CID Grills Harin’s Sister For Five Hours; MP Goes To Court Against Imminent Arrest Under PTA

Unable to touch Opposition MP Harin Fernando while he remains under the care of his doctors at Nawaloka Hospital, President Nandasena Gotabaya Rajapaksa has set the CID on his family.

The CID questioned Fernando’s sister for five hours on Tuesday (27).

The same day, Fernando filed a fundamental rights petition in the Supreme Court against imminent arrest.

In his petition before the Supreme Court, Harin Fernando said he had reliable information that the authorities were seeking to arrest and detain him under the Prevention of Terrorism Act (PTA). On hearing that he would be arrested under the draconian anti-terror law, Fernando said he had suffered severe chest pains and had to be admitted to the Nawaloka Hospital.

Fernando has been in the Intensive Care Unit and underwent surgery for a cardiac event, Colombo Telegraph learns.

The CID was seeking to question him on the basis of a remark he made at a press briefing on April 21, 2019, regarding the Easter Sunday bombings the petition filed by his lawyers in Supreme Court stated.

The petition filed on behalf of the SJB frontliner said that there was no allegation whatsoever that he was in any way connected to the Easter Sunday attacks. The petition also notes that he has consistently been severely critical of the Government over the bombings. On April 20, 2021, Fernando’s Supreme Court petition said he had made another speech in Parliament criticising Government leaders for the attacks and there was a commotion in Parliament that followed his remarks.

The petition stated that subsequent to his highly critical speech, several government MPs and government-affiliated organizations have urged the CID to launch an investigation and take criminal action against MP Fernando.

President’s Counsel Romesh De Silva instructed by counsel Sanath Wijewardane will appear on behalf of the firebrand SJB MP. Fernando’s fundamental petition cites the IGP, the Director of the CID, Public Security Minister Sarath Weerasekera and the Attorney General as respondents.

Government Minister Johnston Fernando said the CID wanted to question Harin Fernando regarding statements he had made two years ago in relation to the Easter Sunday attacks. The knives have been out for Harin Fernando ever since his speech in Parliament on January 6, 2021 when he referred to President Gotabaya Rajapaksa by his first name Nandasena and propagated the idea of the “ස සාපේ” or “Sir Curse”.

Days later, the President shot back that he had killed Prabhakaran “like a dog” warning the Opposition MP that he was capable of becoming “that defence secretary Gotabaya again”.

The chilling warning prompted Fernando to write to the IGP about the President directly threatening his life.

On April 20, 2021 Fernando tempted fate again.

For months, opposition MPs in the JVP and the SJB have been hinting broadly about a connection between the Easter Sunday bomber cell and the Sri Lankan intelligence services.

Last week, Fernando became the first Parliamentarian to openly allude to a relationship between Gotabaya Rajapaksa’s State Intelligence Services Chief Major General Suresh Sallay. Fernando told Parliament about communications intercepts of messaging applications used by the bombers which referred to a code name “Sonic-Sonic” as being a person of authority in terms of the suicide cell. In the same speech Fernando insinuated that the code name Sonic-Sonic referred to the same person in charge of all intelligence services in the country as President Nandasena Rajapaksa’s most trusted intelligence official. He also referred to a certain intelligence chief “briefing” the Attorney General about the Easter Sunday commission report, in an unprecedented move. Recently, after the Government finally released the volumes of the report by the Commission it was holding on national security grounds, Sallay met with Attorney General Dappula De Livera to “brief him”. Intelligence Chiefs do not engage in law enforcement and criminal prosecution matters. However as Gotabaya’s SIS Chief, Sallay has already broken decades of precedent, becoming the only military official to ever serve as head of a police intelligence arm.

Since Fernando’s explosive revelations, decisions have been made at the highest levels that he will be given no quarter. The CID summoned Fernando for interrogation days later and sources inside the Government revealed that the MP was to be arrested under the Prevention of Terrorism Act and detained for a minimum of 90 days.

Former Speaker Karu Jayasuriya slammed the interrogation of Harin Fernando’s sister as a grave violation of her human rights and a morally abhorrent act by the CID.

Jayasuriya who is now Chairman of the National Movement for Social Justice founded by late Ven. Maduluwawe Sobitha Thero, also slammed the Government’s treatment of ACMC Leader Rishad Bathiudeen, referring to the “unconventional nature of the arrest”. “It should be clarified why such an action (the arrest) was taken at 2AM without informing the Speaker,” Jayasuriya charged in a statement issued on Thursday (29).

There has been no reaction yet by the Samagi Janabalawegaya (SJB) about the interrogation of Fernando’s sister by the CID. (By Nimal Ratnaweera)

That is why the Chinese Minister of Defense visited us for two days to discuss matters relating to and advise our President on the “Next Move”. An “Agreement” on “Defense” was also signed between the two (Chinese Defense Minister & our President). What that “Agreement” includes is not known. Could be to “Assist” our President to establish an “Authoritative” (Dictatorship) Government. Perhaps, the “Uninterrupted” spread of the pandemic could be made a “Tool” to step up that “Move”. “Rajapakses'” GREED for power sees no limits.

