Decide Against Releasing Gnanasara Considering Broad Public Implications: Lawyers For Democracy Tells President

Lawyers for Democracy, in a statement, requested President Maithripala Sirisena to decide against releasing Bodu Bala Sena General Secretary Galagoda Atte Gnanasara on Presidential pardon considering the broad public implications of such a move.

In the statement, Lawyers for Democracy said releasing Gananasara Thera on Presidential pardon would set a bad precedence regarding contempt of court and create a culture of impunity, especially for those in priesthood.

The full statement issued by the organization is as follows,

Lawyers challenge the Move to Pardon Convicted Criminal Rev. Gnanasara

Lawyers for Democracy (LfD) is concerned by reports indicating a possible grant of presidential pardon to Rev. Galagoda Aththe Gnanasara, who is well known for his aggressive conduct and inciting of violence, particularly communal hatred. Rev Gnansara has a long history of fueling ethnic and religious tension in this country. It is unfortunate and telling that no formal legal measures has been taken against him thus far except in an instance of contempt of court and of intimidating Mrs. Sandya Ekneligoda. On 24th May 2018, he was convicted of intimidating a victim witness in the case of the alleged enforced disappearance of political journalist Prageeth Ekneligoda in 2018.

We wish to publicly raise the following concerns and urge President Maithripala Sirisena to consider the rule of law & constitutional implications of deciding to so grant a pardon:

1. In August 2018, Rev. Galagoda Aththe Gnanasara was convicted by the Court of Appeal on four charges of contempt of court for disturbing the criminal proceedings in the well of the Magistrate’s Court of Homagama, inter alia, threatening the State Counsel. The incident has been immediately subsequent to a refusal of an application for bail by military intelligence officers who were suspects in a disappearance case. He was sentenced to 19 years of rigorous imprisonment to be served concurrently to be completed within 6 years. He was also previously convicted by the Homagama Magistrate in June 2018 for intimidating witness-victim Mrs. Sandya Ekneligoda in the court and sentenced to 6 months rigorous imprisonment.

2. We have come to know that Rev. Gnanasara has a previous conviction on 22-5-200 in Magistrate Court case number 6315/200 in Colombo Traffic Court on the charge of causing an accident while driving under the influence of alcohol. We are made to understand that there are investigations pending against him regarding other criminal conduct including the communal riots in Aluthgama.

3. The President’s power to pardon a convict is subject to judicial review. In our view, prior to pardoning a criminal, report should be called from the Hon. Attorney General and Ministry of Justice. We are aware that neither the Attorney General nor the Minister of Justice has submitted any report regarding the pardoning of this convict. These observations become indispensable as the pardon that will be administered will be for the offence of contempt of court and will signal to the public that it is possible to act in such threatening manner in a court room and with complete disregard to the judiciary and officers of law, and thereafter use the fact that the criminal belongs to the priesthood and through political influence obtain such a pardon. A pardon if not exercised with due diligence and careful consideration of the rule of law implications will contribute to a culture of impunity.

4. We are surprised to read the letter of the Minister of Buddha Sasana forwarding several requests from personalities claiming to be religious leaders addressed to the President in respect of seeking a pardon. We emphasize that the Minister of Buddha Sasana has no legitimate role to play in pardoning a criminal.

5. This is a rear instance of a convict who was sentenced to imprisonment due to his intimidatory behavior in the well of the Court and intimidate the prosecuting State Counsel. Pardoning him will have a chilling effect on the judiciary and the Attorney General’s Department.

6. We have seen an unfortunate build-up of media reports justify pardoning of this convict suggesting that he has contributed immensely to Buddhism. It is our view that this media hype appears to have vested political interest. Contrary to the position that appears to be promoted by this reportage, Rev. Gnanasara is seen an aggressive violent individual who worked against ethnic and religious harmony of this country and who was an active politician.

7. We have no doubt that his release will have serious adverse impact on the Ekneligoda disappearance case and all other pending cases of political significance particularly those involving the military. Such a pardon will strengthen impunity in Sri Lanka and discourage victims and witnesses from pursuing justice, as the system would be seen as failing them. This will also create a negative antecedent, particularly of the office of the President which will be perceived as protecting a convict who disrupted and threatened legitimate judicial proceedings. It will also diminish respect for and in the office of the Hon. Attorney General.

We urge the President to consider the broad public implications of the decision to grant a pardon to Rev. Gnanasara and to decide against such pardon based on the immensely negative impact it will have. We will be compelled to resort to all available avenues to resist and redress such reprehensible abuse of power.

