicians, Philosophers etc.

However, the interpretation of the MMDA by the ACJU is based on self-interest.

Amarasiri’s interpretation is based on reason as well as Islamic Sources that have properly interpreted it. Recommend that the ACJU read the works of Ibn Rushd, if they have the IQ and intellect.

          @Amaraseri.
you forgot to add some other factors along , Muslim hate , prejudice towards total pure monotheism beside other anti Muslim crap you Google through.

without trying to heal wounds and uniting the people , its individuals like you who feel secured ( most probably ) employed in some Arab country or gained illegally fake asylum in a western Country by fueling hate .
it not yours or my business , let the Muslims from the Schools of thought the Ulamas represent sort it out.

As much as every religion’s affairs should be allowed to decide by each of their authorized religous clergy to decide for their members , so should be with Ullamas ,unless objected by the members whom the Ulamas represent .

Btw which Anti Islamic web did you get your scholarship from? Jihad watch ?
          Shame on you Amerasiri .

            @nameless writer,

Read the works of Mohamed Ibn Rushd. He showed that the Ulama are not the people of knowledge.

What did the Ulama do? Got the ruler, Caliph, to punish Rushd, exiled him and burned his books,

What is the ACJU doing? Applying pressure on the politicians.

You too have the same access as Amarasiri has to the whole World Wide Web, even though you may come short on IQ and Intellect to comprehend the ideas and conclusions.

Just Google Ibn Rushd Darkest Hour.

            The Ulama, the ignorant Ulama
Who is behind trying to scuttle the MMDA reforms?

            Ulama, the ACJU.

For them, the Earth is spread out like a carpet, the Sun goes around the Earth, man came from Adam, and Evolution is not true. It is all intelligent design.

So, they want to continue to discriminate women and deny them human rights .

                Unnamed writer,

Terrorism is nurtured by Wahhabism , Salafism and it’s clones ISiS, Tauheed Jamat and other Wahhabi clones.

For them anybody who do not follow their Satanic Ideology, per prescient Hadith of Najd, must be killed, by Wahhabi terrorism.
Examples: Wahhabi Sack of Karabala, Iraq, April 21, 1801, 5,000 Shia Muslims killed, and Sri Lanka Wahhabi Terrorism, 280 killed.

Whahhabism-Salafism is the root cause of terrorism, because they follow Satan, per prescient Hadith of Najd.

Per Islamic Theology, the Wahhabi-Salafies and clones, will end up in Hell-Fire along with Satan, on the day of judgement, and will not get 72 raisins or virgins. Until then, they will rot in their graves, their bodies consumed by microorganisms, that will recycle the matter and energy contained in their rotting bodies.

Many Ulama knowledge is restricted and very narrow even in their own field. They have not heard about what the greatest Islamic scholars and Philosophers had to say about Ulama. Ibn Rushd said that they are not the people of knowledge.

Ha mud All Ghazali said that the Sufis had It righter. Satan following Wahhabies want to kill the Sufis and other Muslims.

Read what Sulayman Abdul Wahhab, the brother of Abdul Wahhab, wrote in Divine Deliverance.

You may throw out All the Hadiths, like what the Quaranics are doing, but still the data show that the Wahhabi-Salafies follow the Satan, assuming the Satan hypothesis and belief is valid.

No need to stop express his views at all.But you may have to stop trying to isolate from the rest of the world. There is no place for Islamic laws or Buddhist laws or Hindu laws in our country. We must have a common law for everyone. If you want something else it is sad to say that you will never going to make peace and reconciliation. It is because of people with your mentality, the Muslim world is in disarray, and divided. Take a look at Christians, see how united they are, unlike Muslims who are killing each other, and bombing Shiite Mosques. The rest of the world are taking advantage of this division, and setting one against the other. To think one Sunni nation is now best friends with the Jews, all because they want to get the US to bomb Iran. The Shiite are Muslims too. You may not agree with the way they follow the religion, but they are Muslims nevertheless.
        Get over it.

Muslim Law is not unique only to SL but is in practice in many countries where Muslims are a minority. In India, Muslims are governed by The Muslim Personal Law (Shariat) Application Act, 1937. This law deals with marriage, succession, inheritance and compulsory savings tax/charities among Muslims. The Dissolution of Muslim Marriages Act, 1939 deals with the circumstances in which Muslim women can obtain divorce and rights of Muslim women who have been divorced by their husbands and to provide for matters connected therewith. These laws are not applicable in Goa state, where the Goa Civil Code is applicable for all persons irrespective of their religion. Laws which cannot be implemented under Roman Dutch Laws since these laws are unique only to Muslims, and thus must be implemented as separate Laws, uniquely identified as MMDA.

