Sri Lanka is a country with a rich heritage, a diverse community that is multi-racial, multicultural, multi-ethnic, and multi-religious. This multifariousness is what makes the county alluring. Due to these nuances, a country always become vulnerable to violence, as there are conflicting ideologies. The one single fact that holds these unique strings together is being a
‘Sri Lankan’. It is important to foster togetherness as a nation irrespective of differences to reign sovereignty and respect the human rights of all citizens.
Liberation Tigers of Tamil Eelam (LTTE)
LTTE is “widely recognized to be one of the most proficient and dangerous guerrilla/terrorist groups in the world. This reputation is owed to the extremely sophisticated international network that has been built by the organization to sustain its 26 year-long struggle for the creation of an independent state of Tamil Eelam”1
The rise of the LTTE, the terrorist group is not an overnight success. The fundamental cause that gave rise to the war is, LTTE the separatist Tamil insurgents demanded a separate land in a sovereign nation, which eventually threatened harmony and democracy. The approach of LTTE was tenacious. It was a sophisticated, well-formed, facilitated and financially stable insurgent group led by Vellupillai Prabhakaran. It had a separate administrative centre, police, military, courts, banks, schools. They were able to seek assistance from powerful nations as per their whims and fancies.
The stratagem of LTTE is strictly in breach of human rights law and International Humanitarian Law. Moreover, they assassinated prominent world leaders, civil servants, parliamentarians, journalists, military officers, police officers and the public as a whole. Additionally, they attacked nonmilitary targets such as Central Bank, Bandaranaike International Air Port Colombo, religious places including Temple of Tooth Relic, Jaya Sri Maha Bodhiya. Moreover, LTTE closed the gates of the Mavil Aru reservoir and cut the water supply to villages by preventing access to water. Furthermore, they used human shields, detained civilians, used suicide bombers and conscripted child soldiers. Additionally, they promoted extremism, radicalized and brainwashed people to the extent of “willingness to swallow the cyanide pill by the LTTE [is] seen as commitment to the Tamil cause”2 . Moreover, they posed nontraditional security threats such as drug smuggling.
International response
As a result, the notorious, well-established LTTE terrorist group was proscribed by many countries including Sri Lanka, the United Kingdom, Canada, India, United States, European Union and Malaysia. Looking at the above atrocities committed by LTTE it is evident that several International humanitarian customary laws have been breached. Such as the principle of distinction where they were unable to distinguish military and nonmilitary targets3. Harming specifically protected persons and objects, use of weapons and violating laws on the treatment of civilians and persons hors de combat.
Peace initiatives
The Government of Sri Lanka (GOSL) attempted to negotiate with LTTE and mediate the matter. “Indeed, the LTTE entered negotiations five times,…In mid-2006, sensing victory was in its grasp, the LTTE deliberately ended the Norwegian-brokered ceasefire…In response, the Sri Lankan government finally decided to change its strategic objective, from negotiating with the LTTE to annihilating it.”4. Sri Lanka’s former foreign secretary, Palitha Kohona stated that LTTE “used the cease-fire agreement to regroup, rearm .forces”.5 GOSL successfully defeated the LTTE by conducting a humanitarian mission.
Law relating to the crime of Genocide
Sri Lanka is a party to the 1948 Geneva Convention on the Prevention and Punishment of the Crime of Genocide (GC).
When perusing the legal provisions, it is crystalline that the humanitarian mission against the LTTE is justifiable. Sri Lanka abided by the International Humanitarian Law (IHL) and human rights law. On the other hand, LTTE contravened human rights. GOSL had to undergo a humanitarian mission to harbor the rights of all citizens the Sinhalese, Tamils, Muslims and Burghers. GOSL did not conscript child soldiers, they never used human shields. The military personnel were recruited voluntarily as per the standards of international humanitarian law.
