AG Hits Back At Ravi: Calls Him Illiterate

ASG Yasantha Kodagoda PC making a special statement before the Commission investigating the Bond Scam today said that people making allegations on how 8600 pages of data was derived were “illiterate”.

Ravi Karunanayake in his resignation speech yesterday questioned as to how such a large volume of data was deciphered and accused the Attorney General of a “conspiracy”.

“That is how 8600 pages were scanned and details found within 48 hours. Not because I am a genius who could go through all those pages, obviously, illiterate people would think so, but literate people will know that it was done using the search engine of the PDF file,” Kodagoda said.

Referring to how the data which detailed Ravi Karunanayake’s close association with Arjun Aloysius, including Aloysius’ request for minutes of the monetary board meetings on November 28th, 2016 – Kodagoda said it was only illiterate people who would make such allegations.

“Kodagoda can’t fabricate messages of Arjun Aloysius’ phone, and that has to be clarified, because some illiterate people are making false allegations, which only reflect the level of their literacy,” ASG Kodagoda Said in response to a question by the commission as to if the PDF file could have been altered.

When Arjuna Mahendran‘s counsel had opposed Kodagoda making the statement, Kodagoda said that the commission was the only forum he had to voice his opinion. “Where else do I say this, when these illiterate people make comments such as this,” he asked.

Yesterday members of the United National Party were in overdrive mode, accusing the Attorney General’s department of conspiring against Karunanayake and making efforts to slander the officers of the department.

    We had better respect the independence of the AG’s department. The reason why we demanded Ravi’s resignation was the latter’s inappropriate and suspicious behaviour and his conflict of interest as exemplified by that behaviour. However, Ravi conveniently conflates such charges with the subject matter of the bond inquiry. It was all bluff and emotion ( reference to religious leaders) in his speech and an evident attempt to throw sand in our eyes.Plain deceit. In my view, Ravi should never occupy a Ministerial portfolio ever.

      Mr. Jayasinghe, many in this country concerned about the failure of law enforcement over many decades wish that your statement, ‘We had better respect the independence of the AG’s department’, has a solid basis. While there are many reasons for the corruption of law enforcement, chief among them is the intrusion of ethnic bias into the system. Many instances have been raised in the reports of the University Teachers for Human Rights (Jaffna). A particular instance that concerns Mr. Yasantha Kodagoda is the 2007 – 2009 Presidential Commission proceedings into the murder by the security forces, and home guards under their direction, of 17 aid workers serving Action Contre la Faim (ACF).

      Our Special Report No.33 of 2009 (http://www.uthr.org/SpecialReports/spreport33.htm ) summed up our association with the case from 2006. The following describes the role of Yasantha Kodagoda who was supposed to lead the evidence before the Commission: “The Government’s control of the CoI through the role played by Deputy Solicitor General Kodagoda and the complicity of some of the Commissioners, has allowed the extraordinary attempts at cover up described above to take place as well as an obvious and deliberate failure to pursue questioning and investigation that could implicate the Government.”

      Perhaps in Ravi Karunanayake’s case where the ethnic aspect and partisan interests of the security forces do not intrude, his professionalism appears to be more dependable. But this must be so always considering that he is one day expected to become AG.

      I had been in close touch with the family the victim Kohila and am aware of the callousness with which the State denied justice and closure to the shattered family. The absence of a change of heart and change of direction by law enforcement authorities would ensure that ethnic tensions remain dangerously dormant.

      What he lacks is comprehension*, and he has a problem of memory loss.

      Now, what about the FCID’s “illiteracy” and “comprehension ” of the Crimes and fraud committed by Mahinda Rajapaksa, and Cronies, and most of them are in the Joint Opposition.

        Aku, you are trying to say that two wrongs make a right.

        Penta’s dealings were current, immediate, and the public demanded an enquiry/ action. If the AG’s dept were to queue it up along with the others, even what we now know, would not have been known.

        Might as well start somewhere, as we go along revealing the wrong-doers. I have great respect for the AG and its officers. It is only if we are fearless in seeing the wrongs of both ‘camps’ that we – as the neutral party – would be free to call a spade a spade.

        As for the 2 day story, the AG has fittingly answered all his critics.

            I think your assertion is terribly wrong and extremely unfair, as it does not consider the political climate which existed at the time of the Tsunami fund disclosures. Had that same climate existed today, Penta would have walked away, free from any blame whatsoever.

            Never forget that despite all its faults, it is this government that has made brave officers such as Mr Kodagoda act in a fearless manner and permit him to DO HIS JOB.

            That is all he was doing.

