Are Women To Be Blamed For Rape?

Committed in the name of love of women, out of hatred or as a punishment, incidents of rape are definitely on the rise. While the act of rape needs to be considered as a violation of a woman’s (in most cases) right to her body and honor, and not just as a forced sexual act, it is important to address this burning issue taking into consideration all related matters and in a comprehensive manner, including highlighting the importance of preventive measures.

Vidya Sivayoganathan, a beautiful flower, breathed her last few days back after enduring untold brutalities in a supposedly civilized world. Having attended a candle-lit vigil at Colombo’s Independence Square yesterday in memory of the victim, I believe the need to address and contain this inhumane criminal trend should figure among the top priorities of any government in power.

While seeking home-grown solutions, one must have an open mind and it should be tailor-made to suit our country and society. Civil societies and feminist movements may want the death penalty imposed and or bail denied for suspects, but I am of the view that a holistic approach is needed, hence the need to begin examining,

  • The root causes of rape with emphasis and studies on the mentality of the average local male and of each and every known perpetrator.
  • Exiting laws and traditional preventive measures.
  • Existing and possible psychological counselling facilities for victims.
  • Possible enactments of guidelines/laws for public and private behavior of both sexes.
  • Possible regular media campaigns in protecting the rights and honor of the weaker sex.
  • The possibility of enacting laws against immodesty in dress codes when in public and the possible implementation of laws against nudity and objectification of women for commercial gain on all formats of the media.
  • Suitable methods of punishments and as a deterrent.

Vidya SivayoganathanWhile studies have revealed that male rapists in general don’t suffer from any particular medical conditions that could relate to their violent behavior, I believe contributory factors include sexual deprivation, obsessive behavior, broken families, lack of education, poverty, infidelity in relationships (on the part of their women), jealousy, and hardcore pornography among others. Being introverts in nature and more often than not, identifying or profiling rapists before the crime is committed is in no way an easy task either.

Taking in to consideration the number of rape cases 30 years ago and comparing it with current trends, would it be wise not to acknowledge positive aspects in this regard when living in an era where conservative values were more in existence? Once the damage is done, punishing the perpetrators even to the fullest extent of law does not necessarily bring about justice or closure to the victims and/or their families. Hence, the need to establish professional tri-lingual counselling components in order for them to recover from possible emotional/psychological trauma they probably would have undergone.

Data collected over the years from research statistics shows us how almost 80% of the victims knew their offenders. In this scenario, would it not make it a fertile ground for rape when women freely intermingle with little known male strangers especially when there does not exist a pressing need to do so? And now that intoxication has become quite fashionable amongst the young and old alike when in the company of the opposite sex, would it also not make a perfect setting for one to transgress limits when his/her vision and level of comprehension is seriously impaired?

When laws against making lewd remarks, sexual innuendos, whistling, teasing etc. are absent, or when those demeaning practices are widely prevalent against women in public and that which has been an accepted norm, does it also not give rise to a generation of unruly and disrespectful men who may have a higher likelihood to take the abuse of women to a higher level?

In all fairness to the men and more often than not, women too need to take responsibility for rape figures to reach astronomical heights. It is no secret that when skimpily clad woman or in a two piece bikini flaunts herself, it is always another vulnerable woman living somewhere else who ends up paying the ultimate price. Reaching middle age, while I am yet to understand the rationale behind a woman’s need to wear ‘Victoria’s Secret’ thongs when at a beach or a swimming pool environment, I keep foolishly thinking that one may find it impossible to swim should their attire be of knee-length. May be it is about time I get some swimming lessons.

While I respect their freedom to choose, shouldn’t women use the same in a manner where they don’t attract unwanted attention at the same time? Shouldn’t women also be conscious of any social responsibilities… especially when living in a conservative country where it is a far cry from Ibizas and Miamis? Would it also not be sensible/practical for women to be modestly dressed when in public as against educating or expecting the entire male species to ‘look-but-not-touch’?

Giving a hypothetical example, the need for a single or for the deprived woman to attract a good man should be accepted as her universal right. And while at it, she also has the right to show her cleavage or her legs as much to net the most eligible man around. The problem starts only when the woman attracts the wrong kind of man and unknown to her initially. Had it been a case where the man was interested in her only for her physical looks and for expectations of sexual gratifications, rise it does a situation where only the fittest survives, followed by the worst.

Adding insult to injury is when ‘educated’ ladies in the advertising sector objectify female models by making them don sexually arousing attire and for insisting on suggestive poses to sell wares and services of their clients. I guess the old saying ‘nothing sells like sex’ is true after all.

It is also unfortunate that fingers are automatically pointed at the armed forces every time a rape occurs in the Northern Province. Though it is true that there did exist a culture where rape was used as a weapon by the same forces especially during the war, it just might be a positive step in the direction of reconciliation for the armed forces to voluntarily set up a date base of DNA’s of all serving personnel. Let not actions of a few damage the reputation of a heroic lot.