Enough is enough. This has gone for too long now, and has affected many Muslim women in a negative way. Let these revised reforms stand, and the ACJU should try to stop the efforts to give their own sisters and daughters, some help to get away from physical and sexual abuse, and be financially stable for herself and her children.

Why is the ACJU making it hard for their own women to have the same rights as all other women in the country? Their primitive thinking is suitable for Saudi Arabia, not Sri Lanka. It is this kind of backward thinking that adds to the impression in the country that Muslims demand special laws and treatment. Come out of your caves ACJU.

The Muslim women deserve and need to be given the same rights as women of other religions in the country, so that she will be empowered to survive, and fend for herself, if the man divorces her.

      Unknown writer,

      What is Wahhabism?

Per Hadith of Najd, Submit to Satan, Iblis, Devil.

Islam means submit to Satan for Wahhabis. Wahhabies also practice hatred.

      https://m.huffpost.com/us/entry/5717157/amp

For Sufis, Islam means, Submit to God. Besides they love God from their hearts, and Sufis have no hate. They had it righter, according one of the great Islamic Scholars , Hamid Al Ghazali. In fact, there is a great mosque in Damascus called the Al Ghazali Mosque.

Give up your Wahhabism, learn to love other Homo sapiens, and avoid being burned in Hell-Fire along with Satan for eternity, per Islamic Theology.

      Amila,

In the 12th Century, this Ulama barbaric group banned philosophy, exiled philosophers, and burned philosophy books, in Spain.

By the end of the 15th Century, the Spanish expelled the Ulama , the Muslims and the innocent Jews from Spain. What do the Ulama know? The Quran and Hadiths? Do they understand them? No, according to Islamic Jurist, Judge and Philosopher, Ibn Rushd in the 12th Century Spain.

Fast forward to 21st Century Sri Lanka. The Ulama have not changed and still ignorant.

    PUSHBACK?
    .
ACJU, PUSHBACK YOURSELF to the medieval hellhole you originated from. You’re a relic of medieval mentality and that is where you belong. Muslim parliamentarians should represent the people who elected them, that is citizens of this country including women, exercising their constitutional rights. They are not elected by Ulamas or Mullas under Sharia ‘Law.’ Therefore the Muslim MPs should pushback these enslavers and abusers of women and children, and do everything they are obliged to do under the constitution to enable Muslim women and children enjoy the same rights as the rest of the citizenry. Put simply: one law for all, and no protection for the abusers under the cover of religion.

One Country, one law. This is the 21st century & ancient traditions & customs should be brought into line with current laws. SL has a multi ethnic, multi religious society & a democracy. There should be no discrimination against ethnicity, religion, gender or sexuality. I am sure the majority of rational Muslims in SL will accept that separate aspects of the law applicable to one particular sect is not going to promote racial harmony. Polygamy, underage brides, force marriage, etc is not acceptable in modern society. Is SL expected to allow honour killings as well?

The members of the ACJU are mere scholars of Islamic Jurisprudence. They are not, repeat not, ‘Islamic priests’. There is no priesthood in Islam. These members are not consecrated or ordained in any way. A more descriptive name for this group would be the Sri Lanka Association of Islamic Scholars.
The primary role of Islamic Scholars (Ulema) is to guide and advise the Ummah on matters pertaining to Islamic laws.
Unfortunately, the goal of the ACJU has evolved over time to be perceived as ‘Muslim Priests’ which would then place them on-par with the Buddhist, Hindu and Christian Clergy. It is a matter of deep regret that, apart from the non-Muslims, many Muslims too who should know better continue to inflate the egos of the ACJU members by referring to them as ‘clerics’ and ‘clergy’ and showing them the kind of reverence normally associated with ordained priests.
It is therefore not surprising that the ACJU are now beginning to perceive themselves as ‘Enforcers’ of Islamic law in Sri Lanka and ‘Leaders’ of the Ummah.
These scholars have no God-given right to insist that Muslims adhere to outdated laws. They only have the right, by virtue of their academic achievements, to advise and guide the Muslims regarding such matters. If a Muslim breaks a divine law, he or she is answerable only to the Almighty, not to the scholars of the ACJU.
If the ACJU and their political puppets continue to scuttle the MMDA reforms, then the Government of Sri Lanka must ensure that it does not continue to discriminate it’s Muslim citizens by granting them the the option to marry under the General Marriage and Registration Ordinance (GMRO) regardless of whether or not the MMDA undergoes future reform.

