Crime Probe: Let’s Begin From 1994

Of all that is pernicious in all resolutions tabled in the UNHRC against Sri Lanka the most scandalous and disgusting perhaps is limiting investigations calls for to the last few months of the war. We are talking about a conflict that dragged for almost three decades. We are talking about a couple of hundred thousand killed. One life cannot be less valuable than another. One murder cannot be more despicable than another. The grief of one mother cannot be less than that of another mother. The same goes for fathers, children, lovers and friends who grieve.

We are reminded of this monstrous ‘logic’ today when there’s a call for the Mahinda Rajapaksa regime and wrongdoers therein being held responsible for wrongdoing; a call for a full investigation on numerous allegations. Now, ss someone said ‘compassion’ (maithree) is all good but this does not mean that wrongdoing and wrongdoers should go uninvestigated and unpunished respectively. Strangely, though, Champika Ranawaka of the Jathika Hela Urumaya who spearheaded Maithripala Sirisena’s campaign and was clearly the most articulate critique of the regime on all counts including corruption has picked a period, 2004-2014. This is arbitrary and worse it smacks of witch-hunting.

Chandrika and LasanthaTrue, it is the regime that was defeated that is under scrutiny. True, investigation of corruption charges was a key theme of the Sirisena campaign and it can be concluded that people did vote for such an inquiry. Corruption and wrongdoing on the other hand could not have begun in November 2004. We are after all talking about a constitution and institutional arrangement that made for abuse and pilfering in a large scale as well as a culture of impunity that was well and truly made use of by many who wielded power for decades but especially since 1977. Bheeshanaya (terror) and dhooshanaya (corruption) let us not forget were charges leveled by those in the opposition at least since the 1988 Presidential Election.   They had currency.

Some might claim that the bheeshana-dhooshana levels of the past 10 years were unprecedented, but they would be those who have short memories considering what happened in 1988-89 and towards the tail end of Chandrika Kumaratunga’s first term (before her wings were clipped by the Parivasa arrangement with the JVP, the 17th Amendment and the brief UNP Government of 2001-2004).

We cannot go to Year Dot. This is clear. However, since those who were charged (but not investigated) are still around and since this Government has come to clean up, so to speak, we should start at least from 1994 which is when coalitions led by the SLFP first came to power. Most importantly it includes the period 2001-2004 when the UNP held sway. If there’s going to be change, it must be underlined by wholesomeness, not revenge-intent.

Today we have a President who is also the Chairman of the main party of the coalition led by the opponent he defeated. All those who supported ‘the corrupt regime’ have now pledged allegiance to President Maithripala Sirisena. He has as his key coalition partner, the United National Party, which too is not exactly a party of saints. One of his key backers was ex President Chandrika Kumaratunge, a person described as Chaura Regina (The Thieving Queen).

It is good to clean up. It is necessary to investigate. It is non-negotiable that the constitution and institutional arrangement be reformed so that corruption can be stumped. Mark it with ‘vengeance’ and we can shed all illusions about this regime being ‘better’ (forget ‘compassionate’).  Bring to book the crooks of the previous regime by all means, but let other crooks go free and you would be doing a great disservice to those who voted for ‘change’.

    War was declared against the Tamil people in 1984 April when ministry of national security was created and late lalith Athulathmudali was appointed as the minister to prosecute the war. Therefore if a full war crime probe is to be made it should start from that time.

    However, violence against Tamil people started way back in April 1956 with a mini riot in Colombo and Amparai, where Tamil people who had been living there for centuries were subjected to murder and ethnic cleansing. Since then several anti-Tamil pogroms had taken place, but sadly none of the Sinhala perpetrators of crime were brought to book, clearly indicating the collusion of state machinery in them.

    What the UN is trying to do is to investigate last few days of war where serious violation of international laws in conducting a war had been breached. Use of unauthorised weapons such as cluster bombs, chemical and thermobaric weapons and killing of surrendering combatants and non-combatants had taken place for which there is ample proof. Therefore to suggest other periods, is clearly seen as a tactic to divert the attention from this serious crime.

    I had been a medico-legal officer in the war zone in early stages and Therefore I am a medical witness to the atrocities committed by the Srilankan armed forces on the non combatant Tamil people. If the Sinhala people try to cover up these atrocities, there will be no chance of any reconciliation. During my medico-legal work, I have found that the judicial system in Srilanka was overtly racist, and this is the reason that none of the perpetrators of violence on Tamil people have been brought to justice. In most of the instances no prosecution was made, and in few others sham trial was conducted in Colombo courts and criminals were exonerated by racist minded judges.