Therefore, the false allegations imposed on Sri Lanka needs to be imminently countered.
International law concepts
As per the United Nations Charter, there is a plethora of concepts such as territorial sovereignty, the principle of nonintervention and responsibility to protect which can be used to oppose the claim of genocide.
As per Article 1 of the UN, charter. The Purposes of the United Nations are, “To maintain international peace and security. To take effective collective measures for the prevention and removal of threats to the peace, and for the suppression of acts of aggression or other breaches of the peace, and to bring about by peaceful means, and in conformity with the principles of justice and international law, adjustment or settlement of international disputes or situations which might lead to a breach of the peace”. This exhibits the ability of a state to defend its rights to maintain peace.
Section 2(1) of the UN charter states that the Organization is based on the principle of the sovereign equality of all its Members. Art. 2 (4) states Prohibition of threat or use of force in international relations. Article 2 (7) states, “UN has no authority to intervene in matters which are within the domestic jurisdiction of any state, while this principle shall not prejudice the application of enforcement measures under Chapter VII of the Charter”. Therefore, it is perspicuous that steps taken by the GOSL conform to the standards, which are duly mentioned.
The gravity of the issue is, LTTE is now rising in foreign countries, and they have taken a more intellectual approach by trying to convince world leaders, dispersing hate speech and false news, using youth to promote terrorism. Moreover, they are attempting to delist it from the proscribed terror organization.
As discussed extensively, it is explicit that the GOSL has conducted a humanitarian mission in the interest of citizens. Moreover, the government has taken an array of steps to nurture national harmony aftermath of the war.
Formulating a way forward
Diplomatic relations play a vital role. To survive in the modern diverse world, it is important to rely on co-existence. Therefore, fostering international cooperation will enhance friendly relations and will affirm nonintervention.
It is important to prevent the dissemination of false information.
It is essential to prevent hate speech without breaching the right to privacy. Three forces, police as well as the intelligence unit must be attentive. It is important to investigate and monitor social media, printed media to prevent acts that would create ethnic tension. Members of the parliament, provincial council and local council members should not make politically driven hate speech, which would give rise to disputes.
The legal framework must prevent hate speech. Any statement of hatred, prejudice that creates controversy, ethnic tension needs to be penalized,
It is important to establish an inter-agency platform that is well coordinated. Sri Lanka Army, Sri Lanka Navy, Sri Lanka Air Force, Sri Lanka Police and the National Intelligence Bureau need to act together.
Public participation is important. If the public comes with material, secret information relating to terrorism such as attempt to rebel, attack, the messengers’ anonymity needs to be preserved.
GOSL has already done a satisfactory job by establishing a missing person’s office, office of reparations, ensuring victim and witness protection. Sri Lanka has ratified important legal instruments such as the International Convention for The Protection of All Persons from Enforced Disappearance Act, No. 5 of 2018. Additionally, Office for Reparations Act, No. 34
Of 2018 and Assistance to and Protection of Victims of Crime and Witnesses Act, No. 4 of 2015.
National education policy must be capable of shaping a balanced individual who respects all cultures, ethnic groups and capable of speaking all three languages. GOSL is in the process of making the Sinhala language for Tamil students and Tami language for Sinhalese students compulsory.
Finally yet importantly, it is important to foster togetherness. Establishing an inter-faith dialogue mechanism would promote inter-communal relations. Sri Lanka has already taken measures to its best capacity such as singing the national anthem from all three languages.
The Government can take the aforementioned steps to consideration in the best interest of the people.

