Former staff sergeant of the Army Sunil Ratnayake was released from death row on a special presidential pardon today.
Ratnayake was sentenced to death over murder of of eight Tamil civilians including four children in Mirusuvil, Jaffna on 19th December 2000.
Sunil Ratnayake was sentenced to death on June 25, 2015 after a 13-year-trial.
on 24 Dec. 2000, some bodies were found in the septic tank of a toilet by the side of the army camp. The matter was then reported to the Chavakacheri Courts. When the judge inspected the scene, four youths under the age of 18 were discovered besides four men with decomposed bodies, throats slit and eyes blindfolded. Some had their legs and hands chopped off. One had his skin peeled, looking pink. Among the eight murder victims was five-year-old Visvarayan Prasath. Even the most hard-hearted could not fail to be moved by the sight.
Further to it, an inquiry was held at the Chavakacheri Magistrate’s Court and a report was sent to the Attorney General’s Department. The Attorney General filed action in the Jaffna High Court. A direct and important eye-witness was Ponniah Maheswaran, besides others. Staff Sergeant Ratnayake was given a death sentence. Appeal to the Supreme Court failed.

Sunil Ratnayaka was arrested and detained in 2002 by the Chandrika Bandaranaike government to please the EPDP leader.
Sunil was detained in remand prison for 13 years without filing any charges as the evidence against him was not convincible.
In 2015, when the slave government came into power, as a part of their promises to the LTTE diaspora and the TNA, an express court order was delivered making him guilty for a crime he didn’t do. Those who gave fabricated evidence against Sunil were former LTTE cadre.
From the beginning, Sunil maintained that he was not guilty.
His case was heard without a jury.
Sunil served in the prestigious LLRP and fought against LTTE butchers for the country with life. His entire young life was sacrificed for the country.
I am happy at least finally the President decided to release him, after failing to do so for the last 4 months.
During our incessant fight against the slave government since 2015, our one very important request was to release Sunil Ratnayake the moment there was a change in the government.
However, since November 16, 2019 victory, upto 4 months the President didn’t show any interest in releasing him. Instead what the President did was, mobilizing fake patriots to hold press briefings and stage demonstrations on the street to release his friend Duminda.
Even now Sunil was released only to pave the way to release the other, using the current time of crisis.
Therefore, Sunil Ratnayake need not to be grateful or thankful to anyone. He was in prison for 18 years since 2002 while LTTE terrorists who were in prison were released with compensation.
I challenge the President to pay compensation to Sunil Ratnayake, a sum of Rs. 10 million for each year for all 18 years (10Mx18) covering the entire period he was in prison for a crime he did not commit.

The murder case was heard in 2002 before the Trial at Bar with the late Justice Sarath Ambepitiya and two other High court judges. Army sgt. Sunil Ratnayake and other accused were indicted on 17 charges within a year and not 13 years as Champa falsely complains. It took a considerable time because the Defence appealed against an interim order and it took more than three years. Ultimately on 24.06.2015 the Trial at bar court in Colombo consisting of Justices Lalith Jayasuriya, Padman Surasena and Warawewa found the accused Sunil Ratnayake guilty of murder and convicted him to death sentence while discharging the other accused. This accused appealed to the Supreme court and the court consisting of Justices B.P.Aluwihare, Sisira De Abrew, Priyantha Jayawardane, NalinPerera and Murdu Fernando affirmed the judgment and sentence of the High court Trial at bar.
So this is not a fabricated case as Champa alleges.this was a crime against humanity. The case went from the High Court to Supreme Court the highest court according to the proper legal procedure and all judges who heard the case were from Sinhala community. He was defended by the able criminal lawyer in the calibre of Anil Silva President’s Counsel. Deputy Solicitor General Thusitha Mudalige prosecuted on behalf of the Attorney General. Late Mr. D.W. Abeykoon P.C., late Mr.Desmond Fernando P.C., Chandrapala Kumarage, and K.S.Ratnavale appeared for the families of the victims. It is a shameful act on the part of the President Gotabhaya Rajapaksa, but what else can you expect of a war criminal catapulted to power?This is another slap on the face of the Srilankan judiciary . Only shameless apologists like Champa will support the illegal pardon.

Ranaviru Sgt. Sunil Rathnayake played a key role in the Long Range Reconnaissance Patrol (LRRP) of the SL army. The LRRP was a dreaded entity as far as the LTTE and the Tamil racists were concerned. They feared their eventual demise might come at the hands of the LRRP. The Sargeant was also nicknamed as Heluwella (naked man) because he took part in some battles completely naked especially if the enemy forces comprised of LTTE’s women’s brigade. He was a fearless soldier.
As such, during the Norwegian brokered peace farce, a conspiracy orchestrated by the LTTE and aided by the government of the day led by Mr Batalanda (Ra Wick) began to unfold. The sergeant faced criminal charges in a highly politicized case. The government of the day instructed the courts to try the suspects without a jury. How can a government instruct the judiciary? If they do, then it’s clearly political interference. The racist Tamil diaspora also paid huge sums to the state counsel in charge of the case.
It is good to see the current President has reversed this gross injustice. Bravo Mr President.

The decision to charge these murderers before the Trial at bar was made by the Attorney General and not by the government. Trial at bar consists of three High Court judges. No jury is involved in this legal process. This is the law as it stands now. If you want to change it, you may bring an amendment in Parliament. Until then this is the law. In the past there were trials held against Army butchers who murdered civilians in Mailanthannai in Batticaloa and Kumarapuram in Trincomalee. In Mailanthanai, 36 villagers including 12 women and 8 children were massacred by the Army. In Kumarapuram, 21 villagers including women and children were murdered in cold blood by the so called Ranawiruwos. In both cases the killers were properly identified by witnesses at the identification held in court. This was possible because the killers were from army camps set up in the villages and were familiar to the people. When trials came up in the High court they opted to be tried by the jury and the all Sinhala jury returned the verdict of Not guilty and the High Court had to acquit the accused in both cases. Sinhala jury consists usually of highly racist and with low IQ iskola mahattayas, wedamahattayas, government clerical servants etc. who are part of the lower middle class Pancha Maha Balavegaya unleashed by the Bandaranayke social revolution of 1956.