    This racist attitude in the Srilankan judicial process has not changed and therefore Tamil people cannot expect any fair trial in Srilanka by a Sinhala dominated panel. If Sinhala people are sincere about justice being meted out to Tamils, they must agree to an International panel to conduct a war crime inquiry. Those who oppose it either no inquiry at all or only by a Srilankan panel, are those who want to cover up.

      Even the 83 killings was done after LTTE killed SL soldiers. SO war was already there.

        I am puzzled why this “COMPASSIONATE” Malinda waited all these years before he got the “ENLIGHTENMENT” Any way it is better late than never!!!

        My suggestion is, it is justifiable if the scrutiny started from 1956 when STATE SPONSORED POGROMS were unleashed on the TAMIL minority!! There were several state sponsored pogroms after that which got more and more severe. Instead of solving the initial problems, successive Sri lankan Govts. went on a KILLING SPREE. The affected people were left with no alternative except to take up arms against the tormentors!!!

        Malinda should request for a probe from 1950s!!

    I wish you all the best for good leadership to this country and approaching good governance under your presidency. That said, I don’t want to you articulate you about Lord Buddha’s discourse on good governance. You do know them millions time better than me and you outlined them million times in your speeches recently. Speaking is easy, but practicing is most important. So, do the right things on half of our country and people who deserve the respect, dignity, peace, and harmony. If you believe that you are a true Buddhist, then you should know this very clearly and bold that there is no one is above the law. Then practice this rule of good governance and bring all culprits to law and order regardless of ethnic, political status, color, religions, race and gender.     Corruption investigation is a must to prevent recurrence. Intent should not be ‘revenge’ but to establish rules, to fix the loopholes and to recover the loot. Punishments are also necessary as deterrent. It has to be admitted that as the time passed the degree of corruption increased. Therefore, it is logical to begin from the recent and going back to the past. Therefore, why not in two stages: 2004-2014 first and then 1994-2004? However, if anyone has evidence for any period could/should be put forward forthwith. It is normal for politicians (or even others) to raise the issue in a partisan manner or with a ‘revenge’ intent. On the other hand, the proposal to take a longer period and to begin from the longest end (1994!) might amount to an attempt to dilute the effort where recent big culprits can easily escape.

And you know what, I have yet to hear you air an opinion on the massive corruption and large-scale robbery of the state coffers by the Rajapakse clan, so would you let us know how you feel about that? This is not to mention the State Terrorism inflicted on those the Rajapakse paranoia deemed to be ‘against’ them. Look for some objectivity when you next air your views or else it will be the ‘same old same old’ you churn out in support of (what is presently being exposed as) a monumentally corrupt mafiosi disguised as a democratic government. So what does that say about you???

    By the way, there may be a statute of limitations that will apply to governments of the past. Better check that out before you go gunning for past leaders.

    I dont think there is any community in SL that is racist like Tamils.

    The tamils here cannot gather strength to accept they funded LTTE and that is why war continued and human suffering continued. Even we dont want reconciliation with them.

    If Sinhalese were as racist as tamils the tamils in LTTE held area will suffer without food and health care…even Prabha’s father was receiving pension from SL government.

      I am sinhalese, but we are not a super race. I as a born srilanken but today a EU national wish that all mental powers be uplifted in the average people of the island nation. Right after the new ear is dawn – all what they have to do is to find all channels to get united. Then that can alone lead to reconciliation between tamils and sinhalese.

      I always believe- good thoughts and minds can lead us to sustainable peace. Having listend to Sirasa Satana -dated 12Jan2015, the statments made by Hon. Sumanthiran revealed the ALL VERY FUNDAMENTAL ISSUE – main barrier to stay tunned with on going dicussions – it is the langauge barrier – only 3 men of TNA are well conversant in Sinhala. Why could not RAjapkshe adminsitraton or the units that led discussions fail to appoint interpreters so that discussions rounds could be moved on? Even 10 year olds would get it – this should be greater shortcoming – more they the tamil representatives exchange, much better the ways get opened to move on.

    Aiding & abetting criminals is punishable by law. Which means misleading the general public by covering up for these criminals (Rajapakse clan) by falsely writing good about them & criticizing whoever who opposes them is an offense. This is exactly what Malinda was doing until the day of the election by distorting facts & washing dirty linen of the Maha-Raja & his bandits. In my opinion people like Malinda & Dayan Jayatilake should be investigated to find out how they were paid by the Royal family and if so, which state institution made the payments.

