Civil Society Urges The President To Revoke Musali Gazette

2,680 Civil Society activists and 38 organisations have today urged Maithripala Sirisena to review and revoke the recent gazette declaring about 40, 000 hectares of Musali DS division land as Mavillu Forest.

President Sirisena

The gazette declares 40,030 hectares of land in Musali DS division in the Mannar District as Mavillu forest reserve under 3A of the Forest Conservation Ordinance. As a result of the gazette notification a number of villages in Musali including Karadikkuli, Marichchukatti, Wilaththikulam, Periyamurippu, Mavillu and Weppal will be seriously affected as families risk losing land they have traditionally claimed.

The statement while reiterating the need for a concerted effort to ensure protection of forests, highlights the contents of the gazette notification and the manner in which this gazette was drawn up failing to take into account the rights of people from the area and the history of the issue of land claims. The statement notes that unless corrective action is taken there could be serious repercussions for the Northern Muslims forcibly expelled by the LTTE in 1990 attempting to resettle and rebuild their lives after the brutal war, and have a knock on effect on post-war reconstruction and relations between ethnic minorities and the State. It also highlights a wider problem in the State’s failure to address occupation of land by state agencies including the military and the Forrest Department in the North and East and calls for action to recognize the rights and claims of multiple war-affected communities.

We publish below the statement in full:

We, the undersigned, appeal to His Excellency the President, Maithripala Sirisena to review and revoke the gazette notification no. 2011/34 declaring vast tracts of traditional lands owned by the people of Musali DS division in the Mannar District as Mavillu forest reserve under 3A of the Forest Conservation Ordinance. As a result of the gazette notification a number of villages in Musali including Karadikkuli, Marichchukatti, Wilaththikulam, Periyamurippu, Mavillu and Weppal will be seriously affected. We appeal on behalf of the people and their right to voice and justice.

We are of the understanding that this gazette was drawn up in response to deforestation and encroachment of the Wilpathu forest reserve. While there has to be a concerted effort to ensure protection of forests, the gazette notification and the manner in which this gazette was drawn up fails to take into account the rights and the history of the issue of land claims. Unless corrective action is taken we fear that there could be serious repercussions for those attempting to resettle and rebuild their lives after the brutal war, and have a knock on effect on post-war reconstruction and relations between ethnic minorities and the State.

The people of Musali (Muslims, Tamils and Sinhalese) have been living in this area for hundreds of years in some instances and decades in others, except for a 30-year absence when most were forced to flee, due to the war, including the Muslims, who were evicted by the LTTE in 1990. They are largely peasant farmers and dependent on a land based economy that includes paddy cultivation and cattle farming. Yet, the recently declared forest boundary denies them access to their residential, agricultural and cattle grazing lands located in the “declared forest area”. In addition to land owned and used by people, additional land that is required for natural growth of the population and livelihood will also be lost.

Under the gazette notification some 40,030 hectares are to be included into the expanded Mavillu Forest Reserve that will bifurcate the Musali division, disconnecting Musali South and Musali North communities, both Muslim and Tamil, that have been historically connected. It creates discrete enclaves of people, isolating them, restricting their mobility and limiting social interaction. The forest boundary goes along the borders of the houses of the people, fencing them in those enclaves and making the human-animal conflict a grave danger to the people, already under great stress. Communities in Musali have been struggling to build their lives, homes, livelihoods and communities but the limited assistance and resources have resulted in severe hardships and low rates of permanent return. Only about 40% of the Musali South displaced have returned, and the current declaration will place a severe stress on the return of the rest of the community and further deter the growth of the community in the region.

The plight of the displaced from and returnees to Musali is on a continuum with the plight of other displaced communities in the region. It is important to note that the competing claims between forest protection and resettlement is not unique to Wilpattu and its northern boundary. Across the North and East there are similar disputes including Karuvepakulam (Othiyamalai, Oddusudan DS, Mullaitivu), Kiran Komari and Vegamam (Pottuvil DS Ampara) and Mailattamadhu Mathavani (Koralaipatttu South Batticaloa) where returning communities find that land they used and claimed has been demarcated as protected areas for forests, sometimes even without the consultation of district level officials responsible for land administration.

