CC Gives Sirisena Slap In The Face: Decides To Reconfirm Appointments Of Amarasekera And Thurairaja: Surasena Promoted To SC

The Constitutional Council today gave President Maithripala Sirisena a slap in the face when it decided to re-confirm the appointments of Justice Gamini Amarasekera and Justice S. Thurairaja to the Supreme Court.

The majority of CC members today decided to stick with the previous decision and disregard any new nominations by President Sirisena. Therefore, when the CC met this morning, it decided to stand its ground and re-confirms the appointments of Amarasekera and Thurairaja.

Colombo Telegraph exclusively reported that President Sirisena, in a bid to manipulate the judiciary, had refrained from appointing Justice Amarasekara and S.Thurairajah as Supreme Court judges despite the CC recommending their names in October.

Without appointing the two judges with unblemished track records, the President had referred two other names, K.K. Wickremesinghe and Deepali Wijesundara, to the CC for approval to be appointed as the Supreme Court judges.

Mahinda Rajapaksa, in his capacity as the Opposition Leader also attended the Constitutional Council meeting last month and supported the President’s move to nominate two new names to the Supreme Court, undermining the authority of the Constitutional Council.

Rajapaksa was present at the CC this morning as well. He, however, had no say on the matter as the large majority of CC members were against the President’s attempts at undermining the council’s authority.

Meanwhile, the CC unanimously decided to approve the appointment of Court of Appeal Chairman Padman Surasena as a Supreme Court judge. Surasena’s name was nominated by Sirisena as the replacement of Eva Wanasundara who retired from the judicial service last month.

Apart from Rajapaksa, Speaker Karu Jayasuriya, Prime Minister Ranil Wickremesinghe, Minister Thalatha Atukorale, JVP MP Bimal Ratnayake and Dr. Jayantha Dhanapala attended the CC meeting this morning.

      Judiciary on the whole needs Reconstruction Yes indeed. But this does not mean the verdict on dissolution is not ‘historic’.. 6.2 million who voted for Srisena did not want him to engage in ‘Kumanthranayak’. They wanted him to catch all the thieves and put them behind bar but he brought them back surreptitiously to power which was rightly prevented by the SC according to constitution. While I may have my reservations against JVP and TNA they acted well/wisely despite their numbers.
      Numbers are a misnomer. If you visit a restaurant and bar in the evenings there may be more people in the bar than at the restaurant. This does not mean the people in the bar are right and those in the restaurant, though smaller in number, are wrong.
      Sovereignty does not mean holding elections at the whims and fancy
      of a president who seem to have lost his equilibrium.

      Thank you for doing the right thing. No need to appoint Sirisena hired guns who will do his bidding. Sirisena is a Traitor, Quisling, Sevalya, Mala-Perethaya, Pachaya etc. to all those who elected him and more.

      His days are numbered. When will the Parliament take up the illegal and unconstitutional coup by Sirisena and Cronies and punish them?

Look at the difference of quality education in the better International Schools in Colombo vis-à-vis the present Royal-St.Thomas-St,Josephs-Trinity.         I have come across this Piyadasa Yalagala guy before (and there are a couple more like him), and no reader, I’m sure can make out what precisely the guy is trying to say. Obviously, a guy with less knowledge of English than us would be even more confused.

        This time he has had the misfortune of getting his comment in first; it looks as though the second comment submitted, chronologically, came from Analyst, who has poured scorn on Sirisena, calling him a “Gona” and a “Modaya”. Between those two come thirteen comments submitted in response to Piyadasa.

        I have stopped being amused by his strange English by now. I get furious that we have to tolerate the likes of him. So, I understand your disgust that the guy’s vote counts just as much as yours.

        However, that is what our country is, and these are our people. We have to live with them.
        .
        In the process, tear them to shreds. But here’s my surprising appeal to you: focus, if at all, on the content of what he says, don’t ridicule his use of a foreign language, and don’t compare what we consider prestigious schools with the village school that he probably attended.

