Canada Imposes Sanctions On Mahinda Rajapaksa And Gotabaya Rajapaksa For Human Rights Violations

Mélanie Joly, Minister of Foreign Affairs, today announced Canada imposes targeted sanctions under regulations pursuant to the Special Economic Measures Act against four Sri Lankan state officials responsible for gross and systematic violations of human rights during armed conflict in Sri Lanka, which occurred from 1983 to 2009.

The regulations pursuant to the Special Economic Measures Act impose on listed persons a dealings prohibition, which would effectively freeze any assets they may hold in Canada and render them inadmissible to Canada under the Immigration and Refugee Protection Act.

Canada is imposing sanctions against the following individuals who committed gross and systematic violations of human rights during Sri Lanka’s civil conflict, which occurred from 1983 to 2009.

The Special Economic Measures (Sri Lanka) Regulations impose on listed persons a prohibition on any transaction (effectively, an asset freeze) by prohibiting persons in Canada and Canadians outside Canada from engaging in any activity related to any property of these listed persons or providing financial or related services to them. The individuals listed in the Schedule to the Regulations are also rendered inadmissible to Canada under the Immigration and Refugee Protection Act.

The specific prohibitions are set out in the Regulations.

The names of the individuals added to the Schedule of the Regulations are the following:

  • Former President Gotabaya Rajapaksa
  • Former President Mahinda Rajapaksa
  • Staff Sergeant Sunil Ratnayake
  • Lieutenant Commander Chandana Prasad Hettiarachchi

Despite continued calls from Canada and the international community to address accountability, the Government of Sri Lanka has taken limited meaningful and concrete action to uphold its human rights obligations. This jeopardizes progress on justice for affected populations, and prospects for peace and reconciliation.

Victims and survivors of gross human rights violations deserve justice. That is why Canada continues to call on Sri Lanka to fulfill its commitment to establish a meaningful accountability process.

These sanctions send a clear message that Canada will not accept continued impunity for those that have committed gross human rights violations in Sri Lanka.

Canada will continue to collaborate alongside international partners, including through relevant multilateral bodies to advocate for human rights and accountability in Sri Lanka, which is an important step toward securing a safe, peaceful and inclusive future for the country. Canada, as part of the Core Group on Sri Lanka at the United Nations Human Rights Council will continue to advocate for the full implementation of resolution 51/1 and support efforts towards attaining accountability and peace on the island.

Canada supports efforts towards urgent political and economic reforms to alleviate the hardships faced by the people in Sri Lanka. We strongly encourage the Sri Lankan government to promote democracy, human rights and maintain the rule of law as it works to address this crisis.

In addition to today’s announcement, and in response to the humanitarian crisis in Sri Lanka, Canada announced $3 million to the appeals launched by the United Nations and the International Federation of Red Cross and Red Crescent Societies to address immediate needs, including food security and livelihoods, shelter and non-food items, as well as nutritional assistance and primary healthcare services for vulnerable children and women. Canada has also readjusted ongoing international assistance projects to address pressing needs, providing support, for instance, to the World Health Organization for the procurement of essential medical equipment and supplies.

    This is an by Canadian government against those who got involved in human rights violations. This is good enough for protesters, who are concerned about the criminal destroying Island’s economy. They could try to transfer their complain of economy destruction to Canadian courts because it is already recognized in the resolution 51/1. Tamils need an international investigation to bring their lost sovereignty issue in the 1972 constitution. They need to work more.

    Shouldn’t the present President Ranil W be included in this list for appointing the DIG who has been “Promoted” to be the “Second in Command” of the Police Force? This “Police Officer” has been named to be accused of failing to prevent the “Massacre” on 21st August 2019, in the Police Commission Report that inquired into the “Massacre” of 267 who attended the Churches to pray and who were dining in Tourist Hotel and made 500 odd persons disabled and made to suffer life-long suffer?

    This “Police Officer” was the recipient to have had first-hand information from Indian RAW of the imminent “Bomb” attack with dates and exact timings. Yet he failed to take action to prevent the attack.

    Isn’t that a “Crime Against Humanity”? Giving a “Promotion” to such an “Officer” is the WIRST CRIME against humanity. Canada: Please include both the names of this “Police Officer” and President Ranil W knowingly who assigned him a high office in the Police Force.

      Countries are careful not to sanction the head of state of a democratic country because it will create a diplomatic crisis and ultimately affect their own interests. Even some communist or theocratic countries are handled that way if it is dictated by self-interest. It is why Canada didn’t take this step while the Rajapaksas were in power.

      Remember that when a prominent Canadian politician ( a former Ontario PM, party leader, and a UN diplomat), Bob Rae, visited SL in 2009 to discuss some arrangements for avoiding massive civilian casualties in the war, he was kept waiting at the airport for a day or so and then sent back to Canada by MR/GR. Canada’s newspapers wrote angry editorials condemning it, but they didn’t do anything in retaliation. Perhaps the Canadians think the time is now opportune to show there will be consequences for being cavalier about HR and diplomatic norms, even if it may be largely symbolic.

    Unfortunately these sanctions are unilateral sanctions. If they have any assets in Canada it will be frozen. If UN Sanctioned these criminals, then all member countries have to follow UN mandate. The most important country that must sanction these crooks is USA. Then again why would the US sanction these criminals, when they have brought all their loot to the USA, the money USA is happy to have.

      Bert, Gota’s crimes affected the citizens with lack of basic commodities as his family robbed the finances and could not order the regular provisions needed each year, as was done with the past budgets. Mahinda tried to nastily repress the robbed citizens aragalaya and karma imtervened on behalf of justice, chasing his lot out of sight. Why don’t they understand that higher justice even beyond the grave prevails both on earth and in the cosmos. We pay for our crimes.

