Dambulla Mosque Attack: Muslims To Avoid Supreme Court

After the Dambulla Mosque incident, Muslim organizations met with a few very senior Muslim lawyers to discuss possible legal action. Various options were discussed. But all the Muslim organizations told the senior lawyers that they should avoid going before the Supreme Court. Informed sources told Colombo Telegraph that Muslim organizations are likely to file an application in the Court of Appeal.

“So much for the independence of the judiciary and people’s confidence in the judiciary” a senior lawyer told Colombo Telegraph.

    This is a joke that we no confidence in Mahinda Rajapakse’s book-licking Minister of Justice Rauf Hakeem who it seems would sell his mother for some grains of power and make any sort of back room deal to stay in power. The track record of Hakkeem and most of the eastern Province Muslim MP is one of TOTALLY UNPRINCIPLED politics.
    Time has come to demand younger, educated and principled people to represent the Muslim community and stop blaming Sinhalas and Tamils for all the problems of the Muslims!

    It is no wonder the senior Muslims who are breaking bread with MR do not want to take the matter up in Court as it will expose the biased Judiciary in the country and leave MR in a predicament. it is a damn shame for these Muslims who are even cheating their own Almighty Allah who appears impotent after all.

      Allah never comes out and fights for Islam. It is always only the Muslims who protect Islam with the unseen help of Allah. If the fight is won, it is concluded that Allah helped them. If it is lost, then it is concluded that Allah is testing or punishing the Muslims through that defeat. Muslims are used to struggles and they believe that one day everybody in this world will be Muslim. This believe totally contradicts with the Buddhist/Hindu theory of rebirths.

      Shall we ask those Muslims and Buddhists/Hindus who are willing to sacrifice their lives for their religion to gather somewhere and fight it out for a solution? (copied from 23rd Pulicasi comedy). At least the rest will be safe.

According to Islam, the first man on earth Adam was a Muslim and a Prophet. Prophet Mohamed was the last in line of Prophets and he completed the mission.

          Rahmathullah, as you state according to Islam the first man on earth was a Muslim and a Prophet. Let me put the record straight. The early world was inhabited by the Neanderthal man. Then there were the Homo Erectus, Homo Habilis and the Homo Sapians. We are believed to be the offspring of the Homo Sapians who lived in the savana. Down the line of human civilisation there have been many a language developed by man that many have gone into disuse, including the languages through which these Religions have been discovered. A lingua Franca was developed by man. If God had created any human being, then he would have given a language as well. It is not the case. It is man who developed languages and not God for your information. How could one man, created by God have four blood groups common to all mankind today? Obviously there has to be many as the case was. I personally do not object any to believe in whatever faith they uphold. The problem arises when Religion is forced on the young, just because the parents believe so. This is specially true of Mulims who force it on their young, more than other Religions.

          Mr. Gamini, you assume and conclude everything on history and science, which have weak foundation. Do you know in many of the states in US the theory of evolution has been forbidden one to be taught to children? Do you know there are different types of dialects in one language? The English spoken by British is different from English practised by Americans. Even in USA, from one state to another you can see the vast difference in the way people speak English. So, do not conclude people descended from one person cannot have many languages. It is also same in the case of blood group.

          Rahmathullah, going by your own theory that the first Human on this planet was a Muslim and he was Adam, How is it that there are so many other beliefs and Religions today? If the first human was a Muslim, then there should be only Muslims today. Was Adam circumsiced? Did he do it himself? How did Adam produce offspring without a spouse, because according to Islam there is no mention of Eve. You state that History and Science has weak foundations. The Fact is that Islam and all Religions have very weak foundations. It is not a misunderstanding but a fact that all existing Religions are only a couple of thousand years old, whereas mankind had lived tens of thousand years before that and there have been many Religions and beliefs.         Whywhy, circumcission was there long before Islam was born for your information. It was a belief that circumcission enables for the erectile of the penis to remain for a longer period with the tightening of the skin at the base of the prepuce. Muslims obviously adopted the practise because of Jihad, where many a male died at holy wars and was out numbered by the females. In order to propergate the Muslim societies where the male population was depleted, a man was permitted to have more than one wife to bridge the ratio and for repeated copulation, circumcission has been resorted to and adopted as a Muslim Practise thereafter. Otherwise why should man tamper with God’s creation believing that God created man? If Almighty thought the prepuce was not necessary, then he would have created man without the prepuce. Is it not?

      Mr. Gamini, I understand that you have a very weak knowledge about Islam. According to Muslim and Christian beliefs, the Adam was created first and then the Eve. Both were sent down to earth from heaven. Your argument that why there are so many religions now when the first couple on earth were Muslims is absurd. Even now you see children from the same family follow different religions and some even start new religions. Psychologically speaking, no two human beings can be 100% identical in thoughts and behaviors. You may be an atheist but, I make a friendly request you to devote some time to study Islam. There are many websites available. I request you to visit Mr. Yusef Estesse website on Islam, where you can have complete answers for all your misgivings about Islam. Remember, Quran is the only religious book, which could not be disproved by science till now.

At the rate you indulge in belief you will someday in the future, will claim the Computer too was invented by your God. All paper and writing instruments, pens, pencils were invented by man and not by God. Thereafter with your type of believers the quran was written and so is the Bible or the Mahawamsa.

    Many people would not have noticed that failed attempt by the government to introduce a Bill to amend the Town and Country Planning Ordinance which would have given our erstwhile Minister for Buddha Sasana and Religious Affairs immense powers over private property. The move got scuppered by the Supreme Court ruling that the Bill could not become law unless it was referred by the President to every Provincial Council, making it virtually impossible for the Bill to become law. The government withdrew the measure in April this year.