This article lacks depth and facts. For example the author intentionally hides the root causes for the formation of Tamil militancy. There was no LTTE when Tamils were slaughtered in 1956, 1971 and 1978. There were only a dozen of LTTE cadres when the mobs torched the Jaffna library in 1981 and butchered Tamils in 1983. The author also whitewashes all the crimes against humanity that were (allegedly) committed by SL forces in the name of fighting terrorism (massacres, bombing and shelling, rapes etc). It is hard to fight the truth and other allegations in the international arena with these type of analysts and policy makers who have no idea of the island’s history, triggers for war, the actual war and the consequences. Premawathi Manamperi was a girl from Kataragama who was crowned as the beauty queen in 1970. She was arrested by police on suspicion of leading a JVP group in 1971. Later, she was handed over to the army, where she was beaten, tortured, raped and murdered in 1971.
That was in 1971, so in the 21st century, the Sri Lankan forces had greatly improved their technique.

Mahindapala, IPKF left at end of March 1990, while above incident took place on 17.05.1997. Koneswari Murugupilai, mother of three children from Amparai Central Camp Colony 11, was killed after sexual assault by 10 policemen of STF, by blasting a grenade planted in her vagina.
Here are other examples of Tamil women killed after sexual assault:

Another interesting area for Charani Patabendige to do research is ‘People who got rich on the backs of poor Dalits who served as LTTE cadres’. Although Vellala Tamil politicians passed the Batakotte Resolution to create a separate State and declared war against Sinhala Nation, it was Dalits who fought the war as foot soldiers and suicide bombers. Sons and daughters of those who declared war had a good life in Colombo 7 or in foreign countries.

So, when Aanduwa published the list, which it had with it from putting in the truck as DNA results, it was not aware that Pulasthini’s meat pieces (body parts) were not in the sample sent to DNA test. Aanduwa ordered to retest the samples, explored the bombed site repeatedly, but no avail. The driver selected was confirmed that he cannot speak Tamil so he would have no communicate with the passengers. Further neither he nor the passengers were aware where they really were going. But as he was a driver who is street smart and knows the lanes, reached the destination. New King played a role in selecting the Sinhala driver, so he gave the driver a 10laks reward from government funds with false explanations, but mainly to keep him silent. Anybody (the women & children) went with him (the street-smart driver) reached the destination, until another night Rapist Army bombed that house, totally. Pulasthini vanished without a trace in the hands of Rapist Army. Aanduwa blamed India used her as their mole- agents in attack and had retrieved her to India. It is a terrifying thought to imagine when the poor girl was suffering alone in the hands of Rapist Army until she died and her body was made to vanish.

Then again Pulasthini, too, used in the Terrorist Aanduwa organized ISIS attack. Pulasthini from an extremely poor family and her mother (a suspect-able character) went to ME, leaving her teen age girl with some Muslim groups. But the girls were extremely smart; even within her so dire situation, got excellent results in A/L and wanted start medicine. But the Muslim group managing her forced her marry a Muslim man which she did not like by the statements mother made to police. It is not sure what was part of Aanduwa in this forced marriage. It sounds like Aanduwa used this method to paint a picture that the Tamil girls are not interested in developments because their natural terrorist nature. Pulasthini asked her mother to come and rescue her, but mother came back and did additional deals with her agents and went back to ME. Pulasthini was forced into terrorism. But the terrorists did not had confidence in her sincerity to Muslims’ cause, so they did not send her alone to any bombing. The Leader’s wife acted as the guardian during most of it until she was separated by Rapist Army. Apparently, rapist Army took her from the group they assembled as per Aanduwa’s order to send by the Sinhala Driver’s truck (not a bus).

I am a medical witness to war crimes committed by SL security forces on non-combatant Tamils. Any amount of lies by the author is not going to white wash the atrocities.War crimes were committed since 1982 when government enacted law to dispose of dead bodies in war zone without judicial review. It became worse after April 1984 when war was officially declared. Going into houses and shooting people dead, arresting people, lining them and executing them in public, arresting people, locking them inside community centers and exploding bombs, indiscriminately shooting into markets and bus stands killing people, Kumudini boat murder, arresting people taking them to army camps, killing them and burying them (Mannar mass graves), dropping of barrel bombs from helicopters on houses, indiscriminate shelling by army and bombing by Air force etc. This is why Sinhalese are refusing to have an impartial international inquiry.

