Basil’s Man Tipped To Be Judge Of Supreme Court

Reports of the next appointment to one of the vacancies in the country’s apex court – the Supreme Court has sent shockwaves within the Sri Lankan legal and judicial circles with a close ally of Basil Rajapaksa,  Priyantha Jayawardena PC  being nominated as a Supreme Court judge.

Mahinda, Mohan and BasilHis appointment has reportedly been submitted for approval to the Parliamentary Council with the Council expected to approve the nomination.

Priyantha Jayawardena PC who started his legal career as an officer at the Attorney-General reverted to the private bar a few years later. He came into prominence mainly for his connection to Minister Basil Rajapaksa. He was widely seen as playing a central role in the impeachment of Chief Justice Shirani Banadaranayake, and according to close sources his legal acumen  was amply demonstrated in the flawed charge sheet issued during the impeachment process and several defects in the Divi Neguma Bill which he is reported to have drafted.

Jayawardena was also a beneficiary of the mass elevation of the President’s Counsel recently. Colombo Telegraph also learns that Jayawardena was involved in many “deals” as he is  also a close associate of business tycoon Harry Jayawardena. As a Supreme Court Judge Jayawardena will hear important commercial and political cases.

    The supreme court which is ‘supreme’ only in name,is apparently being further strengthened by another ‘justice’ who will see constitutional problems/matters only from the point of view of the continuation of the repressive MR regime.

      These white costumes of the men on the picture should be painted with fe red blood spots symbolizing their real faces. Allged war criminals have been on the worsening mode, making it unbearable day to another. Else, the world would not realize the gravity of the levels this county is driven by them to this day. People are helpless. They are scared. Not only people even any opposition parliamentarian PROVE to have no place in the parliament today. They argue thuggish, they work thuggish, they dont respect others´views. Nor have they investigated anything sofar to stay they were fair. Now Tangalle british murder case is being shaken with former witnesses changing their views in favour of the accused – why ? The danger befoer them, if would go against them, president´s goons would harm them. Fears of all kinds, as people sensed it notimes in the past, make them scared to do whatever today.

      In a country where “might have become the right” and governed by the Rajapkshes clans, there is no place for ones really qualified. Not few days ago religious forces harmed ministries. Two weeks ago, the very same blocked muslims gathered for a discussion scheduled with their parties. Then again, opposition UNP MPs were physically attacked, abused, thrown all faul eggs showing and proving their capacities and aggressions in the native place of the incumbent president, sending a message to th eentire world, they can only be rascals by all activities. This is the jungle justice promoted by Rajapakshe. So what hopes we can keep on the sustatainable peace towards COUNTRY`S minority issues – pigs might fly if ever MR regime would near the peace to the country.

      Not about peace, but about living with safe is people´s general thinking reduced to this day.

      Premadasa was exploded into pieces – though had same qualities, but his siblings or the like were not there to fester the wounds of hurful people. But the man in power today, abuse going beyond all margins.
      My grandfather is shocked reading these news everytime.

          I did not have good feeling towards JVPers in late 80ties. If one would listen to AKD once, he or she would feel – but truth…. anyway, not sure, all these could be achieved through only facts and figures.
          At the begining of MR it was acceptable, but during last 5years, they have only been in wasting mode. over 90% of funds have been gone to waters, as JVPers pointed out clearly.

          However, as opposition JVPers, DPers and some men in UNP too are the ones I think would bring good arguments about the chaotic politics of the day.

      All these against RW are just not provable.
      In a nation, if you raise your voice to be named as NGO worker, dollar greedy egoist etc, what I believe is every rumour could work to the disadvantage of the opposition. That worked on CBK too. Today, state funds have been abused as no other times in the past. Planes have been abused for their own entourages, as no other times in the past. All these are similar to the actitivies of some very poor state leaders in Africa. Mammoth delegations of African leaders are well known to anyone. They would never consider that the amouts of funds being wasted for them. The man in power today, be it within th country of out of the country, he wastes a lots of funds that the authorities could better be used for upliftiing the lives of the poor of the poor which are over 50% or in the country.

      Right at the moment, looking back, RW is the clean politician we ever had/have. He respects digntiy of the life above everything else. For what we need roads and other materials, if the society is becoming a place filled with culprits of all varieties.

      Just because previous UNP regimes in late 80ties went that wrong, it s not right to paint him with the same brush.

    What I want to know is this – Supposing I file a fundamental rights application against state actors in the Supreme Court of Sri Lanka due to some grave infringement of my basic rights, will or will not this legal luminary grant me leave to proceed? If he refuses, will he give the reasons for it?

    Time we initiated an alternative/ unofficial bench of the Supreme Court to review and publish judgements to keep a tab on the Official Verdicts. I recall the appalling judgement in the Tissanayagam case where the judge clearly did not know to co-relate evidence to guilt. If bias and incompetency takes root, it will be a matter of time when only violence will ensure justice.

    “His appointment has reportedly been submitted for approval to the Parliamentary Council with the Council expected to approve the nomination” This so called approval by the Parliamentary Council under the 18th amendment is a which hunt. In facyt it is not an approval under the 18th Amendment.

    So since there are nor gudelines unlike in the 17th amendment, it is one of the two bodies(Other being Parliament) to which any one can be appointed. As per my perception the Constitution has not specified any qualification for a person to be a judge of the Supreme Court.

    So the people of this country have voted this government into power continuously and the Govt. acts aaccordingly. So if you can try please (I presume the people won’t allow such a change because the government has well realized the taste of the people, thanks to the BBS minus development)

    This is not the first time in the legal history. Nevil Samarakoon was brought by JR. Shirani Bandaranayake was brought by Chandrika and JL Peiris. Mohan Peiris is another example. Therefore why not Priyantha Jayawardane?

    Ministry is stromed. Memebers of parliament are chased away. Murderers and drug dealers are freely moving.

    Any one can be a judge in this country. Therefore why not Priyantha Jayawardane?

    Considering recent appointments I am not surprised. The quality of the judgments that we had in the past is no longer there. Sometimes there are conflicting decisions making things worse. So I do not think this appointment would make any difference. One only needs to read the judgments to consider the quality of the highest court of sl.

    Why is it a surprise ? Gota appointed Aluvihare,basil appointed priyantha jayawardena, soon namal ,will appoint another judge. We can also ask the brother -in -law wickramasinghe of air lanka also to appoint a judge. What is wrong ? anybody can act in the comedy !