Good comment. You are right who gave this group the power to enforce any laws pertaining to the Muslims in Sri Lanka? They are full of themselves, and playing the part of indignant leaders of the religion.
Muslims should stop looking up to them, especially because so far they seem unable to comprehend that Sri Lanka is a multi religious nation, and it benefits the women, and the nation, to have the same law, which will prevent children from being given in marriage, and women empowered, so that they can have a better chance to fend for themselves, if their husbands divorce them. Its seems they are inflexible, unreasonable, and backward.

The ACJU is a defunct group of the past. Muslim politicians are not religious scholars and should be totally ignored. Justice Marsoof did an excellent job and the time is ripe to bring in the changes he is suggesting; MMDA reforms are badly needed. Strike when the iron is hot.

THE MUSLIM COMMUNITY SHOULD FACE REALITY AND PREPARE TO FACE THE NEW CHALLENGES, Insha Allah. HOW THE MUSLIM DECEPTIVE “MUNAAFIKK” POLITICIANS AND ULEMA (not all) HAVE CHEATED, HOODWINCKED AND BETRAYED THE SRI LANKA MUSLIMS HAVE BEEN EXPOSED AS MUCH AS POSSIBLE. MUSLIMS IN SRI LANKA HAVE TO MAKE CHANGES IMMEDIATELY, Insha Allah. “The Muslim Voice” is happy that the Muslims and Muslim politicians are thinking “PROACTIVELY”. “The Muslim Voice” is only trying to kindle the “aspirations and ispirations” of the Muslim community concerning this ACJU and Rizvi Mufthi in order to bring about a change and create a new “honest and dignified culture” within in the Sri Lanka Muslim Community. “THE MUSLIM VOICE” WISHES TO KEEP THISE ISSUES WITHIN OUR SELVES/OUR COMMUNITY AND GOING TO THE POLICE TO MAKE COMPLAINTS AS SUGGESTED BY YOU WILL COMPLICATE MATTERS FOR ACJU AND RIZVI MUFTHI. LOOK AT THE QUESTIONS RAISED AT THE PSC AND THE TV REGARDING THE TYPES OF EXPENSIVE VECHILES USED BY OUR ACJU MOULAVIS?
“THE MUSLIM VOICE” has been asking “DUA” from God AllMighty Allah after every daily prayers and Jumma’s since the manner in which the so-called Mufthi Rizvi, the incumbent president started to flirt with politicians and made a “MOCKERY” of the “HALAL ISSUE” to amaze millions of rupees for his personal gains and benefits with the support of “DECEPTIVE/MUNAAFIK” and “HOODWINKING” Muslim politicians and some professionals. The ACJU and Rizvi Mufthi has still NOT answered the question raised by “The Muslim Voice” regarding their relationship with the Mahinda Rajapaksa regime during 2005 -1015. The ACJU received a large block of land in Colombo 12 from former President Mahinda Rajapaksa when they were politically flirting with the UPFA/SLFP government and no one knows what happened to this block of state land that the ACJU got from Mahinda.
The ACJU and Rizvi Mufthi should answer the questions raised by “The Muslim Voice” before talking about other matters.

Unlike other customary laws applicable to Kandyans, Jaffna Tamils etc, the Muslim legal system is based on strict religious principles that date from the 7th century AD. Throughout history, religions have been the cause of conflict between communities, nations and groups of nations. In particular, ongoing religious fervour has been at the root of many sectarian conflicts that have evolved into full-blown wars that presently cause terrible suffering to innocent people caught in its ferocity. Sri Lanka is currently experiencing the rise of an extremist “Sinhala-Buddhist” religiosity, perhaps with political aspirations at its centre, while the country was rocked to its core on 21st April in a thunderbolt from hell, with local accessories and collaborators in surprising numbers. These developments do not bode well for the nation’s struggling masses, who are plundered by a political parasitic mob on one hand and a potential civil war being actively fomented by nefarious elements, further aggravating the innocent victims’ suffering. I believe that there should only be one law for all citizens, applied fairly and equitably.

      Lankan,

Read the Quran, on the Earth spread out like a carpet, mountains pegged, sun going around the earth and setting in murky waters, Adam and Eve etc., etc. Very scientific in the 7th Century, not in the 21st Century.

Use reason. Read Ibn Rushd’s works. Ulama are not the people of knowledge, only Philosophers. See what Quran 3:6 says.

The Bible is not much different.

With the great flood, there was not much water to cover the lands. Even today, if all the icecaps and glaciers melt, the sea levels will only go up by 211 feet.

        Lankan,

        Correction

        Quran 3:7.

Men of understanding are Philosophers not Ulama and theologians per Ibn Rushd aka Averroes, in the West.