The following war crimes were committed by security forces during the last stages of war for which there is evidence from eye witness accounts, Images from mobile phones and Satellite, and documents.
1. Denial of food and medicine to trapped people. – Government had been persistently saying that only 150,000 people are there and sending food and medicine for that amount, while after war ended 350,000 people crossed over, not taking the dead into account.
2. Indiscriminate shelling and bombing of civilian targets especially refugee centers and hospitals killing people. Strangely only hospitals and refugee centers whose coordinates were given were bombed and not others which were unknown to government.
3. Use of banned weapons such as cluster bombs and poison gasses. Ekneligoda was abducted and killed for exposing use of poison gas. (CONTD)

4. Denial of medical treatment to injured people. In a war there are three categories of injured: walking wounded, moderately wounded and severely wounded. After the war only walking wounded crossed over. So what happened to others. They were allowed to die without medical care and those who had burns due to poison gases or had parts of body shattered by cluster bombs were killed to cover up evidence.
5. Execution of people who surrendered. There is photographic and eye witness accounts of people who surrenders being loaded into buses. Catholic priest who accompanied them to give some assurance of no harm, has also gone missing. People who came with white flag as per arrangement were gunned down, as admitted by Sarath Fonseka.
6. Disposal of dead bodies in unaccepted way of incineration and dissolving

7. Refusal to allow journalists or human rights activists into the area to expose atrocities for a period of over 6 months till all mop up operation is completed.
8. Harassing eye witnesses not to speak about the atrocities. Unfortunately one doctor who under duress was asked to sign government statement has escaped and is willing to give evidence. Also policeman Nishantha Rodrigo has given all files relating to war crimes committed by SL security forces to international organisations.
NB: All nations which cherish human rights must not only ban those who had committed war crimes, but also those such as the author who are war crime deniers.
Already dossier on war crimes by Shavendra Silva is compiled and dossiers on others will follow. Till all war criminals are hounded up, there will be no justice.

Only solution is to split the island into 3 mono-ethnic nations equitably and relocate people. There will be Tamil Elam, Sinhala Only Elam and Muslim Elam.

Separatist ideology and anti-Sinhala campaign were started during the time British ruled Sinhale/Ceylon by Tamil politicians emerged in 1930s. GGP and SJVC were the leaders of this campaign. GGP started the campaign by delivering a racially charged speech at Nawalapitiya in 1939 denigrating the Sinhala-Buddhist culture, its history and the people igniting the first Sinhala-Tamil clash. They started a project to ridicule Mahawansa and distort the history of Sinhale to claim North East of the country as the ‘Traditional Homeland’ of Tamils.

If it is a research article, the objectivity was missing and bias was apparent. The researcher should have gone to the root of the problems and conducted her research in a scientific manner.
I will narrate only a selected few , the list is not exhaustive due to limitation of space, and time and I have not adopted any research methodology since I am not a researcher.
Before 1983, the minority protest was mainly non violent and the response of the Governments were either violent by thugs with the connivance of the government like what happened at Galleface Green in June 1956 or 1958 and 1977 riots.
The government’s response was not to protect the victims , but to condone the perpetrators of violence .Law and order was not at all maintained
What the government did to the selection to University admissions in 1970 is racially biased and crude, They simply added marks arbitrarily to subjects in the science stream to enable more Sinhala students enter prestigious faculties of Medicine and Engineering.
Thereafter in the subsequent years, the government was able to adopt various scientific methods to hooding the world at large, but to achieve the same sinister objectives.
All these matters played a part in militarizing the Tamil youth and LTTE was one of them.
I expect a response either from you or by any of your fellow researchers who subscribe to your views

I appreciate your honest open gratitude towards those who helped you, any decent person should follow their ancestors.
However what I don’t understand is why these descent Sinhalese or Sinhala/Buddhists never attempted to keep this island in peace. It is the Sinhala or Sinhala /Buddhist majority which have had total control over state, government and formed majority supported governments.

