Arresting Performance: Shelling Sri Lanka’s Zone In Geneva

With the arrests of an outspoken middle aged Tamil woman activist with no history of violence, her detention in Boossa under the Prevention of Terrorism Act, the handover of her 13 year old daughter to the child protection authorities, the detention without acknowledgement of two human rights activists, Ruki Fernando and Fr Praveen reportedly also under the PTA, the Sri Lankan authorities just torpedoed Sri Lanka’s chances at the ongoing crucial 25th sessions of the UNHRC.

The latest revision made in the US-UK draft resolution requests the Office of the High Commissioner to undertake a ‘comprehensive investigation’ into abuses by both sides. This means that there is no time limitation. This also means that anyone who served in the Sri Lankan armed forces in each and every one of the Eelam wars going back to the first troop deployments and incidents of the late 1970s and early 1980s would come into the net of a comprehensive investigation.

If the resolution goes through with Op 8 (b) in place —the request for ‘a comprehensive investigation’ conducted by the OHCHR— then, the entire war and the entire armed forces are wide open. Thus this clause has to be removed either through negotiation or defeat in a vote. The stakes are sky high. Any concession that can get this clause removed must be made. Any failure to make the necessary compromises is irresponsible. Anything that risks diminishing the votes in favour of Sri Lanka is profoundly counterproductive. Anything that is certain to do so is irrational to the point of lunacy.

This latest round of arrests in Kilinochchi-Vavuniya is not just outrageous, but also decidedly irrational. Apart from the ethics, the optics are all wrong. Detention under the harsh PTA of Tamil and Christian activists simply makes the case that the regime is targeting minorities. This impression is reinforced by the invective against the Sri Lanka Muslim Congress. When it takes place under the Geneva UNHRC searchlight, the impression is one of arrogant regime impunity masquerading as the defence of sovereignty; an impunity that invites a retaliatory response by Sri Lanka’s powerful and unfair critics while embarrassing and alienating potential friends. Thus the behaviour of elements of the regime actually makes Sri Lanka less defensible internationally. It jeopardises national sovereignty while rendering the security forces less secure.

When the timing is all very wrong because that vote pertains to so poisonous a clause as ‘a comprehensive investigation’ by the OHCHR, one cannot but notice that this is not Mahinda Rajapaksa’s usual style. Who decides? Is the Minister of Defence, who is also the President, really making the decisions? Or in the ultimate irony, has there been a dangerous degree of devolution of power?

A crackdown in the North won’t deter dissent. It never did and never will. The decision of then Perm Secretary of Defence and External Affairs, the Sinhala-Buddhist hawk NQ Dias, to send Major Richard Udugama to the North to disperse a peaceful Satyagraha in 1961, which the latter did by cracking heads with rifle butts, didn’t dissuade Tamil nationalism. Nor did the arrest and detention a decade later, of youth who hoisted black flags to protest the 1972 Constitution. Ask Mavai Senathirajah or Vardarajahperumal, who were jailed for several years for that non-violent protest. A policy of zero tolerance of dissent in the North will only catalyse civic protest which, if met coercively by the State, will trigger a huge Tamil Nadu response, which in turn will bring India down on our heads.

Similarly, the repeated insults to the SLMC will only drive Muslim sentiment in the East into the arms of the TNA, changing the balance of forces to the detriment of the security interests of the state.

Coming as they do at this very moment, the worst from the standpoint of the vital interests of the Sri Lankan state and the Security forces, these arrests reveal that there is something almost pathologically wrong within the System. This streak of unreason seems to be uncontrollable. Since the necessary restraining cannot come from enfeebled institutions or a chronically self-destructive Opposition, it can arguably only come from without— from the international system as a whole.

While the runaway unreason within the regime needs to be contained and constrained, by an external counterweight if necessary, such external means have to be ‘smart’ not dumb. A dumb or half-crazy regime cannot be constrained by dumb policies on the part of smarter international players. That would be the equivalent of a smart drone engaging in a dumb strike that kills an entire wedding party of civilians, alienating all their relatives and the tribe as a whole.