      You know well that China will not intervene in internal matters, even in the case of hostile states.
      There was a time when it did by way of party-to-party relations and support for struggles for liberation, without breach of sovereignty of a state. That waned with the end of formal colonial rule and the decline in militancy of communist parties.
      After Mao, China ceased even verbal support for struggles like that in East Timor. However, in fairness, there is consistency in policy.

    If most of that 6.9million are still with their ill-begotten master, then what can the rest of us do.

    Even at this heightened stage of lawlessness, is there enough mass and momentum of defenders of justice and righteousness to checkmate the double-Paksa regime? My sense is that the citizens are not near bubbling-over yet! No doubt there’s a lot of fear… Perhaps the worsening Covid-19 situation is also understandably stifling their drive. And the military backed double-Paksa regime is fully leveraging it.

    Harin Fernando said in the 18 minute speech that the head of the intelligence unit had prevented questioning of a key suspect saying he was part of “their” project (ie not to be involved in “official” inquiries) The intelligence chief who said this could be questioned and his statement analysed. So too can the Internet Protocol address (IP address) of the man referred to as Sonic-Sonic and the evidence gathered by Shani Abeysekera be made public. Perhaps if enough evidence is preserved without being tampered with, an international investigation could be launched to get at the real masterminds rather than a scapegoat chosen for the purpose.

    MP Harin Fernando is a Catholic and he has a right to express his concerns about the Easter Sunday Attack. As an MP and a concerned citizen, he has made some startling revelations in Parliament which I am sure are no secrets to the Members of the PCoI into the Easter Sunday Attack. For reasons not known to me, I understand the Catholic Church is also against Harin.
    I don’t understand why the CID wants to question Harin or his sister, who have nothing to do with terrorists. What he has to say he has already said in Parliament.
    If the CID wants to take action, they should first read a copy of the PCoI Report in full and hunt culprits not lawmakers.
    I understand those who were taken into custody under Gotabhaya regime were severely beaten in the prison (eg: Asela Sampath). I hope, when hearing Harin’s petition, the court will take into account the safety and security aspect as well.

    This is the time that individuals and institutions holding responsible positions need to step forward and speak up boldly. They should not draw back, abdicate their responsibilities, and merge quietly into the background even after such a calamitous situation has arisen.     It is sad CID is paid by public to serve for the Rajapaksas, not for the people of this country. Gota in an interview said that he know who murdered Lasantha. Still not a single CID arrest him under PTA or any other ordinary law. To day, it is for Harin’s sister, but tomorrow it may be your sister, day after tomorrow even the sister or wife of Mahinda Rajapaksa.Who knows?

    This is what thugs and bullies in power do. They target the families, just to intimidate the person they are against. If anyone needs to be investigated and grilled for war crimes, kidnappings, threats against the media, killing of journalists, abuse of powers, and corruption, you will find plenty of “suspects” in the Rajapaksa regime.

    This is how you prevent terrorist attacks. You have to question 20 people before catching 1 person. Harin is useless, but the real terrorists will be put on notice. They know not to mess with Nandasena as he will not leave any stone unturned to catch them.

    The Stupidest Minister we have in the Cabinet is Sarath, his CID too are proving to be a useless group. There have been so many drug raids, but this CID has never caught the major “king pin” behind them. Similarly there have been so many gold smugglings through the airport, the CID has not been able to catch them. So what can this CID do other than harassing and arresting civilians and politicians, including a guy who toots the horn?

    If the Stupid Minister and his CID are truly inclined to investigate the Easter Attack, all they have to do, in addition to what has been done to divert the truth, is to investigate the statements made by Harin and Manusha in the Parliament. Without doing it, this stupid minister and his CID are trying to harass and arrest Harin and harass his sister.

    If I had the power what I would have done is to appoint a high powered commission immediately and have a retired Judge, a retired senior police officer, Harin, Manusha and a representative of the Catholic Clergy to sit as members and conduct a public inquiry.

    The reaction of the “faggot” bandicoots in going after the women on Harin’s family as vengeance for what he said in parliament, makes impeccable logic in the magic land of Nandasena, who shan’t be crossed. Period.

    What intrigues me here, is that that hired gun nicknamed “Mr 32 million” is appearing for Harin. Despite my sense of nausea whenever I hear this bugger’s name for his total lack of scruples, I take this as a positive sign; an epiphany even.

    Has the penny finally dropped in on the gentleman in question, and is he turning against the blatant injustice that he has helped create? One lives in fervent hope.

    Harin Fernando is a fool and need not to be taken seriously. He eagerly believes that Rajapaksas are somehow involved in setting up an explosion at the chinese owned Shangrila hotel. Everyday is an april fool’s day for Harin.