The situation in Musali also highlights a larger problem relating to the State’s approach to addressing land issues in the conflict–affected areas. In the post-war context, a number of State agencies, particularly the Military, continue to occupy land that is owned or claimed by civilians. While the Government has released some lands in the North and East, multiple communities in the region cannot reclaim their land and are completely disenchanted by the Government’s approach to land release: from the largely Sinhalese families in Panama (Ampara) and Muslim families in Ashraf Nagar (Ampara) and Silavathurai (Musali) to Tamil communities across the North (not limited to Mullikulam in Musali), such as Telipallai in Jaffna and Kepappulavu in Mullaitivu. The continuing occupation and claiming of land by multiple State agencies fuels fears, particularly of minority communities, that the State is seeking to dispossess multiple communities of their lands.

The manner in which land issues have been dealt with also raises grave questions about the adherence of the Government to its own National Policy on Durable Solutions for Conflict Affected Persons which was approved by the Cabinet in June 2016. In Section VII.2 the policy clearly identifies the problem of state actors including the Forest and Wildlife Departments gazetting lands without consultations of district level actors and local communities and a process to review and to adopt a transparent and consultative process to resolve individual disputes. We call for the immediate implementation of a National Policy on Durable Solutions for Conflict Affected Persons.

While the problem of displacement appears to be largely resolved, the situation on the ground is that many who were displaced and have returned or are living elsewhere are yet to find durable solutions. We demand that the President look upon this as a historical need and address the concerns of the people of Musali without delay, and in a just manner, by revoking gazette notification 2011/34 of March 2017 immediately, fixing the Musali south boundaries as per the 1992 divisional secretariat mapping and demarcating the forest based on public consultation.

National Security comes first, security and perks of politicians come second, grandiose projects come third, national parks come fourth, collection of revenue and taxes come fifth and so many other things follow. But the people and the rights of the people come last.

RE: Civil Society Urges The President To Revoke Musali Gazette

The people know who you are. You do have earned a few honors and titles.

Apart from that, what about the white Elephant Mattala Elephant? Close that White elephant, save tax payers money, and let it go back to the jungle.

Why cannot you settle IDP,s who were chased out by LTTE by ethnic clensing and let them go back to their homes, as well, and modify the gazette to accommodate some villages?

Except Women’s action network and a few others, the rest are Muslim organisations, some not even with 10 members. So do not worry about this agitation by these who are backed by ISIS and Pakistan.

Fact is that the so called “security forces” that are the biggest timber thieves and sand miners in Sri Lanka. It is the corrupt elements in the Sri lanka Army and navy who are supposed to be “protecting” the national parks, which are actually destroying them, sometimes in collusion with corrupt local govt. officials, while the blame for this destruction is put on innocent civilians.

The army and navy has been doing military business in tree cutting and timber logging. This was the policy of Goon Gota and is continued even today.
Sirisena is a fool to think that Sri Lanka’s forest reserves are safe with security forces “protecting” them. The logging is continuing while area photos do not reveal that the high and intermediate tree canopy is gone because the tall timber trees have been cut down.

The President has proved that he is nothing more than a monkey with its foot perennially in its mouth.

As the head of State, shouldnt he have his wits about him to sign a gazette notification without examining facts first? He’s proved himself to be an imbecile when it comes to making decisions. A man of spontaneity where it isnt required. Dont think we are unaware of the farce of the bond-scam probe through PRECIFAC. How about you hurry up your investigations in that space?

And shame on you so-called “environmentalists”. Why dont you lot scream and shout against the settlement of Sinhalese southerners? Or is it just race and religion that drives you? Bigots.

As commendable as their motive may have been, the Organizers of this petition appear to have shot themselves in the foot.

To begin with, in the list of 38 organizations endorsing the statement, 3 names have been duplicated bringing the total number to 35. One then wonders whether the list of 2680 individuals too contain duplicate names.

Moreover, the list of organizations conveys two important items of information. Firstly, that there is hardly any support for this petition from non-Muslim organizations. Secondly, that leading Muslim organizations such as the ACJU, the National Shoora Council and the Muslim Council of Sri Lanka have not joined this endeavour. Aren’t these organizations interested in the welfare of the Ummah at Musali ?