Furthermore, seeing over-crowded court houses filled with lecherous men every time a woman walks in raises the pressing need to have separate courts to address rape case and marital disputes etc. This may also be an encouragement for the victims to come forward.

When gang rape occurs, it may be wise for authorities to offer a US-styled plea deal and/or monetary rewards for any information that could be of assistance in the prosecution of all suspects but the informant, even if that person would have been complicit in such a crime. The society would be better off at least when the rest of the perpetrators are incarcerated for the rest of their lives. In a nation of back-stabbers, this approach can be quiet effective even when other types of crimes are committed.

Nobody gets out of this world alive… and if few ‘rotten eggs’ are destroyed so the vast majority can live free of fear and intimidation, so be it. Capital punishments are more a deterrent than a punishment itself… at least in countries where Islamic laws are the source of legislation. Religious connotations or no, history has taught us that this ‘deterrent punishments’ indeed transforms societies into law-abiding ones. Criminals are not born… they are made. Let us not have anything to do with that process.

      However, is that the obly punishment for the rape already committed?

        Capital punishment is not the panacea for all social ills. It never worked and will not work and never been a deterrent.

        Barbarism in the 21st century is unacceptable.

        The state cannot adequately compensate if miscarriage of justice happens.

        What sort of state in which you would prefer living, a benovolent and compassionate one or a medieval barbaric kingdom?

        Will capital punishment stop at hanging rapists or will it be extended to adultery, theft, perceived treachery, corruption, vote rigging, ……….. abuse of power, drink and drive, …… ? Where would you draw the line?

        Three more people have been put to death in Saudi Arabia, meaning it has executed more people this year than it did in the whole of 2014.

        The kingdom , which enforces a strict version of Islamic sharia law, carried out its 88th execution on Tuesday, surpassing the 87 prisoners killed last year.
        The interior ministry said the latest to be put to death were Saudis Awad al Rowaili and Lafi al Shammary, who were convicted of smuggling amphetamines.

        They were executed in the northern region of Jawf, the official Saudi Press Agency said.

        Another Saudi, Mohammed al Shihri, was executed in the southwestern region of Asir for murder.

        Those beheaded this year include Siti Zainab, an Indonesian maid who was convicted of murder despite concerns about her mental health.

        Another Indonesian domestic worker, Karni Binti Medi Tarsim, was executed days later.

        The killings led to Jakarta summoning Riyadh’s ambassador in protest.

        Around half of the prisoners executed this year were Saudis – the rest were from Yemen, Pakistan,Syria, Jordan, Burma, the Philippines, India, Chad, Eritrea and Sudan.

        The kingdom is in the top five countries in the world for putting people to death, rights groups say.

        It ranked number three in 2014, after China (2,400 executions) and Iran (289), and ahead of Iraq(61) and the US (35), according to Amnesty International figures.

        Drug trafficking, rape, murder, apostasy (abandonment of religious faith) and armed robbery are all punishable by death in the Gulf nation.

        Executions are carried out in public, mostly by beheading with a sword.

        A surge in executions began towards the end of the reign of King Abdullah, who died in January.

        It accelerated under his successor King Salman, in what Amnesty called an unprecedented “macabre spike”.
        The Berlin-based European Saudi Organisation for Human Rights said the death penalty is “often applied to powerless individuals with no government connection”.

        Amnesty says court proceedings in the country “fall far short” of global norms of fairness.

        “Trials in death penalty cases are often held in secret. Defendants are rarely allowed formal representation by lawyers” and may be convicted solely on the basis of “confessions”, it said in a report.

        With the number of beheadings and limb amputations soaring, the civil service is advertising for eight more executioners.
        It says no special qualifications are needed and the jobs are at the lower end of the civil service pay scale.

        Saudi officials have not said why the number of executions has increased, but experts believe it may be because more judges have been appointed, allowing a backlog of criminal cases to be heard.
        They think it may also be because Salman wants to project a tough image in the face of regional unrest.

        One Saudi activist, who asked for anonymity, said the death penalty is carried out only with the king’s approval.
        “So if the king is strict he will sign this paper,” said the activist.

    Please stop insulting the religion we share by quoting the Quran at the top and then, in the middle of the article, implying that a woman is partly responsible for a rape. That’s the biggest sack of BS I’ve ever read, as a muslim male.

    Yes, I’ve read and studied the Quran, cover to cover as well as all the sahih hadith. You honestly sound like someone who blindly follows these so called “scholars” of the religion as opposed to reading and understanding for yourself as God intended you to (which is why you have a brain and the ability to rationale). Not using these gifts is an insult to your existence so don’t believe in other peoples interpretations. Don’t be afraid to think for yourself.

    Even if a lady strips naked and sticks her crotch in your face, it’s your responsibility to be mindful of yourself and respect boundaries even if she is not aware of hers. Just because she strips naked, it doesn’t make it ok for you to act like an animal.

