Dissolution Invalid: Supreme Court Issues Historic Order Allowing Parliament To Meet Tomorrow

In a landmark order, the tripartite bench consisting Chief Justice Nalin Perera, Justice Prasanna Jayawardena and Justice Priyantha Jayawardena stayed both Gazette notifications issued by President Maithripala Sirisena proroguing and dissolving Parliament.

The Gazette dissolving Parliament was stayed till the 7th December while the case was fixed for argument on the 5th, 6th and 7th December.

Meanwhile, the Gazette convening Parliament on November 14 will stand active, which means Parliament could be convened tomorrow.

The three-judge bench gave the order after considering submissions made by all petitioners and intervening petitioners on the President’s decision to prematurely dissolve Parliament, despite strong constitutional barriers imposed by the 19th Amendment to the constitution.

The Janatha Vimukthi Peramuna (JVP) Parliamentarians also met Speaker Karu Jayasuriya, soon after the order was issued, urging him to convene Parliament as soon as possible.

More stories loaded.Speaking to media from the Hulftsdorp courts presses, UNP Deputy Leader Sajith Premadasa said Parliament could convene even tomorrow. He requested all UNPers to refrain from resorting to violence and maintain law and order. Meanwhile, informed sources told Colombo Telegraph that Speaker Karu Jayasuriya is currently preparing a statement on convening Parliament tomorrow.

UNP Leader and “ousted” Prime Minister Ranil Wickremesinghe informed his Parliamentarians that he was ready to show his Parliamentary majority at any time. He also told them to “get ready” to attend Parliament tomorrow.

Commenting on the order, UPFA Parliamentarian Namal Rajapaksa said, “SupremeCourt has issued an interim order. This is not the Court’s final decision. I have never seen politicians get so excited for postponing elections. The UNP have a history of postponing polls but eventually voters will decide.”

    So, the Parliament dissolution by Sirisena, whose balls are still dissolving, is not valid, per Supreme Court.. It makes sense.

    When will Siisena’s balls be fully dissolved?

    Case is yet to be won. But their strategy is invalidated. Back bone is broken. Before December 7 NCM must be fished in the parliament against New King. Ranil is blocking the UNP from moving forward, others should bring the NCM.

    Second time Jayam Jayantha disasterly differed with SC on the 19A interpretation. Earlier he said New King could be there for 6 years but SC differed on that. Not fit to be AG again. He should resign with this.

    On Behalf of election commission, Ratnajeevan made history, by presenting it as petitioner while it was being sued in the court. Mahinda Deshapriya must now resign if he has shame. Ratnajeen has to be made the election commissioner.

    The murder story has to be verified when the parliament is convened.
    When India invaded Pirapaharan saved the land. Now Sampanthar and Tamil lawyers have done the same thing. They saved the land from Old and New King team- Hitler and Mussolini.

          What about your hero Modawansa who refuses to accept the order? Anybody who took advantage of illegal orders must be arrested. But Ranil is too soft and won’t do it. I don’t know why.

    This is a victory for Democracy. This is not a triumph of the crony cabal of Ranil Wickremesighe. So let us not celebrate this event but regard it as reprieve for democracy and forge a grand alliance of popular left front. Sri Lanka needs a Jeremy Corbyn

    At last democracy has won. As I already mentioned the interpretation of the law is always with the Supreme Court. The whole episode commencing from the action or conduct of the President should be taken into consideration to find out the evil motive of the President and his company. God has finally saved the democracy and the people of Sri Lanka from the ugly grip of a dictator to be. As one could anticipate any developments like imposing emergency and curfew may be imposed to continue to suppress all democratic practices. All religious dignitaries and the entire forces should watch and neutralize the uncivilized conduct of the trouble makers in order to secure the stability of the country.

      If the good country of Australia welcomed you in and gave you citizenship then in the name of God owe your allegiance to Australia.     It took two years for King to make a wrong decision. He waited all these time and got out of SLFP.

    Yes. hoooray, rule of law and democracy won the day! The entire nation Salute the Judges for their impartiality and bravery for the sake of the nation! Shitsena’s and MR’s coup failed miserably, and eggs and black on their faces. What a Shame. Really popy Shame for them for playing with lives of the people.

    The heart of the problem is twofold. First, greed for fruits of some continued post after 2019. Second, ignorance of how government works, illiteracy of the concept the division of power between the three branches of state, and village craftiness that degenerated into naiveté. How embarrassing it must be for the justices of the Supreme Court to have to step in and teach this man the rudiments of his job as President.

    What a fool Mahinda has been to get dragged into this madhouse; he was cruising along as top dog for the next election. Now he has got mud on his face that he goes into the election, whenever it is, as underdog.