This is why I argue that the international community must not re-visit the war, which enables the regime to wrap its unreason up in the flag, the collective emotions against the fascist Tigers and for the heroes who fought to liberate us from them. The idea of an external investigation into the war must be refocused. The OHCHR and the UNHRC must be re-targeted to the present and the future; not the emotive and unalterable past. Thus the call should not be for an OHCHR investigation into the war years and decades, but for a robust OHCHR presence to be established in Sri Lanka, to monitor, report on and thereby deter or reverse ongoing future threats to human rights and international humanitarian law.

The regime is placing all its bets on electoral performance. The Opposition is betting on the deepening of the crisis. Both are in serious error. Elections in and of themselves do not deter, still less resolve crises. As President Jayewardene found out in his second term, neither his re-election nor the frozen two thirds majority in parliament could prevent the destructive ferocity of the ethnic crisis and its external aspect which culminated in a large presence of foreign troops and threatened to capsize the government and state. Conversely, as Madam Sirima Bandaranaike found out in 1988, no crisis, however catastrophic can obliterate negative memories and ensure a comeback, if the other side has a more popular (or populist?) candidate.

We are living through a transition to a new period after both the UNHRC Geneva vote and the Indian elections of May 2014. In that new period the regime, and also, unfortunately, the Sri Lankan state, are in danger of being caught in what is known in economics as a “scissors crisis”. This happens when two factors act as two blades of a pair of scissors and begin to close of an object. In the Sri Lankan case one blade is the Western thrust manifesting itself in a sharper resolution in Geneva. The other blade is the Jayalalithaa-driven threat from the neighbouring North, with her slogan of a referendum on Tamil Eelam. Let’s call it the Kosovo-South Ossetia-Crimea scenario. Over the next several months, the blades of the scissors (which are garden shears in this case) will begin to close.

The Sri Lankan regime seems to believe in nothing but its own preoccupations, prejudices and preconceptions; its own ‘false consciousness’. It can only go a relatively limited distance for a relatively limited period before it encounters the “seismic shock” (as Mervyn de Silva put it after the ’87 airdrop) of external material reality and the actual balance of forces.

Howver, the detention without acknowledgement of two human rights activists, Ruki Fernando and Fr Praveen last night can hint that they can harm anyone. Here you will not be an exception :( One who seem to have no basis for their atrocities, can do any harm to anyone.

          Absolutely you are right. Tamils should take the full responsibility for not questioning Prabha when he oversteps. But, they allowed for a simple reasoning which is devastating, the reason of believing that “Prabha can do no wrong…..”.

          The same way the Sinhala mindset is made to think about Mahinda & Gota. Look at the damage…..not only they have looted the entire country, the country itself is under severe threat of being dismembered.

          If this is what Anagarika wanted to see his future satans to unleash on this beautiful country. Let it happen!

            The Tamil’s support was not based on the belief “Prabha can do no wrong…..”. Rather, it was based on the fact that neither of the two governing parties were allowing any hope for relief or fair treatment of Tamils. Election-after-election, Tamils were increasingly treated as a political football by the two major parties and Tamils needed an escape route from under the ever-tightening iron-grip of the state, no matter which party was in control. For the two parties it actually became a game of political out-bidding as to who could hurt the Tamils more (remember JR’s proclamation?)

            Here is an observation that might help understand what happened – Both national leaders and international observers now stress that if a resolution to the Tamil problem is not found soon, it will inevitably lead to another armed struggle – What do you think is the basis of that conclusion? The fact that if you are pushed to a corner with no escape then violence is predictable. Sri Lankan history indeed proved that. It had nothing to do with worshipping Praba or aspirations for separation – they are all excuses aimed at diversion. Rather, the armed struggle was only a natural response to the unduy over-bullying by the State beyond any reasonable tolerance level.

      To call a spade a spade has taken years, but even today DJ´s wording exclude anything accurate about the country´s incumbent president.       Unfair critics? They are not: They rightly criticize the glaring abuse of power by the government and the state. The regime and the state consist of liars and people with no integrity, starting with the president and the chief justice.

