Alleged Rapist Of 14 Year Old Girl From Minority Community Released By Police

Haputale police have released a 29 year old man who is alleged to have raped a 14 year old girl without carrying out a proper investigation.

According to a complaint lodged by the girl’s parents, a bus driver, who hails from a wealthy family has been released by the police without even being produced before a magistrate on grounds that the victim’s family belongs to a minority.

According to the Asian Human Rights Commission (AHRC), the 14-year-old girl was abducted and raped by her school bus driver on 19th June 2016, and she was threatened to keep quiet or her parents and other family members would be killed. However, despite the threat, her family members filed a complaint with the Haputale Police Station, yet the case has not been investigated.

“The alleged suspect, who belongs to a wealthy family, was simply released, without him being produced before a Magistrate. The victim’s family says that as they belong to an ethnic and religious minority in the region, the police have not given them attention in their quest for justice. The case illustrates the collapse of the rule of law in the country,” AHRC said.

The victim and her family from a Estate in Haputale who are Tamils and ardent followers of the Roman Catholic region live within a small community in a tea estate that is surrounded, predominantly, by the majority Sinhalese people.

On the 19 June 2016, the victim was returning from the Roman Catholic Church at around 11 a.m. She traveled by bus about seven kilometers, and was walking home the last half kilometer, after getting down from the bus. “As the victim was walking home, a three-wheeler stopped and offered her a ride. The Victim knew the two men who were seated behind and therefore she got into the three-wheeler. The two men who were seated behind were the bus driver and the conductor of a private bus in which she used to travel sometimes to school. Students call the bus driver Mr. Gamini (29),” AHRC said.

To her surprise, the victim was not taken to her home but instead to the bus driver’s house. She had objected and questioned them and pleaded to them to take her home. “But the three-wheeler driver and the bus conductor left the victim with the bus driver. The driver forcefully took her into the house, where she had learnt that there was no one in the house. She was frightened and yelled for help. She went into shock and panic,” AHRC said.

She had shouted and made several attempts to run away from the house, but failed. The alleged suspect Gamini then raped her. After this, she was threatened not to reveal what happened to anyone. If she revealed the incident, she was threatened that her parents would be killed. Then the suspect dropped the victim near her house at around 3 p.m. With difficulty she walked to her home. She was in fear.

“Due to the fear that the suspect would harm her family, she kept the matter secret for few days but finally revealed it to her mother on the 7 July 2016. Immediately, the mother informed family members. Violet and her daughter then went to the Haputale Police Station and made a complaint,” AHRC said.

“On the same day, 7 July 2016, in the evening, several hours after the complaint was made, two police officers visited the house of Violet and brought the victim, her father, & mother, to the Haputale Police Station. Within several minutes, police officers brought the alleged suspect, and one of the two men also to the Police Station. The Victim identified the rapist and the other men who aided and abetted in the crime. In front of them, the suspects were put inside the police cell. Then the victim’s mother and her family came back home. But several hours later they learned that the police had sent the suspects home,” AHRC claimed.

Subsequently, on 8th July, the victim, her parents, and her brother went to the Police Station. The police recorded the victim’s statement. It was recorded in Sinhala even though she is not fluent in Sinhala. Statements of her parents were also recorded, and the police officers visited the crime scene, and she was admitted to the Diyatalawa Government Hospital on the same day at around 2 p.m. There the Judicial Medical Officer (JMO) examined her. The JMO confirmed to the victim’s parents that she had been raped. On July 10, she was discharged. When she was discharged, the doctors confirmed that she was not pregnant.

The victim’s mother had later questioned the police officers how the alleged suspect Gamini had been released within several hours after he had been brought to the police. The police told the parents that the suspect was produced before an Acting Magistrate and released on bail. Then the mother inquired for the name of the Acting Magistrate and went to meet him, the Acting Magistrate had said that such a suspect was not produced before him. “Therefore, there is now serious suspicion that the suspect has not been produced before a Magistrate,” AHRC said.

Now under Yahapalana Siras Govt. the same thug appointed as Organizer. Mahinda Amaraweera and other Yahapalakayas defended that decision saying that party need a winnable candidate. which means this rapist also has qualification and power to become a Organizer or Candidate in Haputale under Yahapalana Sira’s Govt. German TV senders show programs how the police work for sending the message across the nation in terms of crime investigations. ALl these are plus information to lanka.       Why cant Namal babies other cases be investigated-since the number of allegations beofre him is not few. So that the bugger could spend the rest of his life in the jail.