    I have never ever seen a craziest president like this stupid . If he had the confidence of his party why he had to dissolve the parliament. He couldn’t stand for what he says pls u step down as president. Get lost and let the country to to run . Already the economy is collapsed and u made it still collapsing .

    It is only an interim order and case will be heard in early December.

    Keep in mind that the judges have to sit in judgment regarding certain actions by their appointing authority!!

    Judges are also human.

    Hope Hopper Sirisen resigns from presidency as he promised in order to avoid looking at Ranil’s face.
    If he shamelessly wants to continue as president he should be made to watch Ranil’s a..e until his terms expires.

    Three cheers to Sri Lanka’s Supreme Court to even temporarily stalling PRESIDENTIAL LUNACY!
    People had come to a point that no matter who became the Prime Minister, the Parliament should not be blocked arbitrarily.

    With this stay order, which makes the Gazette notification to reconvene the Parliament tomorrow stands unchanged, Sri Lanka’s Supreme Court has upheld the fact that people are the ultimate authority and that any ruler can govern the country only with people’s consent which is demonstrated through Representatives in the Parliament and therefore, the Executive should not be allowed to undermine the sovereignty and democracy of the Parliament and above all people’s mandate, no matter which party owns it.
    I am proud of our Supreme Court!!!!!
    The President and Basil Rajapaksa will go down the history as failed coup masters who destroyed a much loved, larger than life leader of Sri Lanka in one night, for their personal gain.
    I posted many comments to a Sinhala Daily and Wimal’s .lk requesting former President to not to fall into their trap as they have nothing to lose.
    Seriously, Maithri and Basil should be given a cocaine parcel and sent to Philippines to end their toxic politics.

      Now I understand the composition of the Bench. New CJ is smart. It is pretty obvious that he wanted to make it clear to all parties involved that SC’s judgement is transparent, impartial and independent. Excellent!!!

    The UNP have a history of postponing polls but eventually voters will decide. (Namal Baby) If UNP is being non-democratic by postponing elections, Namal Baba’s party automatically becomes more democratic by trying to preponing them.

    Since I feel that I am more democratic than Namal Baba’s party, whatever it may be, utilizing my rights as a free citizen of SL, I am going to ask for elections every week. Someone says, that this is not possible because preparations require at least a month, I can increase the period to one month, but not more.
    .
    However, the contention that one month is too short has to be tested. Being a good project planner, that being one of my jobs here, I tested several dafren dafren project plans in MS Project and found surprising and exciting results. But right now I have to have my afternoon siesta. I am prepared to die for my country. But I am not prepared to sacrifice my siesta even for Namal baba.

      See, President himself has handled the phone calls in order to grab MPs to his side.

      With audio tapes being circulated in the air today, president himself to pretend as if he knows nothing about them is beyond all bearing.

      There are two tapes, I myself heard that the voice is 1000000000000000000% authentic to say, that it was from President himself.

      Range Bandara has exposed them and the most ridiculous is that particular Informant -NAMAL KUMARA has made a statement about his contesting in next general election being part of Pohottuwa.

      So Namal Kumara should be arrested by the police if Police is independent right ?

      So in today ‘s context, POLICE is not at all independent.

    Pohottuwa guys and the gang of 16 always interpreted the challenge as “against holding elections & seeking people’s verdict”! But, the challenge was only about the Prez making an illegal order violating the Constitution. The Constitution provides when the the Prez can dissolve the Parliament and NOT AT HIS WHIMS & FANCY.

    SLLP to have 75% rights in parliament (based on midterm results).

    Rajapaksa to remain as Minister of Finance and Economic Affairs.

    Sirisena to remain as President.

    Ranil to remain as PM.

    President to PM power ratio = 75:25.

    Sirisena to have 50% executive rights.

      Plato, Namal baby is the most brilliant lawyer the world has even seen. He completed his studies and all the exams in one month. He also graduated at the top of his class.

    Let saner counsel prevail. Some advise to MP’s who crossed over for money and ministerial positions.When my grand father died in 1945 we went and left him at the cemetery and we came back home and similarly when my grand mother died in 1960 father in 1970 mother in 2004 sister in 2010 and brother in 2014 we carried their remains to the cemetery and left them their and came back home.However much we loved them we did not keep them at home and neither they took with them any of their belongings. I know very well that my children will do the same when I die.Please if you happen to read this take it to your mind. Their final resting place ended up with the rich the poor and people of all castes creeds and religions. With all the big money you got you might get a VIP funeral.

    Now the Parliament should be reconvened tomorrow (14th), take a vote and reinstall Ranil as PM. Then steps should be taken right away to impeach the treacherous Sira and throw him into jail. Sira has indeed committed many heinous crimes against the citizens of this country.
