Court Of Appeal Appointment Crisis: Constitutional Council Unanimously Rejects Srisena’s Nominee

The Constitutional Council today (Aug 9) unanimously rejected president Maithripala Sirisena’s nomination, Luckshmi Menaka Minu Jayawickrema,, for the position of the Court of Appeal justice, Colombo Telegraph reliably learns.

According to highly placed sources the council after taking cognisance of the letter sent to them by the Sri Lanka Bar Association and the Colombo Telegraph story has arrived at this decision.

The CC had written back to the President requesting him to send a list of nominations giving priority to career judges, Colombo Telegraph learns.

Earlier in the week the President took steps to forward the name of his additional secretary of legal without considering two other names that was recommended by the Chief Justice and the Attorney General. This immediately was criticised by the legal fraternity and BASL cautioned the council of bad precedents such an appointment could set.

    This is what happens when people elect a president standing on someone else’s feet. People never elected Sirisena because of his popularity or on his ability to run a country. People voted him to power only because they did not want his opponent Mahinda Rajapakse to be elected as President. Actually, he was elected on Rajapakse’s strength meaning, the hatred people, especially the minorities, had towards Rajapakse. So It was Rajapakse who won for Aiyo Sirisena.

      Does the President not have a nominee on the CC? Did that nominee also reject the President’s proposal?

    It appears this time also New Kings coup doesn’t have a chance to see the Sun. (The unanimous rejection includes Old King too).

    Anyway, whether the stealthy girl ( New King) like it or not, farther and mother have found a new bride(Slap Party) for the brat (Old King). He longer can dodge their marriage proposal. The secret girlfriend (New King) will have to say bye bye to him. There were lot of experiences between them for so easily forget- To hide their immoral affair, they were hiding in beaches, hiding in tall farm crops fields, hiding in movie theaters , sliding together in children park, with other children……… Those experiences can become full only if they two are put on the UN electric chair together too (Their final marriage). But they have to part on Aug 11th.

    On the side of Slap Party, Napoleon has escaped the British Prison! Old Royal on the process creating a new history again.

    Karu, good that CC made a very sensible decision. If you experienced the life in a desert, you will know what a paradise we can make out from SL. MS is an impotent villager who should be fed only Kancun. Some change in the stars the idiot is shining as president. Other idiots MR,RW, GR. & SP are all scheming to usurp what is left. educated citizens must ensure that a newcomer takes the reign of SL, not even you for valid reasons.

      I’m sorry; what I posted may have read too much as a panegyric on Nagananda Kodituwakku, who seems to have suffered much from improperly appointed judges.

    Good. Finally some educated grown ups, and standing up for the law, and the good of the nation. Leaders who act like dictators, behave like they are above all laws, and who stack all institutions with their puppets, must be rejected.

    Perhaps an alarm from the bar association prompted the CC to reject Maru Sira’s nomination. But having heard much about how the machinery works, there could be other possibilities. For some reason or the other Sira is obliged to accede to the request of the fair sex. But even Sira may know that she does not deserve to be. In order to placate her a solo nomination is sent. So Sira has met his part of the demand made by her. But the bar association blurts out something. Interestingly they say in other words that to be a judge of the higher court you must be a judge of the lower court. If that principle is cardinal how is it that it was not met in the past for many times? Now that the CC has rejected her Sira can tell her, I have done my best, DAMN the 19th amendment. Ultimately Sira will pick someone else.

    THe Constitutional Council can stop this appointment but can they stop an illegal passport holding American citizen becoming a candidate for Srilankan Presidency?

      I think we should worry about Modi ‘s influence in this region, rather than the China camp and USA camp. He has got rid of a headache in the North by annexing Kashmir. Will he get rid of a similar headache in the South of India by annexing part of Sri Lanka (Katchchativu for instance)? Only time will tell. If that happens, the so-called friends of Sri Lanka (USA and the EU) will desert us as they need the power player of the region India more than us. What we need right now is a future President who knows how to keep India at bay. Palk Strait fishing disputes and Chinese infiltration in Sri Lanka can be headaches for India which they would want to contain militarily if India succeeds in flexing their muscles in other parts of this region.

        The aborted 1987 plan to try a ‘Cyprus’ solution with a ‘green line’ that took in Trinco is still a possibility if ever India’s southern and Eastern flank is threatened. Maybe then we will see the magnificent INS Kolkatta stationed in Trinco harbour.

    I suspect that the Cyprus style of 1987, that misfired then, may turn out to be a reality !
