‘Commission On Missing Persons’ Suggest Denial Of Truth On Part Of Those Who Appointed It: Bishop Rayappu

Bishop of Mannar, Rev. Rayappu Joseph has declined the invitation to make a submission before the Commission on Missing Persons that recently held sittings in Mannar, citing his lack of faith in domestic mechanisms to resolve serious injustices that Tamil people have faced over the years.

In a letter to the Commission that held sittings in Mannar between August 8 -11, the Bishop has stated that he decided not to make any representation as he has grown weary of domestic mechanisms in resolving serious injustices that Tamil people have faced over the period of war, prior to it and after its end.

He has pointed out that although several other similar Commissions were set up, there has not been even a shred of evidence to indicate that they have succeed in tackling impunity and have only served as eye-washers for governments in power.

Bishop Joseph has recalled the personal appearance he made before the LLRC where he gave evidence although he was well aware for many years that the problem in Sri Lanka is ‘one of lack of political will’ as stated by UN Human Rights Chief Navi Pillay.

He has gone on to state that although he presented 14 grievances before the LLRC, the government has not acted seriously on any of the issues that Tamil people highlighted during the evidence giving. The Bishop has also noted that although initially two meetings were held with regard to the grievances he highlighted with External Affairs Minister Professor G. L. Pieris and President’s Secretary Lalith Weeratunga, both discussions failed even to have a look at any of the facts he highlighted despite his repeated insistence.

Moreover, although a third meeting had been promised, two years have passed without the promise being realised.

Furthermore in the letter, he has criticised the Commission itself, pointing out the name suggests a denial on the part of those who appointed the Commission on the fact that the issue is one in relation to enforced disappearances and not merely about ‘missing persons’.

“People have voiced grievances but that is not because they believe your Commission will help locate their loved ones but because they have nothing to lose in doing so,” Rev. Joseph has informed the Commission on Missing Persons.

He has further criticised the manner in which the sittings have been conducted where the aggrieved families’ economic wellbeing had been inquired of rather than engaging in a serious effort at locating the disappeared as well as the program that is being carried out by the government concurrent to the sittings where families of the disappeared are encouraged to obtain death certificates.

Moreover, the Bishop has described the expansion of the Commission of mandate by the President recently as a ‘deliberate attempt to undermine the work of the UN OHCHR inquiry into Sri Lanka’.

“Without serious commitment to truth there can never be reconciliation and peace will ever remain a mirage,” he has written furthermore in his letter where he has explained the decision to refrain from making a representation.

      Should we not be a little bit more respectful to his grace.

      His beloved LTTE has been responsible for 80% or more of the ‘disappearances’ so far reported to the Commission. He obviously can’t make much of an impact in the face of such glaring evidence as presented by Tamil civilians. Neither must we forget those ‘disappeared’ who enjoy Australian hospitality at Nauru.

        Eleven of the 21 Sinhalese Sri Lankan asylum seekers at Curtin detention centre have begun a hunger strike.

        The hunger strike was launched in protest of the long delays in the processing of the refugee claims. Thirteen out of the twenty one Sinhalese at the Curtin detention centre have reportedly been in the center for over two years.

        Ian Rintoul a spokesperson for the Refugee Action Coalition said “The shocking bureaucratic delays in processing are one of the lesser known injustices of mandatory detention.”

        The authorities have failed to provide an explanation as to why the process has taken such a long time and the delay in taking proper measures to ensure the safety of asylum seekers who have been recognized as refugees.

        The Secretary of the Immigration Department of Australia, Martin Bowles while testifying at the Human Rights Commission inquiry has admitted that the link between prolonged detention and mental illness was an issue.

        The Refugee Action Coalition has called a protest at the Sydney Immigration Department offices to highlight the apprehension of the 157 asylum seekers taken to Nauru.

      Hello Shankaaram,

      I agree with you that his testimony is not important. He is responsible for under estimated death count in North. Before even Royal Government hire the London defense Lawyer to guide the MPCS commission, Rev. Dr. Rayappu estimated it as 147,000. That is too early to judge anything with any certainty and his estimate is absolutely wrong.