    Mercy.Forgiveness and Restitution. For Corruption a fine four times the amount should be levied. Amnesty should be declared.To be fair we must remember the Mahaveli. Many allegations were made.

    Baseless allegations should be punished. Police and Judicial time is precious, People who confess are treated leniently by law. Rehabilitation is necessary. The system has to be fair. But as regulation was not in place a unsuccessful witch hunt that causes unnecessary hardship to the innocent should not occur. The main culprits will be abroad.Presents and money for campaign is allowed normally.
    Let their be reconciliation. Let there be conflict resolution. MR s files should also be investigated what ever the colour.

    Gosh Mr Seneviratne, perhaps you should leave the civic journalism to those brave and intelligent journalists who did not support the previous government? I’m referring to the ones that actually risked their safety in order to tell the public the truth about the bad governance of the past government. Unfortunately, this story is yet another red herring based story written by you. Although it’s more subtle that your previous stories; it fits in nicely with your more blatant red herring based news stories in the past. All your stories have been primarily focused on protecting the previous government and those loyal to it.

    Perhaps you should reconsider your career choice and select a career that excuses intellectual dishonesty. However, if you genuinely want to become a real journalist; that’s great!     I think investigations should be done of all crime and corruption starting with Jan 2015(With the alleged coup).In other words on a LIFO basis(Last In First Out).Once the very last one’s investigation is concluded then you get on to the next last one.This should include very crime including the day to day ones such as murders,rapes etc where politicians are not involved.There should be no time bar as when it should end,if resources permit we should even go up to earliest possible cases where culprits are still alive.No point in going after the dead.

    The war crimes investigations should also have to wait in the same queue.

    Once we finish all the crimes and corruption committed up to Jan 2014 we know that 2014 and 2015 is cleared up and then we move to 2013.

    If you just do it the way it is being done now ad hoc it will become a witch hunt with the police and bribery commissions getting inundated.

    Best is to go by the date it happened in a LIFO basis because LIFO is faster than doing it on a FIFO(First in First Out)basis.When things are fresh it is easier and faster to investigate than when they are old.

    All the development projects also have to be looked at on a LIFO basis.For this i think a special unit consisting of skilled personnel including accountants should be formed and a cost benefit analysis done.Costs must be compared against similar projects done and reasons for discrepancies provided. Lenders like China that gave loans without transparency to the public must be told that the public is not willing to pay these for hundreds of years and that they should write it off.

    Everyone who has got rich beyond their means should be asked to provide details of their assets and how they acquired them.They should be told that if they have not disclosed any asset they will be imprisoned for 6 years immediately and after the investigation is over further jail terms will be added to what they are serving now.

    So the Sri Lank’s mess can be resolved only by tackling the last crime first. The Foreign Minister has moved in the correct direction. The latest Crime was the Planned Coup.

    There is no question of Taking Revenge or witch hunt.

    The next could be the Gold and Money Found at the Temple Trees.

    Then we can search for the Missing Hospital constructed with Tsunami help and the building furnished with additional funds from Germany. ( This was reported in the net.).

    We should continue remorselessly to investigate till we come to 1948. It does not matter who is involved. We have to put the History Straight.

    This guy Malinda is still trying to please his earlier master. Corruption in Sri Lanka would have been even from 1948 but what has been happening during last 9 years is unbelievable corruption, just robbing the state, people and the country. If we had treated Ltte & Praapakaran as terrorists what do we call MR, his sons, brothers and other cronies. Shouldn’t these people also treated as a kind of terrorists under PTA and punished.

    All these persons of the last regime who are suspected of these corruptions must be arrested immediately and tried under PTA so that no one in the future would behave in this manner using politics.

    People like Malinda is a disgrace as they still want to support the rogues, probably he also got labtops and may be other free travel overseas and Santosams.

      all these attempts are to dilute the current efforts being made by newly elected administration. As you see it, this time, it is going to be a clarrity akin to some country in the Europe with JVP and JHU backing not anyone to escape from charges.

      This man Mahlinda S has never been able to call a spade a spade, his kind of Articles though sounded well conversant to some, nothing like valuable contents were thre. But he has to survive coughing further to previous regime – even today he is trying to do to the same. I think Prez to replace these men with other able men can save more .. no doubt about that.. right man should be appointed to right place. .. else, nothing would work to meet the expectations.
