Appoint An Independent Commission On Weliweriya – Bar Association

“We do not see any valid reason to call the Army for assistance.  Further there is strong grounds to show that the normal procedure adopted to disperse a crowd was not followed and it is clearly seen that persons who were running away were pursued and attacked by entering private premises and places of worship.” says the BASL Standing Committee of Rule of Law.

Issuing a statement its Chairman Lal Wijenayake says; It is unlikely that an extraordinary action such as calling the army to disperse a protesting crowed would have been taken without orders from the highest level..

We publish below the statement in full;

The standing committee of the Bar Association of Sri Lanka on Rule of Law at an emergency meeting of the committee considered the brutal attack on persons who were involved in a protest at Weliweriya and resolved as follows:

We vehemently condemn the attack on protesters at Weliweriya since it is the democratic right of the people to dissent and protest, individually and collectively within the law.  It is our view that this action which is manifestly a planned action is motivated by the desire to suppress the legitimate right to dissent and protest, as we see this action as the culmination of a series of attacks by the police on students, trade unions and even lawyers.

We do not see any valid reason to call the Army for assistance.  Further there is strong grounds to show that the normal procedure adopted to disperse a crowd was not followed and it is clearly seen that persons who were running away were pursued and attacked by entering private premises and places of worship.

It is unlikely that an extraordinary action such as calling the army to disperse a protesting crowed would have been taken without orders from the highest level.

We call upon the government to appoint an impartial and independent commission consisting of respected persons with the highest integrity to hold an inquiry and report immediately of the many aspects of the incident.

The inquiry should be open and transparent and the public should be allowed to testify before the commission.

We of the lawyer’s fraternity will offer its professional services to the victims of this brutal assault to seek relief before such a commission or other means by recourse to law.

We are of the strong view that civil society groups should take a united stand to condemn this action and to take further steps to see that the right to dissent and protest is respected in our country.

        Most people understand the difference between the incident in Weliweriya and the other, where armed racist, terrorist murderers had to be dealt with. I have no problem with the latter where the forces acted decisively and admirably. More restraint is needed when dealing with legitimate demonstrations. Better training for crowd control is required. Sadly, the opposition parties who are desperate to get to power, backed by foreign NGOs are encouraging violence when genuine demontrations are taking place. They don’t think about the victims or suffering of loved ones who will endure pain as a consequence of their actions. My heartfelt condolences to the families of the victims in Weliweriya.

    The independent commission should conduct its investigation in open and not inside closed doors. The inquiry should be telecasted live. Opposition should also be given an opportunity to appoint the members to the commission.

    When one family share the authority and compete each other to say who do offense more to show how powerful she is, thins kind of collateral damages are obvious. As there are no exception to coaches of sports team, sons of ministers… So how come an ordinary civilian can be protected…

    Tomorrow when you and me travel in an ordinary bus anything can happen to too as we are no one than just collateral damage for the Gota led Mahinda regime.

    I am Sure so far our Sambudda Saasana Chakrawarthi does not know anything about this killings. Once one of his Advisors inform him about this he will order IGP to hold an Impartial investigation and bring the culprits to books irrespective of political alliance.

    First Step.

    After that IGP will appoint 25 special Investigation teams under Anura Senanayaka’s suoervision.

    Second Step

    Saddarmadvvepa Chakrawarthi agin will appoint another Presidential Commission to investigate the Incident Independently and submit a report within 2 weeks.

    Third Step

    He will call Parents and Families of Killed persons to the Araliya Abode and grant each family 5 Lax cash cheques for each family affected and promise them that he will punish responsible persons.

    Forth step

    ITN, Rupawahini will start giving publicity for these events and start blaming NGO’s, Tamil Diaspora and JVP making Saddarmadveepa Chakrawarthi a Baba Ukkung.

    Fifth Step

    Everybody knows this step and all the reports will be transferred to the Old “Hamas Pettiya” and 3 Singhaladeeshawara will win the election also.

    According to IGP Anura Senanayake and the people who witnessed, they were saying that some “outside” rioters who started this riots. They are not from the area.

    These “terrorist criminal elements” are not from the Weliveriya area but were been brought in by some shadow conspiracy source to instigate violance and murder the .

    I think this is another false flag conspiracy planted by an invisible hand to create mayhem and Genocide in the Weliveriya area.

    Also IGP say he did not eant or asked for STF help to settle this protest, but STF have come with and already pre-planned operation to massacre and Kill people.