      You say you share Islam with the writer. You do not.

      You say you have “read and studied the Quran, cover to cover”. That too is a lie.

      If you are truly a Muslim take the trouble to read Surah 33 verses 32 and 59 and write and tell CT what those verses say.

      There are many reasons for rape: war, politics, poverty, and human depravity. The Quran says the depraved are those that carry a disease in their heart. Through the guidance set out in Surah 33, verses 32 and 59, the Quran gives protection to the vulnerable from being raped and other tortures being inflicted on them by the depraved.

      Results speak for themselves. If a woman will be temperate in her use of language and she dresses decently, the chances are she will not arouse the depraved to such degree as to rape her. This is fact. Those right thinking men who have wives daughters and sisters will do well to pass on the guidance set forth in the Quran. You do not need to be a Muslim to benefit from that guidance.

        All around us, if we look carefully enough, we will see patterns in things. With these patterns and with some intelligence, you can begin to understand things (45:3). Humans are gifted with the mercy of being able to understand and differentiate between wrong and right (8:29). You will be judged based on your ability to understand things (can’t remember the reference to this). Yet, you choose to follow what another human being tells you. Read for yourself (96:1). You are the one responsible for your actions. Pleading ignorance because you were too busy making money instead of spending time to find the Truth is not an excuse. And don’t hate the truth (43:78).
        And don’t just go and read a translation because that again is a mans interpretation. For example, have you never noticed how the different translators interpret the word “mutahhareen” (a word you use in your wudhu dua…do you even know what the meaning of that dua is)? Learn the books native language and then read it and FEEL it. Words mean nothing if you don’t understand what they mean. Even if you understand what they mean, they mean nothing if they don’t spring forth from your heart.

        I have heard arguments like yours many times before. They all sound the same and I’m sure they all come from one source. Have you forgotten 24:30? You can’t pick and choose what you want. 24:31 also applies here.

        I’m sure you’re intelligent enough to know that 33:32 only refers to the Prophets wives. It specifically says so.
        As for 33:59, where in that verse does it even remotely imply that a womans dress can encourage rape? Don’t oversimplify something. Men have been oversimplying our religion for centuries to control women when, in fact, our religion imposes almost identical rules on men as it does on women. If you’d bother to read The Book in it’s native language and comprehend, you’d understand. If you followed The Book the way it was meant to be followed, rape wouldn’t even be an issue because one of the foremost things is how you raise your child and teach the child respect and boundaries and manners. Don’t treat the symptom when you can remove the problem at the root. Again, 43:78.

        Your logic makes no sense to me. And nothing in your argument is a “fact” as you so arrogantly put it.

    Well,fazl..you fail to mention that islam also instructs males to ‘lower their gazes’ i also partially support your view that immodestly dressed women indirectly aid rapist in attacking the innocent..but this is an inevitable reality and innocent modestly dressed women should not be the victims of these savage dogs who pay the price.So rather than pointing a finger at women it is better that authorities are solely blamed for not taking proper action to protect women

    Dear Fazl,

    What you are trying to suggest is that, as a solution for girls to avoid rape is to dress properly (cover their body/skin).

    I used to enjoy reading your articles but here I totally disagree.

    At present there is an unfortunate situation in Burma where innocent Muslims are being attacked/murdered. While condemning this act, what if someone suggest that, as a solution to avoid this kind of attack, why can’t they (Muslims) change their religion? I am sure you don’t want your brothers and sisters to change, you only want the killers to stop. The same goes with rape, do not tell the girls to cover their skin, we should make the rapists to stop.

    This is what happens when half-intelligent people try to tackle issues much larger than their level of understanding can comprehend. If you’re trying to get to the very bottom of the issue, why not blame the people who are taking the picture, more often than not, men! The men have the choice to look at these pictures but women don’t have the choice to wear whatever they want? What is even the point you’re trying to make here?

    I’m not even going to go into your trying to accuse women being at fault as this is ridiculous and laughable. But you are also insulting your fellow males by implying that don’t have the mental capacity to make the decision not to rape because they are too tempted by a picture of scantily dressed female.

    If you did some research beyond the limited scope of your thinking and blaming the victim you will see that there’s plenty of research to indicate that rape is not necessarily a sexually motivated crime and is also used very often as an act of violence and control.

    Please stop making apologies for such heinous crimes and writing irresponsibly. It does not help any cause whatsoever.

    An interesting article addressing some of the evil / dark side of humanity. Whatever the intention of the author he is quite off-track. The male propensity for violent sexual aggression comes from the same place as the propensity for genocidal violence killing members of another tribe. There may be deep rooted, genetic flaws in human make-up, but in today’s society we try to ensure those primeval forces are kept under lock and key – its called being civilised. We protect the weak by our laws and we ensure its not the law of the jungle. A big part of that is not trying to find moral justification for sexual abuse. The author is truly confused and lost.