      90,000 Widows are in the North by this war. According to Sinhala Buddhist Army they killed(or shot) only zero persons. That means almost all them lost their partners to bombs. Bombs does not prejudice. That says another 90,000 widowers are there. Children are the most vulnerable on these war. You have to double them. That means The count is about 400,000 death or missing. If, say for every family there has to be one single person, then the count will be easily 500,000. This is only for the ones laving representatives behind to count. The families fully wiped out must be equal to this. I think the TNA’s very first suggestion of one million missing is right. 2001 Lanka counted only 4 % of Tamils. In 2011 it suddenly increased the count to 11%. These all are fraud. This false 11% is to hide the actual missing Tamils.

      Like you, I too think Rev.Dr. Rayappu should not go to this MPCS commission. It look like that defense lawyer’s idea to call the Bishop there and use his numbers to purposefully underestimate the death or missing count.

      Lord Buddha was a great preacher of equality whose teachings displace all social barriers of race, language, class and religion. He treated all alike and found for them a way of release from suffering. It is unfortunate that Buddha Sasana failed to show any concern for the murdered innocent Tamils (who surrendered holding white flags) by inhuman political leaders in Sri Lanka something similar to the massacre of Zoroastrians in Iran by the Muslim invaders. One ponders whether it is the impact of democracy or theocracy?

        In the circumstances , at least from now on ,the people of the country should use their sane and sensible thinking power to understand , the President who is indulging in his favorite histrionics on every public platform saying , he is prepared to face even the electric chair punishment on behalf of the forces ; and together with his defense secretary Gotabaya Rajapakse are jointly scheming most craftily and plotting most secretly to betray the forces ,’ Mangala Samaraweera pinpointed.

    We bow to Your Grace for your fearless public statement you have no faith in internal investigations seeking details of the deaths of a very large number of Tamil civilians in the North and the East. The regime’s record so-called “investigations” on the Trinco Five and the French Aid workers massacres is now in the hands of the UNO.
    The world will surely not only understand you fully but also sympathise with you for your bold stand. What can the otherwise “military regime” of the Rajapakses do to you? The most they can is to abduct you and kill you – blaming others. Clearly, men of God such as yourself do not fear death.

        Thank you, dear Anpu. I saw the Tamilnet version and others in Tamil as well. Whereas the Sinhala media has distorted the image of the Bishop, I know he is truly a man of God. Though I am a
        practising Hindu, I respect and admire the many Christian and Catholic men of the Cloth who stood by the Tamil people against much violence, intimidation and harassment by army men. We know many of them were killed in the service of their people. They will always be honoured.

    The Bishop made the right decision, and the rationale he provides is very sound. Any participation in such commissions, in the face of the known history of murderous duplicity of the Rajapaksa regime, will simply legitimize a farce.

    Whether the Bishop was insufficiently critical of the LTTE before the end of the war is a separate issue. There may be room for criticism there. But the Bishop’s decision and the arguments he makes in this instance are perfect.

    The latest is that the moron has added one more “expert ” from Japan. We all know where the report will end up.
    The truth is thereid no “will” on the part of the Govt to find out anything about the missing or disappeared persons..

      ranking Bishop of the Catholic church , who always worked for down trodden people of Mannar and they treat him like their God for the services rendered. It is bad etiquette of a BBS Priest to have called Bishop Rayappu, a traitor. without knowing the actual meaning of the word “traitor”. What the Bishop said about the inquiries & commissions are dead right, as sixty years have passed and what kind of reconciliation these commissions & inquiries brought to the Country, except,only communal riots & destructions.

      Govt. must intervene in such cases and take remedial actions against
      those who make hate speeches and maintain religious tolerance among
      the people with different religious beliefs.

          Galle, Sri Lanka: The 41 Sri Lankan asylum seekers transferred by Australian authorities to Sri Lanka have arrived at the Galle Magistrates Court for an appearance before a local magistrate.
          The 37 Sinhalese and four Tamils, including some women and children, are expected to be bailed shortly on charges of leaving the country illegally, a breach of Sri Lanka’s Immigrants and Emigrants Act.

          “Everyone will be bailed,” a Naval officer who accompanied the asylum seekers to the court house said, as their bags and belongings were unloaded from a bus.
          One of the asylum seekers, Anthony Fernando, 38, told Fairfax Media that he had had been “mistreated” by Australian authorities and given food that was past its expiry date.
          “I went [to] Australia to find employment and then settle and bring my wife and family.