    This is the same incident that happened both in Libya and Syria which led to murdered over 100,000 people.

    Therefore It is time that BASL do more indepth study as to find who are these crimimal outside elements who started the riot that led to STF killing innocent stone throwing protesters as well as bystanders.

    There is a strong connection between this outside criminal element who threw molotev cocktail at STF and the STF firing live bullets at innocent by standers.

    We suspect that both these elements (the criminals who started the riots and the STF massacre) would have organised by the Defense secretary. He is already an Insane Lunatic cracko Gone Mad Pig eating shit nut case who needs to be in a Psychiatric ward.

    The war criminal will instigate more mass murder if President keeps him in his position.

    He should be sent for psychiatric evaluation and treatment ASAP.

    Remember how the Rajapakse Govt. paid thugs carrying sticks controlled the streets in Hulsdorf court house during the CJ impeachment trial. This is similar to it, and I have a strong feeling that DS is behind this conspiracy Genocide murder.

    It’s time to call for an International investigation on this Gota instigated Genoside murder, as we do not have any faith in Local investigations conducted by Govt. goons.

    Postwar 2009,Katunayake,Chilaw,Derniyagala,Weliveriya, Yesterday,Today and Tomorrow

    “Violence begets Violence”, “Those who take to the sword, die by it”, “What goes up must come around”— these are synonyms said by grate wise people. Ever since the North –East war ended in 2009,one of the blatant allegations against the SL Government and its security forces was that Thousands of innocent people died in this conflict and nobody has taken responsibility or neither brought anyone to account.
    If a Nation is guilty in killing its own people innocently in any given conflict and does not make account for it, it only relies on its stubborn brutality and never learns it’s lessons the given way or even the hard way, only brutality in its wisdom continues, what we experienced with the bullets of Police, Thugs and Security forces, in Katunayake,Chilaw,Daraniyagala and now Weliveriya for unarmed citizens protesting for their rights for better wages, help for the Fisheries industry, sanity in their villagers to prevail from ongoing thugery or for un-contaminated water, lies, is in blind eyes and deaf ears of Authorities. If this is the way that authorities in the government behave, then we are not far from a country of sheer anarchy and chaos that builds up to a regime that governs with repression and oppression.

    It is wise for President Rajapakse and His Government to turn around now and Build up a Nation that lives Reconciled to one another, be it Authority and Subjects, Rich or Poor, Superior Race or inferior, Majority or minority, Whatever Religion One may belong to, it is still opportune time to work for True Reconciliation, Justice and Peace.

    Real Peace loving citizens and religious leaders are waiting with a right hand of fellowship stretched out with love, please do accept it gladly.

    In this instance you are asking the regime to investigate its own actions. Come on – havent you heard the saying, ‘horage ammagen pena ahawwa wage’.

    Why don’t our gullible idiots demand the resignation of the man responsible for this and many other acts. Why don’t the NGOs push the USA to investigate and issue a subpoena to their citizen who if he does not show up can then be issued with an arrest warrant?     I think this Weliweriya Genocidel Massacre was planned, implemented and executed by Gota / BBS combination using the newly formed “death squad armed special operations force” which is directly working under DS Gotabaya Rajapakse and BBS.

    Also Gota used criminal Gangs to penetrate into protesters and instigate violance using sticks and molotov cocktails to intimidate police and armed forces.

    These criminals are similar to Hulsdorf Gang who occupied the roads with sticks and poles to intimidate CJ Shirani Bandaranayake’s supporters and the public during her impeachment trial.

    This is another Gota’s Planned conspiracy to supress and murder unarmed innocent civilians who were asking for clean water.

    Aloso the civilians said there was a special outside gang who were involved in throwing molotov cocktail at armed forces and police arousing violance. Also these gangs carried poles and sticks to intimidate police and security force.

    It is commendable that the B A S L started an inquiry into the Weliveriya attack and killings.
    Yet I can’t fathom why it is asking to appoint a commission knowing very well that what happened to the reports of commissions appointed earlier by the government.
    I am sure nobody who was involved in killing in Weliveriya will be punished.
    The government knows very well the people who voted for it are angry with the government due to unbearable cost of living.
    The governments knows very well if people are allowed to protest on the street against the government,it may lead to the birth of a mass movement and it will be the beginning of the downfall of the government.
    As such the government is determined to prevent the birth of a mass movement.
    Itseems to think killing a few protesters would discourage future streets protests.