What impact it will have on the Ranils move towards the finding solution to the National problems such as Devolution of power and Economic crisis.         It hopefully reveals was alluding to a different kind of vision on paradise island even after 70 odd years of independence.

        If so would your supposition still persist in the light of the “literary comments” so as to seek any evidence ??

    A few days back, on a motion filed MR asked for “Permission” from the Courts to leave the country (to travel where is not known) from 20 to the 30th of this month. This appeal was granted.

    The “Rumor” in town is that he made an application to “Visit” Canada on an invitation from a “Prominent Sinhala Buddhist” activist serving in the “Dayaka Saba” of a Buddhist Temple in Canada
    This “Rejection” by CANADA…..Is it the result of this pending visit? Please note: This is a “TALK” of the Town of Colombo. We will know the TRUTH in due course.

If I remember correctly, MR has said long ago that he is prepared to face allegations (& die if necessary) at the Hague, so maybe the brothers can go to the Hague voluntarily. Anyway, what about the loot stashed in off shore accounts & assets bought with laundered money? African, Middle Eastern & Asian countries are unlikely to follow Canada. Besides, all those who plundered & raped the country have a good life in SL, so why bother going to other countries?

After centuries of wars and destroying one another, they have built these learned systems for the safety of the world. Avoiding confrontation is one of their ways in this diplomatic relationship. You may remember Langkang Kings deported British, German, Canada and other country’s envoys and officials. There was minimal calamity coming out of these actions. Those countries did not immediately jump and dance. That is the purpose of diplomatic relations. Last week, you know, a South Koren envoy blasted a minister for his dastardly tardiness. But every Langkang’ Dutugemunu hero was hiding in the women folk’s Munthanai, because for a long (75 years) these Gemunus were abusing their diplomatic power vested with them, by insulting other countries. Especially, the Evil Emperor who took a ticket to New York and went to kick the butt of the UNSG, did not show even his whereabouts on this.

    Eelam Tamils, with their supporters like ITJP had played the captain role in sanctioning the Hitler King and Old Rowdy King. But Canada took the opportunity to act partly because of Protesters. That is why I said in my earlier comment that Protesters can and should use this further up their targets that ousting all 225+1 out of the government. After the commission of war, both, Old Rowdy King, and Hitler King were elected by Sinhala Buddhists as their presidents. But this is nullified by the protestors, by ousting them both from the government. There are many democratic countries that recognized protestors toppling these Kings, rather than recognizing their sections in the last few elections by the Sinhala Buddhists. This is a lesson for the Sinhala Buddhists that when they elect a government for them, they should elect one acceptable for them internally and as well as externally (Internationally). The tricky Sinhala Viyathmaha who robbed the people and deposited the money in the foreign countries’ banks, never letting the Sinhala Buddhists understand the modern world order principle. Right or not, in the absence of any other practical method, that is an effort to maintain peace within the world.

They want a new people centric constitution. Realize please, how much gasoline this can put in the Canadian machine that wanted to sanction the Kleptocracy government official for their war crimes. Of course, every idiot who can pronounce the word “Democracy” knows that the Evil Emperor is an illegitimate president. They would agree, because the constitution failed to prevent unintended people from sneaking on the presidential chair, also knows well that it is neither promoting candidates rejected by people to be the presidents.

    The International Community is not going to insist that the faults in the constitution should be fixed if they can depend on the stability of the governments that come to power by these crooked techniques, to lend them a hand in need. But that is one of the reasons for the present tussle in obtaining the IMF loan.

    As you said, we saw in September 2022, the intolerance of South Asian and East Asian countries and the presence of Hitler King in their territory. Later Qatar, EU and America refused visa for him to tour. One cannot brush off these is not the precedent to the action of Canada. So, with a 50-75% accuracy I can mention that Canada is not alone in these sanctions. All these actions can temporarily fix the Longkang government’s and take it back to where Britain left Ceylon. But that fix cannot guarantee Langkang roll back to the place where its kinetic energy is minimum, without restoring the Tamils’ sovereignty. That is the only harness that can make the horse walk on the straight path, in future.

    Royal wanted governmental diplomatic positions to only protect them from international governments acting on them for their war crimes. Resolution 51/1 has opened a new window for UNHRC, if War Crime calls lose momentum, it can go with the economic crime.       Last week, when America sanctioned Chandana Prasad and Sunil Ratnayake, Ali Sabre said “They (US) have their own sources to investigate, so we can do nothing about these sanctions”. In fact, that was the answer Evil wanted Ali to tell the media, last week. Like us all, it seems, neither Evil nor Ali foresaw this coming. Otherwise, they may not have let it go so easily. Canadian FAM has said her government will act on these matters in association with the international community. Though Canada has set the example of full-scale sanctions, when in 2014, Old King went to the US for a UN meeting, America prevented him from visiting other parts of the country, beyond NYC. There are a lot of reasons why the US must let these criminals visit their country. The matter with the UN, matters in Washington DC, their personal properties all over the US, …… these always create complicated legal situations. That is why, US, most of the time, leaves handling the friendly countries’ crimes with Australia, Mexico, UK, Canada….. Unfortunately, the Sinhala Buddhist Intellectuals (Viyathmaga) think that they are on the top of everything. During the latter part of the war, using China, Sonia and Malayalees, the Old King insulted Western countries the most. That time Tamils lacked prudence and ability to turn that situation favorable for an immediate solution for them.