          “We were ill treated mid sea by Australian authorities. They did not give food that had not gone off,” Mr Fernando said.
          Another man, Punchi Banda Podinilame, said he had one son, two sons-in-law and seven other relatives on the boat.
          He said they had all gone to Australia to find employment.
          Executive director of the Centre for Policy Alternatives Pakiasothy Saravanamuttu condemned Australia’s treatment of the refugees as “sad and depressing”.
          “That a liberal democracy such as Australia can treat people in this way, failing to meet their international obligations, failing to uphold the principles that it proclaims are at its foundations, is quite outrageous.”
          Dr Saravanamuttu said Australia had to rid itself of its “single obsession with immigration” and look at other more humane ways to deal with people who were fleeing their home countries on the basis of fears for their personal safety.
          “There are ways to do this that are both humane and cost effective and I would urge the Australia government to consider these other approaches when it comes to dealing with refugees,” Dr Saravanamuttu said.

          He said the current situation – of would-be asylum seekers being transferred at sea and sent back to their home country with such “unseemly haste” – was unprecedented in Sri Lanka.

    The appointment of an investigation panel by the Govt itself indicates the extent of it’s sincerity.. hik…hik..hik…even this panel is full of deception…the objective is to contradict the outcome of the UN investigations and create confusion in the Country…if not for the UN investigations the Govt would have carried on regardless….It is a very wise decision of the Bishop to not to participate….Excellent letter that is sufficient to understand the position of the Country….

    Of course Eelaam Catholic Bishop Rev Raiappu has to boycott it.

    Besides the confessions of the ex alter boy Velupillai Prabakaran , The Rev Bishop was privy to how many Dalit children from his Diocese were taken away to be Child Soldiers,

    How many Dalit young men and women forced to become Black Tigers and Suicide Cadres,

    And How many young Dalit girls who were forced to became martyrs by tying TNT around their bellies .

    In addition ,the Rev leased the Holy premises of our Lady of Madu for LTTE’s Heavy Artillery.

    And evidently the Rev took away the Holy Statute for protection by the LTTE Security Services too. ..

    Last but not least Rev Raiappu prevented any Sinhala Catholics from our Bible Belt paying respects to their Holy Lady of Madu for three decades.

    In light of these can the Bishop front up to an Investigation by an impartial panel who wants only nothing but the truth?.

      How can you say Rev Rayappu prevented Sinhalese from arriving at the Madhu Church, when the permission to enter and leave the Vanni was on a permit system controlled by the Sri Lanka MOD where even a Panadol was a banned item from reaching the north.

    Really any sensible person including singhalese or even MR have any faith on any of these internal commissions/investigation put forward by any srilankan government.MR is very much scared of his life now, he did not realise when killing so many tamils, that will affect him because he belived blindly Mahavansa (killing tamils ok).     The President of the present Commission has already shown his bias by stating that those who appeared before him are not telling the truth.He is also referring to about 147000 persons missing from Mannar District. I think he is talking about Bishop of Mannar’s contention that around 147600 missing and or killed in Vanni based on the statistics of the Govt. Agents of Vanniand the statistics of the Govt. and UNHCR/ ICRC as to how many entered the govt. controlled area from Vanni in 2009.. Whatever it may be he should not express his opinions before the hearing is concluded.

    The fact that only few people are coming before him shows that only the brave are doing it without any witness protection law. This govt. is also afraid to pass a law on ‘Right to information’. Nor are they ready to sign the ‘Rome Statute’ or include ‘Right to life’ in the country’s Constitution. Further it shows that the people have lost their trust on any Commission appointed by the Govt. (Prime Ministers OR Presidents). In our country appointing Committees or commissionsis to buy time or to bury the facts forever without taking any action on the recommendations made while the reports gather dust. Many committees to find a solution to our National conflict(Mangala Munasinghe,Prof.Witharana etc.etc) and the current APC have to be viewed in the same way
    At least 11 such commissions have been appointed according to Law and Society Trust Publication of 2010 titled, ‘ A Legacy to Remember , Sri Lanka’s Commissions of Inquiry from 1963 to 2002. Out of them at least 6 are on ‘Involuntary Removals and disappearances’. I have seen elsewhere about 17 such Commissions of Inquiry being mentioned. It may be upto now. One of them may be the Commission on ‘Grave Crimes including the Trinco 5 and Mutur 17 murders.One of theUniversity Teachers for Human Rights – UTHR(J)- special report, whose earlier Reports against ltte the Govt. and INGOs relied upon heavily has put the blame squarely on STF. The man they pointed out as the mastermind behind it, a former STF officer has been promoted as a DIG.So how do you expect people to have any confidence on these commissions.
