The tragic death of a sixteen years young housemaid, Ishalini, occurred in a Muslim politician’s household has created endless controversies, protest rallies and conspiratorial theories among competing vested interests, and is dragging some parts of the country into a communal frenzy against Muslims. That incident is now being investigated by security authorities and therefore it is advisable to wait for the findings. If it was a calculated murder, then the full force of law should be allowed to prevail without any political interference. Period.
However, what is lost amidst all this hullabaloo is a public discussion on the underlying cause or causes that drove not only Ishalini, but nearly 103,000 girls and boys, according to one budding politician from the hills, all of whom should otherwise be attending schools at their age, but forced by circumstances to join an army of under aged employees toiling in the country’s informal sector. No parent would wish his/her child to sacrifice its happy days in earning and supporting its family. It is the economic condition at home and abject poverty prevailing there that compel thousands of families to send young boys and girls to work in risky industries. Under age domestic servants are a subset of this growing army. This is one of the darker sides of the country’s open economy. In a recent report by the World Bank on “Informality, Job Quality and Welfare in Sri Lanka”, it was pointed out that “informal workers have more precarious employment arrangements and inferior working conditions. Their low earning levels elevate the risk of poverty”. Why is the public or the media and politicians not talking about this shameful feature in society?
Of the three major communities in the country, it is the employees in tea and rubber plantations, a subset of the Tamil community, who suffer most from poverty, and it is that community that has become the largest supplier of house maids to the domestic market. How did this come about?
One of the outcomes of JR’s open economy, which has now become a lifesaver to today’s pandemic hit, debt pressed and an almost bankrupt economy, is the export of human resources. It is a cruel choice between exporting goods or people. Economics of neo-liberalism in the 1980s welcomed this choice as solution to chronic unemployment in many developing countries. Neoliberal economists theorized this phenomenon as a market induced solution for wealth distribution between labour surplus and capital surplus economies. The oil rich Arab Middle East became the chief laboratory to test their thesis. Countless development projects designed chiefly by Western economists, engineers and architects to modernize the medieval desert kingdoms and sheikdoms created a voracious appetite for skilled and unskilled labour, which opened the flood gates for the underpaid and unemployed men and women in developing nations to flock towards the new Eldorado. Sri Lanka too joined the hordes.
In this migration were women, young and old, who went mostly as housemaids to be employed in Arab homes. JR, who was critical in the 1960s and 1970s of Sinhalese women working as housemaids in Muslim homes in Sri Lanka now welcomed them to migrate to Muslim Middle East and remit their earnings in precious dollars. Among those intellectuals who criticized this Sinhalese-Arab nexus was the foremost playwright, Ediriweera Sarachchandra, who in his Dharmista Samajaya (Colombo: Elko Industries, 1982), addressed and warned of the social evils that would accompany this phenomenon. His views were also voiced by some prominent Buddhist monks. However, given the economic conditions prevailing at home that migration was unstoppable. What was new in that wave was the inclusion of many young Muslim girls and women. Neither the Muslim politicians of that time nor Muslim religious leaders raised any concern but remained silent and endorsed JR’s initiatives.
The least represented cohort in the housemaid exodus at that time were Tamil women and girls from the plantation sector. This seems to be true even today. Why? The supply of maids to Middle East is an organized industry riddled with corruption and studded with layers of hurdles to cross before the job seeker reaches her destination. To start with, it needs an initial investment of thousands of rupees which many families do not have but forced to borrow from relatives or friends and money lenders, hoping to pay back with interest later. Such facilities are not easily available to women working in the estate sector. Poverty seems to be their destiny. Besides, there is also a linguistic inability for these women to speak at least a modicum of English or Arabic to work in an Arab family. As a result, the estate women, unable to make good of the Middle East opportunity were trapped in the estates. In the meantime, a shortage of domestic servants increased the cost of employing them and wealthy home owners began to look for cheaper sources of supply. The estate sector driven by poverty turned out to be the most dominant source of that supply.
Ishalini’s death has provoked agitation among politicians to regulate this market to get rid of under-age employment. Even if legislation to that effect were to be passed its strict implementation in the prevailing environment of administrative laxity and corruption is questionable. Besides, will that legislation solve the problem of poverty in the estate sector? How could a government that is unable to award even an increase of 1000 rupees to those workers hope to alleviate the chronic poverty prevailing in that community? Unless the estate workers receive a decent wage for their labour their children would continue to seek employment in the informal sector.
To the politicians sitting on both sides of the Legislature what matters is the vote bank in the estates. The country saw in 1919 how the Rajapaksa clan used the death of late Arumugam Thondaman a rallying point for election propaganda, ignoring the threat of Corona infection. It seems Hishalini’s death is also becoming a political football between the government and opposition. For over two centuries her community had been selling its labour to keep the Sri Lankan economy growing. In spite all efforts at industrialization and export diversification, tea is still the largest income earner and contributor to GDP. It is the blood and sweat of estate workers that nourish this industry. Unless the standard of living improves for those worker families there will be more Ishalinis to mourn for. Politicians should look at the bigger picture behind this girl’s tragedy.