      It is an indisputable fact the masses that contributed to the victory of the rainbow revolution are disillusioned because the present government is not apprehending the culprits . Though the police and other Institutions have concluded their investigations , and have forwarded 874 files to the Attorney General’s (AG) department , the latter has still not filed the cases. All these cases are in cold storage at the AG’s department . Yet strangely the same department examined within two days the charges against Ravi Karunanayake contained in 8800 pages , despite the fact for the last two years the AG department had not been able to verify just the signature of culprit Gotabaya in the case in which the latter has siphoned off public funds illegally to build a mausoleum for his parents. What’s more ! even the criminal cases against Rajapakses were postponed until as many as 8 to 9 months.

      Now , it has come to light that it is none other than the infamous justice minister Wijedasa alias Dealdasa who is behind all these conspiratorial activities and procrastinations .The MP’s and ministers of the government are now aware ,without any trace of doubt it is this tie coat- black coat who has turned into a turncoat -cutthroat . In addition , this slimy scoundrel is now even outrageously making irresponsible and rash statements violating cabinet norms and traditions.

        Amarasiri: We must all be equally or more vociferous in demanding like we did for Ravi, the ouster of Wijedasa. To say the least he is a national pariah, an opportunist – what he has done in the past – getting free trips etc from questionable business persons is no different to the favor Ravi K family had solicited and or obtained from Aloysious! His colleagues – mainly the second tier of ministers – such as the deputies are openly condemning his deliberate and wanton acts of delaying high profile cases of mega corruptions and murders of his paymasters. The President should have sacked him the next minute post his comment on Hambantota.
        I am surprised at the President and PM are mute to the remarks this guy makes especially contradicting a collective decision of the cabinet in reference to Hambantota Port. He is a part of that cabinet, he may have expressed decent to the deal at cabinet deliberations but he is bound by the collective decision made. If he is not happy, RESIGN first and then open his mouth to express opposition.

    AG’s department is either incompetent to the core or corrupt to the core. Considering how quick it is able to act on selective files incompetency could be ruled out.

    The investigations carried out by the Commission to Investigate Allegations of Bribery or Corruption (CIABOC) does not need the sanction of the Hon AG to file charge sheets or indictments. The CIABOC is an independent organization and the commission is statutorily empowered to authorize the Director General of the CIABOC to file indictments or charge sheets.

    The Lankan Minister of Justice should have jumped to defend the AG. Or is he also wondering as to how the AG did what he did!
    The Minister of Justice is an honorable person but illiterate too!

    I agree that automated scanning speeds up search procedures.

    But we are asked to believe that the absence of a single successful prosecution against ministers of the Rajapaksa government or family members (corruption and murder) is due to unavoidable delays in the investigative and prosecution system.

    I think this may be true is some cases, but not one single successful prosecution! Very difficult to accept. Or the AG must declare that he has no case to pursue; no major corruption, no major criminal acts. Then leave it to the public to decide what they think of him and his department!!

    Burt: Can you please inquire from Minister Rajitha Senaratne where and what delay in regard to his own file? There is a FILE opened for him in regard to a leasing of a Fisheries Harbour, when he was the Minister of Fisheries under MR Regime, to one of his friends much below the valuation, causing a loss of some Rs. 27 million. I hope you would remember how he (Minister Rajitha in the present Govt.) failed several times to appear before the Bribery Commission and ultimately he did appear and to date “God” knows what happened thereafter. They are the very “Architects” of these delays and they get highly agitated once one of their colleagues get rounded up. The worst is they think the people of this country are “idiots” who can be deceived as and when they fell like. Let us tell this Minster and many others, that those days are NO MORE.

    These corrupt politicians are not only illitrate but they are also shameless, cunning, and a scheming lot who continue to loot tax payers money and promote their kith & kin.

    Having realised that they are not above the law any more they are now trying to scare and demoralize the honest officers at the AG’s Department similar to the MR’s time.

    The latest plan is to attack them as MRs people which would be an attractive slogan.

    It is extremely important at this decisive juncture for the media and the general public to support these honest officials with unquestionable integrity.

    We also expect President Sirisena who was voted to clean up the corruption will protect these selfless honest officers.

    my comment continued: I am glad, at least now the AG and his staff have AWAKENED to the NEED to serve the COUNTRY and the PEOPLE and NOT anyone in a Cabinet or in the Parliament. They, the AG must distinguish between the STATE of the PEOPLE and the INDIVIDUALS who are handling the STATE FUNCTIONS. The FUNCTIONS, such as of Auditor General; Elections Commission; Attorney General; Chief Justice & the Judiciary etc. must be made INDEPENDENT to look after the State Functions and NOT to cater to the needs of individuals.