However, the biggest faux pas, in my opinion, is the use of the words “We demand that the President …….” It smacks of a sense of arrogance on the part of the petitioners.

Bearing in mind the ultra-sensitive nature of the problem and the pressures on the President from multiple sources for a solution acceptable to all, would it not have been more pragmatic to state “We earnestly request the President ….. “. As things stand now, the usage of the selected words makes it almost impossible for the President to even consider reviewing the order lest he be accused by religious extremists and environmentalists and even his political rivals of caving in to the ‘unjust’ demands of a very small subset of a minority group.

    • 2
      3

Ekelbroom: It would be transparent of you to disclose which names are duplicated.

And pretending that there exist people or organisations who would protest in favour of Muslims is naive and simple-minded thinking from you. Not that I wouldnt expect it from someone like you.

And since when did sending a letter to the President become a faux pas. These things pale in comparison to the heat hes been getting from the GMOA, IUSF, trade unions, etc. Lets not set the bar that high, shall we?

These IDPs have been agitating quietly for the past few decades! What less can you expect than a letter of demand from someone who hasnt bothered to inquire into the issue?

Unjust?? It might be alright by you that they languish in camps for the rest of their lives, but it DOES matter to them. Go be stupid somewhere else.

        [Response to para 1]
        No.10 = No.37
        No.12 = No.34
        No.13 = No.36

        [Response to para 2]
If the cause of any group is perceived to be just, then any form of protest by that group must necessarily attract support from such like-minded persons or organizations. The absence of such external support suggests that either the Muslims decided to go it alone or that such strong support was not forthcoming.

        [Response to para 3]
If you read my comment dispassionately and give time for the words to sink in slowly to your dense brain, you may hopefully experience a ‘light-bulb’ moment. Nowhere have I claimed that sending a petition to the President is a faux pas. What I stated was that the biggest faux pas, in my opinion, is the use of the words “We demand that the President …….”

        “Go be stupid somewhere else”
Before you give someone advice, be sure that you would follow your own advice first. Bear in mind that simply because you possess the remarkable ability to read articles and comments in CT, you are not obliged to post a knee-jerk response to a comment.

It is new fashion in Sri lanka. Special interest groups want it their way. Once civil society group is INGO funded by the west. Another is funded by oil rich countries, mostly muslims.

I think rishad Bathiuddin wants to establish his dynasty by settling muslims here. He is using PEtroleum money to islamize Mannar and to establish political survival. they will bring Tamilnadu and PAkisthan muslims into this area.

      jimsofty,

What is wrong in civil society groups being funded by local government or other countries, if they call a spade a spade?

If the minister has a hand in influencing these groups, that should be publicized and handled appropriately. Why are we addicted to guessing things and come to conclusion?

      • 2
        4

How can you say that they are calling a spade a spade. Musali is a Tamil name and therefore it belongs to Tamils and not Muslims and should be returned back to Tamils, since Muslims say that they are not originally Tamils who were converted to Islam. If Muslims admit that they are converts, then they have right to claim that land.

“Musali is a Tamil name”? Then how come people can pronounce it?

Arabs are sweeping roads and washing toilets in western countries. All Arab countries are going to be bombed out, some by Americans and others by Russians. Very soon Arabs will be labourers and house maids to Sinhalese. So shut your mouth and worship the Sinhalese without trying to be funny. Sinhalese are monitoring the Muslim racists who make comments against them and will take action to teach them a lesson. Muslims are considered outcasts in western countries, and by your actions you are expediting it in Srilanka.

Ha..ha.. Yes I know for sure Sinhalese are better people than Tamils :)
That is why they still tolerate Tamils, and talk about settlements.

Tamils got to learn a lot from Sinhalese.

