Dear Sir,

Request to initiate action against Secretary to MoD and UD for participating in election campaigns

You are well aware by now that Secretary to the Ministry of Defence (MoD) and Urban Development (UD), Mr. Gotabhaya Rajapaksa has participated in the launch of the election campaign of the Colombo District  Jathika Hela Urumaya nominee Udaya Gammanpila, a candidate for the provincial council elections for the Western Province, on the the UPFA list, at the Sri Lanka Foundation Institute on 13 February, 2014.

The law is quite clear about senior public service officers taking part in political activities. All officers from staff grade and above are prohibited in taking part in political activities including attending any event that can be identified by the public as political.

Your attention is therefore drawn to Establishment Code Volume I and Public Administration Circular No. 6/2006 that provides for who a public officer is and Section 11 under the title Grading of Employees that says, tertiary and senior level officers including Secretaries and special posts at the level of Ministry Secretaries, placed at a salary level of 4/2006 are in the category of public officers, debarred from involving or participating in political activities and or events, that brings disrepute to the public service.

We as a recognised political party that had contested presidential and parliamentary elections in the past and contesting the provincial council elections in the West and the South wish to say, your social responsibility as Election Commissioner is derived from the fact that you have not only to be seen as taking every necessary step to hold a free and fair election, but you also take necessary steps effectively and without delay.

The issue of Secretary to the MoD and UD, participating in an election campaign event therefore warrants your immediate intervention. Candidate Gammanpila, commenting on Secretary MoD and UD participating in his election campaign event, accepts the said Secretary had participated in similar events even before. (Refer Ravaya of 16 Feb. 2014, front page main news story)

The Secretary to the MoD and UD not being a permanent employee from public service, we are aware his case can not be dealt with, as in the case of any other such public officer. Yet your responsibility demands you to raise the issue and request the appointing authority to take appropriate action according to the Establishment Code and relevant Public Administration Circulars. As far as our interpretation of the said rules and regulations are concerned, he has to be removed from service if proven guilty and his pension, eligible after 05 years of continuous service, has to be withdrawn.

We are aware you have already taken similar action by referring to the Public Service Commission (PSC), the participation of a Provincial Secretary at the farewell party of outgoing Chief Minister of the Southern Province, after the provincial councils were dissolved.

While these violations of the law at the highest level of the ministries go unchallenged, there are many reports of other officials at local level openly indulging in government party politics, thus making the whole election process a ruling party sponsored carnival. If Secretaries are also allowed to violate law publicly and with arrogance, your responsibility and commitment in holding a free and fair elections, turns out as a sorry debacle. That in turn violates the right of citizens to partake in a free and fair elections.

We therefore urge you to immediately intervene in reporting the issue of violation of law and recommend the Secretary be dismissed forthwith.

        Time has come for the joint opposition to BOYCOTT THE ELECTIONS CIRCUS of the Corrupt and criminal Mahinda Rajapaksa regime and challenge the manner in which staggered elections are held with huge waste of public funds merely to keep the regime in power. There is NO even playing field to have free and fair elections and ALL elections for ALL provinces should be held at the same time.

        The sad fact is that the UNP opposition politicians are also terribly corrupt and brain dead and desperate for their politician’s perks so the participate in the elections circus of the Jarapassa regime. This joke has gone far enough and must stop. There needs to be a joint opposition protest and BOYCOTT of all future PC elections.

        Joint opposition should go on the streets as in Thailand and refuse to participate in elections which is merely a facade of democracy in a Military Dictatorship that is operated though a DEEP STATE or state within a state with select officials form the military intelligence (GOta the goon), Judiciary (illegal Chief Justice), Administration (Lalith Weeratunge the Chaos Specialist) and business cronies of the Mahinda Rajapaksa regime.

    This is a real challenge to the Election Comissioner. Will he have the guts to tell the Defence Secretary to keep away from election campaigns

    Act and he will be white vanned.
    Dont Act and he will be seen as failing in his duty as Election Comissioner.

    He is in a catch 22 situation. Perhaps he may resign or he will be sent away on sick leave similar to the Chairperson of the Missing Persons Comission.

    The Chairman of the missing persons commission is on sick leave. The witness statement is now being taken in his abscene.

    Apparently he could not stomch the stories of the mothers and sisters and wives that they have personlly witnessed their sons, brothers husbands surrendering to the Sri Lankan Army and now there is no trace of them. They say that they believe that the missing person have been excuted by the Sri Lankan army after surrendering.