        Isn’t it significant that there is not even a Muslim name that can be seen in the list of Lawyers for Democracy?
        That too after all the racist inequities and sufferings Muslims underwent in places like Aluthgama ,Digna, Putlam and such places.
        Does that mean they do not believe in democracy and wish Gnanasara Thero’ s pardon and release by Sillysena?

      Let’s start from the last point of “Lawyers-for-What”;
      .
      7.) Venerable Gnanasara Thero is not the judge who handled the case of Ekneligoda’s unverified body-less-death. Therefore, the pardoning of the Thero has no impact on any court cases.
      .
      6.) Lawyers-for-What should learn to respect media freedom. Moreover, any citizen in this country is free to engage in politics. They don’t need the permission from Lawyers-for-What.

      5.) An LTTE terrorist was pardoned by the President. Many hardcore terrorists were given comfortable jail terms and some were released without any punishment. I don’t remember Lawyers-for-What objecting for releasing of terrorists to the society right away.

      4.) Lawyers-for-What has no authority to dictate terms to Minister of Buddha Sasana or any of the religious leaders. Mind your own damn business.

      3.) Presidential pardon is an exclusive power exercised by the President. He doesn’t need anybody’s permission. At his discretion, he can pardon religious leaders, even elderly people or women who are facing death penalty. For your information, Lawyers-for-What, President can even pardon himself for any wrongdoings, except on impeachments!!

      2.) Pending cases have nothing do with this matter. Learn to talk to the point, you, Lawyers-for-What.

          Buddhists priests being vociferous is nothing new to Sri Lanka since ancient times, as they are the custodians of sacred relics, temples and Buddhist monuments. Protecting the country is one of their prime responsibilities. Even the British were intimidated by the “Saffron Robes.” If not, Sinhalese would have been entirely annihilated by the British.

              Explain why LTTE Air Tigers who killed 14 people including Army men and destroyed/damaged 8 + 10 aircraft received only 5 years and Venerable Gnanasara Thero received received 19 years for contempt of court for being vociferous against military intelligence officers not being granted bail?
              Three military officers are on death penalty based on evidence of terrorists while blood thirsty terrorists were given comfortable jail terms. Some terrorists were even paid COMPENSATION.
              There is a profound double standard here. If you think I will keep quiet, you are mistaken.

                I am not here to explain what is happening in your Buddhist Sinhala Fundamentalists courts. It is your courts sentenced your war hero Sarath Fonseka for winning the war with LTTE. There are number of innocent Tamils were inside the jail for many years without any evidence or charge of crime. Even the Mahinda who ordered the murder of Lasantha is free to become the king of Buddhist Sinhala Fundamentalists nation. I fully agree with you that your nation is absolutely a corrupt judiciary system for many decades. Even you are a double standard Sinhala Buddhist Fundamentalist.

                Champa, courts of law law have various acceptable considerations and sentencing policies before handing down the sentences.

                1. Number of years in remand. – It is no secret that suspects are kept in prolonged custody before indictments/charge sheets are filed in court.Trial takes sevaral years. LTTE suspects who are thus convicted may have spent more than a decade before their trial begins.
                2.Some of them plead guilty so as to save the several years that may be spent in trial proceedings. Court gives concessions when the accused plead guilty .
                3.A settlement may be reached for reduced sentence with consent from Attorney general’s department who will weigh the pros and cons of the available evidence against the accused.
                4. Consideration is usually given to the family circumstances of the accused – elderly parents/young children to support, health condition, being the only bread winner in the family etc.

                None of the above will apply to the Most Reverend Gnanassara Thero who is a well nourished, unrepentent criminal with a criminal record to boot and with no family obligations. So let him face the consequences of his acts.

                  I have doubt about this “acceptable considerations.”
                  For an eg: I saw a school teacher was sentenced to 2 year RI for assaulting a child, a police officer was sentenced to 24 years for a Rs. 5000 bribe and another for 8 years for a Rs. 3000 bribe while a notorious drug lord was released on bail and terrorists who killed 14 people and 8 people in separate incidents received only 5 years while in another case, 2 terrorists were received over 100 year sentence!!!!
                  As everybody can see, something is very wrong here. It is not the law. The law is intact.