    This ever jabbering Minister, it is reported, has questioned the Minster in-charge of Women affairs why the wife of one of the AG’s Dept. Lawyers assisting the Presidential Commission on the “Bond Scam” has been appointed to a position in that Ministry. Is this the “YAHAPALANAYA” the people voted and wanted?

    There is no need to say we support Yasantha Kodagoda not this government with corrupt PM and his corrupt gang of Ministers.

    Government, PM and his rogue Ministers should not interfere with AG’s department. They should be allowed to act independently.

    Those who hail transparencey, accountability and justice criticizing AG for bringing out the truth is a joke. They should practice what they preach.

    Pathetic Mahendran’s lawyers are obstructing government officials voicing their opinion. For nearly 3, 4 decades, this is the first Commission where government officials get the opportunity to give evidence without any fear of reprisal. All the officials who were testified before the PCoI on CB Bond scam should be hailed for their true grit and determination to place the truth before the country.

      Kodagoda is a Public Servant.. He should get on with his work which seems to be in arrears in most areas, and stop dispelling hot air from his rear end. It is not his role to have public debates on such matters.

    Yes,now the Attorney General (AG) and his staff should show the same efficiency in bringing to book the crooks and thieves in the Rajapaksa regime on whom many cases are with the AG.Surely if the AG could act so swiftly in regard to Ravi K they definitely have the ability to bring the Rajapaksa Gang on the dock too.

    Two crooks of MR gang have escaped so far and are leading normal luxurious lives by getting long dates in court for the last 2 years.They are the notorious thief Lalith Weeratunge MR’sSecretary who robbed billions to buy Sil Reddi from Telecommunications Regulatory Commission funds.

    The other is that notorious cad ,crook ,rowdy ,criminal , murderer and thug Sajin de Vass Gonaawardene who amassed billions after having started off as a Peon and then Clerk at Trico in Dubai.Today he is doing a rollicking buissness at 29 Grenier Road(road right next to the Keels Super Market at Cotta Road Borella.He drives around in different luxuyBMW and Benz cars accompanied by 50 bodyguards in Land Rovers.All the evidence is there on this thug’s criminal activities.Yet all his cases in courts have been given long dates with the AG raising no objections.Why this double standards Mr Attorney General?Your silence on these cases is most deafening.Yet you fixed RK in a matter of days.Dont know wether to laugh or cry!!

    My preceding comment seems to be missing. I addressed it to Burt. Burt: Could you please inquire from this Cabinet Spokesman, Minister Rajitha Senaratne, where and what happened to the complaint made against him for leasing a Fishery Harbour to a friend, when he was the Minister of Fisheries in MR’s Regime, ignoring the valuation and incurring a loss of around Rs. 27 million. You would also remember that this Minister in the Yahapalanaya Government was called to the Bribery Commission on several occasions to record an statement in relation to that complaint and after lapse of few such summons, he did appear. Do we know what happened thereafter? Where is the “File”? What is the present status of that “File”. Was he cleared of the “Charges”? Was the “complainant” informed of the outcome of investigation? This is like a shrimp with all the dirt in the head speaking of cleanliness. What a set of jokers we have got as Cabinet Ministers?

    This AG is not only literate but also partially blind because he used search engine to find the misdeeds of Ravi Karunanayake but could not use the same engine to find the names of ministers and cohorts of the last president and his youngest brother Gotabaya Rajapakse. Why is that no case on corruptions, bribes, murders and abductions was brought to courts or perpetrators exposed to the media?

Your department cannot verify a simple signature of a prominent politician, neither can it trace the ownership of properties stolen by politicians which belongs rightfully to the sweat of the people. We wish ASG well to sleep contently with whose 87 files until your retirement.

    Is it for finding one (among many ) culprits?

    Would things have been better if even this Penta case was not found out, as some seem to indirectly suggest?

    Let these may be as it may. Even the Sri Lanka Navy is able to proceed with the disciplinary case of former President’s son. May be the pages cannot be done by the computer.

    My deduction is AG is beholden to most of the Rajaoakses who are involved in SL politics (MPs ) and holding ministerial positions in the last govt and the current govt

    You can fool some of the people all the time, and those are the ones you want to concentrate on and that are what Ravi is doing. Looking at the theatre of politics in Sri Lankan parliament and around us today, it is difficult not to give in to a sense of cynicism. Perhaps more than any other theme in contemporary politics, it is the prevalence of lies that characterizes the current condition. This is not restricted to the multiplicity of lies that defined the 2015 election; the climate of blatant lies has entered into the way politics is conducted across the world today. Mechanisms which seemingly would have afforded protection against public lying have failed. Audio and video recordings of crimes are quickly dismissed by claiming that they are fabricated. Perhaps never before has it been so difficult to retain any meaningful notion of truth in the public space. This sadly is part of 70 years of Independence.