One way poor communities can help themselves is by limiting their family size with not more than two children.
God helps those who help themselves, they say. It is a vicious circle they have to break out of to escape poverty. Well to do only pay lip service to the poor.

Muslims are responsible for Ishalini’s death to be politicized. From the time this incident occurred, there has been attempts by Muslims to cover this up. First the Muslim policeman who attempted to bribe the family to prevent it being taken up further. If this was pure and simple suicide why should Badurdeen’s father in law ask the police officer to do so. Next is the Muslim JMO who had done a callous post mortem examination in order to portray it as suicide. I was the first person who raised concern about it and demanded second post mortem by a panel of three persons of integrity. Now this has been done justifying my view. Next is what are the names of doctors who treated her, especially the one who took down admission notes. If the admitting doctor was Muslim, then it elicits strong suspicion. It was first said that the maid has said that she set fire to herself, but the doctor says that it was told by another one and not the patient. (CONTD) Despite hospital police post informing Borella police about the incident, no action was taken by Borella police to record statement from the patient and to seal section of the house where incident took place to prevent tampering of evidence. Inquiry must be made as to whether Borella Police officials received any inducement to suppress this case. Even after death, Borella police went to Diyagama and Puwakpitiya to inquire about the past of the deceased in order to castigate her, and not taken action to investigate the reason for this incident to occur and sweep it down as suicide. Due to this deliberate negligence of Borella police evidence has been tampered with erasing off CCTV camera recordings and mysterious appearance of writing on wall and dress materials. It is when investigations were not satisfactory and the family being harassed, that the mother sought assistance from Tamil politicians. (CONTD)

Similarly in this case, those who are demanding justice for her death are not racists, but those Muslim politicians, lawyers and web sites who are trying to cover up by slandering the character of the deceased and portraying Badiudden’s family as innocent are the racists. It is clear form evidence of other former maids that serial sex abuse had been going on in this household. It is natural for most women not coming out with sex abuse due to fear and shame. Even a prostitute has the right to complain of sex abuse if it was done against her will. Therefore Muslim propaganda of slinging mud on the girl, is purely to distract the case. In the case of the deceased, sex abuse has been done by either father in law or brother in law of Badurdeen or probably both. (CONTD) People do not commit suicide without reason such as shame, debt, severe depression, broken love affair etc. In this case none of these has happened. She had spoken to her mother few days prior and was waiting for her mother to fetch her. So why should she take her life three days before date of her mother’s visit. All previous house maids have complained about physical torture and two about sexual abuse. Deceased in her telephone conversation had also complained of physical abuse, and did not in any way behaved like one harbouring suicidal thoughts. So something must have happened in ensuing days. I have strong feeling that she must have threatened to expose clandestine activity in the house, either sexual abuse on herself or between two other occupants of the house. Investigation should be done about sexual contact between Badurdeen’s wife and male servant who appears to be enjoying privileges not given to maids. Did she threaten to expose this and to silence her, Badurden’s wife, father in law, mother in law and servant connived to kill her. (CONTD)

How can maid kept locked inside the house get hold of kerosine and lighter. They said that kerosine was brought to kill insects, but previous maids have told kerosine was never used in the house. Badurdeen’s mother in law had told that kerosine was brought by driver, which the driver has denied. Who gave her the lighter, when she was never a smoker.They said she came out running with burns and they doused with rugs and dipped legs in fish pond. If so how did she get 70% burns. People committing suicide douse their body and not legs. This leads to suspect that her legs were set on fire by someone. (CONTD) There appears to be interpolation of evidence to support suicide. How did the writing on the wall appear, when in the photographs of the room in social media did not have it. How has the pieces of clothes appear, in order to corroborate the falsehood of Badurdeen’s mother in law that when she tried to ignite the thread, she caught fire. Police must take into custody Badurdeen’s mother in law, the male servant and the Muslim police officer, who may be knowing what really happened. Bank account of Muslim JMO must be examined as there are complaints of him giving false report on a Muslim drug peddler.The criminals are faltering in their attempt to distort the truth. Tamil politicians should continue their agitation to bring out the truth. They need not worry as they have ample support from fair minded Sinhalese. If proper forensic examination is done, culprits will be caught. I hope that the panel of JMOs and officials of government analyst department do their job without fear or favour to deliver justice to the dead girl.

Statements taken from those who took Ishalini to hospital are important as the Police investigators who inspected the house now say that there was no sign of Ishalini setting fire on herself (or someone else setting fire on her).
If Ishalini was taken to hospital by an ambulance, what did the driver and paramedics say about her? Were they also Muslims?
The 16-year old Ishalini was set on fire alive by the same Muslims who vehemently opposed cremation of Covid-19 infected dead bodies!!!
Gender-based violence, assault, molestation, rape and murder have become TOO COMMON in Sri Lanka.
We must raise our voice in both Isahalini’s and 15-year old Sinhalese girl’s cases, as there is all the possibility of rapists and murderers finding another victim and their actions being repeated and addictive.