Fake Arab, Tamil Dravidian convert to Islam Hisrathaya Islamic fanatic . Musali is a pue Tamil word. When did place names in the island were in Arabic an alien language to the island. Now low caste Tamil Dravidian converts to Islam, are trying to be Arab slaves and rename ancient Tamil names in the north east and along the north west coast to Arabic or Arabise them to claim an Islamic homeland
Musali The screw-pine (Thaazhai in common Tamil, Pandanus odoratissimus); varieties of lizards (Old Tamil lexicons Pingkalam and Choodaama’ni); Crocodile (Tamil dictionaries, another form of Muthalai); Mugali: Screw-pine (Malayalam and Telugu); Mukai (pronounced as Muhai): Bud of a flower (Changkam Diction, lexicons and literary Tamil); Muhaya: Flower of plantain, shaped like a big bud (Sinhala); Muhu-ku’lu: pedicle (stalk like structure) of a flower (Sinhala

Musali is an old Tamil word for the screw pine, which grows in abundance along seacoasts and banks of rivers.
If Muslims in Sri Lanka do not want to admit that they are descended fromDravidian Tamil Hindus who converted to Islam and keep on insisting that they are descended from Arabs/Moors, that everyone knows is a lie, they have no claim to the Tamil lands in the north and east. Go and claim your homeland in the Arabian gulf or in Morocco. As you are Arabs/Moors and not Tamils. You cannot have your cake and eat. Tamil then entitled to land in the north and east. Moor or Arab go to Saudi Arabia Iraq or Syria and good riddance

              Real Siva Sankaran Sarma,

Ha..ha..ha.. you started once again with your imaginative funny theory “Tamil Dravidian convert to Islam”? Ok, leave it there.

Did I insult your language? Sorry then. Please hold your anger and see below samples:

              Kankesanturai
              Aadiyapatham
              Needungkulam
              Pudukudiyiruppu
              Echchamaddi

Above are the few area names. For Shiva’s sake, tell me if non-native Tamil speaker can pronounce them?

Imagine, had you guys won the war and got your ‘peelam’ dream come true, how many non-native innocent people would have to under go reshaping, , trimming, cutting and stitching their tongues to do regular business with your ‘peelam’ or even visit there on a vac? :-)

Thank ‘shiva’ it didn’t happen. :-(

Perhaps, this might be a reason UNHRC is not so interested in expediting your cases, since they have issues twisting their tongues when they see your files?

Perhaps, this might be a reason why Tamil (being the oldest language) in its birth place, India, doesn’t seem to grow an extra inch away from Tamil Nadu while native Hindi speakers make fun of it?

This ungrateful language has done so much of damages to a foreign land, Sri Lanka that recognized it and gave official status, while its birth place India doesn’t seem to recognize it more than just another state level language.

So brother, instead of preaching and boasting me about your language, why not go to India and make some impact on a national level to show your respect to this language?

BTW, you get angry with me for insulting your language, then think how generous English people should be to give you asylum seeing the fact that you guys torture and kill their language with every single English word out of your mouth and the way you pronounce it like Tamiglish?

Yeniding whrongu, yexcuse me pa.. :-)

The Muslims should seek the support of fair-minded Tamil and Sinhalese groups in such matters.
There are people if you look around.
It will make a difference to the cause.

If you are a non native Tamil speaker and hate Tamils why do you want Tamil lands? Mad creature. Go and look at your face you deluded immigrant Dravidian low caste Hindu convert to Islam. I no brother of any Tamil hating Islamic extremist who has some delusions that just because he is Muslim he automatically becomes part of the Arab culture. Go and tell the Arabs that and they will laugh. Even they had classified the Sri Lankan Muslims as South Asian converts to Islam. In the cast of the Sri Lankan Muslims low caste Tamil Hindus who converted to Islam. They are not descended from Punjabi, Gujarathi or any other Indian ethnic group. Even the Gujarathi origin Borah and Memon communities in Sri Lanka treat you like dirt and will not allow you to come near their mosques. In Australia there is no common mosque for all the Muslims. Separate Mosque for Arabs( Lebanese,) Turks, European Bosnian and Albanian Muslims. Iraqi Arabs have their own mosques. Somali theirs and South Asian Muslims( Indian, Pakistani Bangladeshi and Sri Lankan Muslims theirs) You can see how ethnically culturally and racially they are divided.
You are trying to make a religion an ethnicity just because 98% of the Muslims in Sri Lanka are descended from immigrant Indian Tamils who still speak Tamil and follow their a certain form of Islam, it is easy to do this. If the Muslims is Sri Lanka belonged to different ethnicities and spoke different languages it would not happened like in the case of Iraq, Pakistan, Malaysia, Indonesia. where Islam or being a Muslim is a religion. Even the small number of Sri Lankan Malays, Borah and Memon who do not speak Tamil and are not of Tamil origin, do not identify with this artificial Muslim ethnic identity conveniently called Moor, but correctly identify themselves by their language and ethnicity.

        isharath:

what you call spade and what we call spade are two different things. You people still can not explain how there are IDPS for 27 years. Even if a new born infant were born there by now, he/she is 27 years old. We have discussed it amply.

