Reports of the next appointment to one of the vacancies in the country’s apex court – the Supreme Court has sent shockwaves within the Sri Lankan legal and judicial circles with a close ally of Basil Rajapaksa, Priyantha Jayawardena PC being nominated as a Supreme Court judge.
His appointment has reportedly been submitted for approval to the Parliamentary Council with the Council expected to approve the nomination.
Priyantha Jayawardena PC who started his legal career as an officer at the Attorney-General reverted to the private bar a few years later. He came into prominence mainly for his connection to Minister Basil Rajapaksa. He was widely seen as playing a central role in the impeachment of Chief Justice Shirani Banadaranayake, and according to close sources his legal acumen was amply demonstrated in the flawed charge sheet issued during the impeachment process and several defects in the Divi Neguma Bill which he is reported to have drafted.
Jayawardena was also a beneficiary of the mass elevation of the President’s Counsel recently. Colombo Telegraph also learns that Jayawardena was involved in many “deals” as he is also a close associate of business tycoon Harry Jayawardena. As a Supreme Court Judge Jayawardena will hear important commercial and political cases.

In a country where “might have become the right” and governed by the Rajapkshes clans, there is no place for ones really qualified. Not few days ago religious forces harmed ministries. Two weeks ago, the very same blocked muslims gathered for a discussion scheduled with their parties. Then again, opposition UNP MPs were physically attacked, abused, thrown all faul eggs showing and proving their capacities and aggressions in the native place of the incumbent president, sending a message to th eentire world, they can only be rascals by all activities. I did not have good feeling towards JVPers in late 80ties. If one would listen to AKD once, he or she would feel – but truth…. anyway, not sure, all these could be achieved through only facts and figures.
At the begining of MR it was acceptable, but during last 5years, they have only been in wasting mode. over 90% of funds have been gone to waters, as JVPers pointed out clearly.

Time we initiated an alternative/ unofficial bench of the Supreme Court to review and publish judgements to keep a tab on the Official Verdicts. I recall the appalling judgement in the Tissanayagam case where the judge clearly did not know to co-relate evidence to guilt. If bias and incompetency takes root, it will be a matter of time when only violence will ensure justice.

So since there are nor gudelines unlike in the 17th amendment, it is one of the two bodies(Other being Parliament) to which any one can be appointed. As per my perception the Constitution has not specified any qualification for a person to be a judge of the Supreme Court.
So the people of this country have voted this government into power continuously and the Govt. acts aaccordingly. So if you can try please (I presume the people won’t allow such a change because the government has well realized the taste of the people, thanks to the BBS minus development)

Considering recent appointments I am not surprised. The quality of the judgments that we had in the past is no longer there. Sometimes there are conflicting decisions making things worse.