        I am one of those who spent a good amount of time
        lambasting previous regime for their all sorts of
        evil behaviours. Never in the hope of a sudden
        miracle from the new comer who are same old wines.
        All these My3-Ranil combo have done is , cooling
        down a tense situation for the time being and
        playing hide and seek with the Rajapaksas until
        the situation is comfortable for both to relax .
        All this to stop a third unwanted force from
        emerging as a strong challenge to the traditional
        ruling forces. JVP opted out of the national govt
        with a purpose and the My3 Ranil combo reaction
        is taking shape accordingly. You can’t bring to a
        halt widespread corruption and lawlessness in
        such a short space of time . Corruption is now
        part of Srilankan’s culture long tolerated by all
        successive governments and the route to success
        of more than 95% of public sector and sizable
        amount of private sector . For me ,yahapalanaya
        means a huge volcano eruption that was going to
        affect the whole nation just passed without
        causing that much destruction thanks to their
        evacuation of possible victims.

We seem to have rapists going around confident that their wealth and race will enable to perpetrate crimes against women and children, and the officials in this country, will save them from facing a court of law, and if found guilty, face a harsh sentence. Did this wealthy criminal’s family pay off some corrupt officials to get out of jail free?

    How about some law and order President Sirisena & Prime Minister Wickremasinghe?

      For your notice the police during MR regime was waiting for the call from the President MR or his mussle man Gota to take any kind of action. I remember the BBS initiated riots against muslims, the police were bystanders, or the patriots demo in front of UN office against ban ki moon, police was asking the permision from Gota to take actions, do you still remember? or the worst the murder and the gang rape of the UN staff in a new years night took so long to start any investigations, or the white van abductions and the grease yakas were never ever cleared but since the regime change not anymore there. In my perception, may be there is a reasonable positive change, however not perfect but measurable advancement is noticeble. Dont you think during MR govt. the police was more corrupt and run by golayas.

    How can the AHRC say that this illustrates the collapse of the rule of law in the country? Rule of law had collapsed some years ago when the AHRC was toothless. Now at least there’s some hope that this victim will find justice since the media is able to highlight this and other crimes committed by the ‘influential’.
    Sadly the media has a habit of not following up on cases once it is reported.
    Let’s hope this brute is brought to justice fast.

    The perpetrator is Sinhalese, the Police are Sinhalese, the authorities are Sinhalese while only the victim is from a poor Tamil family. This is not at all surprising. This is a common occurrence in the Central Estate areas. Countless incidents where the perpetrators are Sinhalese happen in the Central Estates that go totally unreported because the victims are destitute, ignorant of their rights, arrogantly subdued by their perpetrators who are majority Sinhalese and over powered by other sectors such as the Police and Municipal Councils who are again manned by equally supportive Sinhalese.
    We saw this also committed by Sinhalese soldiers with complete State Authority in the north with the Jaffna Tamils, but this time they could not subdue the crime using arrogance, hegemony and local authority, the whole thing with proof moved to the UN. This is because the Jaffna Tamil lot are a much literate, educated and intelligent lot than both the Sinhalese and Estate Labor Tamils and will not hesitate to teach these Sinhalese monkeys a lesson or two.
    Looking at this in another angle of natural justice where it is a common fact how Sinhalese women are treated in the Middle East by the Arabs. This is natural justice that happens to the Sinhalese multiplied many times for the crimes they commit. Watch how the Salawa Army Camp burst and made refugees of the Sinhalese in next to no time. Every action has double or treble the reaction in time to come.

        Massacres of Sinhalese Villagers were certainly done by the LTTE, and that is the reason why the LTTE was classified as a terrorist organization the world over. The world supported the elimination of the LTTE for that reason. However, a democratically elected government cannot behave in the same manner as terrorists on her own minority citizens. While the LTTE comprises of Tamils, all Tamils are not LTTE. This is the fundamental mistake and folly of the Sinhalese and their racist leaders. Even Prime Minister Lee Kwan Yew has termed Rajapakse as a racist.