      A very cunning argument above indeed: Those who do not learn from the past are condemned to repeat the past, said a wise man!               Tamara is ANOTHER political appointment. I suggest you read up more. MR went to Geneva in 89 to highlight the crimes by the UNP in the south. Guess who game space in her small studio apartment to this “human rights champion”, yes this Tamara. She was rewarded with a diplomatic post for that service !
              She is NOT a career diplomat either, another political appointment who has been thrown in the rubbish heap by this regime.

      This is the best opportunity for Jayalalitha to score points. She should start her election campaign by organizing a mass protest against the arrest of this innocent Tamil woman. The Tamil diaspora should also not keep quiet and the TNA should organize a mass protest in the North. Due to this foolish act, the down fall of Rajapakshe regime is getting closer. They have put the country in peril but still the Sinhala Modayas are unable to understand.

    I have declared in the past and do declare once more that DJ is a true patriot.

    He is always there to advice/caution/warn the Regime of the stupidity of its irrational conduct, even at the risk of hurting his own image.

    The many indirect insults the Regime throws at him is all forgiven.

    Now, he comes to the rescue of the Government with a reminder:

    – A crackdown in the North won’t deter dissent. It never did and never will.

    – This latest round of arrests is not just outrageous, but also decidedly irrational.

    I have commented in the past that DJ is smart, but not intelligent. What more of a proof does one need … .

    Breaking News-

    There is an e-mail doing the rounds that Gota has once again done the impossible by Hijacking the missing Malaysian MH 370 plane, just like how he captured KP again from Malaysia and brought him to Sri Lanka without the knowledge of the Malaysian Immigration. Currently the plane is hidden at the Mattala Zoological Airport, hidden easily as the Airport has no other planes coming in or going out. MR is to use the passengers as hostage to garner the required votes at the coming UN vote. Further MR intends using the passengers to swell the numbers of the Tourist arrivals by allowing the families of the passengers to visit. 20 X 299 = 5980 and an income of 5980 X $ 10000/- = $59,800,000/-

    This has now led MR to believe that he can wield power and earn money in similar fashion and the subsequent arrest of Ruki Fernando and Fr. Praveen is with the same motif. Dayan, beware you could be the next.

    Dayan’s aim is to protect the Sri Lankan military from punishment for the war crimes they committed. This in itself is admission the Sri Lankan forces committed war crimes. Dayan wants to try and block justice to the tamil civilians killed and their relatives. I am glad Rajapaksa is behaving in an irrational manner at a time his regime is in the dock in Geneva. The whole world is watching the arrogance and impunity with which Rajapaksa is acting. If anyone is going to expose the SL armed forces to a criminal court it will be Rajapaksa and he may very well do it to protect himself. My heart bleeds for Dayan and the poor poor heroic military forces of Sri Lanka he is trying to defend. LOL

      Obviously, an International investigation will disprove all the lies from both sides but why are they avoiding it? Why are they so scared?

      Why is DJ crying about ‘Comprehensive Inquiry’ against Sri Lanka? What he means by entire war and the entire armed forces are wide open? He is indirectly admitting that war crime has taken place. Is he worried that if the full war is investigated all his lies will come out? He thinks Gota has gone mad with such a foolish move in arresting innocent people. If a real international investigation is approved, there will be several military personnel now considered Missing In Action giving evidence from abroad what really happened and how their conscience made them leave the country. Even if the clause is removed through negotiation, things may take time but the truth will prevail. DJ and others have no escape.

    The regime’s current actions show why Izeth Hussain was wrong in arguing that just because Satellites were watching, the GoSL would not have committed war crimes. Why would a regime that gives the middle finger to the West in the middle of the UNHRC sessions in Geneva, worry about Western satellites? The regime drunk with arrogance that China and Russia would support it no matter what.

    So what is to be done? Just as Gary Kasparov advocated sanctions against Russian oligarchs who prop up and support Putin, I would advocate Western sanctions against all big businessmen in Colombo who support this criminal regime.

    Start with Dhammika Perera, the richest SL businessman, and target all business cronies of Gotabhaya Rajapaksa. If sanctions and asset freezes don’t help, find other ways to cripple their businesses.

    That is better than sanctions against SL as a whole which will affect innocent citizens.