You claimed Sinhalese were evicted from Jaffna (even before Muslim) and they were living as IDPs and should be resettled in Jaffna. So if Sinhalese can be IDPs for longer than 27 years , why can’t the Muslims be IDPs for shorter period ?
Your level of intelligence not any better than an average uneducated monk, who is sent away to temple at a young age due to poverty. Techinically it makes the monks Dalits

    Hon. President Sirisena,

You made a very good decision to declare 40,000 hectares in the Musali DS as state Forests. After all, if a countries’ leader and it’s people do not safeguard their national forests, who will.

Do not bow to the pressure of these bogus organizations in the name of women. There are no women in these bogus organizations, only men. Even if there were, he or she would be covered in a gunny bag and you wouldn’t know whether it is a man or a woman.

Do not allow any individual to cut down the forest and make it look like a Saudi Arabia. That’s exactly what these nefarious groups want. They not only want these precious lands become inhabited by their people but also make the landscape resemble their sand caves.

      That is true.

I can not believe muslims women are this free.

Probably, the husband is heading the association. All the wives are members.

It’s your people who raise their backs during Friday prayers. That’s you offering your rear-end to Allah.

It’s your people who don’t engage women in many activities, that is your tendency to be with Men and thus your Gay heritage.

It’s your people who kiss other men on their face. That’s you just trying to get back to your homosexual roots. Not surprising given that Allah himself was a Homo.

It’s your religion that approves sodomy.

You started by insulting other religions and now you got it back. You are worried about a Gay monk when your people are Homosexuals of the highest order.

There are signs all over Daladamagawa, which says ‘don’t show your back’ when taking photos. This is because monks will start indulge on your back when you show the back.

Ps- what’s the nonsense with Chinese made plastic tooth. I heard monks use that as dildos

It’s your people having homosexual roots and homosexual breeders. We can’t blame the monk. They have to follow celibacy. So when the young boys ordained reach 10-12 years and when they are near older monks, these monks get sexually aroused and boys were abused. After all they are human beings and to stop that their penis had to be cut off. Breeding of homosexuals had taken root in Sri Lanka. Muslim countries cut off the head if caught in such act. I know many army personals as soon as they join, the superior officers have sex with them. I think this Rtd. Lt. Reginald Shamal Perera too was a victim so he get satisfaction by calling others homosexuals. Read below about the SL army disgraced themselves because of their homosexual roots.

“In November 2007, 114 members of the 950 member Sri Lankan Army peacekeeping mission in Haiti were accused of sexual misconduct and abuse. 108 members, including 3 officers of the 950-member-strong Sri Lanka peacekeeping contingent was sent back after being implicated in alleged misconduct and sexual abuse. The details of the sex ring were part of a larger AP investigation of U.N. missions. Officials in Haiti have said that UN peacekeeping soldiers from Sri Lanka who had been accused of sex crimes in 2007 had even raped children as young as 7 years old. One boy said he slept with as many as 100 soldiers, averaging about four per day. The UN released a report slapping the Sri Lankan contingent with accusations of building a brothel in Martissant, Port-au-Prince charging them with systematic sexual exploitation and sexual abuse of minors, prostitution and rape. “In exchange for sex, the children received small amounts of money, food, and sometimes mobile phones,” reported the OIOS, the UN’s investigative arm.

Arabs are the biggest homosexuals in the world. They are also well known to commit bestiality with camels and goats.

What do you know about Islamic prayers. The position taken while praying, with backs pointed up, is to ask Allah to do the needful.

Rtd Lt. S Perera, it’s is very unfortunate people like you are against the citizen of this country to live in their own place. All evidence confirm that the land belonged to them and the documents issued by the State confirm to that effect, you and like minded people are depriving a section of people of this country by refusing to settle in their own people. Is it not inhuman and against all accepted norms and standard, simply because they are Muslims. Be open minded and generous. Work for peace and harmony not against the peace. They are very innocent people, depending on day to day to income.