        Human rights abuses happen in other countries, true, but those countries have exemplary leadership, justice and political systems to investigate such criminality committed by the State and punish the perpetrators in a transparent, honest and independent manner and provide reconciliation to the victims. Sri Lanka unfortunately has a horrible record on State Terrorism and cover-ups. This is a country where a international leader was attacked by the same soldier who was giving that leader a Guard of Honor and the perpetrator Wijemini was considered a hero. This is a country that provided a hero’s welcome to Sepala when he hijacked Alitalia flight to Sri Lanka. The Jaffna Library (one of the best in Asia) was burnt down as a punishment to Jaffna Tamils and organized by some of the highest Sinhalese political and armed forces persons. Did you ever see any investigation or justice for that? Extra judicial killings by the police is a norm in this country. 600 policemen killed in cold blood by the LTTE in Baticoloa, but today the main suspect and perpetrator of this act Karuna Amman is honey boy and senior government member with the Sinhalese government. A child is not born a terrorist, but becomes one due to the environment he lives. The responsibility of this environment lies on society and the leaders we elect. If we have a racist society, we elect equally racist leaders who follow racist policies. If the Muslims in Aluthgama do not trust Sinhalese anymore, do you label them racists? No! they have become that because of society.

President Mahinda Rajapaksa’s reply to Al Jazeera-interviewer’s question about anti-minority violence revealed a mindset and a worldview which is not quite lucid: “There were incidents. There were attacks; some incidents. What was in the background? Why were they attacked? Now see a girl was raped. Seven years old girl was raped. Then naturally they will go and attack them whether they belong to any community or any religion. The people when they heard about it they were so upset, relations everybody. There were incidents like that. All incidents have some background to that”1.

    The President is lying, again. Child rape is rampant in Sri Lanka, but there has been no incident of a Sinhala-Buddhist child being raped by a Tamil/Muslim/Christian, up to now. Even the fecund imagination of the BBS has failed to come up with a lie so deadly. The Sinhala-Buddhist extremists who instigated the attack on Pepiliyana ‘Fashion Bug’ used a false rape story to incite anti-Muslim hatred, but even they did not place the age of the alleged victim at seven, as the President of Sri Lanka unblushingly did.

    Yahapalana UNP Police in Fort, petitions the Colombo Magistrate to ban the IUSF and few other Students Unions going on a protest march against private universities and protect their right to Free Education.

    This is the same UNP Yhapalana Government which lifted the ban on Porno Sites to give students real freedom.

    Perhaps the students should be watching porno instead of going on protest marches.

    Tamils who were not fluent in Sinhalese and extremely distressed over what happened to the victim a minor and their daughter faced by hostile Sinhalese policemen who had overtly sided with the Sinhalese rapist due to their common ethnicity and perceived the Tamil victim and her family as the enemy.
    The Central Uva and Sabragammuwa province as well as the greater Colombo area and the western province has a very high percentage of population that speaks Tamil as their mother tongue. These people have been living in these areas for centuries. Yet there is hardly any Tamil speaking government officials or policeman to serve them in their own language or conduct their business in Tamil. Despite Tamil being an official language with equal status with Sinhalese.
    If Tamil is an official language Tamil people have every right to conduct their business in Tamil and have their statements in Tamil and not in a language that they cannot understand by a racist hostile police officer of government servant. In English speaking western countries non English people are provided interpreters in their own languages at government expense and their statements are translated in their language and has to be signed by the official government interpreter as well as government official to state the person concerned has understood the statement and its contents. Only then it is considered legal. However the 25% population that speaks Tamil as their mother tongue are not offered this facility in their own land by a racist Sinhalese establishment and government, despite Tamil declared as an official language.
    Tamil speakers are denied the use of the Tamil language in the Sinhalese south and even in many parts of the North and East their own land, despite living here for centuries and paying taxes. In contrast Sinhalese AGA and divisions are created for the illegal Sinhalese settlers in the north and east, where they had arrived there only a few decades ago and all government business in these newly Sinhalised ethnically cleansed Tamil lands are conducted only in Sinhalese to the detriment of the original Tamil speaking inhabitants who still remain there.
    This is why we need an international investigation and self determination for Tamil areas. We also need special Tamil speaking AGA and divisions and electorates in the Central, western Uva, Sabragammuva provinces and the greater Colombo area where Tamil speakers are in large numbers. Business in these areas should be conducted only in Tamil and there should be Tamil speaking government officials and police manning the offices and police stations. What is good for the illegal Sinhalese settlers in the north and east is good for the Tamils too.