      At the SLAS meeting the President said that people are more important than all these Codes and Regulations governing the public service. So here is that being proved. Siritunga Jayasuriya and Elections Commissioner Deshapriya can fly kites! Jayasuriya like the UNP’s Karu Jayasuriya is asking for things that will not happen. Deshapriya does not wish to retire as a traitor and flying kites will be the best option!

      Ref to clause 52 of the constitution . Gamanpila has stated that according to This. Sec of. Government institutions are not public servants. The election commissioner has apologised to Gamanpila after ref to the costitution. However ,, gamanpila being a decent politician has apologised to the election commissioner as he was not happy with the arrangements.
      Gamanpila being a lawyer should know what he is doing .

        Clause 41 of the constitution says

        President’s staff.

        41. (1) The President shall have the power to appoint such Secretaries, and, in consultation with the Cabinet of Ministers, such other officers and staff as are in his opinion necessary to assist him in the exercise, performance and discharge of the powers, duties and functions of his office, and to determine their terms and conditions of service.

        (2) The salaries of such Secretaries, officers and staff shall be charged on the Consolidated Fund.

        (3) Such Secretaries, officers and staff shall be deemed to be public officers except that the dismissal and disciplinary control of such Secretaries, officers and staff shall be vested in the President, who may delegate to any such Secretary his powers of dismissal and disciplinary control in respect of any such officers or staff.

        (4) Every such Secretary, officer or member of the staff shall cease to hold office upon a new President assuming office.

        For what purpose they have appointed an EC, if what he has made clear have no value ? Who is active EC here, Gammanpila or Mahinda Deshapriya ?

        It seems Udaya G seems to have respect on “lAW AND ORDER” of the state.

        Gammanpila (blood sucker of the nation) may be a SO CALLED LAWYER,

        EC being there from a initial Asst Election Comm in Hambantota also, knows his onions and no mention of him apologizing to Gammanpila, who is a brief less lawyer.
        Instead Gammanpila accepted he made a mistake and apologized to EC. How can he be decent politician in JHU ?

    It is very welcome that Siritunga Jayasuriya has taken up this issue of blatant violation of election law and democratic traditions by the Secretary of MoD. I wish all other parties particularly in the opposition take up this and similar issues to educate people and uphold the principles of democracy and good governance. At a time when democratic principles have degenerated into the lowest depths, it is necessary to raise the standards high for a necessary regeneration of democracy. This is also necessary to ensure any future government would not deviate from these principles. Otherwise, all efforts of opposing the present regime would be in vain. All the breaches of rule of law and/or responsible government and all forms of corruption should be exposed uncompromisingly.

      I thought specially, those who have served to the state forces would not easily break the laws – because people are aware of the common facts of militaries. They though cause even civilian casualties, seniors must be exemplary before juniors to maintain the least respect – if they have to this date.

    Actually this kind of letters must be produced to EC by almost all other opposition parties.
    To this day,unfortunately EC himself or his office has failed to make any responsible statements in this regard.
    Now people will have to admit that the Election results issued following Presidential Election 2010 could well have been connected with “various of PC jilmarts”.

        Sirimal i just want remind you few of memorable incidents which took place during the last 2010 presidential election , during the actual voting time of the 2010 presidential election , Google Mudyansilage Thummulle Modawansa had arranged a live interview and went on describing why people must refrain from voting for Gen Fonseka , then virtually under curfew environment then election commissioner Mr Athathiratna had done what he was forced to do ,following releasing of that Magic result one poor (brave) Swiss girl Journalist had tried to ask an unwarranted question from Susil P , instead of answering the straight forward question , she was asked to leave the country , these were the little bit of last minute high drama which played during and after last PE , compare to those ,Bakapanditha Udaya G’s incident is a mellow drama.

    All appear to anticipate “no action” on this complaint to the Elections Commissioner by the United Socialist Party.
    They also mention a ‘white van’.
    Election law violations are reported by observers and the EC and police appear helpless to enforce the law.

    There appears to be NO Rule of Law.
    Are we in a Lawless State where State Terrorism reigns?

    Mr. Siritunga Jayasuriya may not succeed in his principled effort – in the highly subverted “democracy” we are forced to live with. The ruling clique goes about regardless in the arrogant believe they own the country and everybody and everything that goes with it. Not merely
    GRs electioneering is illegal. So the manner in which he “stole” that high position that he always dreamed of – judging by how he described the office to BBCs Stephen Sachur.

    Gentlemen,

    You cannot sit on your butts and expect the truth to prevail. The Rajapakses are banking on us idiots just talking and doing nothing about our complaints except to argue amongst ourselves.