      So if the government went ahead and committed war crimes despite the watchful eyes in the sky they must have recorded tons of evidence, no? US sats could have quite easily resolved the “hundreds of thousands of bodies”, “scorched earth”, “mass graves”, “heavy earth movers”, “Chinese incinerators” etc etc. Why not bring it all out and end the debates once and for all? That way you won’t need to keep harping on and on year after year about how the well deserved and timely deaths of a couple of terrorists proves “genocide” :D What’s the hold up, waiting for Christmas? :D

        There has been plenty of evidence with the Trinco-5, ACF17, murders/rape of TRO personnel, TNA MP’s like Raviraj, Lasantha W., Prof. Raveendranath, Matale mass graves, Mannar mass graves, etc. With such a record, even if enough evidence is shown with pictures showing your posterior and face, in the process of raping a Tamil girl in the Vanni bush, you will come to CT to defend the “well-deserved, timely rape of a couple of terrorists.” Even the perpetually lying and murdering GoSL has admitted that the Vanni death count among Tamils was more than 7000.

        Leaving aside the fact that satellite evidence is limited in scope–technology hasn’t helped locate the missing Malaysian plane–why would the US share any evidence it may have with potential rapists and criminals like you or the GoSL? Any evidence they have will go to an international panel of inquiry.

      Absolutely you are right. Tamils should take the full responsibility for not questioning Prabha when he oversteps. But, they allowed for a simple reasoning which is devastating, the reason of believing that “Prabha can do no wrong…..”.

      The same way the Sinhala mindset is made to think about Mahinda & Gota. Look at the damage…..not only they have looted the entire country, the country itself is under severe threat of being dismembered.

    It is really cheeky of you to expect people to erase from their minds the tragedy that befell them simply because two groups of actors decided to slug it out, with no consideration at all for the innocent people that get trapped in between. What else can explain the disproportionate force used against civilian Tamils and this has been characteristic for as long as we can remember. That is the mood in Tamilnadu and knowing Jayalalitha as she is, the tantrums of the defence secretary or the antics of MR is not going to scare her a bit. Instead it will only serve to harden her resolve to see it through during her “lifetime”, if that means anything to you or the Rajapakses.

    What is more concerning is winnings at the next 2 PC Elections and
    any kind of action to keep the heat up locally is necessary, specially
    with intelligence indicating a down-fall this time! Irrational activities
    here is aimed at Jayalalitha showing her power which in turn will prompt
    Champika and gang to push for more patriotic votes to save SL after
    Geneva? The Resolution matter can be “shaped” with time, as were the

    Most of the points are fantastic except the drone attack on a wedding ceremony. You are trying to imply that US has done these atrocities and therefore SL has the right to defend their atrocities too. Yes US has bombed civilians that doesn’t mean MR and co can do the same and escape.

    At the start of the 25th session Kopithas was murdered in the prison(02/24/2014). First of all he should not have been in the prison. The murder was a warning to British Royal Government(David Cameron) for its campaigning against the Royal Government of GOSL. There are lot of prearranged dramas and lies on Jeyakumari’s and Vipushika’s arrests. But they could not arrange anything for for Ruki and FR.Praveen. W heather there is any arrangement or not UNHRC, British government, America, NGOs TNA,….. Diaspora everybody understand the GOSL’s message.

    There are so many thousands are missing. So many thousand in secret prisons. That might include Vipushika’s brother, Ananthi’s husband etc. They all are government’s open area hostages. Tamils can retreat from the resolution if these lifes can be saved. But the truth is retreating is not going to release even a single prisoner. So the Tamils should go ahead to stop so that at least future hostage taking can be stopped. 1958 all Tamils retreated from south, wherever they were working, living to Jaffna and Batticola. That is where the chasing goons have ended up and doing their havoc. So the Tamils retreating not going to work.

    With what ever wording the the resolution ending up, irrelevant of that, Royal government will be taking many more sacrifices. Yet the Tamils have to go forward and see the result of this resolution.

      EPDP and Angajan group everybody knows. Kamal in prison. Douglas branded as notorious by America. So only person available is Angajan. Further this is because C.V. wanted appoint his own secretary. He recently complained that the government cheated him too. Here the America who branded the EPDP and C.V. who asked for his own staff, and UNHRC and India who are asking authority for NPC, all three have been brought down with one stone. This has nothing to with Gotha.