According to what police told courts today, only one doctor has stated that the deceased had set fire on herself, while all others have queried as to what happened. They also said that this doctor named Randika is out of the country and they could not record his statement. Police must investigate whether he had left the country to escape being questioned. Court was told that Badurdeen has told police that he does not know what happened. Police must investigate whether the Muslim JMO who did the first post mortem did so according to his turn in the roster or whether Chief JMO has been requested to allow him to do it.
Fact that none of the doctors of Colombo JMO office had been included in the panel which performed the second post mortem, is a sad indictment on the integrity of these officials.

While investigations are still going on, you seem to know Everything about what happened and also seem to know Everything that is happening on the investigation front though there is very little known about the investigation as they are still ongoing. It is also not proper to give vent to one’s opinion on how a crime has been committed and the nature of the crime (whether suicide or murder) when the investigation is ongoing. Well, if you are an eye witness, to the crime or any other relevant happenings relevant to the crime, then, as a responsible citizen, it is for you to contact the relevant authorities and provide whatever information you have instead of writing to the Media. Three politicians from Badurdeen’s party Amir Ali, member of Kalmunai MC and former member of western provincial council had been vociferous in praising Badurdeen and condemning the dead girl, with one of them saying that she had been having sex from the age of 12. When this matter was brought up in parliament for fresh investigation, Mujibur Rahman tried to distract it saying, then you have to first investigate death of a male in Wimalawansa’s residence. Just because one has been suppressed does mean that all such cases should be suppressed. Silence of Muslims proves that Muslims will never speak against Muslim criminal when offence has been committed on non Muslim. There are several youtube postings by Muslims such as Ceylon voice, CGC talk, Shortnews TV, and few others. One Muslim lawyer said that he has no confidence on the investigations being done. (CONTD) I can only recommend the arrest of criminals, but have no power to arrest them. Regarding Easter bombing, I have mentioned in Colombo Telegraph several times, the names of those involved. Recently Cardinal Ranjith read out in the church names of some Muslim politicians including Badurdeen and Hisbulla, businessmen and professionals involved with the terror group, which endorses my view. Just because no action has been taken on that incident, does not mean that criminals in this case should be allowed to go free. There is no charge on Badurdeen regarding the death of this girl, but as the chief occupant where sex and physical abuse has occurred, he is responsible. Therefore there is no witch hunt on Badurdeen. Police officer who offered bribe will be taken in, as there is suspicion that he is responsible for tampering with evidence. Police must investigate whether there was clandestine sexual relationship between Badurdeen’s wife and male servant who seems to have been given privileges in the house, and whether the girl was killed because she threatened to expose it.

Rishard did not release a statement when the murder story started to spread. They used a policeman to bribe the family and silence them. After two weeks of this has been spread all over the country by the media, Rishard is explaining his version at the parliament using the parliamentary procedure. After the case has gone to court, now Rishard should shut up. The speaker should have limited Rishard defenses in the parliament. He was explaining as philanthropic donation, the money that is claimed by victims as bribe money. Can Rishard release a statement at parliament that what other 11 servant girls worked at his family got by these donation programs? The truth is even if he had done like that, he would not tell that out in public, because that would hurt his votes, saying that he is giving out Tamils only. That is the way he has trained his community to react. They were Muslim traders helped all communities in natural disasters. But Rishard’s name never appeared in the media in those incidents. How Rishard who had to be admitted at hospital to open heart surgery when the murder took place, but he became stronger man and came to parliament to defend his using the parliamentary privileges? Remember, the campaigners are not asking to treat the Tamils fairly, but just fire immediately. Did they do the same when Rozina was murdered in Saudi? The only parallel is the case of Tangalle Christmas party rape of Victoria and murder of her partner, by a government politician, hidden or subverted until commonwealth summit in SL and British PM Cameron’s intervention. This case is a replica, simply because of the perpetrators!

Justice, report of second post mortem is not ready yet. While results of the scans taken would be ready, results of tissues taken will take time. Probably at the next date on 23rd August, we should know it. So far police has not hidden anything to the public. I am watching this case closely and satisfied with the progress. What action taken by the police seems to be according to the recommendations I had made in this column, which makes me think whether police and prosecutors are reading my comments. Only at the last hearing the judge cautioned police not to have briefing to the public about the findings.

Sri Lanka Police bigwigs think if the above-mentioned crimes are not recurrent, the women and children should bear them. Even some judges share the same view. I remember in one case, the rapist was released on bail, considering that it was his first time. And, in another, based on his old age. And, in another, based on the fact that the rapist married the victim. And, in another, considering that the rapist had offered to compensate the victim and her mother.

They said according to statement given by the household Ishalini came out shouting from the room with fire on her body, and they doused the flame with rug and dipped her legs in fish pond, and since she has to come out of her room into the kitchen and then to living room and then to the pond, they have not found any burn marks to the objects in the house on her way from her room to the pond, which arouses suspicion about the statement given. This proves that Ishalini was set on fire inside the room and allowed to burn inside it.