If these people are genuinely do gooders it is their duty to elect the right people, form genuine good governments, make these government accountable …… instead they seem to elect fraudsters, thieves, rapists, war criminals, racists, saffron thugs, … free crooks, murderers, … pardons war criminals, promote war criminals, land grabbing, …………. pass anti democratic, anti people and environmental …. laws.

You became homeless during the war because the Sinhala/Buddhists racists were in control of governance irrespective party politics. You should take all your complaints to Assgiria or Malwattu and dumb it on their dorr steps.

By the way Tamils would not normally confess to receiving protection from Sinhalese.

My heart goes to my deceased loved ones due to war!
Even though I am a Tamil my heart goes to Three forces. I am now in a country where I can travel anywhere with peace, can worship my God, and do a job I like. That is something we all craved irrespective of our ethnics.

Having empathy for a group that is categorized as hostile to your own, and appreciating that other group’s good qualities show that you are brought up by good parents from a respectable background. I remember the days of suicide bombings, power cuts, water cuts, checkpoints, etc. in Colombo. People complain about some terror leaders with white flags being executed. Who cares? It should have been done 30 years ago. Personally, I am glad the entire family of VP was executed as no mercy was shown to those killed by Black Tigers.

False claims of genocide, like that of the Tamils’ false genocide claims should be punishable by international law. At present, any politically motivated minority can level false allegations of genocide, without legal consequences. Tamils have a growth rate almost the double of the Sinhalese since 1946 census to 2011, how can they claim genocide? If anybody can level genocide allegations in this island, its the Sinhalese. But Sinhalese never get busy with this kind of terminology.
The genocide committed on the Sinhalese, first by Tamils and then by Portuguese, Dutch and especially the British colonial masters are out there – visible for everybody, by the de-Sinhalisation of the north and east (the ancient Sinhalese capital of Anuradhapura in ruins until the 20th century, with beheaded Buddha statues all over the place and destroyed Buddhist viharas), and the over a million Plantation Tamils placed in the Up-country in the heartland of the Sinhalese, since Tamils had destroyed Pollonnaruwa in 1215 AD, by the British, not to mention the massacres done by the British army of hundreds of thousands of Sinhalese during the period of 1797 to 1815 (Kandyan wars against the British) and then in 1818 and 1848 revolts.

When Brownrigg marched into Up-country in 1815 and entered Kandy and villages, many of them were deserted – inhabitants gone missing in their thousands!
The Up-country which was a homogenous Sinhalese area is today turned into a cesspit of Muslim extremism and Plantation Tamils, who are even demanding a federal state! They are now complaining that the language of administration in the Upcountry is Sinhalese! The Plantation Tamils do not want to be called so anymore, they want to be called Hill Country Tamils or Upcountry Tamils, which is an appropriation of the Sinhalese designation, “Udarata”/“Kandurata”. Hill Country and Upcountry has been synonymous with Sinhalese people. Appropriations of cultural, national and ethnic designations like “Up-country/Hill Country” by the Plantation Tamils are illegal according to international laws. They learnt all the tricks from the non-Platation Tamils. But nobody seems to care. That’s the plight of the Sinhalese, which was warned by some sympathetic British civil servants and scholars already in the 19th century. The establishment of the Plantations by the British was nothing but ethnic cleansing of the Sinhalese.

I have so many friends living in SL. I have read many articles and I did an extensive search with regards this issue. There is no any barriers to Tamils in the country. They live every where in the country and all of them are permitted to access every and each facility as same as Sinhaleese. I am wonder to hear that some one lives outside of the country, finger points to SL goveernment and forces accusing them without proper reason. Reconciliation process since 2009 has been greatly run and fully sponsored. No tamil civilians treated unequally. Pathetic sued of this story is SL government and Forces been lablled as responsible authority for pretended genocide which is not accepted at all.