    If it had become law, it would have been possible for the Minister to declare any area as a Sacred Area.

    Not long after the Bill was withdrawn we witnessed the attack on the Dambulla mosque and the Minister. It does not take rocket science to draw the inference that the two introduction of the Bill and the attack are part of a move orchestrated by the government and some extreme elements within the country led by the clergy to undermine minority religions.

    It was reported some days ago that Mufti Rizwi announced to an audience in some foreign country that the government is taking measures to solve the problem. Mr Azwar has said something to the same effect in Parliament. Watching the manner of the latter’s loud interventions in parliament compels one to the conclusion that ‘his bark is worse than his bite’. He makes up for the lack of substance in what he says by saying it very loud.
    The Mufti appears to be well suited for carrying the ‘torch’, as evidenced by his role in inviting the President for the opening of a mosque in N Eliya.

    The community is in such a pass because of people like the good Mufti and the Minister.

    Rahmatulla – “the first man was a Muslim”??? To what levels cranks
    take religion to these days where they have made religion also “a business”

    Judaism started many millenia ago. The Mountain, the Holy Book,
    Fasting, abstinence from eating port (due to an outbreak at some point of time when most people were ignorant and would not understand medical advise) are features copied from the Hebrew heritage by other religion in the then Middle East – and that too after many millenia. Sanatana Dharma a.k.a. Hinduism is just as antique. But I don’t think the Jews and the Hindus will sink to the foolish extent of claiming their religion is the oldest, most superior, “special” and other such nonsense.

    The National Question in Ceylon/Sri Lanka was and is based on language.
    Never on religion. The Sinhalese and Tamil-speaking people, hopefully, will settle their differences soon. Merely parroting the name of the leader of a religion 24hrs a day does not make one religious, pious or good – while engaging in all other villainy the rest of the time.

    Learned Muslim Lawyers (and indeed there are some good ones) have rightly advised the matter should not be referred to higher Courts.
    It can do more harm, outside, than good is patently clear. The environment is pretty charged – sadly.

    This response should have appeared in the Transcurrent site which has published a comment by Minister Champika Tanawaka titled “Ayodha and Dambulla”. Restating the question that was posed to him by an Indian journalist, namely “Was the JHU directly involved in the attempt to remove the Dambulla mosque?” he goes on to answer this question stating that “the prayer hall in question had been built without obtaining permission from either the Ministry of Religious Affairs or the Urban Development Authority.”
    Note the word “prayer hall”. He fails to mention the fact that it is a “mosque” and that it has been in existence for decades, even before the area was declared sacred. He wants us to believe that permission had to be obtained from the Ministry of Religious Affairs or the UDA. The mosque required no such permission.
    He says that he takes “great care when answering questions posed by Indian journalists now.” I wonder why?
    He then states that “the riots of July 1983 occurred as the then government did not enforce the law. It was more a case of a complete breakdown in law and order. If not, we would not see so many Tamils back in Colombo and suburbs within a few months of the disturbances.”
    Mr Ranawaka has conveniently forgotten to mention the provocative role played by the saffron brigade and many leading politicians within the government in the period leading up to the July 1983 events and their active participation in what happened then, and the fact that they behaved as if they were above the law. Law and order was not enforced because of the involvement of people connected to the government whose names are too well known to require any mention. He also fails to mention the many who left the shores of the country and never returned.
    Referring to the Dambulla incident he says that the JHU position is that the Dambulla issue was one for the government. He does not say what he wants the government to do.
    He then goes on to explain that “in April 1981, PM Premadasa gazetted the Dambulla Raja Maha Vihara urban development area. On June 28, 1984, then Minister of Lands Gamini Dissanayake brought these lands under the government. On March 24, 1994, Minister Sirisena Cooray took steps to redevelop the Dambulla sacred area. It was this situation that the Asgiri maha nayaka thera and chief incumbent of Dambulla Raja Maha Viharaya tried to explain.”
    He does not explain the need for declaring an area as sacred. What justification is there for reserving large tracts of scarce land in a small country to develop it for the exclusive benefit of one community? The good Minister has failed to explain why no action has been taken against the mob that attacked the mosque even though it was a criminal act punishable under the Penal Code?
    Of course, he omits to mention that the authorities have failed to enforce the law, in the same way for similar reasons that law was not enforced in 1983.
    It would have been better if Mr Ranawaka did not open his mouth.

      The reason minister Ranawaka did’nt call it a mosque because it is not a mosque. It is only a tin shed. The people of the area who used it for prayers said themselves,that it is not a mosque but a prayer house and that house has been the home of one Uduma lebbe sixty odd years back. Further it is only made of tin amano colour bonded sheets and again those people said they did it that way in order to dismantle and move when the need arises. You don’t have to take my word for these,all these are on you tube on many videos by Derana Tv.

      of course you have to obtain building permits wether it is mosque, church or Kovil.

      The Buddhist monks you call ‘saffron brigade’ had nothing to do with the 1983 events. It was purely polically motivated and executed.

      Will you not claim ownership to a property that comes to you from your ancestors for generations? Thats the same way the temples get their land and the ownership of these lands preceed the present deed system introduced by the westerners but even the invaders respected their ownership.
      The need for declaring the land a sacred area is because Dambulla temple is an historic cave temple recognized even by the the UNESCO as a world heritage. Even if you leave all that aside, it is their land and if you challenge that there is only one place to do it. The district court. Wether you have trust in it or not is a different matter but that is the only place to resolve land matters unless you do it amicably.