              There is no truth that Portuguese has deposed the Sacred Tooth Relics. See the history.
              In order for protection, the Sacred Tooth Relics were sent to King Mahasena of Lanka through Prince Danta and Hemamala who travelled to North of the country.
              Historians have later recognized the port where they have embarked may have been Lankapatuna in the East, while Jambukola Patuna was the main port which had been used by Sinhalese Kings, South Indian travellers and invaders as it is the closest point to South India.
              As King Mahasena had passed away before Prince Danta reached Lanka, relics had been hidden in Temples in North before taken to King Mahasena’s son, Keerthi Sri Megavanna in Anuradhapura.
              In 1560, Portuguese have found a replica of reliquary of Sacred Tooth Relics in a Temple in Jaffna. Portuguese had destroyed them in public, thinking that they were the real. Sinhalese knew it was a replica, so they didn’t mourn at the “loss.”
              Having replicas of Sacred Tooth Relics is nothing new.
              Even in 1566, Sinhalese King of Kandy had deceived Portuguese by selling “a replica” of Sacred Tooth Relics while actually keeping the real relics in his possession.
              When the Burmese King Anuruddha has requested the relics be sent to him, King Vijayabahu-I has sent “a replica” of Sacred Tooth Relics, instead of the real ones.
              Even the unchanged body of Venerable Thotagamuwe Sri Rahula Thero, which Portuguese found in a rock cave, which was sent to Goa, India, is erroneously claimed that of Francis Xavier who died during the journey while taking Thero’s body to Goa. Nobody can explain how Xavier’s body remains unchanged, while it is our common knowledge that Venerable Thotagamuwe Sri Rahula Thero consuming “medicinal Siddhartha Oil” is the reason why his body remains incorruptible even today.

              whole lot of varied groups consisting of peaceful, educated, passive kind of budddhists and non-buddhists but non-violence promoters ascribe the SETTING FREE of pseudo monk Ghanasara or the like multi criminals with unpredictable amount of aggressions could lead to speed up of appalling levels of the society today.
              Extremists of varied nature being backed by FORMER President Rajathuma may want him to be released for their hidden agendas to get promoted, but if President or anyone would set him free, the unexpected would be the reality.

      Hi my friends, with freezing temperatures almost kill us across Europe and US, anxities whether or not Ghanasara would be set free, makes us even more unpleasant.
      Let s hope the voice shine by a group of lawyers would be heard above the unanimous decision of the president to release him. Looking back the recent decisions made by President even not respecting the constitution, we are bit pessimistic. However, let s hope the best.

      Even if Ghanasara would enjoy a release, the day his next verdict would not have been far. In that manner, he will have to be in and out when considering the whole lot of crimes already filed against him.       Crime: is him to have thrown a heavy stone on a moving vehicle (a car droven by a mid-aged female) damaging the windscreen of the car.

      Court has verdicted it as – motive to have murdered that woman. The punishment is 7 year-imprisonment.
      :
      This man Balusara is put im jail for 3 years albeit his crimes are not aimed at one single person, but many. Nevetherless, big hue and cry, him tobe released not even having spent just 1 year in the prison. . Our LAW IS NOT RIGROUS enough. These men should put in jail for the rest of life, considering the punishments being given on the west.

            Do you know the Population of Tamils in the Northern region in 1981 and 2012. The population of Tamils in 1981 was over 1000,000 (over 1 million) and in 2012 reduced to 993000. The Sinhalese population in this country increased by 4000,000 (over 4 million). The increase was 1.40. On this basis the Tamil population in the Northern region should be 1.5 million.
            However, You should remember based on Govt information there were 400, 000 Tamils were in the Vanni Region only. But during the last phase it is your govt said that there were only 70,000 but at the end of war 300000 Tamils came out of Vanni. Your boss said that there was not a single civilian were killed during the war. Did they all wake up from the graves? What happened to those 100,000? At this point over 250 skulls were found from the Mannar graves. If you dig all the military camps in the Vanni you may find the truth about how many were massacred by your boss.

              According to the same report, until 2009, Tamil diaspora has donated US$200,000 a year, to LTTE’s terrorist activities in Sri Lanka!
              The number game played by Tamils since 1959 about their population can easily be proved as fabricated.

    Any person who has violated the law of the land and been convicted of an offence or offences must pay the price for what he/she did. This person is no exception. The question that should be asked of the President and all those who are advocating his pardon is whether any other person, especially a civilian, would have received a Pardon for identical offences. or whether this person is being treated differently on account of his attire. The attire cannot be a reason for granting a pardon, as there are serious doubts whether this person complied with the rules contained in the Vinaya Pitakaya that are applicable for a person wearing the attire and calling himself a Buddhist Monk. However, such a violation is the business of the Sangha themselves, but the attire should not protect this person from anything that an ordinary person is not protected from

    Dear Lawyers for democracy and other who oppose Rev. Ganasara’s release from Prison,