          I have little against schools outside the “elites” I mentioned. Many of them have produced excellent students in the English language prior to 1956. One I know came from a Central School in the interior, He was later chosen to serve in the Central Bank. .From where he went to the UN and served there with distinction for a quarter of a century. This fine learned gentleman – who holds Sinhala language and cu,lture here in high esteem to our delight is back in the country. Happily, he now takes an active part in public discourse to protect the country from this pseudo-majoritarian nationalism that has destroyed much of our land and her highly priced features now under attack by “political leaders” acting in the name of our people. Then there were those fine schools in the Galle District that produced quality students, brilliant in the English language, all of whom served the country with much distinction. This includes one who made a name for himself as a much sought after scientist at NASA in the USA.

          My central critique was the culture “in the name of the majority people” where we threw the baby with the bath water. I think almost everyone laments the harm done in the last 7 decades including the Royal Medamulana family. At least now, let us save the present and future generations creating conditions where children more from disadvantaged backgrounds in the rural areas also get a fair chance to benefit from that much despicable – Kaduwa.

    Our Judiciary began to lose its Independence ever since JRJ began to manipulate it to his advantage. During the Rajapakse era it became a joke with the position of Chief Justice being doled out to the most obedient dog in the kennel. Only since 2015 the Judiciary is beginning to exert some semblance of independence.
    During the recent crisis with the political coup the Judiciary managed to gain some recognition round the world as it managed to maintain an image of independence from the Legislative and Executive arms of the state. I feel it still has to go a long way to weed out all the remaining henchmen at various levels of the structure. Only time can tell whether that is ever possible.
    Meanwhile the Rajapakse Sirisena faction is getting anxious with even the minimal cleaning up!

    At last we have seen the end of Eva , who belongs to any other place other than courts.I cannot even remember the last time when the highest courts was not under the influence of our crooked politicians. MR turned it into a road side Petteh market where deals are made only after bargaining. To implement such a system he used people like GLP, Sarath, Eva and Mohan who were acting as middle men/women and some even below as pimps (political prostitution). Such was the state of Law and Order in Lanka. The constitution was used like toilet paper where one uses and discards into dustbin. People who suffered are innocent citizens, people without political influence and common man/woman. Things were so bad the CJ not only delivered a verdict, not based on law but on his personal bias and had the audacity to tell so during session. How pathetic are we???

    First and foremost our judiciary finds a way to eliminate corruption within the system, especially at the functional level.

    Police are getting the commission from Lawyers for referring all the bail cases.

    Lawyers get unregulated fees and do tax evasion at their best and never give receipts to clients.

    While lawyers themselves not loyal to the country, their motive to stand for justice is a myth.

    The judgments were given by Honorable Supreme Courts and Honourable Court of Appeal being published in English languages which reduce the chances of the majority of the citizens to read and understand how some lawyers are playing with technicalities and drag the deliverance of justice to litigants and set an earning mode.

    Until Lawyers become a loyal citizen who pays tax and is fair, its impossible to find just judiciary from the eyes of the ordinary citizens. NOT ONLY JUSTICE SHOULD BE GIVEN, BUT ALSO JUSTICE SHOULD SEEM TO PREVAIL.

      I can’t help admiring Piyadasa Yalagala for coming back with a comment in which he seems to condemn Kangaroo Courts. It is possible that he is an honest man trying to make his views known, for certain reasons which I will proceed to discuss with him.

      Dear Piyadasa, I was very happy with the Supreme Court decision which I fully backed, and still am happy about. However, I’m not all that happy with the aftermath. Many of us who wished this would be the Court ruling, also hoped that Ranil Wickremasinghe would bring about radical changes, starting with his stepping down as leader of the UNP after driving home the point that President Sirisena could not assume the dictatorial powers that he had.

      What we now have to face up to is the fact that however nastily and selfishly the government acts, we have, in effect, no way of controlling it, except by filing action against individual cases of corruption etc. Who is going to spend on that? Early General Elections can still be called by two-thirds of the Members of Parliament voting for it. The ground situation is that no such resolution will succeed. Some UNP M.P.s may be unhappy with Ranil’s apparent determination to rule for thirty years more, physical health permitting. However, he’s a great manipulator, and democracy doesn’t prevail within the UNP.