Visit them and know the situation, if you have tears, prepare to shed them.

        A.W Abulkany,

These lands cannot belong to them. It’s just impossible. The Northwest was inhabited by mainly Veddhas while surrounding areas were inhabited by Sinhalese, Tamils and Muslims.

Let me be more specific, Mahavilachchiya, Saliyawewa and Rajanganaya were mainly Sinhalese ares while Silavathurai and North of it were Tamil Majority areas. The Muslim settlements started only South of Kalpitiya. The Musali area was just North of Silavathurai if I am not mistaken. Mostly Veddha and Tamil areas. There never were Muslims there.

Just because there is a Masjid Kovil there doesn’t mean the Muslims own it. Just because there are 5 Buddhist temples in the Toronto area, Sinhalese Buddhists aren’t making land claims to Toronto.

And don’t ask me to shed tears. I am a Veteran of the Armed forces of Sri Lanka. Even if I am skinned alive, I will bear it and face it like a soldier.

Since you are a war veteran, you understand the ulterior motive of Muslims. Musali has been earmarked as the future pad for landing of Pakistan trained Islamic terrorists as it is surrounded by jungles and not easily detectable. This is the reason Muslims are adamant about this area, being instigated by Pakistani agency. It was tipped off to President who promptly banned any Muslim settlement. For the future safety of Srilanka a tap on all the above organisations must be made as they are false front for Islamic terror groups. This land belongs to Sinhalese who have safeguarded it and developed it for so many years and it should not fall into the hands of Muslims. Keep up your good work in countering false propaganda of Islamic racists.

            Al-faqurlah,

You little tea-boy, your hatred towards Muslims makes you a tea-boy for every other guy :)

Isn’t it shaming all the Tamils when this low life pretend as a Sinhalese,
and act as a tea boy? Lack of education..

This land belongs to the animals and not to Islamic extremist making false claims in this histoirc Tamil majority area, using a broken down mosque as an excuse or two Sinhalese racists.
As for that stupid fake Arab Isharath. Even your name is fake it is Ishrat and not Isharath in Arabic.
Ishrat means happiness, joy , pleasant talk. Everything about you is fake. You hate Tamils and constantly run down Tamil, despite being descended from Indian Tamil low caste converts. May be and your community hate your actual lowly origins, that is why want hate Tamils and badly want to be Arab.
If you hate Tamils and find the Tamil language ugly why do you want Tamil Musali. Shouldn’t you Arab/Pakistani worshiping Sri Lankan Muslims claim some land in Saudi or Pakistan. If Tamils are not good their land is also not good.

There were many disagreements with the Presidents decisions. However, this decision is right. SL needs more forest cover to produce more oxygen and fauna and flora. This has nothing to do with religion or language, but with the need for minimum natural resources.

Nobody open their mouths, when the children of the previous leaders destroyed the forests, built hotels and recreation facilities. Why now, most of you prefer animals, tress and plants, NOT HUMAN BEINGS. Most of you are living in luxurious lives in the cities and towns, never bothered about the people who live in remote areas without proper resources, like water and infra structure facilities. Sitting in your arm-chair,do not allow your pen to scribble non-sense, DO NOT PLAY WITH THE LIVES OF THE PEOPLE.

Not just Muslims, in SL every community has the right to occupy FOREST RESERVATIONS, you know what I mean.

Remember, we are the people who pioneered in destroying water-holes and animal feeding areas to proudly build our 2nd international airport with a wrong runway orientation that was so unique in the world with the record, ‘World’s emptiest airport’

What Civil Society- The 38 organisations listed were created to fight the gazette. Musali will enter the Guinness record book as the world’s highest per capita NGO location.
We challenge the author to present the date of incorporation and the number of members of these 38 fake NGOs
As to the issue, Rishard Bathiyutheen with the help of Basil Rajapakse distributed these Wilpattu reserve land to their political supporters.
There was no official policy or process to distribute these lands.
The Gazette recovered the illegal distribution
    The GAZETTE should stay