    Go to any informal gathering and the topic is always prices, milk powder supplies and falling education standards. Other than talking no one seems to have a clue who is responsible, what needs to happen to change things and how to go about it.

    At the end of the day, sacrifices MUST BE MADE. Who is going to be the first? Not me. Please do not call me selfish. I know that, and have admitted to it. What is your excuse?

    Get real and understand ground realities.

    Large number of government servants are directly o indirectly involved or engaged in election work or supporting candidates using their official position.

    We have much bigger issues to discuss and resolve rather than looking at such incidents.

      As JVP PC election candiates MAKE it clear THESE DAYS, corruption attitude would remain with us as it is – so long the respective authorities would not pay adequate attention to control them already at grassroot levels, regardless them being minor or major issues. For instance, some clerks stealing a bundle of half sheet from their own office is not a big thing to many like Jagath Fernando – even their colleagues would rather help them continuing doing so- because the common excuse for them is that their seniors do lot more abuses in many ways (if he behaves so, why should I respect the law – learnt attitude). In contrary to this, in an european working environment, even if you would take a pen or a pencil that don’t belong to you, your colleague would never allow you to do so. I myself know few medical professionals have lost their jobs perhaps for very unfair reasons like having kept medical drugs (not packets or bundles but just few tablets or capsules) in the pockets of coats. Law is law for these authorities- good thing is equal to everyone, rule of law is rigorously implemented. This is the case in the STATES too. Having lived IN THE STATES, BEING AN US citizen today, Gota cant have any favourable EXCUSES for abusing lanken election/ or any other laws even if UPASAKYA-UDAYA GAMMANPILA may have neglected them.

      Some people like Charles living in a foreign coumtry, is asking a very serious question from Siritunga. Gota is a GOD for Charles as he thinks he won the war, as the DS. Under the Army Act Gotabaya as the DS is a civilian and not a Military person holding the DS position. Siritunga may be not aware that he is not wearing any cloths, as MR and GR also dress like Siritunga.

    For UPFA Govt., getting the Catholic,Muslim and Hindu votes will be a difficult task this time around. They can only play intimidation,or some screwed up “jilmal” to steal the victory and they will do it at any cost. That’s what they are known for and what else these guys are doing ? Are they governing the nation ?No way !
    They are milking the country,killing people,selling lands and properties to foreigners, grabbing lands and properties of opposition party people,minority Tamils’, demolishing Temples, vandalizing Mosques, torching churches, evicting poor people from their abodes, still abducting people in white vans.Who is ruling the country ?
    Now it’s UNHRC again and they are busy trying all kinds of tricks to get out of the trap and continue to do the same. Development, reconciliation,rehabilitation are all humbug and bull talk. It’s never going to be done.Marginalizing the minorities and grabbing their assets are their primary job and everything is done for them and their sordid sellouts hanging around them for the little leftovers.
    Buddhism and Sinhala racism is used for their own benefit at all the time. These bunch of rascals are no Buddhists or real Sri Lankans but parasites of the worst kind..destroying people ,their livelihood,education, social life and the whole country.

    Siritunga has raised a very valid point. I think MR and GR should remember how they drag GSF before a CM alleging he spoke to a guy now a very rich Minister about elections and his future aspirations, but without any records, was punished by removing all his ranks, the pension he paid from his hard earn salary, and proved that he never served in the Army using junior officers as CM judges and the present AG as the Legal representative for the CM.
    If GSF is guilty of engaging in politics because he allegedly spoke to a THUG who took Rs. 100 lacks to get information to kill President Rajapaksa, Gotabaya. Rajapaksa should be sacked from his present position if Mahinda Rajapaksa as the President wants to prove to the Geneva HR Commission meeting commencing on 3 March 2014.
    If President take this action, I doubt he will do so as he is afraid for his life and the Presidency, as GR is emerging as the most powerful man in SL today. GR supported Gamanpila as he is the Patron Saint of the BBS under JHU where Gamanpila is associated with.
    MR got a ver good chance to prove SL follow democratic principles and the Rule of Law, if he Remove GR as the MOD- UDA Secratary and from any such positions in the future. President the ball is in your court.

    Gen. Sarath Fonseka was Court Marshalled for doing politics while in active government service & was sent to jail. If the rule of law prevail in this country, GR should be sacked & sent to jail & Gammanpila should be disqualified. Will this happen? Not at all. The law is enforced only for ordinary citizens & enemies of the regime. That is why we need the International Community to monitor the regime for the country’s common good.

People are forced to believe that it is so but any courageous person would dare to say that it is not only bad but worse than the similar act done by any other person elsewhere.