I here people of certain western countries are complaining that their religion christianity is being Weaponized. IT is known that Islam was against the spread of Communist philosophy as well as it is being used now in Asia to achieve political goals.
It is muslims who blew up killed 300 or so Catholics and maimed 500. Now, that is a complete silence.
Digana, and recent anti-muslims backlash is by foreign powers. Even Sivu-Hele aka Thun-sinhale needs one set of laws. It is not the job for protestants to say to muslims you need the laws amended. Even there are Christians in the world who run polygamous colonies, approves child marriages or incest and spread inbreeding.

Fundamentals of Islamic Jurisprudence cannot be changed. Certain issues may be revised. We are not Islamic sholars and not in a position to justify or criticize. Other religions may have man made laws and open to interpretations, amendments and revisions. We don’t become experts in medicine or engineering my reading Google web pages and we cant become religious experts for sure by reading google whatever religion we possess. Even Muslims don’t comment on the divine laws.

More than the Law, the main problem here is the poverty level of these people, these people don’t have a proper income, not a permanent house to live, and the females doesn’t do a job, and on top of it, the curse of the South Indian culture of having to give DOWRY, this is the biggest problem and this is totally unislamic

The mid income or higher level people hardly hear anything about MMDA, qazi courts or anything else, it’s always the poorest who are suffering due to this unislamic dowry system

So what the government and the Islamic clerics needs to do is lift the economic levels of these people and secondly and most importantly root out the curse of the dowry system, This will solve 90% of the problems without the need to amend any laws

Famous jurist, Ibn al-Qayyim said, “Verily, the Sharia is founded upon wisdom and welfare for the servants in this life and the afterlife. In its entirety it is justice, mercy, benefit, and wisdom. Every matter which abandons justice for tyranny, mercy for cruelty, benefit for corruption, and wisdom for foolishness is not a part of the Sharia even if it was introduced therein by an interpretation.”

Muslims should not be allowed to have Muslim laws in Sri Lanka. As an ex-Muslim, I can assure you that Muslim laws and cultural practises do not afford women any rights at all. If we allow Muslim laws in Lanka, then eventually Lanka Muslims might start having honour killings just like in Pakistan and Afghanistan. Do you think I’m exaggerating? Just look at the trend of Muslim fundamentalism in Lanka. Just a few decades ago, there were no goni billas in Lanka. Now, if you go to a very public place like Galle Face, you will see dozens of goni billo. The trend is very clear! Muslims are becoming more radical in Lanka. One way to stop that trend is to eliminate laws like MMDA and to educate Muslim children properly

So called Muslim leaders and Muslim masses,

    Please note that if you all do not agree for the following, there will never be any reconciliation among other races living in Sri Lanka ;

    1) No polygamy.
2)No black colour full body cover.
3)No full face cover at all.
    4)No underage marriages.
    5)No Shariah Law
    6)No Arabic language in Public
    7)No madrasah
8)No loudespeakers to call to prayers
    9)No Halal food

Among the others, Kandyan law and Thesaalamai law are also to discarded. If you all cannot accept to come under one law in one country, you all will face consequences and there will not be any reconciliation among the majority races in Sri Lanka and instead there will be no trust among other communities as only the suspicion will prevail.

was shocked to hear this news and also disgusted ;we have already created lot of tension due to political party named after the community and now There is a new Ullama Party .

This is outrageous , while We the Muslim community is yet struggling with the worst crime done to.humanity under the label of the community’s religion , without finding ways to heal the wounds and eliminate suspicions and fill in the spaces , unfortunately these Ullamas are creating more issues.
Can the ACJU kindly advice the Muslim and other communities of Sri Lanka if the New Ullama Party that signed the MOU with a political party is a part or is the ACJU ? and also inform the public that you do not represent all Muslims in Sri lanka , like The Dawoodi Borah and Ismaili shias, local Jaffari Shias , Local NDM , Thoweed Jamath, Jamath E Islam Hub ul awliyas aka Sufi Thariqas (no.offence meant , pls correct me if necessary) and The Ahmedya Muslims. if I am b
not mistaken you represent only The Tablique Jamath? This is v.important and sensitive.
    Thank.you

Sincere advice to Muslims who have their own representatives please avoid politics , folllow the examples of Christians with politics in Sri Lanka

.Pls keep politics and religion jealously apart …
As it is there is sweet n0thing our Muslim politicians have done to.uplift the poor Muslims , They have ofcause taken.good care of themselves, their families and circles .
I will only cast my vote if I get the opportunity to Imtiaz Bakeer Macca
no one else derseves it , ofcause Mr.Fowzy is an exception but at his age not much he can do.

Its time Muslims put a stop of becoming scape goats for the politicians .
    When.will Muslims learn ?