I have used one or two expressions which would be outside your knowledge confident that you are the sort of person who would check them out in a Dictionary. I say that because there seems to be no paucity of vocabulary; only you seem to use the wrong form of most words.

      I’ve been a teacher so I understand your difficulties, but by now I find nothing as boring as patiently correcting mistakes. Not many realise that. People who give me things to correct for them don’t realise that it is very difficult work, and sitting at these things means I get “no any” sufficient physical exercise. That “no any” is a give away that many fluent Lankan speakers of English will use to identify a “non-U” (terribly out of date term!) person.

Compared with some International Schools, that school is not very expensive, but it is almost impossible to gain admission there unless it’s an Anglican, or the son of an Old Boy. Basically, it is honest, but I’m not ruling out other ways of getting in. How can one possibly know? The maternal uncle of the boys, the notorious Nishantha Wickremasinghe, had studied there. Never mind, I’m not ferreting beyond that.

      About twelve years ago, there was a problem involving ragging, some prefects were sacked, and there was some discussion of the school on-line, initiated by the Sunday Leader. There was a Rajapaksa sycophant who was claiming that the Rajapaksa siblings were models of rectitude. She was writing Odes (Yes, I mean poetry) in praise of the guys, but a few others were disagreeing.

      This sycophantic mother pounced on one of them for referring to “St. Thomas’ ” said that the guy couldn’t be a “Thomian” etc. Little did she know that when Bishop James Chapman founded the school at Mutwal (the move to Mt Lavinia was in 1918), the school was “St.” and not what some changed it to, so as to be in some way distinctive.

      We all have a right to be distinctive, but not as a way of putting others down. I’m so happy that yesterday My3 had sworn in to the Supreme Court Justice Thurairajah who had studied throughout at Saraswathi Maha Vidyalayam, Pusellawa: the first “Up-country Tamil” to be elevated to such a position.

      When Old Boys of Richmond or Saraswathi get together they can call themselves anything. Let them all be proud of their alma maters. As for me, I try to avoid words like Josephian, Familian and Shepardian, because, obviously I had nothing to do with those schools. However, even the one that I use with my school friends, I will not use in public places.

    this is a turn in the right direction that shows for first time in a long time judiciary is strong enough to withstand politics. this is the first step to moving in right direction. hopefully when new constitution comes the 4.5 years stays and presidents powers are further restricted. also govenors and chief ministers powers should be reduced and given to legislative.
    finally sirisena should retire peacefully in Thailand and enjoy a good life. he has already secured his legacy by defeating rajapaksa cabal. time to pass on to next generation. ranil should consider same. stay on for a few more years and transfer leadership to someone new. not sajith as he is a moron. also not Karunayake. new generations turn to solve pressing issues. this generation has failed to solve the economic issues or find proper solution to ethnic tensions. hopefully new generation will. we have given them since 1994. 24 years is long enough. time for next group to have a go.

    Bunch of unelected morons. CC should be abolished after the next general election. We don’t want unelected clowns picking SC judges. Do it only through the Parliament. That should be the way to go.

    There are many English language Teachers are affiliated to Colombo Telegraphy. I views that is also good. But some of them are majority belongs to a political separatist or anarchist, who are promoting political vandalism to be replace for norms of democracy by means of rule by gun politics of LTTE +JVP line of vision.
    Those politics teaches has be look-back by accountability of that Judiciary. It was failure by our courts of law address the key issues of democracy . That is bad.
    An Ours system of judiciary are NOT that perfect at any way. It has gone through many cancers of seriously illness…..Not being address by Political leadership Parties and their classes in power for long years.
    We have to diagnose each case by case that Judiciary functions as whole that key issues and survival of democratic metholodey that bottom line of fairness of right to VOTE by the People.
    If it rejected SC by right to voting and to be elected their represtaitaive has been rejected by SC last December was that unpersedant error of mode of ongoing Democracy..

    The People are ignorant of Legal system of Sri lanka. We have to enlighten tax payers of right to rule nation by rule of Law. Therefor I view is right cause of citizens of majority engage for board consuses and deliberation also rule of democratic justices.