    Write letters to Singapore PM, and Our President and Inspector General of Police of Sri Lanka to bring Arijuna Mahendran to Sri Lanka and face proper prosecution. Otherwise you all become gentlemen with double standards. We can not have two legal systems. Rev. Ganasara has not done an Economic damge to the country, there is no obvious financial fruad to the country. He was prosecuted and punished. He has been in the Prison for some time now. He did not evade his prosecution.
    But there was a report , that first bond scam itself cost or will cost the Sri Lankan Government and Economy at least One Trillion Rupees over a 30 year period. Now compare this with Ganasara’s crime and punishment .
    I can mention two other examples.
    One school girl who has allegely stolen three coconuts were arrested by the Sri Lankan police. One women who has stolen a few mango fruits from a neighburs garden was arrasted by the Anuradhapura police. How efficient is the Sri Lanka police for poor people. But alleged corporate criminal, Arjuna, working as a consultant in Singapore. But our court system or legal system can not hand over the charge sheet or some legal documents, indicating that his address can not found.
    Then write letters for that, to the above officials and publish in the news papers. That is my kind request.
    Legal system should be equal to every body.

      Do you think those who send comments to CT live in Sri Lanka?
      When an article appears on CT, if it is in favor of RW and his Yahapalana UNP government, at least 10 persons from Diaspora Tamils jump to give a thumb up blindly approving it. This is the sad fact about CT’s nature of comments. The majority people’s opinion is quite the opposite! They hate this government and they hate Sirisena for having sided with the UNP. That’s why he can not be a presidential candidate again. If he does it again what should they do? Sri Lankans are patient but they will make the right decision on time (at the next elections)!.
      Lankan, please come down from the moon and see the ground reality! In this case, Champa is right!

    Dear Lawyers for Democracy and Other friends ,

    I have seen sometimes these Lawyers for Democracy, Civil socities, are clamouring for super democracy and legal independence et cetera. They always cite examples from countries like UK, Australia, New Zeland, West Europe and other best countries. In those countries, there is a system, if some material fraud or other irregularity happens in the government department or ministry, the respective minister will be asked to resign and if liable will be prosecuted.
    Now the Friends and Lawyers for Democracy and other civil socities , please write an open letter requesting Prime Minister of Sri Lanka to resign based on the following allegations and some of these are facts:

    1. Bringing Arjuna Mahendran to Sri Lanka and appointing him to the Central Bank.
    2. An alleged cover up of the Bond Scam by appointing a committee of Lawyers to cover up this Bond Scam. They submitted a report as well.
    3. By giving an speech in the Parliament of Sri Lanka, mentioning sarcastic words such as James bond or Government Bonds.
    4. Behaving in an embarrasing manner in the Parliament, Chanting words saying ” Kawuda Hora, Mahinda Hora”” and many other unacceptable way in the Pariment when questioned about this fraud.
    These are only a few. Please write an open letter to the Prime Minister of Sri Lanka to resign as he was responsible minister for Central Bank at that time in 2015 and 2016. This is my kind request. Rev. Ganasara is a Halmassa and already in the prison but write a letter to the Thalmaha or Mora who is responsible for appointing an alleged bond scam fraudster.

      I have seen and heard a youngish Sinhala Buddhist Thera boast his yellow robe is his
      “Insurance and Passport” to walk into any Govt institution. He was, in other ways, suggesting his robe will intimidate officials to submission. He arrogantly insisted there is no way they can refuse him. In my own understanding of what that wise and pious Prince Siddartha preached, this is certainly not so. It is time what goes as our legal system teach these frauds in robe the power and rationale in our laws. Gnanassara is a good example to start with. Men like him and that violent mad Thera in Batticaloa should be taught a lesson other truant Theras will take note of. It is time the Mahanayakas review the method of their intake of their priests. Poverty alone is not sufficient.

    I am a bean counter and know a bit of bond scam and insider trading. I do not go by the biased reports. There is something called materiality concept. I compare based on the materialty. Plus I also worked and working in these super countries whorshipped by our Friends for Lawyers for Democracy and other Civil society members for democracy and legal systems. I am an old man as well . As such I know the history of all these UNP, SLFP and other politiicans and their actions and report cards since 1960s. I read the daily news papers of Sri Lanka. I compare what is happening in Sri Lanka with these countries. I have seen crimes, punishments and penalties imposed on politicans in these countries specially for Money Laundering, frauds etc.

    I am also not going Kade for Mahinda or any body. What I would like to see is a Developed democratic Sri Lanka with sound law and order systems. That is why I wrote those comments.
    For me Sri Lanka is first, not these bloody useless political parties or any politicians. Ganasara is not the problem today. The bigger problem is that we do not have a democracy in Sri Lanka. We can not have an election for 4 and a half years since August, 2015. We can not give our report card to the current government for 4 and a half years. Is that the democracy for people of Sri Lanka? In these developed countries we can see elections in every three or four years.

    Can a President who has been found by the highest court in the country that he violated the Constitution of the country pardon a person who was sent to jail for disturbing the court?
